APPROVAL OF MINUTES OF THE REGULAR PLANNING COMMISSION MEETING ON JUNE 3, 2003. COMMUNITY DEVELOPMENT STAFF REPORTS 2. TREE REMOVAL PERMIT 2003-0037:7400 ENCINAL AVE. Request to remove ten (10) native oak trees, three of which are in excess of 24 "dbh, in conjunction with the development of an 2,600 square foot new single-family home located at 7400 Encinal Ave. (APN 030-031-015) Staff recommends: The Planning Commission adopt Resolution PC 2003-0059 to approve the request to remove ten (10) native oak trees subject to the guidelines and mitigation required by the Atascadero Native Tree Ordinance. PUBLIC HEARINGS (For each of the following items, the public will be given an opportunity to speak. After a staff report, the Chair will open the public hearing and invite the applicant or applicant's representative to make any comments. Members of the public will be invited to provide testimony to the Commission following the applicant. CUP 2003-0092 Applicant: City of Atascadero, 6500 Palma Ave., Atascadero, CA 93422 Project Title: CUP 2003-0092 Project Location: 5493 Traffic Way, Recreation Center, Atascadero, CA 93422 (San Luis Obispo County); APN 028-361-033 Project The proposed project is an indoor recreation use, Conditional Use Permit (CUP Description: 2003-0092), to establish a public youth recreation center, and community recreation center at 5493 Traffic Way. The General Plan Land, Use and Zoning District is Industrial. Proposed The project has been determined to qualify for a Class 1 Categorically Exemption Environmental under the provisions of the California Environmental Quality Act (CEQA section Determination 15301; Class 1; Minor alteration of existing facilities.) 3. ZCH 2003-0054 Applicant: City of Atascadero, 6500 Palma Ave., Atascadero, CA 93422 Project Title: ZCH 2003-0054 Zoning Text Amendment Project Location: CPK - Commercial Park Zoning District (San Luis Obispo County) Project The proposed project is a zoning text amendment to the City's Municipal Code Description: Article 12, Section 9-3.252 allowing: eating and drinking places of up to 2,000 square feet; office, business and health care services as permitted uses within the City's CPK - Commercial Park zoning district. Proposed The proposed project has been analyzed adequately in the 2002 General Plan EIR Environmental pursuant to applicable standards and impacts have been avoided or mitigated Determination pursuant to the that EIR. Matters are considered by the Commission in the order of the printed Agenda. COMMUNITY DEVELOPMENT STAFF REPORTS None PUBLIC HEARINGS 2. APPEAL 2003-0001 Applicant: Walter Togni, 6605 Santa Ynez Avenue, Atascadero, CA 93422 Project Title: Appeal 2003-0001 Project Location: 7435, 7445 Sombrilla Avenue, Atascadero, CA 93422 (San Luis Obispo County); APN 030-021-005 Project An appeal of the Community Development Director's decision to deny a request to apply for a Description: reduction of the minimum lot size for a parcel within the RSF-Y zoning district. The General Plan Land Use Designation is Single Family Residential. The site is zoned Residential Single Family -Y, a medium density single family zoning designation with a minimum lot size of 1.0 acre. Proposed CEQA Exemption by Statute Section 15061. The project will have no significant effect on the Environmental environment. Determination Planning Services Manager Steve McHarris provided the staff report and with Community Development Director Warren Frace and City Attorney Roy Hanley answered questions of the Commission. PUBLIC COMMENT Dan Stewart, Civil Engineer and applicant's representative, gave a brief history of the project. It is Mr. Stewart's opinion that the variance didn't expire and the applicant should be permitted to file an extension of the map at this time. He would like to find a solution to this issue for the applicant. Mr. Stewart answered questions of the Commission. Chairperson Fond closed the Public Comment period. Commissioner Jones stated that his original concern was to find something to indicate why the map had expired. He sees nothing in the record to support the applicant's position and nothing that would allow the Commission to make an exception for this particular project. Though he is sympathetic with the applicant, he will vote to deny the appeal. Commissioner Bentz raised the option of a lot line adjustment to deal with this issue. He stated that he is unable to find any basis to deny the staff recommendation. MOTION: By Commissioner Jones and seconded by Commissioner Bentz to adopt Resolution No. PC 2003-0044 a resolution of the Planning Commission of the City of Atascadero denying APL 2003-001 subject to the findings as set forth in the staff report, 1 through 4. ZONE CHANGE 2003-0051: Applicant: City of Atascadero Project Title: Zone Change 2003-0051: Zoning Code Text Amendment to remove the Conditional Use Permit requirement for Residential Second Units in the Residential Single Famil -Y Zone District Project Zone Change: Citywide: Single Family Residential (SFR) and Residential Single Location: Family -Y (RSF-Y) zoning districts. Project The project consists of a proposed text amendment to the City Zoning Ordinance Description: Section 9-3.153 Conditional Uses, to remove Residential Second Units as mandated by the State of California, and add Residential Second Units to Section 9-3. 