PUBLIC HEARINGS DISCLOSURE OF EX PARTE COMMUNICATIONS: • Commissioner Ward visited the site but spoke with no one. • Commissioner Bentz stated he spoke with Chairperson Jack about the project. • Chairperson Jack visited the property and met with Ray and Judy Sears, who also wrote a letter with concerns about the project. (Exhibit A). • Vice Chairperson Moreno spoke with Judy Sears, neighbor and discussed the same items in the letter that was submitted. • Commissioner Sturtevant visited the property and spoke with Mr. Smith. • Commissioner Schmidt visited the site. 2. PLN 2009-1337, CONDITIONAL USE PERMIT FOR 7275 TECORIDA AVE. Applicant: Jeffrey and Jennifer Smith, 7275 Tecorida Ave., Atascadero, CA 93422 Project Title: PLN 2009-1337 / CUP 2009-0243 Project Location: 7275 Tecorida Ave., Atascadero, CA 93422 APN 030-351-016 (San Luis Obispo County) Project The project consists of an application to construct an oversized detached Description: accessory garage and workshop at the subject property. The proposed detached garage and workshop is 1,602 square feet. The Atascadero Municipal Code allows accessory structures larger than 50% of the primary residence through approval of a Conditional Use Permit. General Plan Designation: SFR -Y Zoning District: LSF -Y Proposed Exempt per Section 15303: New Construction or Conversion of Small Structures Environmental including accessory structures. Determination: PC Draft Minutes of 10/06/09 Page 2 of 5 Community Development Director Warren Frace gave the staff report. Community Development Director explained that this project area is on sewer, the road is not paved, and the proposed structure is on a site which is on 3/4 of an acre. The proposed project is to add an additional 1600 sq. ft. garage with a 2nd story workshop space. The first floor (approximately 800 sq. ft.) will have a single utility sink and workbench area. The 2nd floor is also approximately 800 sq. ft. and will include a sink, shower, and toilet which are allowed with restrictions under our Zoning Ordinance. The subject property is outside the 100 -year flood plain but within the 500 -year flood plain. Community Development Director and Deputy Director of Public Works/Engineering David Athey answered questions from the Commission. PUBLIC COMMENT Stephen King, Architect, explained to the Commission that staff accurately gave the presentation. The applicant understands the restrictions that come along with this permit. He assured the Commission that there were no future plans to do anything with the project other than what is described in the staff report. Mr. King answered questions from the Commission. Jeffrey Smith, property owner, explained that his architect, Mr. King was given specific instructions on his desire for the project. The desire for the back portion of the garage is to have a small shop. The reason for not having an internal staircase, a utility shower or a bathroom on the first floor is because it would take away from his desired use of that space. The 2nd floor will be used for storage, hence the reason for the internal wall. The recreation room will be used for recreation. He assured the Commission that it is not intended to be a rental unit or living space. Chairperson Jack closed the Public Comment period. MOTION: By Commissioner Bentz and seconded by Commissioner Sturtevant to adopt PC Resolution 2009- 0030 recommending that the Planning Commission approve PLN 2009-1337 / CUP 2009-0243 to allow a 1,602 square -foot garage and workshop which exceeds 50% of the size of the main residence at 7275 Tecordia Ave, based on findings and subject to conditions of approval. Motion passed 7:0 by a roll -call vote. PC Draft Minutes of 10/06/09 Page 3 of 5 COMMUNITY DEVELOPMENT STAFF REPORTS 3. DOWNTOWN DESIGN GUIDELINES Community Development Director Warren Frace gave a brief overview on the Downtown Design Guidelines/Toolbox and Idea Book which was given to Commissioners in their packets. We are recommending that the public and business owners who are interested in this document access it on the City's website or they purchase a book from City Hall. The books were put together in collaboration with Atascadero Main Street. The purpose of the guidelines is to help and encourage and facilitate more creativity in the downtown zone. Because a priority of the City Council is Economic Development which included the downtown area, funds are available for work in the downtown. He explained the details of the facade and permit rebate program. Community Development Director Frace introduced Tom Jess from Arris Studio Architects who gave a presentation to the Commission and answered their questions. COMMISSIONER COMMENTS AND REPORTS Commissioner Schmidt had discussion with the Atascadero Mutual Water Company (AMWC) about water connection fees for 2nd homes. He has made a request to the Board of Directors to reconsider the connection fee. You don't have to have a 2nd meter for a 2nd unit. After research, it was determined that there is a 35% difference in water use between a primary house and a 2nd house. Based on this information, it may be that the Board could