WELCOME TO THE ATASCADERO PLANNING COMMISSION MEETING
The Planning Commission meets in regular session on the first and third Tuesday of each month at 7:00
p.m., at City Hall, 6907 EI Camino Real, Atascadero. Matters are considered by the Commission in the
order of the printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the
Agenda are on file in the office of the Community Development Department and are available for public
inspection during City Hall Annex business hours at the Community Development counter and on our
website, www.atascadero.org. An agenda packet is also available for public review at the Atascadero
Library, 6850 Morro Road. All documents submitted by the public during Commission meetings that are
either read into the record or referred to in their statement will be noted in the minutes and available for
review in the Community Development Department.
In compliance with the Americans with Disabilities Act, if you need special assistance to participate in
a City meeting or other services offered by this City, please contact the City Manager's Office, (805)
461-5000, or the City Clerk's Office, (805) 461-5000. Notification at least 48 hours prior to the meeting or
time when services are needed will assist the City staff in assuring that reasonable arrangements can be

Members of the audience may speak on any item on the agenda. The Chairperson will identify the
subject, staff will give their report, and the Commission will ask questions of staff. The Chairperson will
announce when the public comment period is open and will request anyone interested to address the
Commission regarding the matter being considered to step up to the podium. If you wish to speak for,
against, or comment in any way:
• You must approach the podium and be recognized by the Chairperson
• Give your name and address (not required)
• Make your statement
• All comments should be made to the Chairperson and Commission
• All comments limited to 5 minutes (unless changed by the Commission)
• No one may speak for a second time until everyone wishing to speak has had an opportunity

Development Department at least 24 hours prior to the meeting. Access to hook up your laptop to the
City's projector will be provided. You are required to submit to the Recording Secretary a printed copy
of your presentation for the record. Please check in with the Chairperson before the meeting begins to
announce your presence and turn in the printed copy.
The Chairperson will announce when the public comment period is closed, and thereafter, no further
public comments will be heard by the Council.

spoke about circulation issues for this project and both answered questions of the
Commission.
PUBLIC COMMENT
Russ Thompson, applicant's representative, spoke about the project and requested
several changes including: 1) Condition Nos. 7 and 10 amended to permit the option of
either constructing the median or removing the driveway if the median is not built, and
2) installation of a wooden planter or decorative urn to screen the air-conditioning
condensers. Mr. Thompson answered questions of the Commission.
Jim Shores, applicant, expressed concern with the Conditions of Approval for the
driveway, fencing, lighting, and monument sign. Mr. Shores answered questions of the
Commission.

Chairperson Porter closed the Public Comment period.
There was Commission discussion regarding the driveway and median, fencing,
lighting, signage, screening of the air-conditioning equipment, curbing at back of
property, trees and landscaping, the shade structure, noise mitigation for dryers, and
the fairness of requesting the applicant to make further changes.
MOTION: By Commissioner Kelley and seconded by Chairperson Porter
to adopt Resolution PC 2005-78 approving Reconsideration of
Conditional Use Permit 2000-0022, subject to conditions of
approval and with the following changes to the Conditions on
Page 14 of the staff report:
■ Condition 1: Applicant has agreed to this condition—no
change.
■ Condition 2: Add that ornamental planters similar to what
the city has installed in the downtown redevelopment
agency could be put on either side of the air-conditioning
units.
■ Condition 3 : To be waived
■ Condition 4: To stand as written
■ Condition 5: Applicant has agreed to work with staff and
reduce the blowers from five to three.
■ Condition 6: Applicant advised to reduce driveway and did
so, therefore he met his responsibility, and it was done in
good faith, so Commission must accept that.
■ Condition 7: Fence will be an open one.
■ Condition 8: Applicant has agreed with this condition—no
change.
■ Condition 9: Lights okay as are.
■ Condition 10: Sign will be replaced between the two
masonry pillars that are in place.
■ Condition 11: Bicycle rack should be put in.
Motion failed 3:3 by a roll -call vote. (O'Keefe, Fonzi, Beraud
opposed)
MOTION: By Commissioner O'Keefe and seconded by Commissioner
Fonzi to adopt Resolution PC 2005-78 approving
Reconsideration of Conditional Use Permit 2000-0022, subject
to conditions of approval and with the following changes to
the Conditions on Page 14 of the staff report:
■ Condition 1: Site access will be limited to one driveway
and that's where the landscaping would be done.
■ Condition 2: Sidewalks must be removed and the details to
be worked out between staff and applicant.

