WELCOME TO THE ATASCADERO PLANNING COMMISSION MEETING
The Planning Commission meets in regular session on the first and third Tuesday of each month at 7:00
p.m., at City Hall, Council Chambers, 6907 EI Camino Real, Atascadero. Matters are considered by the
Commission in the order of the printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the
Agenda are on file in the office of the Community Development Department and are available for public
inspection during City Hall Annex business hours at the Community Development counter and on our
website, www.atascadero.org. An agenda packet is also available for public review at the Atascadero
Library, 6850 Morro Road. All documents submitted by the public during Commission meetings that are
either read into the record or referred to in their statement will be noted in the minutes and available for
review in the Community Development Department.
In compliance with the Americans with Disabilities Act, if you need special assistance to participate in
a City meeting or other services offered by this City, please contact the City Manager's Office, (805)
461-5000, or the City Clerk's Office, (805) 461-5000. Notification at least 48 hours prior to the meeting or
time when services are needed will assist the City staff in assuring that reasonable arrangements can be

Ordinance and direct staff to work with the applicant to narrow
the driveway and attempt to preserve the tree.

the Commission.
Chairperson Porter closed the Public Comment period.
Commissioner Kelley expressed concern that the mobile home owners in the park may
not have been informed about this request.

Community Development Director Warren Frace stated that the project was noticed per
the city's code.
Commissioner O'Keefe stated she would like to hear from the owners that the costs
won't be passed on to the mobile home owners in the future.
MOTION: By Commissioner Kelley and seconded by Commissioner
O'Keefe to continue this item to a date certain of December 6,
2005, for the applicant to bring back evidence that all of the
renters within the park are aware of what is going on and of
any possible fee increases that may occur or a statement to
the fact that they don't plan on raising the fees for park rents.
Staff is directed to notify all tenants of the December 6th
meeting.
Motion passed 4:2 by a roll -call vote. (Jones, Porter opposed)
Commissioner Fonzi rejoined the meeting.

There was commission discussion regarding the setback and safety issues for the
driveway.
MOTION: By Commissioner Kelley and seconded by Commissioner
Fonzi to adopt Resolution PC 2005-0095 approving Variance
2005-0006 based on findings and subject to conditions that 1)
that the setback be 20 feet from the property line, and 2) that
the applicant work with city staff and utilize something similar
to the three story plan that was shown to the Commission
tonight.
Motion passed 5:2 by a roll -call vote. (O'Keefe, Patel opposed)
Commissioner O'Keefe stated for the record that she voted against this motion because
she is concerned about the drainage and would like to have had that issue addressed.
7. VARIANCE 2005-0007 ROSARIO AVENUE/PPN 2005-0189

Shelley and James Krause stated they live in the lot adjacent to the project site and
expressed concern about the drainage from this property, where the water would be
directed, and whether an EIR would be required.

Vivian Whitsel indicated she lives down the street from this project and stated this site is
a seasonal riparian habitat with substantial water that remains on site through most of
the year. She is also concerned about traffic safety on the road.
Chairperson Porter closed the Public Comment period.
There was Commission discussion regarding drainage, traffic, setbacks, safety, the
driveway, tree impacts and the use of a three story home on the site.
MOTION: By Commissioner Kelley and seconded by Commissioner
Jones to adopt Resolution PC 2005-0096 approving Variance
2005-0007 based on findings and subject to conditions and
adding that the garages have a 25 foot setback and that the
houses remain the same at 20.
Motion passed 6:1 by a roll -call vote. (Beraud opposed)
Vice Chairperson Beraud stated for the record that she believes this site should have a
three story house.
8. VARIANCE 2005-0008 EL RETIRO AVENUE;PPN 2005-0190

PUBLIC COMMENT
Jamie Kirk, applicant's representative, commented on Condition #8 and her concerns
with safety issues if the frontage is paved. Ms. Kirk answered questions of the
Commission.

