PUBLIC HEARINGS (For each of the following items, the public will be given an opportunity to speak. After a staff report, the Chair will open the public hearing and invite the applicant or applicant's representative to make any comments. Members of the public will be invited to provide testimony to the Commission following the applicant. Applicant: Joe Jordan, 9149 San Diego Rd, Atascadero, CA 93422 Project Title: Tentative Parcel Map 2003-0049 Project 9149 San Diego Rd., Atascadero, CA 93422, San Luis Obispo County Location: APN 045-353-003 Project A proposed subdivision of an existing 7.47 -acre lot into two individual parcels of 2.50 and 4.97 Description: gross acres. The site is currently developed with a single-family residence, which will be confined to one lot. The new lot will be developed with a new single-family residence. The parcels are slight to moderately sloped and contain one native oak tree. The newly created parcel averages slopes of less than 10%. City sewer will serve the property, and water is available from Atascadero Mutual Water Company. General Plan Designation: RE Zoning District: SFR -Y Proposed Based on the initial study prepared for the project, a Mitigated Negative Declaration is proposed. Description The existing parcel is developed with a single-family residence. The newly created parcel would be available for development of a single family home and an 800 square foot secondary residence. The project site is located within the Residential Single Family — Y (RSF-Y) zoning district. The new parcel will take access from Traffic Way. Onsite septic systems will be used for wastewater and water service will be provided by Atascadero Mutual Water Company. City of Atascadero WELCOME TO THE ATASCADERO PLANNING COMMISSION MEETING The Planning Commission meets in regular session on the first and third Tuesday of each month at 7:00 p.m., at the Pavilion on the Lake, 9315 Pismo Ave., Atascadero. Matters are considered by the Commission in the order of the printed Agenda. Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on file in the office of the Community Development Department and are available for public inspection during City Hall Annex business hours at the Community Development counter and on our website, www.atascadero.org. An agenda packet is also available for public review at the Atascadero Library, 6850 Morro Road. All documents submitted by the public during Commission meetings that are either read into the record or referred to in their statement will be noted in the minutes and available for review in the Community Development Department. TREE REMOVAL PERMIT 2004-0043, MIKE POULIN Request to remove thirty-one (31) native oak trees, six of which are over 24 -inches in diameter, in conjunction with the development of a 2,775 square foot single-family home with 400 square foot detached garage located at 2145 San Fernando Rd. Associate Planner Kelly Gleason provided the staff report and answered questions of the Commission. Chip Armani, applicant's arborist, discussed the tree removals and answered questions of the Commission. Mark Davis, project engineer, answered questions of the Commission. Steven Alvarez, project arborist, addressed questions raised by the Commission. PUBLIC COMMENT - None There was Commission discussion regarding giving the Community Development Director the discretion to approve tree removals on this project only, without going before the Planning Commission, when the diameter does not exceed 24 inches. Commissioner O'Keefe stated that any changes or removal requests should be made part of the public record and as such need to come before the Planning Commission. Community Development Director Warren Frace indicated that if the Commission gives staff this latitude, a cap must be placed on the number of trees that can be removed. He suggested a cap of 10%. MOTION: By Commissioner Bentz and seconded by Commissioner Jones to make finding #5 that the project cannot be reasonably redesigned to avoid the need to remove the identified 31 native oak trees and adopt Resolution PC 2004-0001 to approve the removal of thirty-one native oak trees subject to the guidelines and mitigation required by the Atascadero Native Tree Ordinance, and subject to project conditions. The Community Development Director has the authority to approve up to a 10% increase in the removal of trees less than 24 inches in diameter on this project. AYES: Commissioners Bentz, Jones, O'Keefe, Porter and Vice Chairperson Kelley NOES: Commissioner Beraud ABSTAIN: None Motion passed 5:1 by a roll -call vote. Commissioner O'Keefe requested the record reflect that she agreed with all of the motion except for the last sentence. Commissioner Beraud stated she voted against the motion because she was not in agreement with the last part. 4. TRAFFIC CALMING ON SAN DIEGO WAY, SOUTHSIDE VILLAS Commissioner Jones stepped down from consideration of this item stating he has a professional relationship with one of the applicants. Associate Civil Engineer Jeff van den Eikoff provided the staff report and answered questions of the Commission. Steve Orosz, Traffic Engineer, discussed the traffic analysis and answered questions of the Commission. Vice Chairperson Kelley stated his opinion that a stop sign was necessary at the end of the freeway off -ramp to provide for the safety of children and others in the vicinity. Mr. Orosz and City Engineer Steve Kahn explained their reasons for recommending that a stop sign was unwarranted for the location. PUBLIC COMMENT — None MOTION: By Commissioner O'Keefe and seconded by Commissioner Bentz to require no additional traffic calming measures on San Diego Way. AYES: Commissioners O'Keefe, Bentz, Beraud, Porter and Vice Chairperson Kelley NOES: None ABSTAIN: None Motion passed 5:0 by a roll -call vote. Vice Chairperson Kelley indicated that he had voted yes but still supported the use of a stop sign at the location. PUBLIC HEARINGS None COMMISSIONER COMMENTS & REPORTS Vice Chairperson Kelley commended staff on their efforts to get their department back up and running after the San Simeon earthquake. DIRECTOR'S REPORT Director Frace gave a report on the progress at City Hall and on the status of