■ Condition 3: With additional landscaping after closing off
the exit, won't need to do as many trees and the details
could be worked out with staff.
■ Condition 4: Native oak trees will be planted in the back.
■ Condition 5: Carwash blowers will be reduced from five to
three to reduce noise.
■ Condition 6: Site access will be limited to one driveway on
San Anselmo.
■ Condition 7: Iron picket fence to be used to add
consistency to tie project together.
■ Condition 9: Lighting is okay as is—no changes to
condition.
■ Condition 10: Applicant can decide where to put sign as
long as it is attractive
■ Condition 11: No changes.
■ New shade structure.
■ Remove card -lock gas station.
■ Landscaping in driveway area will include trees.

Becky Rogers spoke about problems with mud flow from a property above this project
and expressed concern that runoff from this development would drain directly onto her
property.
Doug Chisholm spoke about the history of this property and stated his concern
regarding the change in lot size from 2 1/2 to 1 acre, and the lack of notification to area
residents.
Bruce Rogers stated there should be no impacts from this development to the
surrounding area. He asked who is to be held responsible for drainage issues and any
future problems. Mr. Rogers submitted a picture (Exhibit A).
Mark Davis spoke about current drainage mitigations on single family homes, and
stated this should address the neighbors' concerns.
Becky Rogers questioned the process for approval of this project.
Chairperson Porter closed the Public Comment period.
There was Commission discussion regarding impacts from parcel no. three, slope of
driveway, impacts to trees, lack of performance standards and percolation tests, no
information on size of homes to determine septic requirements, drainage, retaining
walls, and view shed.
MOTION: By
Commissioner O'Keefe and seconded by Commissioner
Jones to continue this item to some future date and for the
applicant to work with staff to provide additional details on:
1.
Drainage calculations.
2.
Septic proposed and location.
3.
Size of the homes.
4.
Retaining walls.
5.
Driveway locations.
6.
Site shall be limited to two building sites.
7.
Conditions to be attached so that whatever is built on
Parcel No. 2 takes into consideration the view shed,
including stem walls, low profile building, etc.

Description: Tentative Parcel Map for the construction of four new detached single-family homes on individual lots
that will be developed under the requirements of the Planned Development overlay district standards
within the Residential Multi -Family (RMF -10) zoning district. The proposed residences range in size
between 1,440 square feet and 1,894 square feet. The project includes one home per lot each with a
two -car garage and one parking space in each driveway. A seven (7) inch live oak is proposed for
removal.

Associate Planner Lisa Wilkinson gave the staff report and answered questions of the
Commission.
PUBLIC COMMENT
Don Vaughn, applicant, spoke about the discrepancy in the tree report and answered
questions of the Commission.
Chairperson Porter closed the Public Comment period.
Commissioner Fonzi expressed her concerns including: orientation of house on
Navajoa, placement of windows not in keeping with Colony Homes, pillars, and the
need for additional landscaping and architectural features.
MOTION: By Commissioner Fonzi to continue this application so applicant
can work with staff to refine architecture and orientation of homes.
Deputy Community Development Director Steve McHarris clarified the orientation of the
homes.
Commissioner Fonzi withdrew her motion.
MOTION: By Commissioner Kelley and seconded by Commissioner
O'Keefe to adopt Resolution PC 2005-0087 recommending that
the City Council certify Proposed Mitigated Negative
Declaration 2005-0052; and, adopt Resolution PC 2005-0088
recommending that the City Council introduce an ordinance
for first reading by title only, to approve Zone Change 2004-
0087 based on findings; and, adopt Resolution PC 2005-0089
recommending that the City Council approve Conditional Use
Permit 2004-0133 (Master Plan of Development) with the
removal of Condition No. 23 and the removal of three native
trees based on findings and subject to Conditions of Approval
and Mitigation Monitoring; and, adopt Resolution PC 2005-
0090 recommending that the City Council approve Tentative