152 Allowed Uses, in the RSF-Y zoning districts consistent with General Plan Goal HOS 3: Policy 3.1-3. General Plan Designation: Single Family Residential (SFR). Zoning District: Residential Single Family (RSF-Y) Proposed The proposed project has been analyzed adequately in the 2002 General Plan EIR Environmental pursuant to applicable standards and impacts have been avoided or mitigated Determination: pursuant to that EIR. City Attorney Roy Hanley provided the staff report and answered questions of the Commission. PUBLIC COMMENT — None MOTION: By Commissioner Jones and seconded by Vice Chairperson Kelley to recommend that the City Council adopt an Ordinance by the City of Atascadero approving Zone Change 2003-0039 to amend the Zoning Ordinance to allow residential second units in the RSF-Y zoning district subject to performance standards as proposed by the planning staff with the text amendments. AYES: Commissioners Jones, O'Keefe, Beraud, Porter, Bentz, Kelley and Chairperson Fonzi NOES: None ABSTAIN: None Motion passed 7.0 by a roll -call vote. Commissioner Jones left the meeting at 7:47 p.m. 4. ZONE CHANGE 2003-0052: Applicant: City of Atascadero Project Title: Zone Change 2003-0052: Zoning Code Text Amendment to amend the land use definition of "Auto Dealers" Project Zone Change: Citywide: All General Plan Designations and Zone Districts Location: Project The project consists of a proposed text amendment to the City Zoning Ordinance Description: Section 9-3.701 Land Use Definitions, to add "wholesale" operations. Proposed The proposed project has been analyzed adequately in the 2002 General Plan EIR pursuant to Environmental applicable standards and impacts have been avoided or mitigated pursuant to that EIR. Determination: City Attorney Roy Hanley provided the staff report and answered questions of the Commission. Vice Chairperson Kelley requested a notation be added that this will correspond with the state law. City Attorney Hanley stated that this notation could be added to the staff report for the City Council. PUBLIC COMMENT Bill Brite, 11875 Santa Lucia Road suggested the definition be changed to read "sale of motorized vehicles." Chairperson Fond closed the Public Comment period. MOTION: By Commissioner Bentz and seconded by Chairperson Fonzi to recommend to the City Council that it introduce for first reading by title only, draft Ordinance amending the definition of "auto dealer" in the Atascadero Municipal Code, and including a revision to Section One as recommended by the City Attorney to read as follows: The definition of "Auto Dealers" in 9-3.701 is changed to read as follows: Auto Dealers (New and Used) and Supplies. Retail and wholesale trade establishments selling new and used automobiles and including but not limited to, light trucks, motorcycles and mopeds. AYES: Commissioners Bentz, Beraud, Porter, O'Keefe, Kelley and Chairperson Fonzi NOES: None ABSTAIN: None Motion passed 6:0 by a Noll -call vote. COMMISSIONER COMMENTS & REPORTS Commissioner Beraud reported on the Community Housing presentation, which she and several other Commissioners attended. She was impressed with the fact that there are many ways to meet the required numbers and many options to encourage people to live in the affordable units for the long term. Chairperson Fonzi asked for a summary of the day's events and what was learned. Commissioner Porter reviewed the day's events and stated he came away with the conclusions that: 1) it is possible to provide affordable housing and it is working in other areas of the county, and 2) people are very happy to have a place of their own, either rented or owned. He felt that projects set up as "communities" with common areas, front porches, etc., seemed hold the greatest appeal to the occupants and worked better overall. Community Development Director Frace reminded the Commission of the joint meeting tomorrow evening, 6:30 p.m. on inclusionary housing. Director Frace informed the Commission