projects in the Community Development Department. City Engineer Steve Kahn reported on the crosswalk at Santa Rosa and El Camino Real pursuant to Commissioner O'Keefe's request. RECOMMENDATION: Staff recommends: The Planning Commission adopt Resolution PC 2004-0003 to approve the request to remove one native oak tree subject to the guidelines and mitigation required by the Atascadero Native Tree Ordinance. Project Address: 1215 EI Camino Real (Space #1258) Atascadero, CA 93422 APN 049-042-019 ANALYSIS: 02-03-04 TRP 2004-0044 1215 ECR.PC-SR.doc ITEM NUMBER: DATE: 02/03/04 The applicant is proposing to remove one (1) Live Oak tree, 48" dbh, on a site that is zoned Residential Multi Family (RMF -16) within an existing mobile home park. The applicant has applied for a Tree Removal Permit with the City in accordance with the requirements for multi -family residential tree removals. The applicant has requested the removal as recommended by a certified arborist. The arborist has determined that the tree is a significant future hazard to property and persons living in the mobile home. The arborist has concluded that the cavity has created rot and decay within the support system of the tree. The City of Atascadero's Tree Ordinance requires that mitigation for native tree removals be implemented as a condition of approval. The arborist's report findings conclude that the native oak tree to be removed is in poor condition and, due to its placement in relation to the mobile home, presents a hazard and could potentially cause damage to persons and property. Staff is recommending that the applicant replant trees or pay into the tree replacement fund to mitigate removal of the tree. The proposed mitigation is shown in the following table. In considering any tree removal request, at least one of the below stated following findings must be made. Staff has identified finding #1 as appropriate for the application request. 1) The tree is dead, diseased or injured beyond reclamation, as certified by a tree condition report from an Arborist; 2) The tree is crowded by other healthier native trees, thinning (removal) would promote healthier growth in the trees to remain, as certified by a tree condition report from an Arborist; 3) The tree is interfering with existing utilities and/or structures, as certified by a report from the Site Planner; 4) The tree is inhibiting sunlight needed for existing and/or proposed active or passive solar heating or cooling, as certified by a report from the Site Planner; 5) The tree is obstructing proposed improvements that cannot be reasonably designed to avoid the need for tree removal, as certified by a report from the Site Planner and determined by the Community Development Department based on the following factors: • Early consultation with the City; • Consideration of practical design alternatives; • Provision of cost comparisons (from applicant) for practical design alternatives; • If saving tree eliminates all reasonable uses of the property, or • If saving the tree requires the removal of more desirable trees. CONCLUSION: The applicant has submitted a tree condition statement as prepared by a certified arborist. The tree has been determined to be in poor condition and, due to their proximity to the existing residence, has been determined to be a potential hazard. This finding has been certified by the Community Development Department, and therefore meets the required findings for removal. Fair to poor condition. This is a mature oak tree located on the right middle of the property. The entire weight of this tree is leaning over the residence. Pruning all lower limbs of this tree over the years has pushed all the weight up and out over the coach. This tree has a full crown with heavy outboard limbs that extend out over the roof. Years ago approximately 50% of the main stem had fallen off leaving a large cavity in the remaining support system. The cavity measures approximately 40"X 50". The result of this old wound over time has created a lot of rot and decay inside the remaining support system, which is supporting all the weight over this residence. Because at least 50% of the main stem is compromised by decay I strongly recommend removal as soon as possible to promote safety for the resident and public. If permission is granted the owner may offer to replace this tree with three 24" box Live Oak trees with a minimum 4" caliper or pay into the cities tree replacement fund $400.00 using the Base Fee Formula @ $50.00 per 6" dbh. The arborist finds that the tree may pose a significant hazard to property and persons along EI Camino Real. The arborist has noted that the tree contains a significant cavity at the baseline and that trunk failure at crown level is possible. The root crown contains severe decay and the branches contain nesting holes. The City of Atascadero's Tree Ordinance requires that mitigation for native tree removals be implemented as a condition of approval. The arborist's report findings conclude that the native oak tree to be removed is in poor condition and immediate action is necessary. Staff recommends that the removal of the tree be mitigated by payment into the tree mitigation fund or replant trees onsite. The proposed mitigation is shown in the following table. Staff has identified finding #1 as appropriate for the application request. 