Commissioner Jones asked Chairperson Porter to consider agendizing a request to the
City Council to consider establishing a Planning Commission policy to have public
workshops for larger projects.
There was Commission discussion regarding the benefits and possible criteria for public
hearings and notification on large projects.
Chairperson Porter stated he would contact Mayor Scalise to inform her of the
Commissions desire for a study session on the Del Rio project.
There was Commission consensus to place an item on their next agenda to
discuss thresholds and criteria for public workshops.
Commissioner Kelley requested an update on Carl's Junior. Director Frace stated that
staff is working with the applicant's consultant and traffic engineer on a revised traffic
mitigation plan for the project.
Commissioner Jones asked for an update on the Principal project. Director Frace
reported that staff has asked the applicant for more information and an arborists report.
DIRECTOR'S REPORT
Community Development Director Warren Frace reviewed the agenda for the next
Planning Commission meeting and reported that there will be a study session regarding
affordable housing on the City Council's next agenda; Commissioners are asked to
attend. Director Frace also announced that the next Planning Commission meeting will
be held at the new City Hall building, and reported on the Safe Neighborhoods Program.
ADJOURNMENT
Chairperson Porter adjourned the meeting at 9:54 p.m. to the next regularly scheduled
meeting of the Planning Commission on November 15, 2005.

The Planning Commission adopt Resolution PC 2005-0094 to approve the request to
remove one (1) native tree subject to the guidelines and mitigation required by the
Atascadero Native Tree Ordinance and direct staff to work with the applicant to
narrow the driveway and attempt to preserve the tree.

BACKGROUND:
On June 7, 2005, the Planning Commission approved the removal of 14 native oak
trees for the development of a single family residence. The applicant is currently
requesting the additional removal of one (1) native oak tree as it is obstructing

proposed driveway improvements.
ANALYSIS:
During the preconstruction meeting for the proposed residence, staff reviewed the
tree protection plan with the grading team and project arborist. At that meeting, Tree
#9, a 22 -inch Live Oak, was determined to be closer to another tree on the adjacent
property (Tree #10) and therefore an obstruction with the proposed driveway.
Originally, the plans demonstrated a 40% impact to Tree #9 with an adjoining tree
well and a 16'-0" driveway width. The Fire Department has verbally agreed to allow a
reduction in driveway width in the area of Tree #9.
The City of Atascadero's Tree Ordinance requires that mitigation for native tree
removals be implemented as a condition of approval. Staff is recommending that the
applicant make payment into the native tree fund and reasonably attempt to preserve
the tree.
FINDINGS:
Pursuant to the Tree Ordinance (Ordinance No. 214), "decisions on native tree
removals of 24 -inch dbh-size or larger shall be made by the Planning Commission."
In considering any tree removal request, at least one of the findings must be made.
Staff has identified finding #5 as appropriate for the application request:
5. The tree is obstructing proposed improvements that cannot be reasonably
designed to avoid the need for tree removal, as certified by a report from the Site
Planner and determined by the Community Development Department based on
the following factors:
• Early consultation with the City;
• Consideration of practical design alternatives;
• Provision of cost comparisons (from applicant) for practical design
alternatives;
• If saving tree eliminates all reasonable uses of the property; or
• If saving the tree requires the removal of more desirable trees.
CONCLUSION:
The applicant has submitted a Tree Protection Plan with an Arborist letter. The tree
has been determined to be obstructing proposed improvements according to the
original plan, as determined by the Site Planner and Arborist.

