WELCOME TO THE ATASCADERO PLANNING COMMKISSION MEETING
The Planning Commission meets in regular session on the first and third Tuesday of each month at 7:00
p.m., at the Pavilion on the Lake, 9315 Pismo Ave., Atascadero. Matters are considered by the
Commission in the order of the printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the
Agenda are on file in the office of the Community Development Department and are available for public
inspection during City Hall Annex business hours at the Community Development counter and on our
website, www.atascadero.org. An agenda packet is also available for public review at the Atascadero
Library, 6850 Morro Road. All documents submitted by the public during Commission meetings that are
either read into the record or referred to in their statement will be noted in the minutes and available for
review in the Community Development Department.
In compliance with the Americans with Disabilities Act, if you need special assistance to participate in
a City meeting or other services offered by this City, please contact the City Manager's Office, (805)
461-5000, or the City Clerk's Office, (805) 461-5000. Notification at least 48 hours prior to the meeting or
time when services are needed will assist the City staff in assuring that reasonable arrangements can be

The Chairperson will announce when the public comment period is closed, and thereafter, no further

Eric Greening stated it would be helpful to have a clear definition of what is considered
the downtown area. He suggested a study session or a handout clarifying the
boundaries of the area covered by the downtown master plan.
Joanne Main reminded those present that Tuesday Night's in the Park begin next week.
Season passes are available at the Chamber of Commerce until Tuesday night.

Assistant Planner Lisa Wilkinson gave the staff report and answered questions of the
Commission.
PUBLIC COMMENT
Chip Tamagni, applicant's arborist, spoke about tree protection for the project and
answered questions of the Commission. He requested that it be required for the
grading contractor and his operators to be present at the pre -construction meeting so
that he can go over the mitigations and when the arborist must be called.
Mark Davis, applicant's engineer, answered questions of the Commission.

Chairperson Porter closed the Public Comment period.
Commissioner O'Keefe expressed concern regarding tree #31 in which it appears over
50% of the canopy had been pruned back.
MOTION: By Commissioner Kelley and seconded by Commissioner
O'Keefe to adopt Resolution PC 2005-0037 to approve the
request to remove fourteen (14) native trees subject to the
guidelines and mitigation required by the Atascadero Native
Tree Ordinance, with the addition of the following conditions;
that there will be an additional fee of $150 to the mitigation fee
for tree #31 that was over -pruned, that air spading will be used
for the trees identified by the arborist as needing it, and that a
pre construction meeting will be required.

MOTION: By Commissioner Kelley and seconded by Commissioner
Fonzi to adopt Resolution PC 2005-0010 certifying Proposed
Mitigated Negative Declaration 2004-0054; and, adopt
Resolution PC 2005-0011 approving Conditional Use Permit
2003-0089 and including the removal of 10 native oak trees,
subject to conditions of approval and mitigation monitoring,
and; adopt Resolution PC 2005-0012 approving Tentative Tract
map 2004-0050, subject to conditions of approval and
mitigation monitoring.
Motion passed 4:2 by a roll -call vote. (O'Keefe, Beraud
opposed)
Commissioner O'Keefe stated for the record that she voted against the motion because
no landscape plan was provided and no effort was made to save any of the native trees.
Vice Chairperson Beraud stated that she voted against the motion because out of the
10 trees she believes that at least one tree could have been saved.
COMMISSIONER COMMENTS AND REPORTS
Vice Chairperson Beraud spoke about ex parte communications and suggested that
their disclosure be part of the public hearing process as it is important to be forthright
with the public when a Commissioner has met with an applicant.
Chairperson Porter thanked Commissioner Jones for the invitation to the Economic
Forecast he sent to all the Commissioners.
DIRECTOR'S REPORT

