Two new metal buildings, the construction of a new 12,000 square -foot, single -story administration office for Water Company management, and a new 80 -foot tall radio mast are proposed. The project is located on a 10 -acre site on Sycamore Road, near Atascadero Creek and the Salinas River. No construction is proposed within the Creek or the River. The project proposal consists of the removal of nine (9) native trees with a total diameter of forty-eight (48) inches. All trees proposed for removal are less than nine inches DBH. General Plan Designation: Industrial (1) Zoning District: Industrial (1) and Industrial Park (IP) Proposed Based on the initial study prepared for the project, a Mitigated Negative Declaration is Environmental Proposed. Matters are considered by the Commission in the order of the printed Agenda. Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on file in the office of the Community Development Department and are available for public inspection during City Hall Annex business hours at the Community Development counter and on our website, www.atascadero.org. An agenda packet is also available for public review at the Atascadero Library, 6850 Morro Road. All documents submitted by the public during Commission meetings that are either read into the record or referred to in their statement will be noted in the minutes and available for review in the Community Development Department. She called him back stating she didn't see a reason to meet with him and that the Commission would be meeting tonight. ■ Commissioner Marks stated he received a phone call from Mr. Tompkins, and they did not discuss the project. ■ Vice Chairperson Slane stated he received call from Roger Tompkins and chose not to meet with him. ■ Chairperson Fonzi stated she received a call from Mr. Tompkins and did not meet with him. She called John Neil from the Atascadero Mutual Water Company and discussed some issues regarding the matter before the Commission. ■ Commissioner O'Grady stated he received a phone call from Mr. Tompkins. He called him back and they discussed the statistics on apartments and condos. PUBLIC COMMENT — None CONSENT CALENDAR 1. It has been determined that the oak tree is damaged beyond reclamation by a certified arborist and creates a hazardous situation for residents. Mr. Tamagni answered questions of the Commission. PC Draft Minutes 05/06/08 Page 2 of 10 Carol Eastman stated she lives across from the tree in question, and stated she did not like to see it removed as it is beautiful and looks healthy. Harold McIntire, Maintenance Manager for the mobile home park, explained why it was decided to inspect the tree and his concern for the safety of the residents and their property. Mr. McIntire answered questions of the Commission. Chip Tamagni spoke about regeneration on the property and answered questions of the Commission. Chairperson Fonzi closed the Public Comment period. MOTION: By Vice Chairperson Slane and seconded by Commissioner Jack to adopt Resolution PC 2008-0025 to approve the request to remove one (1) native oak tree subject to conditions of approval and payment into the mitigation fund. Motion passed 6:1 by a roll -call vote. (Heatherington opposed) COMMUNITY DEVELOPMENT STAFF REPORTS PUBLIC HEARINGS CONTINUED BUSINESS: 2. PUBLIC COMMENT Bob Fowler, applicant, explained the reasons for requesting the changes to his project and addressed the issues of condominium fees, phasing, and apartment vacancies in Atascadero. Mr. Fowler answered questions of the Commission. Chairperson Fonzi closed the Public Comment period. Commissioner O'Keefe stated she could support 10 condominiums with 10 rental units, as these would be apartments that are rented. She explained that through the Specific Plan, the applicant received a significant increase in density with conditions for higher architectural standards, etc. She believes the five condos with 10 rental units in each would meet the financing difficulties and still have apartments available, therefore, she cannot support the proposal as presented. There was Commission discussion regarding the changing financial situation in the economy and the need to provide the applicant the opportunity to meet his obligations, and further discussion regarding distribution of the moderate -income units within the project. MOTION: By Commissioner Jack and seconded by Commissioner Marks to adopt Resolution No. PC 2008-014 approving the Amendment to Conditional Use Permit 2004-0123 modifying the Master Plan of Development from 100 apartments to 50 apartments and 50 individual condominiums and allowing for the placement of condominium status on the five (5) apartment buildings subject to conditions and mitigation monitoring; and, adopt Resolution No. PC 2008-0015 approving TTM 2007- 0100 Tentative Tract Map 2937 for air space condominium purposes subject to conditions and mitigation monitoring, and of the eight moderate units that are available, six of them will be applied to the apartments and two to the condominiums, and that the applicant's statement of justification shall become Exhibit D for each resolution. The project site is currently being developed with the approved Lube -n -Go project and Carl's Jr. project. The proposed subdivision would allow each use to be located on an individual parcel. General Plan Designation: General Commercial (GC) Zoning District: Commercial Retail (CR) Proposed Exempt per CEQA Section 15315 — minor land divisions. Environmental Determination: Commissioner O'Grady read from a prepared statement explaining he found it necessary to recuse himself from consideration of this item for reasons of bias and his interpretation