There is a live oak (Quercus agrifolia), tree #9 (22" dbh) located along the proposed
driveway. The plan showed a tree well for the tree. The engineer has determined that the
fill will be 6 feet deep near this tree and a tree well will not be feasible. A retaining wall
would require a footing that would eliminate 45% of the roots and the tree may not
survive. After meeting with grading company, it was determined that tree #22 (17"), tree
#42 (28"), and tree #19 (12") can now be saved (all live oaks). The impacts to these three
trees will be 15-20% drip line impacts with some possible root pruning. The owner and
grader have been notified of the monitoring necessary to help insure survival of these
trees. Non-compliance will result in a negative final letter along with recommended
bonding.

Background: The Colony at Apple Valley Development is a 70 -unit residential
subdivision on approximately 28 acres. The project includes a 5 -acre public park and a
2 -acre open space lot. City Council approved the project on August 12, 2003. At the

time of approval, sixty-five (65) trees were approved for removal based on the Grading
and Drainage Plan and Tree Protection Plan. In April of 2005, the Planning
Commission approved the removal of an additional eleven (11) trees.
Much of the project grading has been completed and many of the homes are under
construction. In accordance with the conditions of approval, the project has been
monitored by a certified arborist and periodic updates have been submitted by the
Arborist to Community Development staff. During the monitoring process, the Arborist
has determined that there are two (2) trees which are posing problems with foundation
clearance and emergency access.
Analysis: Based on discussions with the Soils Engineer, the Arborist has determined
that tree No. 76 will pose a problem for the home's foundation in the future. In addition,
sliding glass doors will open directly in front of the tree and there will not be enough
room to exit the home. Several design alternatives were discussed and rejected for
various reasons relating to the requirements of the building code and safety issues.
Tree No. 112 is located between lots 44 and 45 and will interfere with emergency
access between the proposed residences.
When this project was first considered, the Planning Commission recommended a
condition of approval that was ultimately approved by the City Council that states:
"Any trees damaged during construction, as verified by the project arborist, be
included in the City's tree removal fee mitigation and any trees initially identified
for removal but saved during construction as verified by the project arborists be
credited against the tree removal fees."
To date, there are a number of trees that were approved for removal, which have not
yet been removed. Because of the transplanting of many of the trees, it is difficult to
accurately determine just how many trees have been saved. Staff is recommending
that a final tree count be prepared and submitted no later than January 30, 2006
(Condition 6 & 7). This report will then be brought back to the Commission as an
informational item prior to release of any mitigation fees.
FINDINGS:
This project is required to return to the Planning Commission for authorization to
remove the additional trees, even though the trees are less than 24 -inches in size,
because the Commission approved the Master Plan of Development for the site, which
included the tree protection plan. In considering any tree removal request, at least one
of the following findings must be made:
1) The tree is dead, diseased or injured beyond reclamation, as certified by a
tree condition report from an Arborist,

2) The tree is crowded by other healthier native trees, thinning (removal) would
promote healthier growth in the trees to remain, as certified by a tree
condition report from an Arborist;
3) The tree is interfering with existing utilities and/or structures, as certified by a
report from the Site Planner;
4) The tree is inhibiting sunlight needed for existing and/or proposed active or
passive solar heating or cooling, as certified by a report from the Site Planner,
5) The tree is obstructing proposed improvements that cannot be reasonably
designed to avoid the need for tree removal, as certified by a report from the
Site Planner and determined by the Community Development Department
based on the following factors:
• Early consultation with the Cites
• Consideration of practical design alternatives;
• Provision of cost comparisons (from applicant) for practical design
alternatives;
• If saving tree eliminates all reasonable uses of the property; or
• If saving the tree requires the removal of more desirable trees.
Conclusion: Staff has determined that the proposed tree removals are consistent with
Finding #5 as one tree directly interferes with a required egress and the other tree will
interfere with emergency access.