Deputy Community Development Director Steve McHarris gave the staff report and
answered questions of the Commission. A memorandum with updated exhibits for this
project was distributed to the Commission. (Exhibit A)
Commissioner comments were as follows:
Commissioner Jones stated he was pleased with the plans and that this is a major
improvement.
Vice Chairperson Beraud indicated she was pleased with the changes and that staff
was able to work with the applicant. She stated that the reason this came back for
discussion tonight was that the appeals she and a Council Member had filed were
withdrawn because some major redesign work was done, and now this is a much better
project with better flow, landscaping and color scheme.
Commissioner O'Keefe clarified that the applicant was more than willing to work with the
city staff. She commented that she was happy that access in the back was reopened to
the applicant, and commended staff for working with the applicant to come up with a
very nice design.
Commissioner Kelley commended the applicants for sticking with the project, the
Commission for doing what they felt was right, and the staff for working with everyone to
come to a good conclusion. He suggested the applicants receive assistance with the
permit process.
Commissioner Fonzi disclosed that she has met with the applicants on the site several
times. She stated her appreciation of the applicants' openness to listen to the
Commissions ideas and incorporating them into the plan, which she feels is superior.
Chairperson Porter, spoke about the public and that City officials had not really
understood and considered what they wanted in this case. He commended the
applicants' for staying with the project and stated he was not happy with the timetable
but thinks the final product will be great for the city and the community.
PUBLIC COMMENT
Adam Scattini, applicant, thanked the Commission for taking the time to see this
through. He feels they have put together a project that is superior to what they had
hoped for and they look forward to doing business in Atascadero.
Chairperson Porter closed the Public Comment period.
Community Development Director Frace announced that the City Council will discuss
the affordable housing policy at their next meeting on June 14th; the Planning
Commission is invited to be there and comment. Director Frace reviewed the agenda

for the next Planning Commission meeting. The meeting of July 5th will be cancelled
creating a longer agenda for the July 19th meeting. An informational memo from the
City Attorney regarding the issue of the 15 year sunset clause was distributed to the
Commission. Director Frace answered questions of the Commission.
ADJOURNMENT
Chairperson Porter adjourned the meeting at 8:05 p.m. to the next regularly scheduled
meeting of the Planning Commission on June 21, 2005.

The proposed Conditional Use Permit Amendment consists of a request to remove
condition #8, which states: "The Atascadero Mutual Water Company shall provide a
minimum water pressure of 45 PSI to 14555 EI Monte Road/Vaughan's property. Any
cost incurred will be the responsibility of the Water Company."
RECOMMENDATION:
Staff Recommends:
1. Adopt Resolution No. PC 2005-0040 approving Conditional Use Permit (CUP
2004-0125) based on findings and Conditions of Approval.

DISCUSSION:
Background
On July 6, 2004, Planning Commission approved Conditional Use Permit 2004-0125 to
allow a 150,000 -gallon water storage tank, subject to conditions of approval. The
applicant, Atascadero Mutual Water Company (AMWC), requests the removal of
condition #8 from the Conditional Use Permit for legal purposes.
Analysis
According to information submitted by the AMWC, the water storage tank is near
completion and has provided the minimum 45 PSI water pressure required by the
conditions of approval (Attachment 2). The AMWC has entered into an agreement with
the property owner at 14555 EI Monte Road to provide a private booster pump with the
understanding that condition #8 be removed from the Conditional Use Permit
(Attachment 3).
Environmental Determination
The project has been determined to be consistent with the certified Mitigated Negative
Declaration 2004-0017.
CONCLUSION:
Based on the information provided, Staff recommends the Planning Commission
approve the request to remove Condition #8 from the Conditional Use Permit.
ALTERNATIVES:
1. The Planning Commission may add conditions to the proposed request.
2. The Planning Commission may recommend denial of the proposed request.
3. The Planning Commission may continue the hearing and refer the project back to
staff for further analysis. Direction should be given to staff and the applicant on
required additional information.

Dear Mr Frace,
The planning commission of the City of Atascadero, in a regular session
assembled on July 6, 2004, resolved to approve Conditional Use Permit 2004-0125. This
permit allowed the Atascadero Mutual Water Company (AMWC) to construct a new 150,000
gallon water storage tank at 14595 EI Monte Rd, subject to the conditions stipulated in Exhibit
B of Planning Commission Resolution No. 2004-0069.
AMWC is now substantially complete with this construction project and is
respectfully requesting a recession of condition No 8, from Exhibit B of the conditions of
approval, from the official record of conditions. Condition No. 8 stales that " The Atascadero
Mutual Water Company shall provide a minimum water pressure of 45 psi to 14555 EI Monte
Road/Karen Vaughan's property. Any cost will be incurred will be the responsibility of the
Water Company". We have fully completed this condition to the satisfaction of Ms. Vaughan
(see attached letter) and are now requesting, with her full cooperation, the recision of this
condition from the official record. We believe the Intention of the Planning Commission
condition was specifically for Ms. Vaughan's benefit. Now that the condition Is complete, to
her satisfaction, we request iCs removal. If you have any questions we will be happy to meet

