WELCOME TO THE ATASCADERO PLANNING COMMISSION MEETING
The Planning Commission meets in regular session on the first and third Tuesday of each month at 7:00
p.m., at the Pavilion on the Lake, 9315 Pismo Ave., Atascadero. Matters are considered by the
Commission in the order of the printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the
Agenda are on file in the office of the Community Development Department and are available for public
inspection during City Hall Annex business hours at the Community Development counter and on our
website, www.atascadero.org. An agenda packet is also available for public review at the Atascadero
Library, 6850 Morro Road. All documents submitted by the public during Commission meetings that are
either read into the record or referred to in their statement will be noted in the minutes and available for
review in the Community Development Department.
In compliance with the Americans with Disabilities Act, if you need special assistance to participate in
a City meeting or other services offered by this City, please contact the City Manager's Office, (805)
461-5000, or the City Clerk's Office, (805) 461-5000. Notification at least 48 hours prior to the meeting or

Commissioner O'Keefe stated for the record that though the new building is an
enhancement to the corner, she is voting against the amendment because she thinks it
is important to follow the sign ordinance.

Vice Chairperson Beraud stated for the record that she does not think the steeple
should exceed the height limit and she does not want to set a precedent.

Tentative Tract Map for the construction of 62 new single-family attached homes on individual lots
that will be developed under the requirements of a custom Planned Development Overlay District
within the RMF -16 Zoning District. Proposed homes range in size from 1100 to 1510 square feet.
The project includes one home per lot each with a one -car garage and one parking space in each
driveway. Four native trees are proposed for removal. The project will take access off of El Camino
Real.

PUBLIC COMMENT
Mike Bertachini, applicant's representative, spoke about the applicant and their goal for
this development. He explained that the applicant would like to keep Lot 25 a three
story unit if possible and asked that language be added that the deed restrictions be
reviewed by the City Attorney. Mr. Bertachini answered questions of the Commission.
Chip Tamagni, applicant's arborist, spoke about the tree protection plan for this project
and answered questions of the Commission.
Chairperson Porter closed the Public Comment period.
Chairperson Porter recessed the hearing at 8:22 p.m.
Chairperson Porter called the meeting back to order at 8:32 p.m.
MOTION: By Commissioner Kelley and seconded by Commissioner
Jones to adopt Resolution PC 2005-0044 recommending that
the City Council certify Proposed Mitigated Negative
Declaration 2005-0028; and, adopt Resolution PC 2005-0045
recommending that the City Council introduce an ordinance
for first reading by title only to approve Zone Text Change
2005-0099 establishing a Planned Development 26 Overlay
District based on findings; and, adopt Resolution PC 2005-
0046 recommending that the City Council introduce an
ordinance for first reading by title only, to approve Zone
Change 2005-0101 based on findings; and, adopt Resolution
PC 2005-0047 recommending that the City Council approve

Conditional Use permit 2005-0157 (Master Plan of
Development) based on findings and subject to Conditions of
Approval and Mitigation Monitoring; and, adopt Resolution PC
2005-0048 recommending that the City Council approve

subject to Conditions of Approval and Mitigation Monitoring
with the following changes to the conditions of approval:
1. The plans submitted shall stay as they are for lot 25, which
shall remain a three story structure.
2. The applicant will work with staff to maximize pedestrian
walkways and to add speed tables and cross walks to all
open space areas for public safety.
3. The architect will work with staff regarding the
enhancements of the buildings facing EI Camino Real
(units 55 through 46) to verify and certify that they have a
good appearance towards EI Camino Real.
4. The applicant will work with the City Engineer to look at the
entry and exit onto EI Camino Real to verify that it is safe
and whether there is any additional grading or elevation
changes that can be made to make it as safe as possible.
5. The inclusionary housing to be corrected to City Council
recommendations.
6. Vertical tubing to be used per the arborists report.
7. Outdoor equipment (park benches, etc.) will be included on
the site improvement plans and maintained by the
homeowners association to the approval of city staff.
8. Oak trees will be incorporated into the plan for the drainage
area toward EI Camino Real.

existing portions of Title 11 Subdivisions, Chapter 6 Flag Lots (deep lot subdivisions) into Title 9-
1.118 and Title 9-4 for Lot Line Adjustments; and update fencing and screening standards (AMC 9-