that Associate Planner Glenn Rider had resigned. Project Address: 7400 Encinal Ave, Atascadero, CA 93422; APN 030-031-015 1/28/2003 TRP 2003-0037 7400 Encinal.PC-SR.doc ITEM NUMBER: 2 DATE: 6/17/03 ANALYSIS: The applicant has proposed a 2,600 square foot single-family residence on the project site. The project site is comprised of moderate slopes up to 18 percent. The project will gain access from Encinal Ave. The majority of the parcel contains heavy to moderate concentrations of oak tree clusters. The proposed building site is located on a level portion of the site to minimize grading impacts. Additionally, the proposed septic system has been located to avoid disturbance of the existing oak tree clusters. The access driveway serving the proposed residence currently exists and the tree removals associated with the driveway construction are due to the necessary widening of the existing route in order to meet fire standards. The City of Atascadero's Tree Ordinance requires that a certified arborist prepare an accurate and appropriate Tree Protection Plan, and that appropriate mitigation for native tree removals be implemented as a condition of the project. The applicant submitted a Tree Protection Report and staff reviewed and approved the recommendations, which have been incorporated into the site plan. The aborist's report findings conclude that the native oak trees to be removed are obstructing proposed improvements. 1/28/2003 TRP 2003-0037 7400 Encinal.PGSR.doc ITEM NUMBER: 2 DATE: 6/17/03 Staff is recommending that removal of the trees be mitigated by payment of $1,716.67 into the City's Tree Replacement Fund. In addition, staff will require that the applicant implement the tree protection measures that are recommended in the report prior to the issuance of the building permit. The Plans drawn by Eric J Gobler were used to locate the trees; they have been signed at the lower right corner to verify their use. This lot has numerous Oak trees (live oak, white oak and scrub oaks). All oak trees potentially impacted by this development have been identified on the plans. A few trees were not identified on the original plans but were added to them at the approximate scale. The trunk Diameters and species were confirmed and or changed to reflect the true assessment. The Trees proposed to be removed were flagged with red tape and those to have mitigation measures were flagged with yellow tape. On the site plans the trees were numbered to correspond to the accompanying spreadsheet. The trees were either identified as "removal" or given a specific mitigation measure to protect them. The first column identifies tree number. The second column identifies species. The third column lists diameter and number of trunks (ie.2x = 2 trunks). The fourth column identifies those trees where removal is requested (the tree exists either within the proposed residence or in the driveway). The fifth column lists the general condition. The sixth column lists acronyms for mitigation measures described below. • F = Fencing Construction fencing should be placed at the edge of the critical root zone where possible. Certain trees may require some fence line adjustment due to their proximity to the driveway or home. Fencing should be installed prior to any construction. Project Summary: The proposed Conditional Use Permit consists of a request to establish an indoor youth and community recreation center at an existing 9,800 square foot warehouse facility. The site, located at 5493 Traffic Way, is a 0.761 -acre net parcel and is surrounded on each side by industrial and public uses. Immediately adjacent to the proposed site is a public park facility with two sports fields. The conversion of the existing warehouse building into a community recreation center would be integrated into this master plan. The existing structure is a steel frame warehouse building with parking areas at the front and rear of the facility. The eastern edge of the site borders Atascadero Creek. The property is currently vacant. Surrounding Land Use and Setting: North: Industrial West: Industrial South: Traffic Way Park East: Atascadero Creek ITEM NUMBER: DATE: 6-17-03 2. Background: Over the past 10 years, the City has planned for a City funded community and youth recreation center that would meet a variety of needs throughout the community. The proposed project location presents a feasible alternative and would allow for pedestrian connections and shared parking opportunities with the adjacent Traffic Way Park sports facilities. City staff has collaborated with a number of community members and organizations to effectively design a facility that meets