PRIVATE BOOSTER STATION AGREEMENT
THIS AGREEMENT ("Agreement') is made and entered into by and between the
Atascadero Mutual Water Company, a California corporation ("AMWC") and Karen E.
Vaughan ("Owner"), with respect to the real property referred to as Lot 2, Block 84,
Atascadero Colony (APN 50-361-006), recorded in the County Recorder's Office in the
County of San Luis Obispo, State of California (the "Property").
RECITALS
A. WHEREAS, AMWC has recently completed the construction of a new water storage
tank to serve the area it refers to as the Cencero Boosted Zone (the EI Monte Tank).
B. WHEREAS, the EI Monte Tank will improve the reliability of the water supply to the
Property and other shareholders within the Cencero Boosted Zone;
C. WHEREAS, the EI Monte Tank will reduce the potential for water service disruptions due
to power outages, allow better regulation of water pressure, and provide more sufficient
flows for fire fighting purposes and other emergencies within the Cencero Boosted Zone;
D. WHEREAS. when the EI Monte Tank comes into service, the water pressure at the
Property will likely reduce by approximately 15 - 20 pounds per square inch (psi);
E. WHEREAS, such reduction in water pressure is less than the 45 psi to which Owner has
become accustomed;
F. WHEREAS, at Owner's request, the City of Atascadero (City) imposed a condition of
approval on the EI Monte Tank project through the Conditional Use Permit process to
maintain the water pressure at the Property at no less than 45 psi at no cost to Owner
(the CUP Condition);
G. WHEREAS, to make up for the reduction in water pressure, AMWC is willing, at its
expense, to install a booster pump and appurtenances on the Property to increase the
water pressure at the Property and provide other consideration to Owner;
H. WHEREAS, the booster pump will restore water pressure to the Property to the level that
existed before the EI Monte Tank came into service: and
I. WHEREAS, once the booster pump is installed, there will be no need for the CUP
Condition.
NOW, THEREFORE, the parties hereto do promise and agree with one another as follows:
1. Hoosier Station Installation. AMWC shall install, at its expense, a booster pump and
appurtenances on the Property to increase the water pressure at the Property.

Booster Station Operation and Maintenance. Owner agrees to accept ownership of the
booster pump and appurtenances and the ongoing, long -tens operation and
maintenance responsibilities for same.
3. Compensation. Notwithstanding paragraph 4 below, the total consideration paid or
otherwise granted by AMWC to Owner under this agreement _ cash or other
consideration, which AMWC will pay Owner in two installments. AMWC will pay the first
cash installment upon Owners execution of this Agreement. Owner agrees
that AMWC will pay the first cash installmer
- AMWC will pay to Owner the second cash installment upon the
occurrence of the City's rescission or removal of the CUP Condition (as specified in
paragraph 5 below) or final denial of the reconsideration request.
Electrical Consumption. The payment to Owner, as provided in paragraph 3 above, is
based on the assumption that the booster pump will consume 162 KW-hrs of electricity
over a one-year period. AMWC agrees to monitor the actual electrical consumption of
the booster pump with an electrical sub -meter for a single. one-year period beginning on
the date Owner executes this agreement. If the actual energy consumption during this
one-year period is less than 162 KW -hr, there will no adjustment in the payment to be
paid to Owner as provided in paragraph 3 above If the actual energy consumption over
the one-year period, however, is greater than 162 KW-hrs, AMWC agrees to pay Owner
a further single, one-time, cash payment to compensate Owner for the greater electrical
consumption of the booster pump. Such payment will be based on the difference
between the actual electrical consumption above 162 KW -hr for the one-year period (as
shown on the booster station sub -meter) and 162 KW -hr. The single, one-time, cash
payment will be calculated by determining the present value of the cost of electricity
consumed above 162 KW -hr for the one-year period, at $0.14 per KW -hr, at an annual
interest rate of two and one-half percent (2.5%) over twenty (20) years.
5 CUP Condition. Owner agrees, in good faith, to join with and support AMWC in promptly
making a request to the City to reconsider and rescind or remove the CUP Condition.
AMWC will pay all application or other fees needed to process the reconsideration
request, and Owner agrees to take all actions reasonably required of her to submit and
process the reconsideration request at no expense to Owner. The cash consideration to
be paid to Owner, as specified in paragraph 3 above, will be paid upon the final action by
the City either granting or denying the reconsideration request.
6. Successors and Assigns. This Agreement shall be binding on and shall inure to the
benefit of the heirs, executors, administrators, successors and assigns of Owner and
AMWC and to all future owners of the Property.
7. Ownership. Owner represents and warrants that she is the sole owner of the Property
and has the legal right, capacity and authority to enter into this Agreement.
8 Time is of the Essence. Time is of the essence in this Agreement.