of the ethics law, which prevent him from considering this application objectively. Senior Planner Kelly Gleason gave the staff report and answered questions of the Commission. PUBLIC COMMENT Adam Scattini, applicant, explained why he is bringing this proposal before the Planning Commission and answered questions of the Commission. Chairperson Fonzi closed the Public Comment period. MOTION: By Commissioner O'Keefe and seconded by Vice Chairperson Slane to adopt Resolution PC 2008-0026 as revised, approving Tentative Parcel Map 2007-0093, based on findings and subject to conditions of approval. Motion passed 5:1 by a roll -call vote. (Heatherington opposed, O'Grady abstained) Commissioner O'Grady rejoined the hearing. PLN 2099-0876, RECONSIDERATION OF CONDITIONAL USE PERMIT 2005- 0148,4300 EL CAMINO REAL Property Owner: K -Mart Corporation, 3100 W. Big Beaver Rd., Troy, MI 48084 Applicant: Allied Atascadero, LLC, 11150 Santa Monica Blvd., Ste. 770, Los Angeles, CA 90025 Project Title: Reconsideration of Conditional Use Permit 2005-0148 Project Location: 4300 EI Camino Real, Atascadero, CA 93422 (San Luis Obispo County) APN 049-221-063 Project The previously approved entitlement has expired. The applicant has applied for a Description: reconsideration of the previously approved Conditional Use Permit to allow the following: The proposed project consists of an application for a Conditional Use Permit for a drive-through restaurant located on 0.83 acres within the Commercial Retail Zone. The proposal includes a main dining building with outdoor patio areas for restaurant patrons and a drive-through facility along the EI Camino Real and San Anselmo frontages. The site is currently vacant and located within the existing K -Mart Shopping Center. General Plan Designation: General Commercial (GC) Zoning District: Commercial Retail (CR) Proposed Consistent with the previously Certified Mitigated Negative Declaration. Environmental Determination: Senior Planner Kelly Gleason gave the staff report and with City Engineer Steve Kahn answered questions of the Commission. PUBLIC COMMENT Joel Pickens, applicant's representative, gave a brief history of their marketing efforts for the site and answered questions of the Commission. Chairperson Fonzi closed the Public Comment period. Commissioner O'Grady spoke about the recent approvals of drive-through businesses by this Commission and remarked that the General Plan calls for balanced development, which he does not see with so many of this type of business proliferating throughout the City. Commissioner O'Keefe expressed concern that when this was originally approved it was for a specific project which included improvements along San Anselmo. Because this may be a different project she is reluctant to approve it not knowing what the City would get at the site. Vice Chairperson Slane stated that this was approved prior to this Commission, and also approved by the City Council. The big picture for him is the traffic issue at this location and with the funding coming in to mitigate the traffic there, and with the PC Draft Minutes 05/06/08 Page 6 of 10 Council's approval, he questions why the Commission would not approve the project. If the APCD requirements can be met, he believes this project should go forward. Commissioner Jack stated this has already gone through the process and it is back only because a time limit ran out. Because the City Council has fully addressed and approved this, with the Amendments as presented, he sees no reason to not approve the project as long as the traffic situation can be mitigated. Commissioner Heatherington expressed dismay that this could be considered for approval without it being updated, and if the only way to get it updated would be to come back with an actual project, there would be no way she could support approval. Commissioner Marks commented that drive-throughs don't fit into the City's General Plan, and smart growth principles are very clear about projects not encouraging traffic. He believes the Commission would not be acting wisely if it approves an old project without some updating from the APCD. He would be willing to look at a drive-through if this project were sent back to APCD. Senior Planner Gleason suggested staff can reissue the original Mitigated Negative Declaration, and then bring that back to the Commission with any comments they receive from the APCD or others, and the Commission could decide at that time if suggested mitigation measures would be addable without changing the project, or if the project must be redone due to the extent of their mitigation measures. Chairperson Fonzi stated she is torn on this, because, at this time there is no actual applicant, so the Commission doesn't know what the project will be. She is also torn about the traffic, as there must be improvement, and the City Council wanted those improvements and voted in favor of the project. Based on the Council's direction she is inclined to vote in favor of this, but she questions what the City will be getting. MOTION: By Vice Chairperson Slane and seconded by Chairperson Fonzi to adopt Resolution PC 2008-0020 approving Conditional Use Permit 2005-0148 based on findings and subject to Conditions of Approval and Mitigation Monitoring. Motion failed 3:4 by a roll -call vote. (O'Grady, Marks, Heatherington, O'Keefe opposed) Commissioners Jack, Slane, and Chairperson Fonzi stated for the record that they voted in favor of the motion solely because of the City Council's vote and the affect on the traffic mitigation. MOTION: By Commissioner O'Keefe to have staff re -circulate the Negative Declaration. Motion died for lack of a