WELCOME TO THE ATASCADERO PLANNING COMMISSION MEETING
The Planning Commission meets in regular session on the first and third Tuesday of each month at 7:00
p.m., at the Pavilion on the Lake, 9315 Pismo Ave., Atascadero. Matters are considered by the
Commission in the order of the printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the
Agenda are on file in the office of the Community Development Department and are available for public
inspection during City Hall Annex business hours at the Community Development counter and on our
website, www.atascadero.org. An agenda packet is also available for public review at the Atascadero
Library, 6850 Morro Road. All documents submitted by the public during Commission meetings that are
either read into the record or referred to in their statement will be noted in the minutes and available for
review in the Community Development Department.
In compliance with the Americans with Disabilities Act, if you need special assistance to participate in
a City meeting or other services offered by this City, please contact the City Manager's Office, (805)
461-5000, or the City Clerk's Office, (805) 461-5000. Notification at least 48 hours prior to the meeting or

Vice Chairperson Kelley called the meeting to order at 7:00 p.m. and Commissioner Beraud led
the Pledge of Allegiance.

COMMUNITY DEVELOPMENT STAFF REPORTS
3. TREE REMOVAL PERMIT 2004-0043, MIKE POULIN
Request to remove thirty-one (31) native oak trees, six of which are over 24 -inches in
diameter, in conjunction with the development of a 2,775 square foot single-family home
with 400 square foot detached garage located at 2145 San Fernando Rd.
Associate Planner Kelly Gleason provided the staff report and answered questions of the
Commission.
Chip Armani, applicant's arborist, discussed the tree removals and answered questions of the
Commission.
Mark Davis, project engineer, answered questions of the Commission.
Steven Alvarez, project arborist, addressed questions raised by the Commission.
PUBLIC COMMENT - None
There was Commission discussion regarding giving the Community Development Director the
discretion to approve tree removals on this project only, without going before the Planning
Commission, when the diameter does not exceed 24 inches.
Commissioner O'Keefe stated that any changes or removal requests should be made part of the
public record and as such need to come before the Planning Commission.
Community Development Director Warren Frace indicated that if the Commission gives staff
this latitude, a cap must be placed on the number of trees that can be removed. He suggested a
cap of 10%.
MOTION: By Commissioner Bentz and seconded by Commissioner Jones to make finding
#5 that the project cannot be reasonably redesigned to avoid the need to remove
the identified 31 native oak trees and adopt Resolution PC 2004-0001 to approve
the removal of thirty-one native oak trees subject to the guidelines and mitigation
required by the Atascadero Native Tree Ordinance, and subject to project
conditions. The Community Development Director has the authority to approve
up to a 10% increase in the removal of trees less than 24 inches in diameter on
this project.

Motion passed 5:1 by a roll -call vote.
Commissioner O'Keefe requested the record reflect that she agreed with all of the motion except
for the last sentence.
Commissioner Beraud stated she voted against the motion because she was not in agreement
with the last part.
4. TRAFFIC CALMING ON SAN DIEGO WAY, SOUTHSIDE VILLAS
Commissioner Jones stepped down from consideration of this item stating he has a professional
relationship with one of the applicants.
Associate Civil Engineer Jeff van den Eikoff provided the staff report and answered questions of
the Commission.
Steve Orosz, Traffic Engineer, discussed the traffic analysis and answered questions of the
Commission.
Vice Chairperson Kelley stated his opinion that a stop sign was necessary at the end of the
freeway off -ramp to provide for the safety of children and others in the vicinity.
Mr. Orosz and City Engineer Steve Kahn explained their reasons for recommending that a stop
sign was unwarranted for the location.
PUBLIC COMMENT — None
MOTION: By Commissioner O'Keefe and seconded by Commissioner Bentz to require no
additional traffic calming measures on San Diego Way.

Motion passed 5:0 by a roll -call vote.
Vice Chairperson Kelley indicated that he had voted yes but still supported the use of a stop sign
at the location.

COMMISSIONER COMMENTS & REPORTS
Vice Chairperson Kelley commended staff on their efforts to get their department back up and
running after the San Simeon earthquake.
DIRECTOR'S REPORT
Director Frace gave a report on the progress at City Hall and on the status of projects in the
Community Development Department.
City Engineer Steve Kahn reported on the crosswalk at Santa Rosa and El Camino Real pursuant
to Commissioner O'Keefe's request.
ADJOURNMENT
Vice Chairperson Kelley adjourned the meeting at 7:55 p.m. to the next regularly scheduled
meeting on February 3, 2004.