There are two trees that are posing problems for foundation clearance and firemen access
on two lots in Apple Valley. The first lot is #39 with tree #76 three feet from the
foundation. The tree is a 4 stem, 12" dbh live oak (Quercus agrifolia). The soils
engineer feels it will pose a problem for the foundation in the future. This tree was not
plotted by the surveyor so its location on the plans is 7 feet off the reality in the field.
The second tree #112 is located between lots 44 and 45. This tree is a 3" dbh valley oak
(Quercus lobata)The plans show this tree in front of lot 45, however, it is actually
between the two lots. Its location will provide access problems for the fire department
clearance.
Please add these proposed removals to the planning commission agenda as soon as
possible.

Analysis: Minimum lot size for RSF -Y parcels is one acre,rg oss. Secondary
residences of 1,000 square feet are permitted on RSF-Y lots of 1 acre, net or greater,
provided the lot can accommodate an additional septic system or has access to City
wastewater facilities. This subdivision would result in two lots, which would qualify for a
secondary residence, allowing 4 residential units on the overall property.

Conclusion:
As conditioned, the subdivision is consistent with the General Plan and Zoning
Ordinance. The parcel configurations are consistent with the Subdivision Ordinance
requirements and the size and shape of the proposed lots are consistent with the
character of the immediate neighborhood. Staff recommends the Planning Commission
approve the Tentative Parcel Map as proposed, subject to findings and conditions.
FISCAL IMPACT:
The project would likely have a slight negative impact on city revenues. As a general
rule, single-family dwellings require services that exceed the revenue generated by the
proposed uses.
ALTERNATIVES:
1. The Commission may approve the subdivision subject to additional or revised
project conditions. The Commission's motion to approve needs to include any new
or revised project conditions.
2. The Commission may deny the subdivision if it is found to be inconsistent with the
General Plan or any of the other required findings. The Commission's motion to
deny must include a finding basis for denial.
3. The Commission may continue the hearing and refer the item back to staff for
additional information or analysis. Direction should be given to staff and the
applicant on required information.

WHEREAS, Harold & Gloria Myers, 3325 Chico Road, Atascadero, California 93422
(Applicant/Property Owner) applied for a Tentative Parcel Map to subdivide one lot totaling 2.1
acres, net into two lots of 1.08 and 1.02 acres, net; and,
WHEREAS, the proposed project has a General Plan Designation of SFR -Y (Single -
Family Residential, 1 acre, gross, minimum) and is in conformance with the Land Use Element
of the General Plan and all other applicable General Plan policies; and,
WHEREAS, the site is located in the RFS -Y (Residential Single -Family, one acre, gross,
minimum) Zoning District with a minimum lot size of 1 acre, gross, which allows for the
proposed use and density when certain findings are made; and,
WHEREAS, the project is a Class 15 Categorical Exemption from the requirements of
the California Environmental Quality Act (CEQA); and,
WHEREAS, the Planning Commission held a duly noticed public hearing to consider the
proposed Tentative Parcel Map application on November 15, 2005 at 7:00 p.m. and considered
testimony and reports from staff, the applicants, and the public.
NOW, THEREFORE, the Planning Commission takes the following actions:
SECTION 1. Findings for approval of subdivision. The Planning Commission
finds as follows:
1. The proposed subdivision, as conditioned, is consistent with the General Plan and
applicable zoning requirements.
2. The design and improvement of the proposed subdivision is consistent with the
General Plan and applicable zoning requirements.

3. The site is physically suitable for the type of development proposed.
4. The site is physically suitable for the density of development proposed.
5. The design and improvement of the proposed subdivision will not cause
substantial environmental damage or substantially and unavoidably injure fish

6. The subdivision is consistent with the character of the immediate neighborhood.
7. The design of the subdivision will not conflict with easements acquired by the
public at large for access through, or the use of property within the proposed
subdivision; or substantially equivalent alternative easements are provided.
8. The proposed subdivision design and type of improvements proposed will not
cause serious public health problems.
9. The proposed subdivision will be accomplished without detriment to the adjacent
properties.
SECTION 2. Approval. The Planning Commission does hereby approve Tentative
Parcel Map 2004-0059 (AT 04-0052) to subdivide one parcel totaling 2.1 acres into two parcels

