Zone that would allow a dirt track for Bicycle Motocross (BMX) on an existing lot owned
by Atascadero Mutual Water Company adjacent to the Salinas River. The Planned
Development Overlay Zone Change would be site specific and include a Master plan of
Development (CUP) that would include the construction of a BMX Track, a registration
and concession building, portable restroom facilities, and a utility building. Overflow
parking is proposed within the Caltrans right-of-way under the existing Highway 41
bridge across the Salinas River. No lighting is proposed as part of this project.

WELCOME TO THE ATASCADERO PLANNING COMMISSION MEETING
The Planning Commission meets in regular session on the first and third Tuesday of each month at 7:00
p.m., at City Hall, Council Chambers, 6907 EI Camino Real, Atascadero. Matters are considered by the
Commission in the order of the printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the
Agenda are on file in the office of the Community Development Department and are available for public
inspection during City Hall Annex business hours at the Community Development counter and on our
website, www.atascadero.org. An agenda packet is also available for public review at the Atascadero
Library, 6850 Morro Road. All documents submitted by the public during Commission meetings that are
either read into the record or referred to in their statement will be noted in the minutes and available for
review in the Community Development Department.
In compliance with the Americans with Disabilities Act, if you need special assistance to participate in
a City meeting or other services offered by this City, please contact the City Manager's Office, (805)
461-5000, or the City Clerk's Office, (805) 461-5000. Notification at least 48 hours prior to the meeting or
time when services are needed will assist the City staff in assuring that reasonable arrangements can be

Members of the audience may speak on any item on the agenda. The Chairperson will identify the
subject, staff will give their report, and the Commission will ask questions of staff. The Chairperson will
announce when the public comment period is open and will request anyone interested to address the
Commission regarding the matter being considered to step up to the podium. If you wish to speak for,
against, or comment in any way:
• You must approach the podium and be recognized by the Chairperson
• Give your name and address (not required)
• Make your statement
• All comments should be made to the Chairperson and Commission
• All comments limited to 5 minutes (unless changed by the Commission)
• No one may speak for a second time until everyone wishing to speak has had an opportunity

Development Department at least 24 hours prior to the meeting. Access to hook up your laptop to the
City's projector will be provided. You are required to submit to the Recording Secretary a printed copy
of your presentation for the record. Please check in with the Chairperson before the meeting begins to
announce your presence and turn in the printed copy.
The Chairperson will announce when the public comment period is closed, and thereafter, no further
public comments will be heard by the Council.

COMMUNITY DEVELOPMENT STAFF REPORTS
2. BUDGET PRESENTATION
Administrative Services Director Rachelle Rickard gave the staff report and answered
questions of the Commission.
PUBLIC COMMENT
Eric Greening raised questions regarding: 1) the percentage budgeted for transit versus
roads, 2) funding for AGP video, 3) what specialty is the City expecting to be most in
demand for the biologist, 4) research of wildlife corridors in Atascadero as a compliment
to the Native Tree inventory, 5) what funds would be used to bridge the gap in
negotiations with FEMA if needed, and 6) source of local match for Prop 1 B funding.
Don Giessinger spoke about property tax fluctuations and their effect on the cash flow
set aside in the reserve funds.
Chairperson O'Keefe closed the Public Comment period.
Director Rickard addressed questions raised during the Public Comment period.

The proposed project was continued from the Planning Commission meeting of April

17, 2007 until a Historic Survey/Report could be obtained for the project, which has
now been completed.
The proposed project consists of an application for construction of 7 single-family
detached homes on individual lots that will be developed under the requirements of a
Planned Development Overlay -29 within the RMF -10 Zoning District. One existing home,
designated as an Atascadero Colony Home is proposed to remain. Proposed homes
range in size from 1500 to 2300 square feet. Lot sizes range from 3155 to 22,407 square
feet. The project includes one home per lot, each two stories tall and with either a porch
or a deck. Eight native trees are proposed for removal; 4 Toyons, 2 Live Oaks, and 2
Valley Oak trees. The project will take access from Palma, Rosario, and Ridgeway Court.
General Plan Designation: Medium Density Residential (MDR)
Zoning District: Residential Multi -Family -10 (RMF -10)