9. Entire Agreement. This Agreement constitutes the entire agreement between the parties

the laws of the State of California.

WHEREAS, an application has been received from Atascadero Mutual Water
Company (5005 El Camino Real, CA 93422), applicant and property owner, to consider a project
consisting of a Conditional Use Permit Amendment to remove Condition #8 from the approved
Conditional Use Permit; and,
WHEREAS, the project is located within the RE (Rural Estates) land use designation of
the City of Atascadero's General Plan Land Use Diagram; and,
WHEREAS, the project is located within the RS (Residential Suburban) zoning district;
and,
WHEREAS, the project is consistent with certified Mitigated Negative Declaration
2004-0017; and,
WHEREAS, the Planning Commission of the City of Atascadero, at a duly noticed
Public Hearing held on June 21, 2005, studied and considered the proposed Conditional Use
Permit Amendment; and,
WHEREAS, the Planning Commission has determined that the proposed request is
consistent with the Conditional Use Permit; and,
WHEREAS, the laws and regulations relating to the preparation and public notice of
environmental documents, as set forth in the State and local guidelines for implementation of the
California Environmental Quality Act (CEQA) have been adhered to; and,
NOW, THEREFORE, the Planning Commission takes the following actions:
SECTION 1. Findings of Environmental Exemption. The Planning Commission finds
as follows:
1. The proposed project has been analyzed adequately in Certified Mitigated Negative
Declaration 2004-0017 for the original Conditional Use Permit.
SECTION 2. Findings for Approval of Conditional Use Permit Amendment. The
Planning Commission finds as follows:
1. The proposed project or use is consistent with the General Plan and the City's
Appearance Review Manual; and,
2. The proposed project or use satisfies all applicable provisions of the Title (Zoning
Ordinance); and,
3. The establishment, and subsequent operation or conduct of the use will not, because of
the circumstances and conditions applied in the particular case, be detrimental to the
health, safety, or welfare of the general public or persons residing or working in the

capacity of all roads providing access to the project, either existing or to be improved in
conjunction with the project, or beyond the normal traffic volume of the surrounding
neighborhood that would result from full development in accordance with the Land Use
Element.

Commission does hereby approve Conditional Use Permit 2004-0125 to delete condition #8 from

Section 6.3: Construction Equipment
• Maintain all construction equipment in proper tune according to

