Prior to a project hearing Planning Commission Members must disclose any communications they have had on any

WELCOME TO THE ATASCADERO PLANNING COMMISSION MEETING
The Planning Commission meets in regular session on the first and third Tuesday of each month at 7:00 p.m. at City
Hall, Council Chambers, 6907 EI Camino Real, Atascadero. Matters are considered by the Commission in the order
of the printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on
file in the office of the Community Development Department and are available for public inspection during City Hall
business hours at the Front Counter of City Hall, 6907 EI Camino Real, Atascadero, and on our website,
www.atascadero.org. An agenda packet is also available for public review at the Atascadero Library, 6850 Morro
Road. All documents submitted by the public during Commission meetings that are either read into the record or
referred to in their statement will be noted in the minutes and available for review in the Community Development
Department. Commission meetings are video taped and audio recorded, and may be reviewed by the public.
Copies of meeting recordings are available for a fee. Contact the City Clerk for more information (470-3400).

Associate Planner Callie Taylor gave the staff report. Associate Planner Callie Taylor,
Deputy Public Works Director David Athey, and Community Development Director
Warren Frace answered questions of the Planning Commissioners.
PUBLIC COMMENT:
Ted Weber, applicant's Architect, stated it is understandable to restrict the parking on
San Anselmo due to Sight Standards. He also asked that the CUP be valid for 24
months rather than 12 months.
Mr. Weber answered questions of the Planning Commissioners on the parking lot
configuration.
Pastor Vern Haynes and Assistant Pastor Vern Haynes, Jr., answered questions of the
Commissioners.

Jolene Horn spoke in favor of the project and of the positive impact on the community of
this church. She asked if the indentation in front of church could be handicapped
parking.
Jerry White, Youth Minister of True Spirit Missionary Baptist Church, urged passing this
project as this is a wonderful church that is rapidly growing.
Jolene Horn spoke again about the existing small sanctuary which will become office
space and the new sanctuary which will be a separate space.
Chairperson Jack closed the Public Comment period.
Commissioners asked about changing Condition No. 4 from 12 months to 24 months
and the parking possibilities for handicapped in front of the church as well as the
parking lot configuration. Deputy Public Works Director David Athey and Community
Development Director Warren Frace answered questions of the Planning
Commissioners.
MOTION: By Vice Chairperson Moreno and seconded by Commissioner
Bentz to adopt Resolution PC 2009-0012 approving PLN 2008-
1293, an amendment to Conditional Use Permit 1989-003,
based on findings and subject to Conditions of Approval,
changing Condition No. 4 to twenty-four (24) months rather
than twelve (12) months.
DISCUSSION:
The Commissioners held a discussion on the street parking. Commissioner Schmidt felt
the sight distance was not a problem when he parked along side of the road, and would
like to consider adding a caveat that the applicant could apply for street parking if they
felt it necessary.
Commissioner Bentz called for the motion.
Motion passed 6:1 by a roll -call vote. (Commissioner Schmidt
opposed.)
COMMISSIONER COMMENTS AND REPORTS
Community Development Director Warren Frace discussed the up -coming conference
details and Administrative Services Director Rachelle Rickard provided pointers on
conference expense rules from the Travel Policy.

DIRECTOR'S REPORT
• Announced a Special Training March 31, 2009, at 6 p.m. in City Council
Chambers with the Parks and Recreation Department hosted by City Staff,
including information on the Brown Act, ethics training, the Norms, ex -parte
disclosures and the City Manager's presentation on the Budget.
• Next meeting of the Planning Commission is April 7, 2009, and the agenda has
only two minor items at this time.
• The next City Council meeting on March 24, 2009, will cover the Tractor Supply
Store as well as the West Front mixed use project. Also on the City Council's
agenda for that meeting will be the Greenhouse Gases issue.

property between an existing developed residential property and Stadium Park for the
purposes of providing an accessway from Capistrano Avenue.

Staff Recommends Planning Commission:
1. Adopt Resolution PC 2009-0018 recommending that City Council approve General
Plan Amendment 2009-0024 between amending a portion of APN 029-105-028 from
SFR -Y (Residential Single-Family—Y) to REC (Recreation) consistent with the
proposed Lot Line Adjustment.
2. Adopt Resolution PC 2009-0018 recommending that the City Council introduce an
ordinance for first reading, by title only, to change the zoning designation of a portion
of APN 029-105-028 from RSF-Y (Residential Single-Family—Y) to L (Recreation).
3. Adopt Resolution PC 2009-0015 finding that the purchase of a portion of the
Renzaglia/Hughes property for inclusion as part of Stadium Park is consistent with
the General Plan as proposed for amendment.