Senior Planner Kelly Gleason gave the staff report and answered questions of the
Commission.
The following addendums were recommended by staff:
1. Colors to be of a historic -type palate to be consistent with the existing Colony
Home and the nature of Colony home development in Atascadero.
2. Eliminate Condition No. 11.
3. Modification of Mitigation Measure 5.a.2.: addition of a sentence to the end of
measure that states "none of the walls shall be used as project signage."
PUBLIC COMMENT
Gary Tharp, applicant, stated he would like to see the Commission vote to recommend
this project go through with the staff recommendations. Mr. Tharp answered questions
of the Commission.
Jim Beck, applicant, answered questions of the Commission.
Greg Ravatt, neighbor to project, stated his concerns regarding the entry feature for this
project and asked the Commission to consider the fact that this is the entry to

Atascadero's historic neighborhood and will be so forever. He also expressed concern
that the renderings and building elevations didn't match.
Eric Greening spoke of safety issues for the project including safe bicycle and
pedestrian circulation. He asked if an analysis of Palma Avenue has been done
regarding backing out, turning motions, and flow of traffic.
Chairperson O'Keefe closed the Public Comment period.
Deputy Public Works Director David Athey and Senior Planner Gleason addressed
questions raised during the Public Comment period.
Commissioner O'Grady expressed concern regarding the discrepancies between the
rendering and what is delineated on some of the drawings showing the lack of
architectural details that are needed for the historic neighborhood.
PUBLIC COMMENT
Jim Beck explained the issue of the discrepancy between the rendering and the actual
elevations. Mr. Beck stated all the houses have historic features and will not look
identical, and that they have done everything staff has asked them to do.
Chairperson O'Keefe closed the Public Comment period.
Chairperson O'Keefe suggested the following additions to the conditions of approval:
1. A condition added that historic colors will be used on the houses.
2. On lot 3 the horizontal lap siding will be used on the upper portion and stucco on
the first floor.
3. The belly band to be eliminated as much as possible and that something other
will be used for the transition.
4. Carriage garage doors will be used on all units.
5. Clipped corners on the roofline will be eliminated.
6. A qualified stone mason to be used as a consultant for the wall and how the
materials will be put back together again.
Vice Chairperson Fonzi suggested that staff attention be given to the entry feature so
that it looks historic.
Commissioner O'Grady stated there was too much ambiguity for such an important
project at such a critical location for this neighborhood, and he cannot vote for the
project.
Commissioner Heatherington remarked that she could not make Colony sense out of
these houses, that she was not comfortable with historic preservation at this level, that
the PD was too crowded for the area, and that she was unable to make the findings.

MOTION: By Vice Chairperson Fonzi and seconded by Commissioner
Slane to adopt Resolution PC 2007-0029 recommending the
City Council certify Proposed Mitigated Negative Declaration
2007-0003; and, adopt Resolution PC 2007-0030
recommending the City Council introduce an ordinance for
first reading by title only to approve Zone Text Change 2006-
0121 to establish Planned Development Overlay Zone #29;
and, adopt Resolution PC 2007-0031 recommending the City
Council introduce an ordinance for first reading by title only,
to approve Zone Map Change 2007-0135 based on findings;
and, adopt Resolution PC 2007-0032 recommending the City
Council approve Conditional Use Permit 2006-0184 (Master
Plan of Development), with parking option "c", based on
findings and subject to Conditions of Approval and Mitigation
Monitoring; and, adopt Resolution PC 2007-0033
recommending the City Council approve Vesting Tentative
Tract Map 2006-0089 based on findings and subject to
Conditions of Approval and Mitigation Monitoring with all
recommended changes plus staff changes.
Motion passed 5:2 by a roll -call vote. (O'Grady, Heatherington
opposed)
Commissioner Marks stated for the record that he voted in favor of the motion because
he believes in developing with more density at this point as an approach for mitigating
some of the global housing crisis.