The applicant is proposing to remove one (1) Live Oak tree, 48" dbh, on a site that is zoned
Residential Multi Family (RMF -16) within an existing mobile home park. The applicant has
applied for a Tree Removal Permit with the City in accordance with the requirements for
multi -family residential tree removals.
The applicant has requested the removal as recommended by a certified arborist. The
arborist has determined that the tree is a significant future hazard to property and persons
living in the mobile home. The arborist has concluded that the cavity has created rot and
decay within the support system of the tree.
The City of Atascadero's Tree Ordinance requires that mitigation for native tree removals be
implemented as a condition of approval. The arborist's report findings conclude that the
native oak tree to be removed is in poor condition and, due to its placement in relation to the
mobile home, presents a hazard and could potentially cause damage to persons and
property. Staff is recommending that the applicant replant trees or pay into the tree
replacement fund to mitigate removal of the tree. The proposed mitigation is shown in the
following table.

Pursuant to the Tree Ordinance (Ordinance No. 214), "decisions on native tree removals of
24 -inch dbh-size or larger shall be made by the Planning Commission." In considering any
tree removal request, at least one of the below stated following findings must be made. Staff
has identified finding #1 as appropriate for the application request.
1) The tree is dead, diseased or injured beyond reclamation, as certified by a tree
condition report from an Arborist;
2) The tree is crowded by other healthier native trees, thinning (removal) would
promote healthier growth in the trees to remain, as certified by a tree condition
report from an Arborist;
3) The tree is interfering with existing utilities and/or structures, as certified by a
report from the Site Planner;
4) The tree is inhibiting sunlight needed for existing and/or proposed active or
passive solar heating or cooling, as certified by a report from the Site Planner;
5) The tree is obstructing proposed improvements that cannot be reasonably
designed to avoid the need for tree removal, as certified by a report from the Site
Planner and determined by the Community Development Department based on
the following factors:
• Early consultation with the City;
• Consideration of practical design alternatives;
• Provision of cost comparisons (from applicant) for practical design
alternatives;
• If saving tree eliminates all reasonable uses of the property, or
• If saving the tree requires the removal of more desirable trees.
CONCLUSION:
The applicant has submitted a tree condition statement as prepared by a certified arborist.
The tree has been determined to be in poor condition and, due to their proximity to the
existing residence, has been determined to be a potential hazard. This finding has been
certified by the Community Development Department, and therefore meets the required
findings for removal.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ATASCADERO APPROVING A TREE REMOVAL PERMIT
TO ALLOW THE REMOVAL OF ONE NATIVE OAK TREE
LOCATED AT 1215 EL CAMINO REAL, #1258.

WHEREAS, an application for a Tree Removal Permit has been received from, Rob
Boneso, 5050 Mill Road, Paso Robles, CA 93446, to allow the removal of one native oak tree
located at 1215 El Camino Real, #1258; and,
WHEREAS, the proposed project is located within the Medium Density Residential
land use designation of the City of Atascadero's General Plan Land Use Diagram; and,
WHEREAS, the proposed project is located in the Residential Multi Family (RMF -
16) zoning district; and,
WHEREAS; the Planning Commission reviewed the proposed Tree Removal
application on February 3, 2004, at 7:00 p.m. at the Lake Pavilion located at 9315 Pismo
Avenue and considered testimony and reports from staff, the applicants, and the public; and,
NOW, THEREFORE, the Planning Commission takes the following actions:
SECTION 1. Findings for Approval of Tree Removal Permit. The Planning
Commission finds as follows:

One Live Oak - Quercus Agrifolia - 48" diameter at breast height. Fair to poor
condition.
This is a mature oak tree located on the right middle of the property.
The entire weight of this tree is leaning over the residence.
Pruning all lower limbs of this tree over the years has pushed all the
weight up and out over the coach. This tree has a full crown with heavy
outboard limbs that extend out over the roof.
Years ago approximately 50% of the main stem had
fallen off leaving a large cavity in the remaining support
system. The cavity measures approximately 40"X 50".
The result of this old wound over time has created a lot of
rot and decay inside the remaining support system, which is
supporting all the weight over this residence.
Because at least 50% of the main stem is compromised by decay
I strongly recommend removal as soon as possible to promote safety for
the resident and public.
If permission is granted the owner may offer to replace this tree
with three 24" box Live Oak trees with a minimum 4" caliper or pay into
the cities tree replacement fund $400.00 using the Base Fee Formula @
$50.00 per 6" dbh.

possible. The root crown contains severe decay and the branches contain nesting holes.
The City of Atascadero's Tree Ordinance requires that mitigation for native tree removals be
implemented as a condition of approval. The arborist's report findings conclude that the
native oak tree to be removed is in poor condition and immediate action is necessary. Staff
recommends that the removal of the tree be mitigated by payment into the tree mitigation
fund or replant trees onsite. The proposed mitigation is shown in the following table.