• Fuel all off-road and portable diesel powered equipment, including
but not limited to bulldozers, graders, cranes, loaders, scrapers,
backhoes, generator sets, compressors, auxiliary power units, with
ARB certified motor vehicle diesel fuel (Non -taxed version suitable
for use off-road).
• Maximize to the extent feasible, the use of diesel construction
equipment meeting the ARB's 1996 or newer certification standard
for off-road heavy-duty diesel engines.
Section 6.4: Activity Management Techniques
• Develop a comprehensive construction activity management plan
designed to minimize the amount of large construction equipment
operating during any given time period.
• Schedule of construction truck trips during non -peak hours to
reduce peak hour emissions.
• Limit the length of the construction workday period, if necessary.
• Phase construction activities, if appropriate.
Section 6.5: Fugitive PM10
All of the following measures shall be included on grading, demolition and
building plan notes:
A. Reduce the amount of the disturbed area where possible.
B. Use of water trucks or sprinkler systems in sufficient quantities to
prevent airborne dust from leaving the site. Increased watering
frequency would be required whenever wind speeds exceed 15 mph.
Reclaimed (non -potable) water should be used whenever possible.
C. All dirt stockpile areas should be sprayed daily as needed.
D. Permanent dust control measures identified in the approved project re -
vegetation and landscape plans should be implemented as soon as
possible following completion of any soil disturbing activities.
E. Exposed ground areas that are planned to be reworked at dates greater
than one month after initial grading should be sown with a fast-
germinating native grass seed and watered until vegetation is
established.
F. All disturbed soil areas not subject to re-vegetation should be stabilized
using approved chemical soil binder, jute netting, or other methods
approved in advance by the APCD.
G. All roadways, driveways, sidewalks, etc, to be paved should be
complete as soon as possible. In addition, building pads should be laid
as soon as possible after grading unless seeding or soil binders are
used.
H. Vehicle speed for all construction vehicles shall not exceed 15 mph on
any unpaved surface at the construction site.
I. All trucks hauling dirt, sand, soil, or other loose materials are to be
covered or should maintain at least two feet of freeboard (minimum
vertical distance between top of load and top of trailer) in accordance
with CVC Section 23114.
J. Install wheel washers where vehicles enter and exit unpaved roads onto
streets, or was off trucks and equipment leaving the site.
K. Sweep streets at the end of each day if visible soil material is carried
onto adjacent paved roads. Water sweepers with reclaimed water
should be used where feasible.
L. The contractor or builder shall designate a person or persons to monitor
the dust control program and to order increased watering, as necessary,
to prevent transport of dust off site. The name and telephone number of
such persons shall be provided to the APCD prior to land use clearance
for map recordation and land use clearance for finish grading of any
structure.

4. Vehicles and stockpiled material shall be stored outside the dripline
of all trees.
5. All trees within the area of work shall be fenced for protection with
4-foot chain link, snow, or safety fencing placed per the approved
tree protection plan. Tree protection fencing shall be in place prior
to any site excavation or grading. Fencing shall remain in place
until completion of all construction activities.
6. Any roots that are encountered during excavation shall be clean cut
by hand and sealed with an approved tree seal.

DISCUSSION:
Project Definition
The proposed project consists of a 4 -unit Multi -Family Development on a 0.3 -acre site.
The applicant is requesting Conditional Use Permit approval to allow a density bonus of
35% consistent with State Density Bonus standards to allow one additional unit above
the base density of three units. The General Plan requires a Conditional Use Permit for
the density bonus request.