AMENDMENTS

The project consists of a proposed Zoning Ordinance Text Amendment to portions of Title

9 Planning and Zoning, of the Atascadero Municipal Code (AMC). The proposed text
updates consist of three Amendments that encompass the following:
1.) Amend the timeframe for determination of completeness for Precise Plan and
Conditional Use Permit applications to be consistent with the requirements of the State of
California's Permit Streamlining Act (AMC 9.2-102).
2.) Extend the permit timeline for planning entitlements, including Conditional Use Permits
and Precise Plans, from 12 months to 24 months, to be consistent with the approval period
of Tentative Tract Maps (AMC 9-1.104, AMC 9-2.113, AMC 9-2.114, AMC 9-2.119).
3.) Amend RSF-Y and RSF-Z minimum lot size from net area to gross area in order make
the Zoning Ordinance consistent with the General Plan requirements (AMC 9-3.154).

Commission.
PUBLIC COMMENT
Don Giessinger complimented staff on the recommendation for the Time Extension and
explained why this is important.
Greg Ravatt stated this was needed and commented that the real estate forecast for
this area is not good, and experts are looking at two years before it bottoms out, so
adding additional time is good.
Chairperson O'Keefe closed the Public Comment period.
Commissioner O'Grady stated he cannot support section #2, as he disagrees with
striking 9-2.119(b).
MOTION: By Commissioner Jack and seconded by Commissioner
O'Grady to approve staff recommendations 1., 3., and 4. as
follows: 1) Amend the processing timeframe for a
determination of completeness for Precise Plan and
Conditional Use Permit applications to be consistent with the
requirements of the State of California's Permit Streamlining
Act, and amend time limit for processing application to allow

applicant up to one year before application is deemed
withdrawn (AMC 9.2-102); and, 3. Change RSF-Y and RSF-Z
minimum lot size from net area to gross area in order to make
the Zoning Ordinance consistent with the General Plan
requirements (AMC 9-3.154); and, 4) Change the 10 -foot
minimum setback from an access way to 5 feet in order to be
consistent with side property line setbacks (AMC 11-6.26, AMC
9-4.107).
Motion passed 7:0 by a roll -call vote.
MOTION: By Commissioner Slane and seconded by Commission Jack to
approve staff recommendation #2 as follows: 2) Extend the
permit approval period for planning entitlements from 12
months to 24 months, so that all planning applications have an
approval timeline consistent with the limitations of Tentative
Tract Maps, and additional amendments to substantial site
work definition and what constitutes progress towards work
on an entitlement (AMC 9-1.104, AMC 9-2.113, AMC 9-2.114,
AMC 9-2.119).
Motion passed 6:1 by a roll -call vote. (O'Grady opposed)
5. PLN 2007-1200, ROAD ABANDONMENT, PRECISE PLAN, AND LOT LINE

Consideration of a request to have the City of Atascadero abandon a portion of Marchant

Avenue right-of-way and allow a Lot Line Adjustment between one legal lot of record (Tesoro
Gas Station / Car Wash) located at 6305 Morro Road and adjacent Marchant Avenue right-of-
way. The project is proposed to accommodate an 850 square -foot Car Wash adjacent to an
existing Car Wash / Gas Station.

answered questions of the Commission.
PUBLIC COMMENT
Don Giessinger, applicant, spoke about the history of the project site and stated he has
an issue with the fair market price wording. Mr. Giessinger answered questions of the

Commission, and stated he has submitted plans to the Building Department for a car
wash.
Chairperson O'Keefe closed the Public Comment period.
MOTION: By Commissioner Marks and seconded by Chairperson
O'Keefe to recommend the City Council summarily vacate the
landscaped portion of Marchant Avenue right-of-way (Road
Abandonment 2007-0018); and, approve Lot Line Adjustment
2007-0082, based on findings and subject to Conditions of
Approval; and, recommend the City Council seek market rate
compensation for the landscaped portion of Marchant Avenue
right-of-way.
Motion passed 7:0 by a roll -call vote.
Chairperson O'Keefe recessed the hearing at 10:35 p.m.
Chairperson O'Keefe called the meeting back to order at 10:45 p.m.
COMMISSIONER COMMENTS AND REPORTS
Chairperson O'Keefe stated she would like to have the City Council give more direction
regarding historic houses. She commented it would be helpful to require a historical
analysis report with each historic house or building that comes up, and to get more
specific direction as to what the Council wants regarding this subject.
MOTION: By Chairperson O'Keefe and seconded by Vice Chairperson
Fonzi to have the City Council develop some standards for
how they want the Planning Commission to handle historic
buildings, and including when they would require an historical
analysis.
Motion passed 7:0 by a roll -call vote.
Commissioner O'Grady asked for a copy of the minutes of the meeting between the
Mayor, Mayor Pro Tem and the Commission Chairs and Vice Chairs. Director Frace
reported that the draft minutes have been circulated to those who participated in the
meeting and he would check with the City Clerk as to when they will be available for
distribution.