BACKGROUND:

Single -Family Residence / City Park
The City has submitted an application requesting a General Plan consistency
determination as part of a Lot Line Adjustment between a residential and recreation
zoned parcel. The application also includes a General Plan amendment and Zone Map
change to bring the purchased portion into conformance with existing General Plan
designations for Stadium Park.
ANALYSIS:
The subject parcel is approximately 2.91 acres and is designated Single -Family
Residential -Y in the General Plan. The zoning designation is Residential Single -Family -
Y with a 1.0 acre gross minimum lot size. The parcel shares the eastern boundary with
Stadium Park, is bordered by State Highway 41 to the northwest, and a residential
parcel to the north and south. The existing single-family residence takes access from
Valle Avenue.
Stadium Park is approximately 24.6 acres of recreation and open space within the City
of Atascadero. Stadium Park has a land use and zoning designation of Recreation.

The City has an opportunity to purchase a 0.52 acre piece of land from the
Renzaglia/Hughes property which will provide the City with an access to Stadium Park
from Capistrano Ave. There is an existing dirt access road that provides access to the
park, but this road crosses the Renzaglia/Hughes property without easements. The City
Council has determined that the best way to resolve this access issue is to purchase the
land occupied by the road. The portion of land proposed for inclusion into Stadium Park
includes an existing 10 -foot wide easement for City access purposes that is not in the
location of existing road. This proposed property sale will give the City this area of land
plus additional acreage for future City use.
The proposed General Plan Amendment and Zone Change will bring the purchased
portion of the Renzaglia/Hughes property into conformance with existing Stadium Park
designations. The 0.52 acre piece of land proposed for transfer to City ownership does
not meet minimum lot size for a RSF-Y parcel. Although the total parcel size will be
25.12 acres including the existing Stadium Park land area, the Zoning and General Plan
designations must be changed for consistency with minimum lot size standards and
conformance with existing Stadium Park zoning. The Renzaglia/Hughes parcel will
become 2.39 acres with the proposed Lot line Adjustment, exceeding the 1 -acre
minimum lot size and remaining consistent with the General Plan and Zoning
Ordinance.

General Plan Consistency Determination
State Law requires that the Planning Commission make a finding of consistency with
the General Plan for all property purchases. The proposed property purchase provides
a strategically located strip of land for the City to utilize for access to Stadium Park. The
proposed General Plan Amendment and Zone Change will bring the property
designations into conformance with the existing designations for Stadium Park.
FINDINGS:
General Plan Amendment
1. The proposed amendment is in the public interest.
2. The proposed amendment is in conformance with the adopted General Plan
goals, policies, and programs and the overall intent of the General Plan.
3. The proposed amendment is compatible with existing development,
neighborhoods and the environment.
4. The proposed amendment will not create any new significant and unavoidable
impacts to traffic, infrastructure, or public service impacts.
5. The proposed amendment is consistent with adopted General Plan EIR and
mitigation monitoring program.
6. The proposed amendment is in the best interest of the City to enact this
amendment to the General Plan Land Use Diagram to protect the health, safety
and welfare of its citizens and is compatible with existing and proposed
development.
Zone Mar) Amendment
As specified in the City's General Plan and Zoning Ordinance, the following specific
findings for the proposed Zone Change shall be made in order to approve the proposed
project:
The proposed Zone Change is in conformance with the adopted General Plan
goals, policies, and programs and the overall intent of the General Plan.
2. The proposed Zone Change is compatible with existing development,
neighborhoods and the environment.

3. The proposed Zone Change will not create any new significant and unavoidable
impacts to traffic, infrastructure, or public service impacts.
4. The proposed Zone Change is consistent with the project -specific Mitigated
Negative Declaration.
Lot Line Adiustment
1. The application, as submitted, conforms to all applicable building and zoning
regulations of the City of Atascadero and is consistent with the City's General
Plan.
CONCLUSION:
The proposed Lot Line Adjustment and associated General Plan Amendment and Zone
Change applications are consistent with the goals and policies of the General Plan and
provide consistency with the existing Stadium Park designations. The Planning
Commission must also find that the proposed property purchase is consistent with the
General Plan and make a recommendation to the City Council. Staff believes that the
proposed property purchase and associated applications are consistent with the
General Plan and provide the City with expanded access opportunities to Stadium Park.
ALTERNATIVES:
1. The Planning Commission can find that the proposed property purchase and
associated applications are not consistent with the General Plan. The Planning
Commission should be specific about which finding(s) cannot be made.
2. The Commission may continue the hearing and refer the item back to staff for
additional information or analysis. Direction should be given to staff on required
information.