Commissioner Kelley stated he is uncomfortable negotiating for the Water Company
because it is a private company, and suggested in the future they just provide a will
serve letter for the Commission.
Community Development Director Warren Frace indicated that staff has similar
concerns to Commissioner Kelley's and can do more research on this issue to provide a
more appropriate mechanism to let the developers know what to expect.
Vice Chairperson Beraud asked several questions including the August 4th High Density
Workshop, the strong odor at Santa Rosa and Morro Road, Metro Scan, the lack of
bike -safe zones, and requested a progress report on the San Gabriel light. Director
Frace and Public Works Director Steve Kahn addressed the questions.
Commissioner Kelley informed the Commission that he will not be at the next Planning
Commission meeting.
Commissioner Jones asked several questions including the progress on the Lewis
Street Bridge, the West Pac projects on Principal, and enforcement of the sign
ordinance for a restaurant on EI Camino Real. Directors Frace and Kahn addressed the
questions.
Commissioner O'Keefe questioned the Elks "Bingo on Sunday" sign. Director Frace
stated he would notify code enforcement of the Elks sign as well as the EI Camino Real
restaurant sign.
Vice Chairperson Beraud asked about sandwich board signs on EI Camino Real.
Director Frace indicated he would notify code enforcement. She also questioned the
rotation of signage at the bottom of the large Weyrich billboards. Director Frace stated
he would get more information on the billboards from Redevelopment Specialist Marty
Tracey.
DIRECTOR'S REPORT
Community Development Director Warren Frace reviewed the agenda for the next
Commission meeting as well as projects scheduled for future meetings and provided an
update on the new city hall facilities.
ADJOURNMENT
Chairperson Porter adjourned the meeting at 9:25 p.m. to the next regularly scheduled
meeting of the Planning Commission on August 2, 2005.

A request to remove one (1) native oak tree 40" in diameter along the Traffic Way
right-of-way adjacent to the recently constructed Masonic Lodge. The oak tree has
been determined to be a hazard by a certified arborist.
RECOMMENDATION:

remove one (1) native oak tree subject to conditions of approval.

BACKGROUND:
The applicant is proposing the removal of one (1) native oak tree located along the
Traffic Way frontage and adjacent to the recently completed Masonic Lodge building.
The tree has been determined to be hazardous by a certified arborist. The arborist
recommends immediate removal of the tree.

ANALYSIS:
One of the major scaffold limbs noted in the arborist report as having a high degree
of failure recently failed. In addition, as noted in the arborist report, the tree includes
numerous areas of decay which degrade the structural integrity of the tree.
As the project was approved with a Master Plan of Development, staff is
recommending that the applicant replant with like species along the Traffic Way
frontage.

As the tree has been determined to be hazardous, staff is recommending that the
tree be replaced with three 24 -inch box -sized trees along the Traffic Way frontage at
30 -feet on center.
FINDINGS:
In considering any tree removal request, at least one of the findings must be made.
Staff has identified the following finding as appropriate for the application request.
The tree is dead, diseased or injured beyond reclamation, as certified by a tree
condition report from an Arborist.
CONCLUSION:
The tree has been determined to be a hazard by a certified arborist. Based on the
arborist report and above analysis, findings can be made to approve the requested
removal.

Masonic Lodge Hazard Tree
A hazard evaluation was performed on one 40 inch diameter valley oak (Quercus lobata)
located next to the Masonic lodge on Traffic Way near Portrero Rd. in Atascadero, Ca.
This tree has become a haven for woodpeckers and dozens of nesting holes are present
that are seriously degrading the structural integrity of the tree. There are large past
failures that are decaying at the point of the break. There is a cavity near the base of the
tree and heart rot is visible. The tree rated an 11 out of 12 on the hazard evaluation form
which is very dangerous. The most likely part of the tree to fail is the large scaffold
branch comprising 30% of the canopy of the tree which hangs over the building. The
nesting holes are numerous on this limb and it will fail. The cavity and decay at the base
of the tree most likely extends into the root crown which may lead to total tree failure.
Another aspect to this tree is its location in the public right-of-way. Traffic Way actually
jogs around this tree and with the increased traffic volume in this area, this is and
inherent problem and safety issue. At a minimum, remove the large limb over the
building and inspect the crown for other nesting holes/decay. The tree may need a root
crown inspection to determine the extent of that decay. If the decay is extensive, the tree
will need to be removed.

City facilities located at the existing Wastewater Treatment Plant. The proposal includes
a 12,000 square -foot maintenance and office facility and vehicle shelters for the City's
transit vehicles. The project site improvements include parking and site landscaping.
RECOMMENDATION:

DISCUSSION:
Project Definition
The proposed project consists of an infill development located at the existing City
Wastewater Treatment Plant and maintenance facility. The application includes a
proposal for a 12,000 square foot office/maintenance building and vehicle shelters for
City transit vehicles.

Setting:
North: Open Space
South: Railroad / Recreation
East: Open Space
West: Residential
The project site is within the Public General Plan Land Use Designation and Zoning
District, which allows for the existing and proposed City facilities. The project site is flat
and is surrounded by existing facility improvements. Located to the west of the project
site is the railroad. The proposed facilities will replace facilities currently located at 5599
Traffic Way.
Appearance Review
The site plan has been designed to meet the requirements of the Atascadero Municipal
Code and the appearance review requirements of the General Plan. The proposed
metal building will include landscaping and is proposed to utilize colors that blend with
the surrounding landscape. The project includes construction of paved parking areas to
include parking lot shade trees. The site will maintain the existing interior circulation and
site entrance. The site plan includes 28 paved parking spaces located adjacent to the
proposed new buildings.