There was Commission discussion of the proposed norms and the following sections

• Criteria for commissioner for re -appointment (and in extreme cases, removal) shall include:
issues of conflicts of interest
- Attendance (Absence from 3 consecutive meetings, or from 4 meetings during a calendar
year without formal consent of the C ;onCouncil).
- Support of General Plan.
- Respect for staff/public.
- Working for community versus personal purposes. (Needs to be clarified or deleted)
COMMISSION VALUES

• Commission Members will have respect for each other as individuals.

DISCUSSION:
Site Description
The existing lot is 1.40 acres and has an average slope of 26% at the building site. The
site is covered by Coast Live Oaks and Valley Oaks. The tree canopy is dense. The
slope of the site becomes very steep on the west side of the lot behind the proposed
residence. A drainage swale begins on the west side of the lot towards the top of the
hill, and leads down across the site. The swale becomes more defined at the southern
portion of the site where it is parallel to Ardilla Road. The site is currently vacant.
Site Design
The proposed residence is designed at 2,272 square feet with a 941 square foot
attached garage. The residence is designed to take access from Ardilla Road. The
proposed residence and driveway cross a natural drainage course with a proposed
culvert. The swale is considered a significant drainage course, but it is not identified as
a Blue Line Creek, and therefore, is not subject to building setbacks by City Ordinances.
The on-site septic system shall have a minimum setback of 50 feet from the swale per
City Standards. An interceptor channel is being proposed to catch runoff from behind
the residence and empty into a catch basin on the northwest side of the residence and
then deposit the runoff on the southeast side.

Approximately 50 cubic yards of cut and 100 cubic yards of fill will be required in order
to construct the driveway and residence. The slope at the building site averages 26%.
In order to minimize the area of grading, the house is designed to step up the hill above
the garage to follow the natural slope.
The residence will connect to a proposed on-site septic system. The septic maintains a
minimum 50 foot setback from the drainage course. The arborist believes that the trees
being impacted by the septic system will survive. The applicant is proposing a deep pit
expansion area at the request of the arborist. The applicant has looked into the
possibility of connecting to the sewer line which is currently being expanded to 5350
Ardilla, however, the connection has shown to be cost prohibitive.

prepared by A&T Arborists, shall be implemented prior to and during all construction
activity on the project site (Condition #3). Tree protection fencing and arborist
monitoring shall be required. An on-site pre -construction meeting shall be required
between the City, arborist, applicant, and grading contractor prior to permit issuance
(Condition #5). Upon project completion, a final status report shall be prepared by the
Project Arborist certifying that the tree protection plan was implemented, the trees were
protected during construction, and arborist monitoring took place as required (Condition
#6). All utilities shall be located within roadways and driveways and outside the
driplines of native trees (Condition #4).

The proposed project has been reviewed by staff for compliance with the Atascadero
Native Tree Ordinance. If approved, the project would allow for the removal of 5 native
trees totaling 70 inches DBH. The applicant shall pay mitigation fees totaling $883.33.
An additional mitigation deposit of $791.67 shall be held for all trees impacted over 45
percent during construction. The deposit may be refunded one year after project
completion if the trees are in good health. Staff recommends the Planning Commission
approve the Tree Removal Permit as conditioned.
ALTERNATIVES:
1. The Commission may approve the subject to additional or revised project conditions.
The Commission's motion to approve needs to include any new or revised project
conditions.
2. The Commission may deny the project if it is found to be inconsistent with the Native
Tree Ordinance or any of the other required findings. The Commission's motion to
deny must include a finding basis for denial.
3. The Commission may continue the hearing and refer the item back to staff for
additional information or analysis. Direction should be given to staff and the
applicant on required information.