WHEREAS, an application has been received from the City of Atascadero, 6907 El
Camino Real, Atascadero, CA, 93422, (Applicant and Property Owner), and Gary J. Renzaglia &
Sandra E. Hughes, 6900 Valle Avenue, Atascadero, CA 93422, (Property Owner), to consider a
project consisting of a consistency determination for the purchase of property for inclusion into
Stadium Park and associated Lot Line Adjustment, General Plan Amendment, and Zone Change
application; and,
WHEREAS, the site's General Plan Designations are (REC) recreation and (SFR -Y)
Single -Family Residential - Y; and,
WHEREAS, the site's current zoning districts are L (Recreation) and RSF-Y
(Residential Single -Family — Y); and,
WHEREAS, the planning Commission has recommended that the City Council approve
a Lot line Adjustment that would incorporate 0.52 -acres of existing residential property into
Stadium Park; and,
WHEREAS, the proposed lot line adjustment applications qualifies for a CEQA
exemption per section 15305: Minor alterations in land -use limitations; and,
WHEREAS, the Planning Commission has determined that it is in the best interest of the
City to enact this amendment to the General Plan Land Use Diagram to protect the health, safety
and welfare of its citizens by applying orderly development; and,
WHEREAS, the laws and regulations relating to the preparation and public notice of
environmental documents, as set forth in the State and local guidelines for implementation of the
California Environmental Quality Act (CEQA) have been adhered to; and,

WHEREAS, a timely and properly noticed Public Hearing upon the subject General Plan
Amendment application was held by the Planning Commission of the City of Atascadero at
which hearing evidence, oral and documentary, was admitted on behalf of said general plan

WHEREAS, the Planning Commission of the City of Atascadero, at a duly noticed
Public Hearing held on April 21, 2009 studied and considered General Plan Amendment 2009-
0024, and,
NOW, THEREFORE, the Planning Commission of the City of Atascadero, California,
hereby resolves to take the following actions:
SECTION 1. Findings for Approval of a General Plan Amendment: The Planning
Commission finds as follows:
1. The proposed amendment is in the public interest.
2. The proposed amendment is in conformance with the adopted General Plan
Goals, Policies, and Programs and the overall intent of the General Plan.
3. The proposed amendment is compatible with existing development,
neighborhoods and the environment.
4. The proposed amendment will not create any new significant and unavoidable
impacts to traffic, infrastructure, or public service impacts.
5. The proposed amendment is consistent with adopted General Plan EIR and
mitigation monitoring program.
6. The proposed amendment is in the best interest of the City to enact this
amendment to the General Plan Land Use Diagram to protect the health, safety
and welfare of its citizens and is compatible with existing and proposed
development; and,
SECTION 2. Approval. The Planning Commission of the City of Atascadero,
California, in a regular session assembled on April 21, 2009 hereby resolves to approve General
Plan Amendment 2009-0024 consistent with the following:

DISCUSSION:
Background:
On January 27, 2009, the City Council gave staff direction to process the
Walmart/Annex applications. As part of that hearing, the City Council also directed staff
to process a General Plan Amendment to add the properties surrounding the Del Rio
Specific Plan Area (Walmart / Annex Specific Plan) to the General Plan list of Master
Plan of Development Overlay Areas to ensure development compatibility for future
adjacent projects.
Summary
Updating the General Plan's Master Plan of Development Overlay table and
corresponding diagram will require that future development proposals on those sites
apply for a Conditional Use Permit to approve a Master Plan of Development thus
ensuring architectural consistency, circulation, parking and access compatibility with the
adjacent Del Rio Specific Plan Area and EIR. The Walmart/Annex Specific Plan and
EIR will include a traffic study that will recommend mitigation measures to reduce traffic
impacts. This will prevent adjacent commercial projects from being disconnected like
the Albertson and Food -4 -Less Centers. Staff anticipates that shared access and
parking will be a component of traffic mitigation along EI Camino Real and around the
interchange. Requiring Master Plan of Developments for the surrounding parcels will
reduce traffic impacts and ensure compatibility with required Specific Plan traffic
mitigation improvements.

Analysis:
Site #13
Site #13 is located to the north of the proposed Del Rio Specific Plan Area. There are
two (2) parcels included in this Master Plan area, one zoned Commercial Retail and one
zoned Residential Single Family -X. Staff expects the Annex project will be required to
provide access easements to the commercial portion of site #13 allowing for
connectivity between the future commercial centers. This commercial site is currently
included in the Master Plan table and diagram as part of the combined Annex shopping
center area; however, it is not under the control of the current Annex application and will
require its own designation in the Master Plan of Development Overlay Areas table to
allow for future specific connectivity requirements. The residential portion of site #13 is
located adjacent to the residential portion of the Annex development. Past projects have
been designed to allow for connectivity of these parcels and requiring the Master Plan
of Development will ensure safe and efficient access to all future developments in this
location.
Site #14
Site #14 is comprised of four (4) parcels and is located to the south and west of the
proposed Annex project. The parcels vary in size from 0.17 acres to 1.5 acres and are
zoned Commercial Tourist. The sizes of the parcels and proximity to the Del Rio/EI
Camino Real intersection and the northbound 101 freeway on-ramp make shared
access and consistency with the traffic analysis an important component of future
commercial development. Without shared access, some of these parcels may have
significant access limitations that would limit commercial viability.
Site #15
Site #15 includes one (1) parcel on the west side of the US 101 freeway along Del Rio
Rd. The parcel is directly adjacent to the south -bound US 101 freeway off -ramp. The
Master Plan of Development requirement will ensure shared access compatibility with
future interchange improvements required as part of the Del Rio Specific Plan EIR and
will allow access alignment with site #16.
Site #16
Site #16 includes two (2) parcels on the west side of the US 101 freeway along Del Rio
Road zoned Commercial Tourist. One parcel is owned by the City and is currently
leased to Modern Fleet Liquidation accessed off of Ramona Rd. The Master Plan of
Development requirement will ensure shared access compatibility with and future
interchange improvements required as part of the Del Rio Specific Plan EIR and will
allow access alignment with site #15 off of Del Rio Rd.