lower the connection fee by 35% (approx. $6,000). The Board will discuss this at their meeting this month as a discussion item only. Commissioner Ward talked about the paving in front of Sunken Gardens and the Carlton. He asked if the speed bump was going to be replaced. If it is, he believes it is a traffic hazard. If there is a move to slow traffic down, there may be an alternative. Director Frace read an email from the Public Works Department regarding the paving project. DIRECTOR'S REPORT • Community Development Department announced that both Kelly Gleason, Senior Planner and Callie Taylor, Associate Planner, are both officially out on maternity leave. We have fewer staff, so it may take a little longer to get back to you if you call. Mimi Whitney, Contract Planner is assisting in the Planning Department, as is Cynthia Gordon, our new Planning Intern. • The next Planning Commission Meeting will be on October 20, 2009. • Permits have been issued for the Colony Square movie theatre, and the loan documents have been signed. We expect the project to start construction in the very near future. PC Draft Minutes of 10/06/09 Page 4 of 5 • The La Plaza Movie Theatre project came in today, and will eventually come before the Planning Commission. • The Rite-Aid Project is expected to pull permits in November 2009. • The Tractor Supply project is moving forward. • Historic City Hall 2nd phase plans were submitted this week, and are moving forward. RECOMMENDATION: Staff Recommends.- Adopt ecommends: Adopt Resolution PC 2009-0032 approving PLN 2009-1333 (Amendment #1) to Conditional Use Permit 2005-0160, based on findings and subject to Conditions of Approval. Environmental Status: Class 1 Categorical Exemption DISCUSSION: Project Definition The proposed project includes the expansion of the church use to provide additional parking on the adjacent lot and the addition of a 1,800 sq.ft "shade structure" at the rear of the church for use during social occasions. A 2.1 -acre parking lot expansion is proposed to be built on the vacant lot adjacent to the existing church. Surrounding Land Uses and Setting: North: Residential Suburban (Vacant and one residence) South: Residential Suburban (Church and open space/Graves Creek) East: Ramona Road/Highway 101 West: Residential Suburban (Vacant and two residences) ITEM NUMBER: 2 DATE: 11-17-09 Background The establishment of this Latter Day Saints Church occurred in 1983 when the project was approved by the County. The project was a 25,100 sq. ft. church and classroom facility with parking and landscaping. Building permit approval was granted by the City in 1986. The 1983 staff report analyzed issues such as environmental considerations, traffic capacity, neighborhood compatibility, and parking to ensure that the proposed use was appropriate for the site. Ramona Road is consider a "Local" road, servicing the neighborhood. In 1983, the lot was zoned A-1 with the General Plan description as "Suburban Single -Family Residential." A "Negative Declaration" was issued for this project pursuant to the provisions of CEQA. It was determined that the project would not have an adverse effect on the environment providing drainage and erosion control, tree removal, grading minimization, and sewage disposal were conditions of approval. The Planning Commission approved an "exception to height" for a 40 foot high steeple in 2005 (Conditional Use Permit 2005-0160). An initial study and mitigated negative declaration were prepared to address the aesthetics of the steeple by requiring specific exterior colors and no exterior lighting to reduce glare. Analysis The applicant has submitted this Amendment to modify the Master Plan of Development (1983) to allow for an expansion of the existing parking into the adjacent lot. Currently, church members are using the street and vacant lot to accommodate overflow parking needs on an occasional basis. The existing parking lot at the church contains 133 parking spaces and can accommodate regular services. The parking lot expansion proposes to add 126 spaces for a total of 259 spaces to accommodate larger events. Seven total handicapped accessible stalls are proposed, three of which would be van accessible thus meeting parking standards of the AMC 9-4.115(c)(1). The new parking lot area would be accessed by two interior connections from the existing parking lot. There would be no additional entrances from Ramona or Conejo Roads. The parking lot expansion retains all existing native trees except one 5 inch dbh California Live Oak. The applicant has filed the required Tree Removal Permit and has agreed to meet or exceed the City's Tree Ordinance standards. Additionally, the proposed landscape provides a grass lined retention and detention area for improved infiltration of storm water and incorporates native, drought tolerant vegetation on the proposed parking lot islands and perimeter landscaping. There is no lighting element proposed for the parking lot expansion at this time. The addition of lighting would be subject to Community Development review and a building permit. ITEM NUMBER: 2 DATE: 11-17-09 The total site area