the needs of both adult and teen residents. The proposed facility will provide classroom and meeting spaces for a variety of activities and classes. The City collaborated with art teachers from Atascadero Junior High School in the design of an arts and crafts classroom. A dance room was also included and will provide a permanent place for the Children's Dance Program which is currently held at the Lake Pavilion. Plans for the renovated facility will also include an indoor gymnasium, a recreation room and cafe, and a TV room. 3. Design and Appearance: The Conditional Use Permit process requires site design and appearance review including architecture and landscaping. Because the proposed facility utilizes an existing structure, the opportunities to alter the architectural appearance of the building are limited. The applicant has proposed a number of features to enhance the appearance and the site design of the existing facilities, as discussed below. In addition, staff has added conditions of approval consistent with General Plan & Zoning requirements, including landscape enhancements and the use of stucco coated siding over a portion of the fagade. Facade Enhancements and Landscape The proposed recreation center includes the addition of a number of fagade elements to visually enhance the appearance of the existing building. As proposed, the design includes a covered entry portico that extends along the west face of the building and wraps around to include portions of the south fagade. Within this covered area are a number of landscape planters designed to double as seating areas. ITEM NUMBER: DATE: 6-17-03 Site Plan, Circulation, and Parkin The proposed site design maintains the existing circulation and parking areas. All landscape planters will be landscaped and will include an automatic irrigation system. The existing parking areas will be re -striped to accommodate no less than 38 parking spaces, consistent with the requirements and standards set forth in the Zoning Ordinance. Site Drainage Currently the site drains towards the northeast corner of the rear parking area which then drains into Atascadero Creek. As proposed, the site runoff would flow through a swale along the eastern edge of the parking area into a grease filter before entering the creek. Part of the landscape plan for this site includes revegetation and stabilization of the existing onsite creek bank. 4. General Plan Consistency: The proposed project is consistent with the General Plan Land Use Element Policy 12.2.2: "Establish a community/youth recreation center in the vicinity of downtown ". The addition of recreation facilities throughout the City also meets the recreation goals set by the general plan including goals targeted at providing a greater variety of recreation opportunities to City residents. As analyzed above, the proposed project, as conditioned is consistent with the General Plan. 5. Environmental Determination: The project has been determined to qualify for a Class 1 Categorical Exemption under the provisions of the California Environmental Quality Act (CEQA section 15301; Class 1; Existing Facilities). 6. Conditional Use Permit Findings: The Conditional Use Permit process provides the opportunity for the public and the Planning Commission to review land use proposals, including architectural design, site design, landscape, and specific standards of the zoning ordinance. There are five standard findings required for the approval of a Conditional Use Permit. It is staffs opinion that all of the following findings can be made for the proposed project, subject to the conditions and exhibits as attached. 1. The proposed use is consistent with the General Plan. Staff Comment: The use is consistent with the Industrial Land Use Designation and ITEM NUMBER: DATE: 6-17-03 General Plan Policy 12.2.2. 2. The proposed use satisfies all applicable provisions of the Zoning Ordinance. Staff Comment: As conditioned, the project satisfies all zoning code provisions. I The establishment, and subsequent operation or conduct of the use will not, because of the circumstances and conditions applied in this particular case, be detrimental to the health, safety or welfare of the general public or persons residing or working in the neighborhood of the use, or be detrimental of injurious to the property or improvements in the vicinity and the use. Staff Comment: The proposed recreation building will not be detrimental to the general public or working persons health, safety, or welfare. 4. The proposed use will not be inconsistent with the character of the immediate neighborhood or contrary to its orderly development. Staff Comment: The proposed use is compatible with the adjacent Traffic Way Park and, as conditioned, will be consistent with the surrounding uses and neighborhood. 