Standard Planning Conditions
1. The approval of this application shall become final,

company indicating their review of the map. The
letter shall identify any new easements that may be

be shown on the final map.
23. All public improvements shall be constructed in

DISCUSSION:
Background
On October 30, 1968, the County Planning Commission approved a Conditional Use
Permit to allow a 61 -unit mobile home park with an existing residence on an
approximately 8 -acre lot, subject to Conditions of Approval. The location of the mobile
homes is clustered toward the rear of the property. Access is taken from El Camino
Real with separate access to the mobile home park and the single-family residence.
The mobile home park is connected to an onsite septic system, located adjacent to the
single family residence.
On October 28, 2004, the City received an application for a Lot Line Adjustment to
reconfigure the existing lots (Attachment 3). The proposed lot configuration will
separate the existing residence to be located on Parcel 1 from the mobile home park to
be located on Parcel 2 with an access easement serving 61 dwelling units.

One of the required findings for a Conditional Use Permit is "that the proposed project or
use will not be inconsistent with the character of the immediate neighborhood or
contrary to its orderly development" (Attachment 4, finding 4). The General Plan
designation for the subject site is High Density Residential (HDR). There are
underdeveloped lots located west of the Mobile Home Park and approved Planned
Developments located to the north and south (fig. 3).
Staff recommends that the mobile home park maintain the access way in -fee in order to
avoid the inappropriate creation and overburdening of an access easement. Staff also
recommends that there be a 25'-0" wide offer of dedication to the site in order to plan for
the orderly development of the adjacent multi -family lots (Condition 8). The 25-0" wide
offer of dedication will provide a portion of the requirement for a local street, in the event
that a street became necessary for future development.

Environmental Determination
The project has been determined to be Categorically Exempt under Class 5 section
15305 Minor Alterations in Land Use Limitations, according to the provisions of the
California Environmental Quality Act (CEQA).
CONCLUSION:
As conditioned, the proposed project is consistent with the General Plan and
Atascadero Municipal Code. Staff finds that the project, as conditioned, meets the
required findings necessary for Planning Commission approval.

Frontage Improvements
The applicant will be required to construct Linda Vista Rd to a minimum width of 20 -
feet (EI Retiro Condition 8).
Findings:
Variance
In order to approve an exception to the Development Standards contained in the
Zoning Ordinance, the Planning Commission must make the following findings:
1. The Variance does not constitute a grant of special privileges inconsistent
with the limitations upon other properties in the vicinity and zoning district
in which such property is situated; and,
Staff Comment: Each project site is sloped and contains native trees.
The zoning ordinance allows for a sloping lot setback adjustment to 5 -feet
for sites with more than 7 -foot rise measured 50 -feet from the centerline
of the street with the approval of an AUP. The proposed building sites
present a similar situation but are not sloped enough to meet the code
requirements for the setback adjustment. The Variance to reduce the
front setback Variance will preserve native trees and reduce on-site
grading.
2. There are special circumstances applicable to the property, including size,
shape, topography, location, or surroundings, and because of these
circumstances, the application of this title would deprive the property of
privileges enjoyed by other property in the vicinity and in the same zoning
district; and,
Staff Comment: Due to the site slopes and native oak trees, the proposed
Variance appears to be superior to an alternative building site that would
significantly impact the site in terms of hillside grading and native tree
impacts.
3. The Variance does not authorize a use which is not otherwise authorized
in the zoning district; and
Staff Comment: A single family home is allowed use on the subject site.
4. The granting of such Variance does not, under the circumstances and
conditions applied in the particular case, adversely affect the health or
safety of persons, is not materially detrimental to the public welfare, nor
injurious to nearby property or improvements.
Staff Comment: Staff has reviewed the proposed building locations. All
proposed residences will have adequate sight distance to exit onto the
respective streets.
Tree Removals
Pursuant to the Tree Ordinance (Ordinance No. 214), "decisions on native tree
removals of 24 -inch dbh-size or larger shall be made by the Planning Commission."
In considering any tree removal request, at least one of the following findings must
be made:
1) The tree is dead, diseased or injured beyond reclamation, as certified by a
tree condition report from an Arborist,
2) The tree is crowded by other healthier native trees, thinning (removal)
would promote healthier growth in the trees to remain, as certified by a
tree condition report from an Arborist;
3) The tree is interfering with existing utilities and/or structures, as certified
by a report from the Site Planner;
4) The tree is inhibiting sunlight needed for existing and/or proposed active
or passive solar heating or cooling, as certified by a report from the Site
Planner;
5) The tree is obstructing proposed improvements that cannot be reasonably
designed to avoid the need for tree removal, as certified by a report from
the Site Planner and determined by the Community Development
Department based on the following factors:
• Early consultation with the City;
• Consideration of practical design alternatives;
• Provision of cost comparisons (from applicant) for practical design
alternatives;
• If saving tree eliminates all reasonable uses of the property; or
• If savina the tree reauires the removal of more desirable trees.
Based on staff's analysis in the preceding sections, it appears that all of the required
findings for approval of the requested Variances and tree removals can be met.
CONCLUSION:
The proposed project is consistent with the General Plan and Atascadero Municipal
Code, including the Native Tree Ordinance, as analyzed within this staff report. It is
staff's opinion that the proposed projects allow the Planning Commission to make all
of the required findings for project approval.
ALTERNATIVES:
1. The Commission may recommend modifications to the project and/or
conditions of approval for the project.
2. The Commission may determine that more information is needed on some
aspect of the project and may refer the item back to the applicant and staff to
develop the additional information. The Commission should clearly state the
type of information that is required and move to continue the item to a future
date.
3. The Commission may deny the project. The parcel would retain its
designation of Single -Family Residential - Y. The Commission should specify
the reasons for denial of the project and make an associated finding with such
action.