second. PC Draft Minutes 05/06/08 Page 7 of 10 MOTION: By Commissioner O'Grady and seconded by Commissioner Heatherington to deny the project. Motion failed 3:4 by a roll -call vote. (Jack, O'Keefe, Slane, Fonzi opposed) MOTION: By Commissioner O'Grady and seconded by Commissioner Jack to refer the item back to staff until such time as the applicant comes forward with a more definitive project for the site. Commissioner O'Grady withdrew his motion. MOTION: By Commissioner O'Grady and seconded by Commissioner Heatherington to deny the reconsideration of the original project and that when the applicant has a real tenant, to resubmit a CUP application. Motion fails 3:4 by a roll -call vote. (Jack, O'Keefe, Slane, Fonzi opposed) MOTION: By Commissioner Jack and seconded by Vice Chairperson Slane to continue this to the next meeting to give the Commission time to consult with their respective City Council Members for any additional direction. Motion fails 3:4 by a roll -call vote. (Marks, Heatherington, O'Keefe, Fonzi opposed) MOTION: By Commissioner Marks to deny the project and have the applicant resubmit the project for the full analysis. Motion died for lack of a second. MOTION: By Commissioner Heatherington and seconded by Commissioner O'Grady to deny the reconsideration of the Conditional Use Permit. Motion passed 7:0 by a roll -call vote. 5. PLN 2007-1257, CONDITIONAL USE PERMIT FOR RECHARGE PONDS Owner / Applicant: Atascadero Mutual Water Company, P.O. Box 6075, Atascadero, CA 93423 Project Title: PLN 2007-1257 / Conditional Use Permit 2007-0221 Project Location: River Parcel, Near Well #7 Atascadero, CA 93422 (San Luis Obispo County) APN 049-011-003 Project The proposed project includes an application for a Conditional Use Permit to construct Description: three (3) water recharge ponds as part of the Atascadero Mutual Water Company's facilities expansion. The ponds are approximately 250 feet by 440 feet in size. They are proposed to be a kidney bean shape, and will be enclosed with a six-foot tall coated chain link fence. A landscape buffer will be installed around the fence to minimize PC Draft Minutes 05/06/08 Page 8 of 10 Associate Planner Callie Taylor gave the staff report and answered questions of the Commission. PUBLIC COMMENT John Neil, Atascadero Mutual Water Company, addressed issues raised by the Commission and spoke about the project. He stated their concern with Condition No. 7 and asked that the Commission strike equestrian use and work out a method of getting motorcycle use under control on the property. Chairperson Fonzi closed the Public Comment period. Commissioner Heatherington expressed concern regarding soil disruption and the potential for Valley Fever. She offered to take this issue to the Health Commission and to the Public Health Officer and have them address this concern. MOTION: By Commissioner Jack and seconded by Commissioner O'Keefe to adopt Resolution PC 2008-0024 certifying proposed Mitigated Negative Declaration 2008-0004 as amended, and approving Conditional Use Permit 2007-0221 (PLN 2007-1257) based on findings and subject to conditions of approval with the condition changes modifying Condition No. 7 to exclude horses, and add an archeologist and one certified monitor to be on site during site disturbances. The first phase will include the construction of one (1) water recharge pond requiring 22,000 cubic yards of cut. The second phase will be constructed only if necessary, and will include the construction of two (2) additional water recharge ponds requiring a total of 32,850 cubic yards of cut. The excavated fill dirt is proposed to be used to create a building pad on the same parcel for upgrades to Well #4. Excess dirt will be stock piled at the Atascadero Mutual Water Company's property on Sycamore Road. General Plan Designation: Public (P) Zoning District: Residential Public (P) Proposed Based on the initial study prepared for the project, a Mitigated Negative Declaration is Environmental proposed. Due to the fact that the radio mast is necessary for the Water Company's plant operations, including radio communications, well monitoring, and remote control systems, staff is recommending that the Planning Commission approve the mast as proposed. A large landscape planter is located along the back of the parking lot to screen the corporation yard from the administration building. Landscape fingers with shade trees are provided every four parking spaces throughout the parking lot. The proposed landscape will include public information and exhibits on water use and drought tolerant landscaping. The area around the administration building near Sycamore Road is designed as a large demonstration garden. An outdoor meeting space is proposed in addition to an informational kiosk for self -guided tours. Examples of climate adapted plant species, irrigation strategies, and planting schemes will be featured. Security fencing is proposed throughout the project site. A 42 -inch high decorative black metal fence is proposed around the demonstration gardens along the Sycamore frontage and the new access driveway. The black metal fence would be combined with 4 -foot tall stone pilasters. The front of the corporation yard would be enclosed with new 8 -foot decorative security fence. The back section of the corporation yard will be enclosed with a combination of new and existing 6 -foot high chain link fencing with 3 -strand barbed wire. The Atascadero Municipal Code allows chain link fencing in the Industrial zones, provided that is green vinyl coated and screened with evergreen landscaping. Staff has included Condition 7 in the attached resolution to ensure that the new