The project site is currently developed with two single-family residences. Based on the
existing site acreage (0.3 acres), the property can be developed with a maximum of
three units.
The applicant is requesting a 35% density bonus (1 unit) for the provision of affordable
income units. The State density bonus program allows a 25% density bonus for the
provision of affordable housing. The City's current General Plan increases the minimum
density bonus allowance to 35% if the State requirements for affordable units are met.
In order to qualify for the density bonus, the State mandates that either 10% of the pre-
density bonus project units be deed restricted as very low-income units, or 20% of the
pre -density bonus units be deed restricted as low-income units. In accordance with this
provision, the applicant is requesting one density bonus unit to allow a 4 -unit Multi-
family Development on the project site. In exchange for the density bonus, the applicant
will deed restrict one of the units for 30 years at the low-income level.
Zoning Ordinance Conformance
Site and Buildina Desian
The site plan has been designed to meet the requirements of the Atascadero Municipal
Code and the appearance review requirements of the General Plan. Each unit has a
minimum of 300 square -feet of open space. All parking has been designed to meet the
minimum standards of the Zoning Code. Each unit has a two car garage and one
additional parking space for guest parking, consistent with City code requirements. The
proposed site has a 32% building coverage ratio which exceeds the minimum standard
of 40% maximum set by the Municipal Code.
General Plan Consistency
The proposed project is consistent with the following General Plan Land Use Element
Policies:
Land Use Program 1.1.7: "Within the Urban Core encourage infill development or
revitalization or reuse of land already committed to urban development where utilities
and public services exist.
Land Use Policy 2.1: "Ensure that new development is compatible with existing and
surrounding neighborhoods".
Housing Element Program 2.1.1: "Offer a 35% density bonus for projects that include
deed restricted very -low-, low-, and moderate -income housing."
As analyzed above and as conditioned, the proposed project is consistent with the
General Plan and has been designed to be compatible with the context of the
surrounding neighborhood.
Findings
Conditional Use Permit
A Conditional Use Permit is required for granting of the requested 35% density bonus.
The requested Conditional Use Permit is only for the density bonus allowance of one
additional unit and does not establish a Master Plan of Development or consider any
uses that might negatively impact the surrounding neighborhood. The Planning
Commission must make the following five findings to approve a Conditional Use Permit:
1. The proposed project or use is consistent with the General Plan and the City's
Appearance Review Manual.
Staff Comment: The use is consistent with the Medium Density Residential
designation of the General Plan and General Plan Land Use Element Policy 1.1.7,
2.1, and Housing Element Program 2.1.1.
2. The proposed project or use satisfies all applicable provisions of the Title (Zoning
Ordinance).
Staff Comment: As conditioned, the project satisfies all zoning code provisions
related to multi -family development.
3. The establishment, and subsequent operation or conduct of the use will not,
because of the circumstances and conditions applied in the particular case, be
detrimental to the health, safety, or welfare of the general public or persons residing
or working in the neighborhood of the use, or be detrimental or injurious to property
or improvements in the vicinity of the use.
Staff Comment: The proposed development will not be detrimental to the general
public or working persons health, safety, or welfare.
4. That the proposed project or use will not be inconsistent with the character or the
immediate neighborhood or contrary to its orderly development.
Staff Comment: The project is consistent with the surrounding neighborhood uses
and existing site improvements.
5. That the proposed use or project will not generate a volume of traffic beyond the
safe capacity of all roads providing access to the project, either existing or to be
improved in conjunction with the project, or beyond the normal traffic volume of the
surrounding neighborhood that would result from full development in accordance
with the Land Use Element.
Staff Comment: The proposed project and use is consistent with the traffic
projections and road improvements anticipated within the General Plan.
6. The density bonus provides for affordable housing costs for low- and/or very -low-
income persons that cannot be otherwise obtained.
The State density bonus program is specified in the General Plan to comply with the
affordable housing requirements specified in Government Code Section 65915 and
Health and Safety Code Section 50052.5. The City does not currently offer any other
incentives for the provision of affordable housing units within multi -family projects not
requiring legislative approval.
Based on staff's analysis in the preceding sections, it appears that all of the required
findings for approval of a Conditional Use Permit can be made.
Proposed Environmental Determination
The proposed project qualifies for a Categorical exemption per CEQA 15332 (In -fill
Development Projects).
Conclusion
The proposed project will for one additional unit on an infill multi -family site consistent
with the State density -bonus program. The applicant will provide one unit within the
development as an affordable unit, deed restricting the unit for 30 -years at a low-income
level. It is staff's opinion that the proposed project, as conditioned allows the Planning
Commission to make all of the required findings for project approval.
ALTERNATIVES
1. The Commission may find that the project does not meet the design
requirements of the Zoning Ordinance for multi -family developments and may
deny the project.
2. The Commission may determine that more information is needed on some
aspect of the project and may refer the item back to the applicant and staff to
develop the additional information. The Commission should clearly state the type
of information that is required and move to continue the item to a future date.

SITUATION AND FACTS:

DISCUSSION:
Background: The property is located west of EI Camino Real and directly south of Del
Rio Road and is the site of the Atascadero Factory Outlets (Outlets). The Outlet project
was originally approved in 1992/1993 and construction was completed in 1994.
There is Commercial Zoning to the north, south and east, and Single -Family Zoning to
the west behind Highway 101. There is an existing Master Plan of Development and a
PD -1 Overlay on the site. Changes to the Master Plan are not being proposed at this
time and the condominium project is consistent with the PD -1 Overlay.
The site is currently served by public utilities.
Condominium Design: The condominium map will merge 5 existing lots into one lot and
allow for the establishment of airspace units within the two existing buildings. The
underlying lot will be held in common ownership. The size of the retail units will be
flexible, allowing for the purchase of space needed by the individual retailer.