WHEREAS, an application has been received from Kelly Gearhart, 6205 Alcantara
Avenue, Atascadero, CA 93422), applicant and property owner, to consider a project
consisting of a Variance to allow encroachment into the front yard setback on APN 028-332-
027; and,
WHEREAS, the site's General Plan Designation is SFR -Y (Single -Family
Residential -Y); and,
WHEREAS, the site's current zoning district is RSF-Y (Residential Single -Family -
Y); and
WHEREAS, an Initial Study and Proposed Mitigated Negative Declaration 2005-
0054 were prepared for the project and made available for public review in accordance with
the requirements of the California Environmental Quality Act (CEQA); and,
WHEREAS, the laws and regulations relating to the preparation and public notice of
environmental documents, as set forth in the State and local guidelines for implementation of
the California Environmental Quality Act (CEQA) have been adhered to; and,
WHEREAS, a timely and properly noticed Public Hearing was held by the Planning
Commission of the City of Atascadero at which hearing evidence, oral and documentary, was
admitted on behalf of said Variance; and,
WHEREAS, the Planning Commission of the City of Atascadero held a public
hearing on November 15, 2005 following the close of the review period to consider the Initial
Study and Proposed Mitigated Negative Declaration; and,
NOW, THEREFORE, the Planning Commission of the City of Atascadero takes the
following actions:
SECTION 1. Certification of Proposed Mitigated Negative Declaration 2005-
0054
The Proposed Mitigated Negative Declaration has been completed in
compliance with CEQA; and,
2. The Proposed Mitigated Negative Declaration was presented to the Planning
Commission, and the information contained therein was considered by the
Planning Commission, prior to recommending action on the project for which
it was prepared; and,
The project does not have the potential to degrade the environment when
mitigation measures are incorporated into the project.
4. The project will not achieve short-term to the disadvantage of long-term
environmental goals.
The project does not have impacts which are individually limited, but
cumulatively considerable.
6. The project will not cause substantial adverse effects on human beings either
directly or indirectly.