fencing is installed according to code requirements, which includes additional landscaping along the chain link fences. A 20 -foot setback from the top of the bank of Atascadero Creek will be maintained with the fences, consistent with the creek setbacks required by General Plan Policy 8.2. Currently, a narrow accessway to the De Anza Trail is located between Atascadero Creek and the Atascadero Mutual Water Company's corporation yard. The AMWC has proposed to widen and improve the access at this location in order to extend the De Anza Trail from Sycamore Road to the Salinas River. The existing fence and a portion of the existing corporation yard paving will be removed to accommodate the trail improvements. This will allow for a 20 -foot wide trail access along the top of the bluff of Atascadero Creek. Any areas along the trail zone which are disturbed by grading for the trail improvements will be vegetated with indigenous plantings as necessary (Condition 9.) No construction is proposed within the creek or the river. Several mitigation measures have been included in order to protect the native plants and animal habitat during and after construction (Mitigation Measures 4.b.2 through 4.e.3; see attached CEQA document and attached resolution). The project proposal consists of the removal of nine (9) native trees with a total diameter of forty-eight (48) inches. All trees proposed for removal are less than nine inches DBH. The large trees along Sycamore Road will remain on site. While many of these trees are not species which are protected under the Atascadero Native Tree Ordinance, proposed improvements have been designed to save the trees. Tree protection shall be installed to protect these trees during construction (Condition 16.) Street Improvements Frontage improvements are proposed along Sycamore Road and at the intersection of Sycamore and Capistrano. Currently, only the southeast leg of the 3 -way stop has a stop sign for traffic control; the other two legs have no traffic control devices. There is limited sight and stopping distance at this intersection, which causes concerns in regards to the existing pedestrian trail on the west side of the intersection and the increased pedestrians which will be accessing the proposed trail improvements at this location. A warrant analysis was prepared, which recommended the installation of a 3 -way stop at this intersection in order to create safe pedestrian access. A pedestrian crosswalk will be installed across the north leg of the intersection to allow safe access to the De Anza Trail. A raised island will be installed at the corner of Capistrano and Sycamore in to further aid in traffic control. Frontage improvements along the project frontage include upgrades to Sycamore Road. The proposed use is consistent with the General Plan. Staff Comment: The use is consistent with the Industrial and Industrial Park land use designation. 2. The proposed use satisfies all applicable provisions of the Zoning Ordinance. Staff Comment: As conditioned, the project satisfies all zoning code provisions. 3. The establishment, and subsequent operation or conduct of the use should not, because of the circumstances and conditions applied in this particular case, be detrimental to the health, safety, or welfare of the general public or persons residing or working in the neighborhood of the use, or be detrimental of injurious to the property or improvements in the vicinity and the use. Staff Comment: The facility upgrades will not be detrimental to the general public or working persons health, safety, or welfare. All impacts have been mitigated through the environmental review analysis. 4. The proposed use will not be inconsistent with the character of the immediate neighborhood or contrary to its orderly development. Staff Comment: The project has been designed to improve the visual character of the facility with new structures, landscaping, and fencing improvements along Sycamore Avenue. The project will not be inconsistent with the neighborhood character. The new administration building, road improvements, and new landscape will improve the visual quality of the site. 5. The proposed use will not generate a volume of traffic beyond the safe capacity of all roads providing access to the project; either existing or to be improved in conjunction with the project. Staff Comment: The site is currently used as a corporation yard for the water company. Significant traffic increases are not expected to be generated by the facility upgrades. Street improvements on Sycamore Road and pedestrian safety features at the intersection are included to mitigate any additional traffic. ITEM NUMBER: 3 DATE: 7-15-08 Proposed Environmental Determination A Draft Mitigated Negative Declaration was circulated to public agencies and residents within 1000 feet of the property on June 13, 2008. Agencies which were notified include the Southern Pacific Transportation Co., Cal Trans, Regional Water Quality Board, Department of Fish and Game, Army Corps of Engineers, APCD, the Salinan Tribe, and the Chumash Tribe. The applicant shall work with the APCD to meet all of the permitting and construction requirements for projects over one acre of disturbed area. A Phase I Archeological Study was completed for the project and is available in the project file for review. The majority of the site has been previously graded and has been previously used as the Water Company's construction yard. The project archeologist recommends that no further cultural resource studies be required for this project. A finding is proposed that this project would not have a significant effect on the environment with the