This tree protection plan is in regard to Lot 21, Block KB, 5240 Ardilla Avenue in
Atascadero, California. The APN # is 030-251-023. The lot is a heavily forested area
with a slight slope down from Ardilla Avenue to a rather flat area where the home will be
built. From the home site, the elevation rises rapidly to the south. The native trees on
site consist of coast live oaks (Quercus agrifolia) and valley oaks (Quercus lobata). Five
trees are being proposed for removal with a total diameter of 70 inches. The plans show
several small oak trees approximately 35 feet into the driveway on the right hand side.
These trees are not native. There is a natural drainage that runs through the property. An
interceptor channel will be constructed that captures the sheet runoff from the hillside
behind the home. It will then collect water from the natural channel and direct it to a
catch basin on the northwest side and the driveway. An additional detention basin will
collect water from the driveway area and deposit it on the south side. The slope is steep
near trees #5 and #6 and we expect root interaction with the detention basin trenching.
The catch basin near trees #21 and #22 is fairly close to the trunks. This area appears to
have significant historical fill. We feel the retaining wall can be constructed with proper
monitoring. In the event that large buttressing roots are encountered from either tree, the
trees may have to be removed due to potential instability. The septic system will pump
uphill into the leach fields. The line originally passed close to trees #22, #1 and #2. The
line was redesigned as shown on the plans so the route is further from the trees. The
primary leach fields has been shifted to the east away from trees #1 and #2 from the
original design. The secondary leach fields were converted to a pit system to allow for a
greater distance from the native trees. All fencing needs to be designed as shown in
orange ink on the plans. Utilities are planned on the north side of the driveway and do
not pass through any drip lines. All the trees appear to have sufficient clearance and do
not need pruning for construction. However, trees #9, #21 and #22 will be targeting
improvements and they should have some weight reduction pruning prior to construction
activities. We strongly feel trees #5, #6, #7, #9, #21, and #22 should be treated with a
systemic anti -fungal fertilizer and systemic insecticide to help them defend against pest
and disease due to the moderate impacts. Trees with moderate construction impacts will
die on occasion without proper monitoring and remedial measures, therefore, we feel
these measures are necessary to give the trees the best chance for survival.
It is the responsibility of the owner to provide a copy of this tree protection plan to any
and all contractors and subs that work within the drip line of any native tree. It is highly
recommended that each contractor sign and acknowledge this tree protection plan.

This project shall require an on-site pre -construction meeting with the city, owner,
grading contractor and the arborist. Topics will include fencing, monitoring and
requirements for a positive final occupancy letter.
All trees potentially impacted by this project are numbered and identified on both the
grading plan and the spreadsheet. Trees are numbered on the grading plans and in the
field with an aluminum tag. Tree protection fencing is shown on the grading plan. In the
field, trees to be saved have yellow tape and trees to be removed have red tape.
Tree Rating System
A rating system of 1-10 was used for visually establishing the overall condition of each
tree on the spreadsheet. The rating system is defined as follows:

1 Evidence of massive past failures, extreme disease and is in severe
decline.
2 May be saved with attention to class 4 pruning, insect/pest
eradication and future monitoring.
3 Some past failures, some pests or structural defects that may be
mitigated by class IV pruning.
4 May have had minor past failures, excessive deadwood or minor
structural defects that can be mitigated with pruning.
5 Relatively healthy tree with little visual structural and or pest
defects.
6 Healthy tree that probably can be left in its natural state.
7-9 Have had proper arboricultural pruning and attention or have no
apparent structural defects.
10 Specimen tree with perfect shape, structure and foliage in a
protected setting (i.e. park, arboretum).
The following mitigation measures/methods must be fully understood and followed by
anyone working within the drip line of any native tree. Any necessary clarification will
be provided by us (the arborists) upon request.
1. Fencing: The proposed fencing shall be shown in orange ink on the grading
plan. It must be a minimum of 4' high chain link, snow or safety fence staked at the edge
of the drip line or line of encroachment for each tree or group of trees. The fence shall be
up before any construction or earth moving begins. The owner shall be responsible for
maintaining an erect fence throughout the construction period. The arborist(s), upon
notification, will inspect the fence placement once it is erected. After this time, fencing
shall not be moved without arborist inspection/approval. If the orange plastic fencing is
used, a minimum of four zip ties shall be used on each stake to secure the fence. All
efforts shall be made to maximize the distance from each saved tree. The fencing must
be constructed prior to the city pre -construction meeting for inspection by the city and the
arborists.