Steve Ross, EI Retiro resident, expressed concern regarding the condition of EI Retiro
Avenue especially when it rains and the safety of the driveway for the proposed house.
Larry Arnett, EI Retiro resident, stated that setting this project five feet from the property
line is a poor design and would be an eyesore. He was also concerned with the
condition of the road and drainage issues.
Mel Danielson, EI Retiro resident, spoke about the problem of rocks and mud coming
down the road during the rainy season.
Chairperson Porter closed the Public Comment period.
There was Commission discussion regarding the driveway setback, the possibility of a
development credit, abandonment of Linda Vista, and re -vegetation of the area for
erosion prevention.
MOTION: By Commissioner Fonzi and seconded by Commissioner
Jones to continue this project to a date indefinite and allow the
developer to come in with some alternatives to include
abandonment of the road.
Motion passed 7:0 by a roll -call vote.
COMMISSIONER COMMENTS AND REPORTS
There was Planning Commission discussion of criteria for workshops on projects.
Commissioner comments regarding possible triggers for workshops included: square
footage and value of property particularly the commercial interchanges, 10,000 square
feet, if one of 10 sites in town designated as prime commercial comes up, an option in
the original application process for the applicant to request a workshop, a zone change
to the General Plan that creates a neighborhood impact, and a method where the
Commission could request a workshop if there is a project not triggered by the selected
criteria.
Community Development Director Warren Frace explained the three types of projects
that come before the Commission and suggested staff brings back workshop options
based on these three project types.
There was Commission discussion regarding receipt of staff reports, submittal
requirements for projects, and the importance of receiving all applicant documentation
on time.
Director Frace stated staff is letting developers know of the two week deadline for
project submittals and anything not in on Thursday, when agenda packets are ready for
the Commission, will be continued.

Vice Chairperson Beraud asked about the San Anselmo CUP and if there is a timeline
for the applicant to remove the exit. Director Frace stated there will be a timeline, but
reported that the Commission's decision was appealed by a Council Member.
Vice Chairperson Beraud read a letter into the record regarding motorcycle use in the
city and would like to see the Council agendize this issue to address citizen's concerns.
Commissioner Jones asked about the special meeting for training on the Brown Act and
whether every trainer will be certified by the California Bar. Director Frace stated City
Attorney Patrick Enright would handle the training.
DIRECTOR'S REPORT
Community Development Director Frace reported on the special training session on
November 29th, and reviewed the agenda for the next regular meeting. Director Frace
inquired whether the Commission would like to cancel the December 20th meeting.
There was Commission consensus to cancel the December 20, 2005 meeting.
ADJOURNMENT
Chairperson Porter adjourned the meeting at 9:30 p.m. to the next regularly scheduled
meeting of the Planning Commission on December 6, 2005.

BACKGROUND:
The applicant is proposing the removal of one (1) native oak tree located in the public
right-of-way at 9705 EI Camino Real with the development of a nineteen -unit senior
hotel. The project arborist has determined that the tree has been damaged beyond
reclamation.

ANALYSIS:
The initial sidewalk plans were designed to meander around the tree to prevent
further impacts to the native tree. Project mitigation included grading by hand and
minimal grading in general to lessen impacts to the tree. According to the arborist,
the contractor used an excavator and broke several large roots of the tree. The
project arborist has determined that the tree will soon be completely dead and
recommends the removal of the tree.
Per the requirements of the Atascadero Native Tree Ordinance, the following

Staff has conditioned that the applicant pay double fees for violating the original
mitigation required by the project arborist, in addition to planting one 24 -inch box
native Live Oak tree.
FINDINGS:
In considering any tree removal request, at least one of the findings must be made.
Staff has identified the following finding as appropriate for the application request.
The tree is dead, diseased or injured beyond reclamation, as certified by a tree
condition report from an Arborist.

Re: Senior Housing Project on El Camino Real
Per the original tree protection plan and the pre -construction meeting, the proposed
sidewalk near tree #11 was to circumvent around the tree. Grading was to be completed
by hand and kept to a minimum. Unfortunately, the contractor used an excavator and
broke off several large roots. This act combined with the former street improvements
that caused roots to be pruned has caused the tree to die. There is less than 5% live
canopy remaining and the tree will be completely dead soon. We recommend removing
the tree

DISCUSSION:
Background
On October 30, 1968, the County Planning Commission approved a Conditional Use
Permit to allow a 62 -unit mobile home park with an existing residence on an
approximately 8 -acre lot, subject to Conditions of Approval. The location of the mobile
homes is clustered toward the rear of the property. Access is taken from EI Camino
Real with separate access to the mobile home park and the single-family residence
(Figure 1). The mobile home park is connected to an onsite septic system, located
adjacent to the single family residence (Figure 2).
On October 28, 2004, the City received an application for a Lot Line Adjustment to
reconfigure the existing lots (Attachment 3). The proposed lot configuration will
separate the existing residence to be located on Parcel 1 from the mobile home park to
be located on Parcel 2. The new lot configuration will separate the existing septic
system from the mobile home park.
On November 15, 2005, the Planning Commission voted 5-2 to continue the proposed
Conditional Use Permit amendment in order to notify all residents within the mobile
home park.
Analysis
The figures below demonstrate the existing and recommended lot reconfigurations to
provide the access way in -fee:

One of the required findings for a Conditional Use Permit is "that the proposed project or
use will not be inconsistent with the character of the immediate neighborhood or
contrary to its orderly development" (Attachment 4, finding 4). The General Plan
designation for the subject site is High Density Residential (HDR). There are
underdeveloped lots located west of the Mobile Home Park and approved Planned
Developments located to the north and south (fig. 3).
Staff recommends that the mobile home park maintain the access way in -fee in order to
avoid the inappropriate creation and overburdening of an access easement. Staff also
recommends that there be a 25'-0" wide offer of dedication to the site in order to plan for
the orderly development of the adjacent multi -family lots (Condition 8). The 25-0" wide
offer of dedication will provide a portion of the requirement for a local street, in the event
that a street became necessary for future development.

Sewer Connection
The 62 -unit mobile home park will require a City sewer connection prior to recordation
of the proposed lot configuration (Condition #12). Each mobile home will be connected
to a mainline extension from the existing line on EI Camino Real.
Environmental Determination
The project has been determined to be Categorically Exempt under Class 5 section
15305 Minor Alterations in Land Use Limitations, according to the provisions of the
California Environmental Quality Act (CEQA).

CONCLUSION:
As conditioned, the proposed project is consistent with the General Plan and
Atascadero Municipal Code. Staff finds that the project, as conditioned, meets the
required findings necessary for Planning Commission approval.
ALTERNATIVES:
1. The Commission may modify the project and/or conditions of approval for the
project.
2. The Commission may determine that more information is needed on some
aspect of the project and may refer the item back to the applicant and staff to
develop the additional information. The Commission should clearly state the type
of information that is required and move to continue the item to a future date.
3. The Commission may deny the project. The Commission should specify the
reasons for denial of the project and recommend an associated finding with such
action.

RECOMMENDATION(S):
Planning Commission adopt Resolution 2005-0100 recommending the City Council
summarily vacate an unconstructed alley right-of-way based on findings and subject to
conditions of approval.
SITUATION AND FACTS:

DISCUSSION:
Background: This alley abandonment is being requested to facilitate the construction
of an approved development project. On October 12, 2004, the City Council approved a
General Plan Amendment, Zone Change, Conditional Use Permit and Tentative Tract
Map for a mixed use (residential/commercial) development on the northeast corner of EI
Camino Real and Principal. The alley right-of-way, originally created by an old
subdivision map (Map ADS Additional No. 1, Book 5, Page 1 of Map) has never been
constructed or used.
Analysis:
State Requirements - Requirements for summarily vacating a road are found in the
Streets and Highways Code, Section 8331, which provides:
8331. The legislative body of a local agency may summarily vacate a street
or highway if both of the following conditions exist:
(a) For a period of five consecutive years, the street or highway
has been impassable for vehicular travel.
(b) No public money was expended for maintenance on the street
or highway during such period.
City Requirements - California Government Code Section 65402 requires that all
abandonments be consistent with the legislative bodies General Plan, as follows:
"If a general plan or part thereof has been adopted ... no real property shall
be ... vacated or abandoned... until the location, purpose and extent of
such ... street vacation or abandonment... has been submitted to and reported
upon by the planning agency as to the conformity with said general plan or part
thereof. "
The right-of-way under consideration was created by a subdivision map in
approximately 1929. The alley has never been constructed. In addition, the alley is not
identified in the General Plan Circulation or Bikeway/Trail diagrams as a potential
pathway for community residents. Therefore, abandonment of the alley would not be
inconsistent with the General Plan.
Conclusion: The proposed abandonment meets both criteria of the State requirements
as the alley has not been constructed and has been impassable for vehicular travel for a
period of five consecutive years and public money has not been expended for
maintenance on the alley during the stated time period.
The abandonment is consistent with the City's Circulation Element of the General Plan
and will not reduce or interfere with planned roads, bikeways or trails.
ALTERNATIVES:
1. The Commission may approve the project, subject to additional or revised project
conditions. The Commission's motion to approve needs to include any new or
revised project conditions.
2. The Commission may deny the project if it is found to be inconsistent with the
General Plan or any of the other required findings. The Commission's motion to
deny must include a finding basis for denial.
3. The Commission may continue the hearing and refer the item back to staff for
additional information or analysis. Direction should be given to staff and the
applicant on required information.