is 2.1 acres, of which 50% will be landscaped. The proposed landscaping will be consistent with City guidelines, codes, and regulations. Additionally, all landscaped areas will have an automatic irrigation system and will be permanently maintained. The proposed 1,800 sq. ft. shade pavilion will be located at the rear open space area of the existing church. This will provide shade for outdoor and social activities. (See Attachment 4) Churches, and related uses such as parking, are allowed in residential zones with a Conditional Use Permit. Because the church and the proposed expanded parking area are located on two separate lots, there will be a condition requiring recordation of a cross -access easement. Findings The Conditional Use Permit process provides the opportunity for the public and the Planning Commission to review the specifics of land use proposals, such as architectural design, site design, landscape, signage, and specific standards of the zoning ordinance. The Planning Commission must make the following findings to approve the Conditional Use Permit: 1. The proposed project or use is consistent with the General Plan and the City's Appearance Review Manual. Staff Comment: The proposed use is consistent with the Suburban Estate designation of the General Plan and General Plan Land Use Element. The parking lot expansion has been designed to meet the appearance review manual standards. 2. The proposed project or use satisfies all applicable provisions of the Zoning Ordinance. Staff Comment: The existing church was approved as a Development Review in 1983, with an Amendment in 2005 for a steeple. An amendment is required to make any changes to an approved Conditional Use and Master Plan of Development. The current project satisfies all current Conditional Use Permit and zoning code provisions (9-6.121). 3. The establishment, and subsequent operation or conduct of the use will not, because of the circumstances and conditions applied in the particular case, be detrimental to the health, safety, or welfare of the general public or persons residing or working in the neighborhood of the use, or be detrimental or injurious to property or improvements in the vicinity of the use. Staff Comment: The proposed development will not be detrimental to the general public or working persons in the vicinity or to health, safety, or welfare. ITEM NUMBER: 2 DATE: 11-17-09 4. That the proposed project or use will not be inconsistent with the character or the immediate neighborhood or contrary to its orderly development. Staff Comment: The project is consistent with the surrounding neighborhood uses and existing site improvements. 5. That the proposed use or project will not generate a volume of traffic beyond the safe capacity of all roads providing access to the project, either existing or to be improved in conjunction with the project, or beyond the normal traffic volume of the surrounding neighborhood that would result from full development in accordance with the Land Use Element. Staff Comment: The proposed project is designed to accommodate existing overflow membership and special event parking needs and will not generate an increased volume of traffic beyond the safe capacity or the normal traffic volume experienced in association with the church use and of the surrounding neighborhood. Based on staff's analysis in the preceding sections, it appears that all of the required findings for approval of a Conditional Use Permit can be made. Environmental Determination A Negative Declaration was prepared and certified for the use of the site as a church facility in 1983. The 1983 Negative Declaration determined that there would be no detrimental impacts as a result of the new conditional use, provided certain conditions were followed. The current project qualifies for Class 32 (a -e) Categorical Exemption. Class 32 of the California Environmental Quality Act (CEQA) (Section 15332) exempts projects characterized as in -fill, provided that the development is consistent with the General Plan and zoning designations and regulations; and, the site is not more than five (5) acres and is substantially surrounded by urban uses; and, the project site has no value as a habitat for endangered, rare, or threatened species; and, approval of the project would not have significant effects relating to traffic, noise, air quality, or water quality. Because the church is an existing use, and the project is served by public services and facilities, staff recommends the proposed project meets all of the requirements for a Class 32 Exemption. Conclusion The proposed project includes a Master Plan of Development Amendment in order to add a 2.1 acre expansion of use of the existing church parking lot. The addition of the parking lot and the outdoor pavilion is consistent with the appearance review manual and will enhance the overall appearance and functionality of the site. It is staff's opinion ITEM NUMBER: 2 DATE: 11-17-09 that the proposed project, as conditioned, allows the Planning Commission to make all of the required findings for project approval. ALTERNATIVES 1. In addition to approving the project in accordance with staff's recommendation, the Commission may consider modifications to the project and/or conditions of approval for the project and recommend staff make these changes. 