2. Soil Aeration Methods: Soils within the drip line that have been compacted
by heavy equipment and/or construction activities must be returned to their original state
before all work is completed. Methods include water jetting, adding organic matter, and
boring small holes with an auger (18" deep, 2-3' apart with a 24" auger) and the
application of moderate amounts of nitrogen fertilizer. The arborist(s) shall advise.
3. Chip Mulch: All areas within the drip line of the trees that cannot be fenced
shall receive a 4-6" layer of chip mulch to retain moisture, soil structure and reduce the
effects of soil compaction.
4. Trenching Within Drip Line: All trenching for foundations within the drip
line of native trees shall be hand dug. All major roots shall be avoided whenever
possible. All exposed roots larger than 1 " in diameter shall be clean cut with sharp
pruning tools and not left ragged. A Mandatory meeting between the arborists and
grading/trenching contractor(s) shall take place prior to work start. This activity shall be
monitored by the arborist(s) to insure proper root pruning is talking place.
5. Grading Within The Drip Line: Grading should not encroach within the drip
line unless authorized. Grading should not disrupt the normal drainage pattern around the
trees. Fills should not create a ponding condition and excavations should not leave the
tree on a rapidly draining mound.
6. Exposed Roots: Any exposed roots shall be re-covered the same day they
were exposed. If they cannot, they must be covered with burlap or another suitable
material and wetted down 2x per day until re -buried.
7. Paving Within The Drip Line: Pervious surfacing is preferred within the
drip line of any native tree. This includes coring vertical tubing approximately 4 feet on
center within the drip line and backfilling with Mychorizza, slow release fertilizer and
pea gravel. Due to the significant fill and planned retaining wall near trees #21 and #22,
pavers are not required.
8. Equipment Operation: Vehicles and all heavy equipment shall not be
driven under the trees, as this will contribute to soil compaction. Also there is to be no
parking of equipment or personal vehicles in these areas. All areas behind fencing are off
limits unless pre -approved by the arborist.
9. Existing Surfaces: The existing ground surface within the drip line of all
native trees shall not be cut, filled, compacted or pared, unless shown on the grading
plans and approved by the arborist.
10. Construction Materials And Waste: No liquid or solid construction waste
shall be dumped on the ground within the drip line of any native tree. The drip line areas
are not for storage of materials either.
11. Arborist Monitoring: An arborist shall be present for selected activities
(trees identified on spreadsheet and items bulleted below). The monitoring does not
necessarily have to be continuous but observational at times during these activities. It is
the responsibility of the owner(s) or their designee to inform us prior to these events so

we can make arrangements to be present. It is the responsibility of the owner to contract
(prior to construction) a locally licensed and insured arborist that will document all
monitoring activities.

• any utility or drainage trenching within any drip line
• All grading and trenching near trees requiring monitoring on the spreadsheet
inlcuding trees #1, #2, #5, #6, #7, #9, #21, #22, #23, and #24. Arborist monitoring is
mandatory and a firm commitment shall be made between the arborists and
grading/trenching contractor(s) at the time of the pre -construction meeting.
12. Pre -Construction Meeting: An on-site pre -construction meeting with the
Arborist(s), Owner(s), Planning Staff, and the earth moving team shall be required for
this project. Prior to final occupancy, a letter from the arborist(s) shall be required
verifying the health/condition of all impacted trees and providing any recommendations
for any additional mitigation. The letter shall verify that the arborist(s) were on site for
all grading and/or trenching activity that encroached into the drip line of the selected
native trees, and that all work done in these areas was completed to the standards set forth
above.
13. Pruning: Class 4 pruning includes -Crown reduction pruning shall consist of
reduction of tops, sides or individual limbs. A trained arborist shall perform all pruning.
No pruning shall take more than 25% of the live crown of any native tree. Any trees that
may need pruning for road/home clearance shall be pruned prior to any grading activities
to avoid any branch tearing.
14. Landscape: All landscape under the drip -line shall be drought tolerant or native
varieties. Lawns shall be avoided. All irrigation trenching shall be routed around drip
lines; otherwise above ground drip -irrigation shall be used. It is the owner's
responsibility to notify the landscape contractor regarding this mitigation.
15. Utility Placement: All utilities and sewer/storm drains shall be placed down
the roads/driveways and when possible outside of the drip lines. The arborist shall
supervise trenching within the drip line. All trenches in these areas shall be exposed
by air spade or hand dug with utilities routed under/over the roots. Roots greater
than 2 inches in diameter shall not be cut.
16. Fertilization and Cultural Practices: As the project moves toward
completion, the arborist(s) may suggest either fertilization and/or mycorrhiza applications
that will benefit tree health. Mycorrhiza offers several benefits to the host plant,
including faster growth, improved nutrition, greater drought resistance, and protection
from pathogens.
The included spreadsheet includes trees listed by number, species and multiple stems if
applicable, diameter and breast height (4.5'), condition (scale from poor to excellent),
status (avoided, impacted, removed, exempt), percent of drip line impacted, mitigation