Pursuant to the Tree Ordinance (Ordinance No. 214), "decisions on native tree removals of
24 -inch dbh-size or larger shall be made by the Planning Commission." In considering any
tree removal request, at least one of the below stated following findings must be made. Staff
has identified finding #1 as appropriate for the application request.
1) The tree is dead, diseased or injured beyond reclamation, as certified by a tree
condition report from an Arborist;
2) The tree is crowded by other healthier native trees, thinning (removal) would
promote healthier growth in the trees to remain, as certified by a tree condition
report from an Arborist;
3) The tree is interfering with existing utilities and/or structures, as certified by a
report from the Site Planner;
4) The tree is inhibiting sunlight needed for existing and/or proposed active or
passive solar heating or cooling, as certified by a report from the Site Planner;
5) The tree is obstructing proposed improvements that cannot be reasonably
designed to avoid the need for tree removal, as certified by a report from the Site
Planner and determined by the Community Development Department based on
the following factors:
• Early consultation with the City;
• Consideration of practical design alternatives;
• Provision of cost comparisons (from applicant) for practical design
alternatives;
• If saving tree eliminates all reasonable uses of the property, or
• If saving the tree requires the removal of more desirable trees.
CONCLUSION:
The applicant has submitted a tree condition statement as prepared by a Certified Arborist.
The tree has been determined to be in poor condition and, due to the proximity of EI Camino
Real, has been determined to be hazardous. This finding has been certified by the
Community Development Department, and therefore meets the required findings for removal.

WHEREAS, an application for a Tree Removal Permit has been received from Steve
Kahn, City Engineer, 6905 El Camino Real, Suite #6, Atascadero, CA 93422, to allow the
removal of one native oak tree located at 1205 El Camino Real; and,
WHEREAS, the proposed project is located within the Medium Density Residential
land use designation of the City of Atascadero's General Plan Land Use Diagram; and,
WHEREAS, the proposed project is located in the Residential Multi Family (RMF -
16) zoning district; and,
WHEREAS; the Planning Commission reviewed the proposed Tree Removal
application on February 3, 2004, at 7:00 p.m. in the Lake Pavilion located at 9315 Pismo
Avenue and considered testimony and reports from staff, the applicants, and the public; and,
NOW, THEREFORE, the Planning Commission takes the following actions:

which will be confined to one lot. The new lot will be developed with a new single-
family residence. The parcels are slight to moderately sloped and contain one native
oak tree. The newly created parcel averages slopes of less than 10%. City sewer will
serve the property, and water is available from the Atascadero Mutual Water
Company.

Site description: The site is a gently sloped lot located on the north side of San
Diego Rd. The site is developed with a single-family residence toward the midway
point of the property. The average slope for the individual parcels is 4.4% and 4.6%.
There are several pine trees and one native oak tree located along the existing
driveway.
DISCUSSION:
Subdivision Design:
The subdivision will divide one existing lot into two parcels. Proposed Parcel 1 will
be a flag lot as required by ordinance. Staff has also conditioned that the existing
driveway be paved to a width of 20 -feet with 2 -foot shoulders, as required by
ordinance. Proposed Parcel 2 will exceed the 3:1 depth to width ratio. However, the
proposed parcel width widens to exceed 250 feet at the location of the proposed
building envelope, allowing enough area to meet all required setbacks and therefore,
will not be detrimental to neighboring parcels. In addition, the depth to width ratio
will not impede future development as the majority of the surrounding property to the
west and south has previously been subdivided and the 101 -freeway corridor
borders the subject property to the east.

The existing improvements on the site will be confined to proposed Parcel 1.
Percolation tests indicate that each lot is suitable for an onsite septic system.
Atascadero Mutual Water Company will provide water to the potential new residence
at the time of development. Future utilities to the new lot will be required to be
placed underground and located within the driveway area to reduce any potential
impacts to topography and existing vegetation. An arborist report has been
submitted for review with the map application. Staff has conditioned that appropriate
tree protection measures be implemented for the existing native oak tree during all
future construction of the site. (Planning Condition No. 11).
The subdivision is consistent with the General Plan Rural Estate land use
designation and Residential Suburban zoning regulations with minimum lot sizes of
2.50 and 4.97 acres, gross, based on performance standards.
Public Improvements:
The project has been conditioned to overlay the San Diego frontage to a location
determined by the City Engineer, prior to recordation of the final map.