1) The tree is dead, diseased or injured beyond reclamation, as certified by a tree condition report from an Arborist; 2) The tree is crowded by other healthier native trees, thinning (removal) would promote healthier growth in the trees to remain, as certified by a tree condition report from an Arborist; 3) The tree is interfering with existing utilities and/or structures, as certified by a report from the Site Planner; 4) The tree is inhibiting sunlight needed for existing and/or proposed active or passive solar heating or cooling, as certified by a report from the Site Planner; 5) The tree is obstructing proposed improvements that cannot be reasonably designed to avoid the need for tree removal, as certified by a report from the Site Planner and determined by the Community Development Department based on the following factors: • Early consultation with the City; • Consideration of practical design alternatives; • Provision of cost comparisons (from applicant) for practical design alternatives; • If saving tree eliminates all reasonable uses of the property, or • If saving the tree requires the removal of more desirable trees. CONCLUSION: The applicant has submitted a tree condition statement as prepared by a Certified Arborist. The tree has been determined to be in poor condition and, due to the proximity of EI Camino Real, has been determined to be hazardous. This finding has been certified by the Community Development Department, and therefore meets the required findings for removal. CONCLUSIONS: The subdivision, as conditioned, is consistent with the 2002 General Plan and Zoning Ordinance. The parcel configurations are consistent with the Subdivision Ordinance requirements with the finding that the depth to width ratio of proposed Parcel 2 will not be detrimental to neighboring properties and will not impede future development. The size and shape of the proposed lots are consistent with the character of the immediate neighborhood. Staff recommends the Planning Commission approve the tentative parcel map as conditioned. ALTERNATIVES: 1. The Commission may approve the subdivision subject to additional or revised project conditions. The Commission's motion to approve needs to include any new or revised project conditions. 2. A six (6) foot Public Utility Easement (PUE) shall be FM CE provided contiguous to Traffic Way property frontage. 12. The applicant shall acquire title interest in any off- FM CE site land that may be required to allow for the construction of the improvements. The applicant shall bear all costs associated with the necessary acquisitions. The applicant shall also gain concurrence from all adjacent property owners whose ingress and egress is affected by these improvements. Drainage easements shall be obtained by the FM CE applicant as needed to accommodate both public and private drainage facilities. The applicant shall address storm water detention prior to grading and drainage approval. 14. A preliminary subdivision guarantee shall be FM CE submitted for review in conjunction with the processing of the final parcel map. 15. The final map shall be signed by the City Engineer FM CE prior to the map being placed on the agenda for Planning Commission/City Council acceptance. 16. Prior to recording the final map, the applicant shall FM CE pay all outstanding plan check/inspection fees. 17. Prior to recording the final map, the applicant shall FM CE complete all improvements required by these conditions of approval. 18. Prior to recording the final map, the applicant's FM CE surveyor shall set monuments at all new property corners. A registered civil engineer or licensed land surveyor shall indicate by certificate on the parcel map, that corners have been set or shall be set by a date specific and that they will be sufficient to enable the survey to be retraced. 19. Prior to recording the parcel map, the applicant shall FM CE submit a map drawn in substantial conformance with the approved tentative map and in compliance with all conditions set forth herein. The map shall be submitted for review and approval by the City in accordance with the Subdivision Map Act and the City's Subdivision Ordinance. 20. All existing and proposed utility, pipeline, open FM CE space, or other easements are to be shown on the final map. The applicant shall show all access restrictions on the final map. 21. Prior to recording the final map, the applicant shall FM CE have the map reviewed by all applicable public and private utility companies (cable, telephone, gas, electric, Atascadero Mutual Water Company). The applicant shall obtain a letter from each utility company indicating their review of the map. The letter shall identify any new easements that may be required by the utility company. A copy of the letter shall be submitted to the City. New easements shall be shown on the final map. 22. All public improvements shall be constructed in FM CE conformance with the City of Atascadero Engineering Department Standard Specifications and Drawings or as directed by the City Engineer. 23. The applicant shall be responsible for the relocation FM CE and/or alteration of existing utilities. 24. The applicant shall install all new utilities (water, FM CE gas, electric, cable TV and telephone) underground. Utilities shall be extended to the property line frontage of each lot or its public utility easement. 25. Prior to the final inspection of any public FM CE improvements, the applicant shall submit a written statement from a registered civil engineer that all work has been completed and is in full compliance with the approved plans. 26. The applicant shall monument all property corners FM CE for construction control and shall promptly replace them if disturbed. The access way for Lot 2 shall be constructed in FO BS accordance with the City's Subdivision Ordinance and shall have a minimum paved width of 20 feet. Building /Fire Marshal: 28. 2. All roads, access ways and driveways shall be built GP FD/PS/BS to Fire Department standards, including turnouts and/or turnarounds, as required. 29. 3. All residential structures shall be within 800 feet of GP FD/PS/BS a fire hydrant as measured along the road and driveways. Water Company: FM AMWC 30. Prior to recordation of the Final Map, the applicant shall submit plans for review and approval by AMWC for all existing and proposed water distribution facilities that provide water service to the proposed lots. All new water distribution facilities shall be constructed in conformance with the Atascadero Mutual Water Company standards. The plans shall show any facilities required for fire protection. The plans shall show all cross - connection devices required to isolate the fire protection and landscape irrigation systems from the domestic water system. 31. Prior to the issuance of building permits, the applicant shall obtain a "Will Serve" letter from the Atascadero Mutual Water Company for the newly created Lots. 32. Prior to the start of construction, the applicant shall pay all installation and connection fees required by the Atascadero Mutual Water Company.