flows on-site. Development of the site shall not exacerbate any

9. Barrenda Avenue shall be overlayed to City Standard, subject to the

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ATASCADERO, CALIFORNIA, CERTIFYING
PROPOSED MITIGATED NEGATIVE DECLARATION 2005-0055 AND
APPROVING VARIANCE 2005-0008, ALLOWING A REDUCTION IN
FRONT YARD SETBACK ON APN 031-112-004
(El Retiro / Gearhart)
WHEREAS, an application has been received from Kelly Gearhart, 6205 Alcantara
Avenue, Atascadero, CA 93422), applicant and property owner, to consider a project
consisting of a Variance to allow encroachment into the front yard setback on APN 031-112-
004; and,
WHEREAS, the site's General Plan Designation is SFR -Y (Single -Family
Residential -Y); and,
WHEREAS, the site's current Zoning District is RSF-Y (Residential Single -Family -
Y); and
WHEREAS, an Initial Study and Proposed Mitigated Negative Declaration 2005-
0055 were prepared for the project and made available for public review in accordance with
the requirements of the California Environmental Quality Act (CEQA); and,
WHEREAS, the laws and regulations relating to the preparation and public notice of
environmental documents, as set forth in the State and local guidelines for implementation of
the California Environmental Quality Act (CEQA) have been adhered to; and,
WHEREAS, a timely and properly noticed Public Hearing was held by the Planning
Commission of the City of Atascadero at which hearing evidence, oral and documentary, was
admitted on behalf of said Variance; and,
WHEREAS, the Planning Commission of the City of Atascadero held a public
hearing on November 15, 2005 following the close of the review period to consider the Initial
Study and Proposed Mitigated Negative Declaration; and,
NOW, THEREFORE, the Planning Commission of the City of Atascadero takes the
following actions:
SECTION 1. Certification of Proposed Mitigated Negative Declaration 2005-
0055
The Proposed Mitigated Negative Declaration has been completed in
compliance with CEQA; and,
2. The Proposed Mitigated Negative Declaration was presented to the Planning
Commission, and the information contained therein was considered by the
Planning Commission, prior to recommending action on the project for which
it was prepared; and,
The project does not have the potential to degrade the environment when
mitigation measures are incorporated into the project.
4. The project will not achieve short-term to the disadvantage of long-term
environmental goals.
The project does not have impacts which are individually limited, but
cumulatively considerable.
6. The project will not cause substantial adverse effects on human beings either
directly or indirectly.
SECTION 2. Findings for approval of Tree Removal. The Planning Commission
finds as follows:
The tree is obstructing proposed improvements that cannot be reasonably designed to
avoid the need for tree removal, as certified by a report from the Site Planner and
determined by the Community Development Department based on the following
factors:
• Early consultation with the City;
• Consideration of practical design alternatives;
• Provision of cost comparisons (from applicant) for practical design
alternatives;
• If saving tree eliminates all reasonable uses of the property; or
• If saving the tree requires the removal of more desirable trees.
SECTION 3. Findings for approval of Variance. The Planning Commission finds
as follows:
9. The Variance authorized does not constitute a grant of special privileges
inconsistent with the limitations upon other properties in the vicinity and zoning
district in which such property is situated: and
10. There are special circumstances applicable to the property, including size, and
shape of the lot, and the existence of three large native trees, and because of these
circumstances, the application of this title would deprive the property of
privileges enjoyed by other property in the vicinity and in the same zoning
district; and
11. The Variance does not authorize a use which is not otherwise authorized in the
zoning district; and
12. The granting of such Variance does not, under the circumstances and conditions
applied in the particular case, adversely affect the health or safety of persons, is
not materially detrimental to the public welfare, nor injurious to nearby property
or improvements.
SECTION 4. Approval. The Planning Commission of the City of Atascadero, in a
regular session assembled on November 15, 2005, resolved to approve Variance 2005-0008
consistent with the following:

1. The approval of this Variance shall become final and effective

plans shall be reviewed and approved bathe City Engineer. Approval
of this Variance application shall not preclude the requirements of the
Atascadero Municipal Code or Engineer Standards for on-site grading
and drainage.
8. The developer shall be required to construct Linda Vista Rd to a