Environmental Review:
The Initial Study concludes that there will be no significant harm to the environment
as a result of this subdivision. A proposed Mitigated Negative Declaration has been
prepared for the project and certification of the Mitigated Negative Declaration is
included in draft Planning Commission Resolution 2004-0004.
CONCLUSIONS:
The subdivision, as conditioned, is consistent with the 2002 General Plan and
Zoning Ordinance. The parcel configurations are consistent with the Subdivision
Ordinance requirements with the finding that the depth to width ratio of proposed
Parcel 2 will not be detrimental to neighboring properties and will not impede future
development. The size and shape of the proposed lots are consistent with the
character of the immediate neighborhood. Staff recommends the Planning
Commission approve the tentative parcel map as conditioned.
ALTERNATIVES:
1. The Commission may approve the subdivision subject to additional or revised
project conditions. The Commission's motion to approve needs to include any
new or revised project conditions.
2. The Commission may deny the subdivision if it is found to be inconsistent with
the General Plan or any of the other required findings. The Commission's motion
to deny must include a finding basis for denial.
3. The Commission may continue the hearing and refer the item back to staff for
additional information or analysis. Direction should be given to staff and the
applicant on required information.

7. The proposed subdivision design and type of improvements proposed will not cause

coverage, preferably in the late morning and after work
is finished for the day.
b. All clearing, grading, earth moving, or excavation
activities shall cease during periods of high winds (i.e.
greater than 20 mph averaged over one hour) so as to
prevent excessive amounts of dust.
c. All material transported off-site shall be either
sufficiently watered or securely covered to prevent
excessive amounts of dust.
d. The area disturbed by clearing, grading, earth moving,
or excavation operations shall be minimized so as to
prevent excessive amounts of dust.
e. Permanent dust control measured identified in the
approved project revegetation and landscape plans
shall be implemented as soon as possible following
completion of any soil disturbing activities.
f. Exposed ground areas that are planned to be reworked
at dates greater than one month after initial grading
shall be sown with fast -germinating native grass seed
and watered until vegetation becomes established.
g. All disturbed areas not subject to revegetation shall be
stabilized using approved chemical soil binders, jute
netting, or other methods in advance by the APCD.

Background: The site consists of one existing parcel and is very gently sloped. There
is a 42" oak tree on proposed parcel 1 and a 72" oak tree in the Traffic Way right-of-

Analysis: Minimum lot size for RSF -Y parcels is one acre,rg oss. Secondary

This subdivision would result in one lot, which would qualify for a secondary residence,
allowing 3 residential units on the overall property. Development on proposed lot 2
would not result in impacts to native trees.
Proposed lot 2 is designed as a flag lot with access off of Traffic Way. The flag would
be approximately 240 feet in length and would be required to be 24 feet in width with 20
feet of pavement.
Environmental Review: The proposed parcel map is a Class 15 categorical exemption
from the California Environmental Quality Act.

As conditioned, the subdivision is consistent with the General Plan and Zoning
Ordinance. The parcel configurations are consistent with the Subdivision Ordinance
requirements and the size and shape of the proposed lots are consistent with the
character of the immediate neighborhood. Staff recommends the Planning Commission
approve the Tentative Parcel Map as proposed.
FISCAL IMPACT:
The project would likely have a slight negative impact on City revenues. As a general
rule, single-family dwellings require services that exceed the revenue generated by the
proposed uses.
ALTERNATIVES:
1. The Commission may approve the subdivision subject to additional or revised
project conditions. The Commission's motion to approve needs to include any new
or revised project conditions.
2. The Commission may deny the subdivision if it is found to be inconsistent with the
General Plan or any of the other required findings. The Commission's motion to
deny must include a finding basis for denial.
3. The Commission may continue the hearing and refer the item back to staff for
additional information or analysis. Direction should be given to staff and the
applicant on required information.