Public Improvements: Public improvements are not being required for this project.
Curb, gutter and sidewalk are in place, along with street trees and landscaping. All
project conditions for Master Plan of Development CUP 04-91 will remain in place.
Environmental Review: Staff has determined that the project qualifies for a Class 1
Categorical Exemption per the California Environmental Quality Act Guidelines.
Conclusion: The proposed condominium map is consistent with the 2002 General Plan
and Zoning Ordinance and the airspace units are consistent with the requirements of
the Subdivision Ordinance. Staff recommends the Planning Commission approve
Tentative Tract Map 2005-0069 based on findings and conditions.
ALTERNATIVES:
1. The Commission may approve the project, subject to additional or revised project
conditions. The Commission's motion to approve needs to include any new or
revised project conditions.
2. The Commission may deny the project if it is found to be inconsistent with the
General Plan or any of the other required findings. The Commission's motion to
deny must include a finding basis for denial.
3. The Commission may continue the hearing and refer the item back to staff for
additional information or analysis. Direction should be given to staff and the
applicant on required information.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ATASCADERO APPROVING
TENTATIVE TRACT MAP 2005-0069 (TRACT 2749), ESTABLISHING
CONDOMINIUM AIRSPACE UNITS ON ONE COMMON LOT
WITH VARIED SQUARE FOOTAGES
AT 2000-2300 EL CAMINO REAL

WHEREAS, an application was received from Owner, Levon Investments, 200 E.
Carrillo Street, Ste. 200, Santa Barbara, CA 93101, and Applicant, Kelly Gearhart, 6205
Alcantara Avenue, Atascadero, California 93422, for a Tentative Tract Map to establish
airspace units on one common lot to allow for Condominium Use and varied square footages
among the individual units; and,
WHEREAS, the proposed project has a General Plan Designation of CPK (Commercial
Park) and is in conformance with the Land Use Element of the General Plan and all other
applicable General Plan policies; and,
WHEREAS, the site is located in the CPK (Commercial Park w/PD-1 Overlay) Zoning
District, which allows for the proposed use and density when certain findings are made; and,
WHEREAS, the proposed project qualifies for a Class 1 Categorical Exemption per
Section of the California Environmental Quality Act; and,
WHEREAS, the Planning Commission held a duly noticed public hearing to consider the
proposed Tentative Tract Map application on June 21, 2005 at 7:00 p.m. and considered
testimony and reports from staff, the applicants, and the public.
NOW, THEREFORE, the Planning Commission takes the following actions:
SECTION 1. Findings for approval of condominium map. The Planning Commission
finds as follows:
1. The proposed map, as conditioned, is consistent with the General Plan and
applicable zoning requirements.
2. The design and improvement of the proposed map, as conditioned, is consistent
with the General Plan and applicable zoning requirements.
3. The site is physically suitable for the density of development proposed.
4. The design and improvement of the proposed map will not cause substantial
environmental damage or substantially and unavoidably injure fish and wildlife or
their habitat.
5. The map is consistent with the character of the immediate neighborhood.
6. The design of the condominium map will not conflict with easements acquired by
the public at large for access through, or the use of property within, the proposed
subdivision; or substantially equivalent alternative easements are provided.
7. The proposed condominium map design and type of improvements proposed will
not cause serious public health problems.
SECTION 2. Approval. The Planning Commission does hereby find:
1. That the project qualifies for a Class 1 Categorical Exemption per Section 15301
of the Guidelines for California Environmental Quality Act, and;
2. Approves Tentative Tract Map 2005-0069 to establish commercial airspace units
on one common lot; and,

Standard Planning Conditions
1. The approval of this application shall become final, subject to the completion of

property corners. A registered civil engineer or licensed land surveyor shall
indicate by certificate on the parcel map, that corners have been set or shall be
set by a date specific and that they will be sufficient to enable the survey to be
retraced.
28. Prior to recording the final map, the applicant shall pay all outstanding plan

29. Prior to recording the map, the applicant shall complete all improvements

required by these conditions of approval.
30. Prior to recording the map, the applicant shall have the map reviewed by all

Atascadero Mutual Water Company). The applicant shall obtain a letter from
each utility company indicating their review of the map. The letter shall identify
any new easements that may be required by the utility company. A copy of the
letter shall be submitted to the City. New easements shall be shown on the
parcel map.
31. Upon recording the final map, the applicant shall provide the City with a black