incorporation of the recommended mitigation measures. Staff is recommending that the Planning Commission certify Proposed Mitigated Negative Declaration 2008-0011. CONCLUSION: The proposed project consists of an application for facility upgrades at the Atascadero Mutual Water Company production and distribution site. The project provides landscaping throughout the site and demonstration gardens for public education. Parking is located towards the center of the site to provide for a pedestrian -oriented frontage. The project proposal includes the construction of two (2 new metal buildings, a 12,000 square -foot, single -story administration building, and a radio tower. Improvements are proposed to the trail along Atascadero Creek, behind the AMWC facility. The trail will be widened in order to create better access to the De Anza Trail. Frontage improvements will be installed along Sycamore Road and at the intersection of Sycamore and Capistrano. Staff finds that the proposed project, as conditioned, meets the required findings necessary for Planning Commission approval. ITEM NUMBER: 3 DATE: 7-15-08 ALTERNATIVES: 1. The Commission may modify the project and/or conditions of approval for the project. 2. The Commission may determine that more information is needed on some aspect of the project and may refer the item back to the applicant and staff to develop the additional information. The Commission should specify the reasons for denial of the project and recommend an associated finding with such action. BOX 1311 TEMPLETON, CA 93465 (805) 434-0131 6-27-06 AUG 2 2 2006 Atascadero Mutual Water Company Expansion COMMUNITY DEQ_PMXI This tree protection plan is in regard to the planned expansion fort e Water Company's expansion plans on Sycamore Road in Atascadero, California. The native trees on-site consist of coast live oaks (Quercus agrifolia), valley oaks (Quercus lobata), California sycamores (Platairus racemosa), and toyon (Heteromeles arbutifolia). Also tagged and numbered were several manzanita trees (Arclostaphylos sp. ). They are not on the native tree list, however, they were tagged to provide reference for locating other native trees. Total number of removals for the protected trees is nine with a total diameter of 50 inches. All removals are relatively young trees. Some may be able to be transplanted on site. There is existing cyclone fencing for trees 91 through #5. This fencing should provide sufficient protection and no other fencing is needed for these trees as long as the original fence remains in place. Trees #28 and 929 are pointed out on the preliminary site plan to be removed. We do not see the impact that would require these trees to be removed. Possibly they can be saved. There are no new utilities shown on the plans, however there appears to be ample space to route the trenches outside of all native tree drip lines. There is some landscape planned near trees 922 through #27. The landscape mitigation below shall be followed by any landscape contractors/designers. It is the responsibility of the owner to provide a copy of this tree protection plan to any and all contractors and subs that work within the drip line of any native tree. It is highly recommended that each contractor sign and acknowledge this tree protection plan. This project shall require an on-site pre -construction meeting with the city, owner, grading contractor and the arborist. Topics will include fencing, monitoring and requirements for a positive final occupancy letter. All trees potentially impacted by this project are numbered and identified on both the grading plan and the spreadsheet. Trees are numbered on the grading plans and in the field with an aluminum tag. Tree protection fencing is shown on the grading plan. In the field, trees to be saved have yellow tape and trees to be removed have red tape. Tree Rating System A rating system of 1-10 was used for visually establishing the overall condition of each tree on the spreadsheet. The rating system is defined as follows: Rating Condition 0 Deceased I E\ ;nce of massive past failures, extreme ;ase and is in severe decline. 2 May be saved with attention to class 4 pruning, insect/pest eradication and future monitoring. 3 Some past failures, some pests or structural defects that may be mitigated by class IV pruning. 4 May have had minor past failures, excessive deadwood or minor structural defects that can be mitigated with pruning. 5 Relatively healthy tree with little visual structural and or pest defects. 6 Healthy tree that probably can be left in its natural state. 7-9 Have had proper arboricultural pruning and attention or have no apparent structural defects. 10 Specimen tree with perfect shape, structure and foliage in a protected setting (i.e. park, arboretum). The following mitigation measures/methods must be fully understood and followed by anyone working within the drip line of any native tree. Any necessary clarification will be provided by us (the arborists) upon request. 1. Fencing: The proposed fencing shall be shown in orange ink on the grading plan. It must be a minimum of 4' high chain link, snow or safety fence staked at the edge of the drip line or line of encroachment for each tree or group of trees. The fence shall be up before any construction or earth moving begins. The owner shall be responsible for maintaining an erect fence throughout the construction period. The arborist(s), upon notification, will inspect the fence placement once it is erected. After this time, fencing shall not be moved without arborist inspection/approval. If the orange plastic fencing is used, a minimum of four zip ties shall be used on each stake to secure the fence. All efforts shall be made to maximize the distance from each saved tree. The fencing must be constructed prior to the city pre -construction meeting for inspection by the city and the arborists. 