General Plan Consistency
The proposed project is consistent with the following General Plan Land Use Element
Policies:
Land Use Policy 2.1: "Ensure that new development is compatible with existing and
surrounding neighborhoods".
Implementing General Plan programs requires appearance review of architectural
design, materials and color, and landscaping to fit with the existing setting and natural
environment. As analyzed above, the proposed project, as conditioned is consistent
with the General Plan.
In staff's opinion the proposed expansion and consolidation of City facilities at the
existing Wastewater Treatment Plant is consistent with the goals and policies of the
Land Use Element. The project will provide office space and covered maintenance and
vehicle parking areas. As conditioned, the project incorporates elements that are
consistent with the existing setting and consistent with the General Plan's appearance
review requirements, providing earth toned colors and upgraded site landscaping.
Findings
Conditional Use Permit
A Conditional Use Permit is required for all commercial development in excess of
10,000 square feet. The Conditional Use Permit process provides the opportunity for
the public and the Planning Commission to review the specifics of land use proposals,
such as architectural design, site design, landscape, signage, and specific standards of
the zoning ordinance. The Planning Commission must make the following five findings
to approve a Conditional Use Permit:
1. The proposed project or use is consistent with the General Plan and the City's
Appearance Review Manual.
Staff Comment: The use is consistent with the General Commercial designation of
the General Plan and General Plan Land Use Element Policy 2.1.
2. The proposed project or use satisfies all applicable provisions of the Title (Zoning
Ordinance) including the Planned Development Ordinance.
Staff Comment: As conditioned, the project satisfies all conditional use permit and
Planned Development zoning code provisions for a commercial development.
3. The establishment, and subsequent operation or conduct of the use will not,
because of the circumstances and conditions applied in the particular case, be
detrimental to the health, safety, or welfare of the general public or persons residing
or working in the neighborhood of the use, or be detrimental or injurious to property
or improvements in the vicinity of the use.
Staff Comment: The proposed commercial development will not be detrimental to
the general public or working persons health, safety, or welfare.
4. That the proposed project or use will not be inconsistent with the character or the
immediate neighborhood or contrary to its orderly development.
Staff Comment: The project has been designed to include upgraded landscaping
and utilize earth toned colors. The project site has been designed to minimize
impacts to surrounding residential uses by using existing site entrances and locating
the proposed structures within the existing developed area.
5. That the proposed use or project will not generate a volume of traffic beyond the
safe capacity of all roads providing access to the project, either existing or to be
improved in conjunction with the project, or beyond the normal traffic volume of the
surrounding neighborhood that would result from full development in accordance
with the Land Use Element.
Staff Comment: The proposed project and use is consistent with the traffic
projections and road improvements anticipated within the General Plan. Traffic
increases will occur with the additional office uses and expanded maintenance
facilities; however, the increases will not generate a volume of traffic beyond the
capacity of the existing roads.
Based on staff's analysis in the preceding sections, it appears that all of the required
findings for approval of a Conditional Use Permit can be made.
Proposed Environmental Determination
The proposed project qualifies for a categorical exception in accordance with CEQA
section 15332: Infill Development Projects.
Conclusion
The proposed project represents an infill project that will expand existing City facilities
located at the wastewater treatment plant. The proposed project is consistent with the
General Plan and Atascadero Municipal Code, as analyzed within this staff report. It is
staff's opinion that the proposed project, as conditioned allows the Planning
Commission to make all of the required findings for project approval.
ALTERNATIVES
1. The Commission may recommend modifications to the project and/or conditions
of approval for the project.
2. The Commission may determine that more information is needed on some
aspect of the project and may refer the item back to the applicant and staff to
develop the additional information. The Commission should clearly state the type
of information that is required and move to continue the item to a future date.
3. The Commission may deny the project. The Commission should specify the
reasons for denial of the project and make an associated finding with such
action.

WHEREAS, an application has been received from The City of Atascadero (6905 El

project consisting of a Master Plan of Development for a 12,000 square foot office and
maintenance facility (CUP 2005-0159); and,
WHEREAS, the site's current General Plan Designation is Public (P); and,
WHEREAS, the site's current zoning is Public (P); and,
WHEREAS, a Conditional Use Permit to establish a Master Plan of Development is
required for all commercial projects in excess of 10,000 square feet; and,
WHEREAS, the proposed project qualifies for a categorical exemption in accordance
with the requirements of the California Environmental Quality Act (CEQA) Section 15332; and,
WHEREAS, the laws and regulations relating to the preparation and public notice of
environmental documents, as set forth in the State and local guidelines for implementation of the
California Environmental Quality Act (CEQA) have been adhered to; and,
WHEREAS, a timely and properly noticed Public Hearing upon the subject Conditional
Use Permit application was held by the Planning Commission of the City of Atascadero at which
hearing evidence, oral and documentary, was admitted on behalf of said Master Plan of
Development; and,
WHEREAS, the Planning Commission of the City of Atascadero, at a duly noticed
Public Hearing held on August 2, 2005, studied and considered the Conditional Use Permit
2005-0159, and,
NOW, THEREFORE, the Planning Commission of the City of Atascadero takes the