Standard Planning Conditions
1. The approval of this application shall become final,

subject to the completion of the conditions of approval,
fourteen (14) days following the Planning Commission
approval unless prior to that time, an appeal to the
decision is filed as set forth in Section 9-1.111(b) of
the Zoning Ordinance.
2. Approval of this Tentative Parcel Map shall be valid for

two years after its effective date. At the end of the
period, the approval shall expire and become null and
void unless an extension of time is granted pursuant to
a written request received prior to the expiration date,
or a final map is recorded with the County Recorder's
Office.
3. The Community Development Department shall have

the authority to approve minor changes to the project
that (1) result in a superior site design or appearance,
and/or (2) address a construction design issue that is
not substantive to the Tentative Parcel Map.
4. A parcel map drawn in substantial conformance with

the approved tentative map, and in compliance with all
conditions set forth herein, shall be submitted for
review and approval in accordance with the
Subdivision Map Act and the City's Subdivision
Ordinance.
5. The subdivider shall defend, indemnify, and hold

6. The final map shall be subject to additional fees for

7. In the event that the applicant is allowed to bond for

this map, the applicant shall enter into a Subdivision
Improvement Agreement with the City Council.
8. An engineer's estimate of probable cost shall be

Engineer to determine the amount of the bond.
9. The Subdivision Improvement Agreement shall

record concurrently with the Final Map.
10. The applicant shall enter into a Plan

11. A six (6) foot Public Utility Easement (PUE) shall be

provided contiguous to Traffic Way property
frontage.
12. The applicant shall acquire title interest in any off-

site land that may be required to allow for the
construction of the improvements. The applicant
shall bear all costs associated with the necessary
acquisitions. The applicant shall also gain
concurrence from all adjacent property owners
whose ingress and egress is affected by these
improvements.

13. Drainage easements shall be obtained by the

and private drainage facilities. The applicant shall
address storm water detention prior to grading and
drainage approval.
14. A preliminary subdivision guarantee shall be

processing of the final parcel map.

prior to the map being placed on the agenda for
Planning Commission/City Council acceptance.
16. Prior to recording the final map, the applicant shall

18. Prior to recording the final map, the applicant's

surveyor shall set monuments at all new property
corners. A registered civil engineer or licensed land
surveyor shall indicate by certificate on the parcel
map, that corners have been set or shall be set by a
date specific and that they will be sufficient to
enable the survey to be retraced.
19. Prior to recording the parcel map, the applicant shall

submit a map drawn in substantial conformance with
the approved tentative map and in compliance with
all conditions set forth herein. The map shall be
submitted for review and approval by the City in
accordance with the Subdivision Map Act and the
City's Subdivision Ordinance.
20. All existing and proposed utility, pipeline, open

space, or other easements are to be shown on the

final map. The applicant shall show all access
restrictions on the final map.
21. Prior to recording the final map, the applicant shall

have the map reviewed by all applicable public and
private utility companies (cable, telephone, gas,
electric, Atascadero Mutual Water Company). The
applicant shall obtain a letter from each utility
company indicating their review of the map. The
letter shall identify any new easements that may be
required by the utility company. A copy of the letter
shall be submitted to the City. New easements shall
be shown on the final map.
22. All public improvements shall be constructed in

conformance with the City of Atascadero
Engineering Department Standard Specifications
and Drawings or as directed by the City Engineer.
23. The applicant shall be responsible for the relocation

and/or alteration of existing utilities.
24. The applicant shall install all new utilities (water,

CE
gas, electric, cable TV and telephone) underground.
Utilities shall be extended to the property line
frontage of each lot or its public utility easement.
25. Prior to the final inspection of any public

improvements, the applicant shall submit a written
statement from a registered civil engineer that all
work has been completed and is in full compliance
with the approved plans.
26. The applicant shall monument all property corners

for construction control and shall promptly replace
them if disturbed.

distribution facilities that provide water service to the
proposed lots. All new water distribution facilities
shall be constructed in conformance with the
Atascadero Mutual Water Company standards. The
plans shall show any facilities required for fire
protection. The plans shall show all cross -
connection devices required to isolate the fire
protection and landscape irrigation systems from the
domestic water system.
31. Prior to the issuance of building permits, the
applicant shall obtain a "Will Serve" letter from the
Atascadero Mutual Water Company for the newly
created Lots.
32. Prior to the start of construction, the applicant shall
pay all installation and connection fees required by
the Atascadero Mutual Water Company.

33. All water distribution facilities shall be constructed in
conformance with Atascadero Mutual Water
Company standards, policies and approved
procedures. All cross -connection devices shall be
constructed in conformance with AWWA and
Department of Health Services standards.
34. Separate legal parcels require separate water
meters for domestic water service.