Obispo (Owner / Applicant), applied for a Road Abandonment to abandon a 0.24 acre alley
portion of an alley way, created by A.D.S. Addition No. 1, City of Atascadero, County of San

WHEREAS, the Planning Commission held a duly noticed public hearing to consider the
proposed Road Abandonment on December 6, 2005 at 7:00 p.m. and considered testimony,
reports from staff, the applicants, and the public;
NOW, THEREFORE, the Planning Commission takes the following actions:
SECTION 1. Environmental Review. The Planning Commission recommends the City
Council find that the proposed project is consistent with Mitigated Negative Declaration 2004-
0024, adopted by the City Council on October 12, 2004 for the Principal Avenue Mixed Use
Project.
SECTION 2. Findings off Approval. The Planning Commission recommends that the
City Council find as follows:
1. The proposed project is consistent with the General Plan.
2. The alley proposed to be abandoned has been impassable for vehicular travel for a period
of five consecutive years and no public money has been expended for maintenance on the
street during such period.
BE IT FURTHER RESOLVED, that the Planning Commission of the City of
Atascadero does hereby recommend that the City Council approve Road Abandonment 2004-
0015 as shown on Exhibit A and subject to Conditions of Approval contained in Exhibit B.

ENGINEERING CONDITIONS:
Prior to City Council approval of the road abandonment, the applicant shall have the
application reviewed by all applicable public and private utility companies (cable,
telephone, gas, electric, Atascadero Mutual Water Company). The applicant shall obtain
a letter from each utility company which indicates their review of the application. The
letter shall identify any new easements which may be required by the utility company. A
copy of the letter shall be submitted to the City. New easements shall be recorded prior
to or concurrently with the road abandonment.

Summary:

Currently, Indoor Recreational Uses are not an allowed use in the Commercial Park
Zoning Districts. The applicants are requesting that the allowed uses in the CPK
Districts be expanded to include Indoor Recreational uses to facilitate the development
of indoor shooting and archery ranges.

Following is the proposed addition to the purpose of Indoor Recreation Services:

This zone is established to provide for large lot commercial and light manufacturing uses.
It is intended that special attention be given to providing for comprehensive development
plans to achieve appropriate functional relationships between various uses and preclude

The proposed text changes are consistent with the Environmental Impact Report
prepared for the City's General Plan and adopted by the City Council in June 2002.

The General Plan has identified Commercial Park (CPK) districts as:
"...areas along the northern portion of El Camino Real to accommodate uses that
require large parcels, such as automobile and mobile home sales, factory outlet centers,
traveler destination and recreation complexes, craft uses, nurseries and planned
commercial developments. Certain types of light industrial uses, including research and
development facilities and clean manufacturing facilities, along with office parks and
business uses may also be appropriate in this area. " (Emphasis added.)
The proposed text amendments are consistent with the General Plan, which is
implemented by the Zoning Ordinance. The proposed changes will allow for indoor
recreational uses, with Planning Commission approval, in areas where lot sizes are
generally large enough to accommodate the larger size buildings needed to facilitate
such uses.
ALTERNATIVES
1. The Commission may recommend modifications of the text amendments to the
City Council.
2. The Commission may determine that more information is needed on some
aspect of the project and may refer the item back to the applicant and staff to
develop the additional information. The Commission should clearly state the type
of information that is required and move to continue the item to a future date.
3. The Commission may recommend the City Council deny the project. The
Commission should specify the reasons for denial of the project and recommend
an associated finding with such action.

WHEREAS, an application has been received from Robert Bennet, c/o Fence Factory,
2419 Palma Drive, Ventura, California 93003, to consider Zone Change Text Amendments to
conditionally allow indoor recreational uses in the Commercial Park (CPK) Zoning Districts;
and,
WHEREAS, an the project is consistent with the Environmental Impact Report (EIR)
prepared for the City's General Plan, adopted in June 2002, whereby the EIR assessed impacts
associated with "recreational complexes" in the CPK land use designated areas; and,
WHEREAS, the Planning Commission has determined that it is in the best interest of the
City to enact this amendment to the Zoning Code Text to protect the health, safety, and welfare
of its citizens by applying orderly development and expanding housing opportunities within the
City; and,
WHEREAS, a timely and properly noticed Public Hearing upon the subject Zone Text
Change application was held by the Planning Commission of the City of Atascadero at which