2. Soil Aeration Methods: Soils within the drip line that have been compacted by heavy equipment and/or construction activities must be returned to their original state before all work is completed. Methods include water jetting, adding organic matter, and boring small holes with an auger (18" deep, 2-3' apart with a 24" auger) and the application of moderate amounts of nitrogen fertilizer. The arborist(s) shall advise. 3. Chip Mulch: All areas within the drip line of the trees that cannot be fenced shall receive a 4-6" layer of chip mulch to retain moisture, soil structure and reduce the effects of soil compaction. 4. Trenching Within Drip Line: All trenching for foundations within the drip line of native trees shall be hand dug. All major roots shall be avoided whenever possible. All exposed roots larger than 1" in diameter shall be clean cut with sharp pruning tools and not left ragged. A Mandatory meeting between the arborists and grading/trenching contractor(s) shall take place prior to work start. This activity shall be monitored by the arborist(s) to insure proper root pruning is talking place. 5. Grading Withii. se Drip Line: Grading should not t -oach within the drip line unless authorized. Grading should not disrupt the normal drainage pattern around the trees. Fills should not create a ponding condition and excavations should not leave the tree on a rapidly draining mound. 6. Exposed Roots: Any exposed roots shall be re-covered the same day they were exposed. If they cannot, they must be covered with burlap or another suitable material and wetted down 2x per day until re -buried. 7. Paving Within The Drip Line: Pervious surfacing is preferred within the drip line of any native tree. This includes coring vertical tubing approximately 4 feet on center within the drip line and backfilling with Mychorizza, slow release fertilizer and pea gravel. Not applicable for this project. 8. Equipment Operation: Vehicles and all heavy equipment shall not be driven under the trees, as this will contribute to soil compaction. Also there is to be no parking of equipment or personal vehicles in these areas. All areas behind fencing are off limits unless pre -approved by the arborist. 9. Existing Surfaces: The existing ground surface within the drip line of all native trees shall not be cut, filled, compacted or pared, unless shown on the grading plans and approved by the arborist. 10. Construction Materials And Waste: No liquid or solid construction waste shall be dumped on the ground within the drip line of any native tree. The drip line areas are not for storage of materials either. 11. Arborist Monitoring: An arborist shall be present for selected activities (trees identified on spreadsheet and items bulletcd below). The monitoring does not necessarily have to be continuous but observational at times during these activities. It is the responsibility of the owner(s) or their designee to inform us prior to these events so we can make arrangements to be present. It is the responsibility of the owner to contract (prior to construction) a locally licensed and insured arborist that will document all monitoring activities. • pre -construction fence placement • any utility or drainage trenching within any drip line 0 All grading and trenching near trees requiring monitoring on the spreadsheet 12. Pre -Construction Meeting: An on-site pre -constriction meeting with the Arborist(s), Owner(s), Planning Staff, and the earth moving team shall be required for this project. Prior to final occupancy, a letter from the arborist(s) shall be required verifying the health/condition of all impacted trees and providing any recommendations for any additional mitigation. The letter shall verify that the arborist(s) were on site for all grading and/or trenching activity that encroached into the drip line of the selected native trees, and that all work done in these areas was completed to the standards set forth above. 13. Pruning: Class Tuning includes-Crown reduction prur. , shall consist of reduction of tops, sides or individual limbs. A trained arborist shall perform all pruning. No pruning shall take more than 25% of the live crown of any native tree. Any trees that may need pruning for road/home clearance shall be pruned prior to any grading activities to avoid any branch tearing. 14. Landscape: All landscape under the drip -line shall be drought tolerant or native varieties. Lawns shall be avoided. All irrigation trenching shall be routed around drip lines; otherwise above ground drip -irrigation shall be used. It is the owner's responsibility to notify the landscape contractor regarding this mitigation. 