2. The Commission may determine that more information is needed on some aspect of the project and may refer the item back to the applicant and staff to develop the additional information. The Commission should clearly state the type of information that is required and move to continue the item to a future date. 3. The Commission may deny the project. The Commission shall specify the reasons for denial of the project and make an associated finding with such action. The City Engineer may request revisions to the building plans to GP, BP CE NA resolve drainage, grading or other construction conflicts at the time of building permit review. 2. Per municipal code section 9-4.160, the developer shall slurry seal GP, BP CE NA San Ramon Avenue across the frontage of the property to a width of 1/2 the roadway plus 10'. The applicant shall submit a traffic control plan 48 hours in advance of any road work. The applicant shall obtain an encroachment permit for work in the right-of-way. 3. Closed conduits shall be designed to convey the 10 -year flow with gravity flow, the 25 -year flow with head, and provide safe conveyance for the 100 -year overflow. 6. Prior to the issuance of building permits the applicant shall provide GP, BP CE NA for the detention and metering out of developed storm runoff so that it is equal to or less than undeveloped storm runoff. 7. Drainage basins shall be designed to desilt, detain and meter GP, BP CE NA storm flows as well as release them to natural runoff locations. Project runoff shall not negatively affect offsite drainage structures. The drainage report shall address the adequacy of offsite drainage structures to accommodate the projects runoff. The applicant must file an NOI with the Central Coast Regional Water Quality Control Board prior to building permit issuance. 12. All public improvements shall be constructed in conformance with GP, BP CE NA the City of Atascadero Engineering Department Standard Specifications and Drawings or as directed by the City Engineer. Planning Division Standard Project Conditions 13. A detailed landscape plan will be required at time of building BP B, P NA permit review. Include information on irrigation and specify drought tolerant plants, quantities and sizes. A Tree Protection Plan shall be prepared for review and approval for all existing trees by Planning Division. 14. Lighting not included. Future lighting of parking lot would require BP B, P NA Planning approval and a building permit. 15. Three foot high landscaped berm or a three foot high solid fence BP B, P NA or decorative wall is required to shield any adjacent residential areas from headlights. Design of any wall shall be reviewed and approved by Planning Division. 16. Parking lots that abut a residential zone shall be separated from BP B, P NA such property by a landscaping stip with a minimum width of five feet and a six foot high solid fence or wall (AMC Sec. 9-4.119) 17. ITEM NUMBER DATE: 11-17-09 ATTACHMENT 7: Draft Resolution DRAFT RESOLUTION PC 2009-0032 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ATASCADERO APPROVING PLN 2009-1333, AN AMENDMENT TO CONDITIONAL USE PERMIT 2005-0160 6075 CONEJO ROAD/ 2600 RAMONA ROAD (APN 049-142-0099 007) (Church of Jesus Christ of Latter Day Saints) WHEREAS, an application has been received from the Church of Jesus Christ Latter Day Saints, 343 E. 500 Street, Salt Lake City, UT 84111 (Applicant & Property Owner), to consider a project consisting of an Amendment to Conditional Use permit 2005-0160 to allow a 2.1 -acre parking lot expansion on an adjacent property; and, WHEREAS, the site's General Plan Designation is Suburban Estates (2.5-10 acre minimum); and, WHEREAS, the site's current zoning district is Residential Suburban (RS); and, WHEREAS, an Amendment to Conditional Use Permit 2005-0160 is required to allow any changes to the approved conditional use and Master Plan of Development on the project site; and, WHEREAS, the proposed use is CEQA exempt: Article 19. Categorical Exemptions, Class 32, Section 15332. The establishment, and subsequent operation or conduct of the use will not, because of the circumstances and conditions applied in the particular case, be detrimental to the health, safety, or welfare of the general public or persons residing or working in the neighborhood of the use, or be detrimental or injurious to property or improvements in the vicinity of the use; and, 4. That the proposed project or use will not be inconsistent with the character or the immediate neighborhood or contrary to its orderly development; and, 5. That the proposed use or project will not generate a volume of traffic beyond the safe capacity of all roads providing access to the project, either existing or to be improved in conjunction with the project, or beyond the normal traffic volume of the surrounding neighborhood that would result from full development in accordance with the Land Use Element. SECTION 3. Approval.