required (fencing, root pruning, monitoring), construction impact (trenching, grading),
recommended pruning and individual tree notes.
If all the above mitigation measures are followed, we feel there will be no additional
long-term significant impacts to the remaining native trees.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ATASCADERO APPROVING
PLN 2007-1228 / TREE REMOVAL PERMIT 2007-0112,
REMOVAL OF NATIVE TREES FOR CONSTRUCTION OF A SINGLE-FAMILY
RESIDENCE AT 5250 ARDILLA ROAD
(FERGUSON)
WHEREAS, an application was received from John Ferguson, 192 Country Club Drive,
San Luis Obispo, CA 93401, (Owner/Applicant), for a Tree Removal Permit to remove 5 native
trees with a total 70 inches DBH; and,
WHEREAS, the proposed project has a General Plan Designation of Single -Family
Residential, minimum lot size 1 % - 2 '/z acre (SFR -Z) and is in conformance with the Land Use
Element of the General Plan and all other applicable General Plan policies and the Native Tree
Ordinance; and,
WHEREAS, the site is located in the Residential Single -Family, minimum lot size 1 '/2 -
2 %2 acre (RSF-Z) which allows for the proposed use and density when certain findings are made;
and,
WHEREAS, the Planning Commission held a duly noticed public hearing to consider the
proposed Tree Removal Permit application on October 2, 2007 at 7:00 p.m. and considered
testimony and reports from staff, the applicants, and the public.
NOW, THEREFORE, the Planning Commission takes the following actions:
SECTION 1. Findings for tree removal. The Planning Commission finds as follows:
1. The tree is obstructing proposed improvements that cannot be reasonably designed to
avoid the need for tree removal, as certified by a report from the Site Planner and
determined by the Community Development Department based on the following
factors:
• Early consultation with the City;
• Consideration of practical design alternatives;
• Provision of cost comparisons (from applicant) for practical design
alternatives;
• If saving the tree eliminates all reasonable uses of the property; or
• If saving the tree requires the removal of more desirable trees.

SECTION 2. Approval. The Planning Commission does hereby approve Tree Removal
Permit 2007-0112 to remove 5 native trees with a total 70 inches DBH to establish a Single -
Family Residence, subject to the following Conditions and Exhibits:

Standard Planning Conditions
1. The approval of this application shall become final, subject to the completion of

Commission approval unless prior to the time, an appeal to the decision is filed
as set forth in Section 9-1.111(b) of the Zoning Ordinance.
Project Planning Conditions
2. Prior to issuance of construction permits all tree mitigation fees shall be

3. All recommendations and tree protection measures, as outlined in the Tree

Protection Report, prepared by A&T Arborists shall be implemented prior to
and during all construction activity on the project site.
4. All utilities shall be located within roadways and driveways and outside the

driplines of native trees.
5. An on-site pre -construction meeting shall be required between the City,

arborist, applicant, and grader prior to permit issuance. Tree protection
fencing shall be installed at the line of encroachment into the tree's root
zone area, as to the tree protection plan
6. Upon project completion, a final status report shall be prepared by the

Project Arborist certifying that the tree protection plan was implemented,
the trees were protected during construction, and arborist monitoring took
place as required.