15. Utility Placement: All utilities and sewer/storm drains shall be placed down the roads/driveways and when possible outside of the drip lines. The arborist shall supervise trenching within the drip line. All trenches in these areas shall be exposed by air spade or hand dug with utilities routed under/over the roots. Roots greater than 2 inches in diameter shall not be cut. 16. Fertilization and Cultural Practices: As the project moves toward completion, the arborist(s) may suggest either fertilization and/or mycorrhiza applications that will benefit tree health. Mycorrhiza offers several benefits to the host plant, including faster growth, improved nutrition, greater drought resistance, and protection from pathogens. The included spreadsheet includes trees listed by number, species and multiple stems if applicable, diameter and breast height (4.5'), condition (scale from poor to excellent), status (avoided, impacted, removed, exempt), percent of drip line impacted, mitigation required (fencing, root pruning, monitoring), construction impact (trenching, grading), recommended pruning and individual tree notes. If all the above mitigation measures are followed, we feel there will be no additional long-term significant impacts to the remaining native trees. A & T Arborists strongly suggests that the responsible party (owner of their designee) make copies of this report. Box 6075, Atascadero, CA 93423, (Owner and Applicant), to consider a project consisting of a Conditional Use Permit (PLN 2006-1146) for the expansion of production and distribution support facilities located on the 6575 Sycamore Road Parcel (APN 028-111-003); and, WHEREAS, the site's current General Plan Designation is Industrial (I); and, WHEREAS, the site's current zoning district is Industrial (I) and Industrial Park (IP); and, WHEREAS, an Initial Study and Proposed Mitigated Negative Declaration 2008-0011 were prepared for the project and made available for public review in accordance with the requirements of the California Environmental Quality Act (CEQA); and, WHEREAS, the laws and regulations relating to the preparation and public notice of environmental documents, as set forth in the State and local guidelines for implementation of the California Environmental Quality Act (CEQA) have been adhered to; and, WHEREAS, a timely and properly noticed Public Hearing upon the subject Conditional Use Permit application was held by the Planning Commission of the City of Atascadero at which hearing evidence, oral and documentary, was admitted on behalf of said application; and, WHEREAS, the Planning Commission of the City of Atascadero, at a duly noticed Public Hearing held on July 15, 2008, studied and considered the Conditional Use Permit PLN 2006-1146, after first studying and considering the Proposed Mitigated Negative Declaration prepared for the project, and, NOW, THEREFORE, the Planning Commission of the City of Atascadero, California, takes the following actions: SECTION 1. Findings for Certification of the Proposed Mitigated Negative Declaration. The Planning Commission finds as follows: 1. The project does not have the potential to degrade the environment when mitigation measures are incorporated into the project's mitigation monitoring program as conditions of approval; and, 2. The project will not achieve short-term to the disadvantage of long term environmental goals; and, 3. The project does not have impacts which are individually limited, but cumulatively considerable; and, 4. The project will not cause substantial adverse effects on human beings either directly or indirectly. 5. Added Air Quality mitigation measures are equivalent to or better than those included in the circulated draft MND and will not create any additional impacts. SECTION 2. Findings for approval of Conditional Use Permit. The Planning Commission finds as follows: 1. The proposed project or use is consistent with the General Plan and the City's Appearance Review Manual; and, 2. The proposed project or use satisfies all applicable provisions of the Title (Zoning Ordinance); and, 3. The establishment, and subsequent operation or conduct of the use will not, because of the circumstances and conditions applied in the particular case, be detrimental to the health, safety, or welfare of the general public or persons residing or working in the neighborhood of the use, or be detrimental or injurious to property or improvements in the vicinity of the use; and, 4. That the proposed project or use will not be inconsistent with the character or the immediate neighborhood or contrary to its orderly development; and, 5. That the proposed use or project will not generate a volume of traffic beyond the safe capacity of all roads providing access to the project, either existing or to be improved in conjunction with the project, or beyond the normal traffic volume of the surrounding neighborhood that would result from full development in accordance with the Land Use Element. SECTION 3. Approval. Closed conduits shall be designed to convey the 10 -year flow with gravity flow, the 25 -year flow with head, and provide safe conveyance for the 100 -year overflow. 9. Prior to the issuance of building permits the applicant shall provide for GP, BP CE the detention and metering out of developed storm runoff so that it is equal to or less than undeveloped storm runoff. 10. Drainage basins shall be designed to desilt, detain and meter storm GP, BP CE flows as well as release them to natural runoff locations. 11. Prior to the issuance of building permits the applicant shall show the GP, BP CE method of dispersal at all pipe outlets. Include specifications for size & type. 12. Prior to the issuance of building permits the applicant shall show GP, BP CE method of conduct to approved off-site drainage facilities. 