5. The proposed use will not generate a volume of traffic beyond the safe capacity of all roads providing access to the project, either existing or to be improved in conjunction with the project, or beyond the normal traffic volume of the surrounding neighborhood that would result from full development in accordance with the Land Use Element. Staff Comment: The proposed building and use are consistent with the traffic projections and road improvements anticipated within the General Plan. As conditioned, the existing on-site parking and circulation meets the zoning ordinance requirements. CONCLUSION: The proposed City Recreational Center is consistent with the goals and policies established in the General Plan. The project has been conditioned to integrate appropriately within the context of surrounding uses and meets all site development and appearance review requiremerts of the zoning ordinance. Therefore, staff recommends approval of the proposed recreation center. ALTERNATIVES: 1. ITEM NUMBER: 4 DATE: 6-17-03 Background: The City of Atascadero adopted a series of Smart Growth principles as the basis of the 2025 General Plan. The Smart Growth principles call for the efficient use and reuse of existing lands within a City and for more compact, pedestrian scaled development. One way to achieve this goal is with intensification of commercial and light industrial uses along major transportation corridors such as the northern portion of El Camino Real. Intensification of use will also increase economic activity while ensuring that goods and services are available at appropriate and convenient locations. This approach to development has the added benefit of placing the proposed business uses in closer proximity to jobs, residences and transit which reduces dependency on the automobile. The final General Plan includes goals, policies and programs to encourage sound economic development along major corridors, as discussed below. General Plan Commercial Park (CPK) Definition This designation applies to areas along the northern portion of El Camino Real to accommodate uses that require large parcels, such as automobile and mobile home sales, factory outlet centers, traveler destination and recreation complexes, craft uses, nurseries and planned commercial developments. Certain types of light industrial uses, including research and development facilities and clean manufacturing facilities, along with office parks and business uses may also be appropriate in this area. The corresponding zoning is CPK with appearance review required. General Plan Economic Development Policies General Plan LOC 13: Provide a sound economic base to sustain the City's unique character by establishing a range of employment and business opportunities and generate sufficient revenue to support adequate levels of public services, and environment, social and educational quality. Policy 13.1 "Facilitate convenient location of goods and services needed by local residents." Larger establishments are currently allowed within the CPK Zone only in conjunction with a commercial center containing at least one major tenant with a minimum of twenty thousand square feet of floor area. The require for larger establishments would remain unchanged. The following section identifies the proposed zoning ordinance amendment. WHEREAS, the General Plan contains Policies and Programs under LOC Goals 13 and 14 that identifies a zoning ordinance update to allow office, business and health care services within the CPK zoning district and review and update of the zoning ordinance to encourage sound economic development along major corridors; and, WHEREAS, the Planning Commission of the City of Atascadero, at a duly noticed Public Hearing held on June 17, 2003 considered a recommendation to the City Council, and, WHEREAS, the Planning Commission has determined that it is in the best interest of the City to update the Zoning Ordinance to allow eating and drinking places of up to 2,000 square feet; office; business; and health care services as permitted uses within the City's CPK district to ensure orderly and efficient use of land within this district; and, WHEREAS, the laws and regulations relating to the preparation and public notice of environmental documents, as set forth in the State and local guidelines for implementation of the California Environmental Quality Act (CEQA) have been adhered to; and, ITEM NUMBER: 4 DATE: 6-17-03 NOW, THEREFORE, the Planning Commission takes the following actions: SECTION 1.