13. Concentrated drainage from off-site areas shall be conveyed across GP, BP CE the project site in drainage easements. Acquire drainage easements where needed. The contractor or builder shall designate a person or persons to monitor the dust control program and to order increased watering, as necessary, to prevent transport of dust off site. The name and telephone number of such persons shall be provided to the APCD prior to land use clearance for map recordation and land use clearance for finish grading of any structure. Mitigation Measure 3.b.2: Naturally Occurring Asbestos. The project site is BP, GP BS, PS, CE 3.b.2 located in a candidate area for Naturally Occurring Asbestos (NOA), which has been identified as a toxic air contaminant by the California Air Resources Board (ARB). Under the ARB Air Toxics Control Measure (ATCM) for Construction, Grading, Quarrying, and Surface Mining Operations, prior to any grading activities at the site, the project proponent shall ensure that a geologic evaluation is conducted to determine if NOA is present within the area that will be disturbed. If NOA is not present, an exemption request must be filed with the District (see Attachment 1). If NOA is found at the site the applicant must comply with all requirements outlined in the Asbestos ATCM. This may include development of an Asbestos Dust Mitigation Plan and an Asbestos Health and Safety Program for approval by the APCD. Mitigation Measure 3.b.3: Developmental burning of vegetative material is BP, GP BS, PS, CE 3.b.3 prohibited. This requires prior application, payment of fee based on the size of the project, APCD approval, and issuance of a burn permit by the APCD and the local fire department authority. Sediment catchment basins, erosion control mats, fabric fences, or other appropriate means shall be used when such diversion are necessary. ■ Wash water containing mud or silt from construction operations shall not be allowed to enter the stream. ■ Structures and associated materials not designed to withstand high seasonal flows shall be removed to areas above the high water mark before such flows occur. • No debris, soil, silt, bark, sawdust, rubbish, cement or concrete or washing thereof, oil or petroleum products or other organic or earthen material from construction or associated activity or whatever nature shall be allowed to enter into or placed where it may be washed by rainfall or runoff into the stream. When operation are completed, any excess materials or debris shall be removed from the work area. No rubbish shall be deposited within 150 feet of the high water mark of the stream. Mitigation Measure 4.e.1: The building permit site plan shall identify all BP, GP BS, PS, CE 4.e.1 protection and enhancement measures recommended by the Certified Arborist in the Tree Protection Plan. Tree protection fencing shall be installed at the locations called out in the Tree Protection Plan. Mitigation Measure 4.e.2: The developer shall contract with a certified BP, GP BS, PS, CE 4.e.2 arborist during all phases of project implementation. The certified arborists shall be responsible for monitoring the project during all phases of construction through project completion, as follows: (a) A written agreement between the arborist and the developer outlining a arborist monitoring schedule for each construction phase through final inspection shall be submitted to and approved by planning staff prior to the issuance of building/grading permits. (b) Arborist shall schedule a pre -construction meeting with engineering /planning staff, grading equipment operators, project superintendent to review the project conditions and requirements prior to any grubbing or earth work for any portion of the project site. All tree protection fencing and trunk protection shall be installed for inspection during the meeting. Tree protection fencing shall be installed at the line of encroachment into the tree's root zone area. (c) As specified by the arborist report and City staff: • Prune all trees in active development areas to be saved for structural strength and crown cleaning by a licensed and certified arborist; ■ Remove all debris and spoils from the lot cleaning and tree pruning. ■ In locations where paving is to occur within the tree canopy, grub only and do not grade nor compact. (d) Upon project completion and prior to final occupancy a final status report shall be prepared by the project arborist certifying that the tree protection plan was implemented, the trees designated for protection were protected during construction, and the construction-related tree protection measures are no longer required for tree protection. Mitigation Measure 4.e.3: Erosion control hydroseed/slope stabilization BP, GP BS, PS, CE 4.e.3 shall consist of native species matching the existing plant species within the tributary stream. The seed and plant material shall not contain any introduced plant species. Mitigation Measure 5.d. 1: Should any human remains be discovered on the BP, GP PS 5.d.1 property, all work on the project should stop and the County Coroner contacted. If the human remains are identified as being Native American, the California Native American Heritage Commission (NAHC) should be contacted at (916) 653-4082. Mitigation Measure 6.b.1: The grading permit application plans shall include GP PS, BS, CE 6.b.1 erosion control measures to prevent soil, dirt, and debris from entering the storm drain system during and after construction. A separate plan shall be submitted for this purpose and shall be subject to review and approval of the City Engineer at the time of Building Permit application. Mitigation Measure 6.c.1: A soils report shall be required to be submitted GP PS, BS, CE 6.c.1 with a future building permit by the building department. Mitigation Measure 8.e.f.1: The developer is responsible for ensuring that BP, GP PS, BS, CE 8.0.1 all contractors are aware of all storm water quality measures and that such measures are implemented. Failure to comply with the approved construction Best Management Practices will result in the issuance of correction notices, citations, or stop orders. Mitigation Measure 8.e.f.2: A Stormwater Pollution Prevention Plan BP, GP PS, BS, CE 8.0.2 (SWPPP)/Erosion Control Plan shall be submitted and approved by the City Engineer prior to the issuance of the building permit.