The update to the General Plan to include parcels adjacent to the Del Rio Specific Plan
Area in the Master Plan of Development Overlay Area table and diagram is exempt per
CEQA Section 15305 (Minor alterations to land use limitations). Each subsequent
Master Plan of Development application will require CEQA analysis and review at the
time of submittal. The requirement for a Master Plan of Development does not alter the
development potential of any of the included sites.
Conclusion:
The addition of the parcels adjacent to the Del Rio Specific Plan Area and across the
US101 freeway will allow for consistency with the Del Rio Specific Plan EIR and traffic
improvements called out in the Specific Plan. The parcels identified for inclusion in the
General Plan Master Plan of Development Overlay diagram and table are consistent
with City Council direction.
FISCAL IMPACT:
The City's cost recovery fees will require that planning staff time is covered for the
processing of future Master Plan of Development applications.
ALTERNATIVES:
1. The Planning Commission can make recommendations to the City Council to
modify the proposed Master Plan of Development requirements or add or
eliminate additional adjacent parcels.
2. The Planning Commission can refer the item back to staff for additional analysis.
The Commission should be specific about the information requested.
3. The Planning Commission can recommend that the City Council deny the
proposed General Plan Amendment. If the recommended parcels are not
included in the General Plan Master Plan of Development Overlay diagram and

CITY OF ATASCADERO, CALIFORNIA,
APPROVING GENERAL PLAN AMENDMENT 2009-0023, CYCLE 2009-1,
AMENDING THE GENERAL PLAN TABLE II -5 AND MAP II -4 (MASTER

WHEREAS, an application has been received from the City of Atascadero, 6907 El
Camino Real, Atascadero, CA 93422, (Applicant) to consider a project consisting of a General
Plan Amendment to Table II -5 and Diagram II -4 adding properties surrounding the Del Rio
Specific Plan Area to the list of Master Plan of Development Overlay Areas; and,
WHEREAS, including the listed parcels in the Master Plan of Development Overlay
Areas Table and Diagram will ensure orderly development and consistency with the Del Rio
Specific Plan; and,
WHEREAS, the addition of the subject parcels to the Table and Diagram is exempt per
CEQA section 15305: Minor alterations in land use limitations; and,
WHEREAS, the Planning Commission has determined that it is in the best interest of the
City to enact this amendment to the General Plan Land Use Diagram to protect the health, safety
and welfare of its citizens by applying orderly development; and,
WHEREAS, the laws and regulations relating to the preparation and public notice of
environmental documents, as set forth in the State and local guidelines for implementation of the
California Environmental Quality Act (CEQA) have been adhered to; and,
WHEREAS, a timely and properly noticed Public Hearing upon the subject General Plan
Amendment application was held by the Planning Commission of the City of Atascadero at
which hearing evidence, oral and documentary, was admitted on behalf of said General Plan
Amendment; and,
WHEREAS, the Planning Commission of the City of Atascadero, at a duly noticed
Public Hearing held on April 21, 2009 studied and considered General Plan Amendment 2009-
0023, and,
NOW, THEREFORE, the Planning Commission of the City of Atascadero, California,
hereby resolves to take the following actions:
SECTION 1. Findings for Approval of a General Plan Amendment to Table II -5
and Diagram 11-4 as follows:
The Planning Commission finds as follows:
1. The proposed amendment is in the public interest.
2. The proposed amendment is in conformance with the adopted General Plan Goals,
Policies, and Programs and the overall intent of the General Plan.
3. The proposed amendment is compatible with existing development,
neighborhoods and the environment.
4. The proposed amendment will not create any new significant and unavoidable
impacts to traffic, infrastructure, or public service impacts.
5. The proposed amendment is consistent with adopted General Plan EIR and
mitigation monitoring program.
6. The proposed amendment is in the best interest of the City to enact this
amendment to the General Plan Land Use Diagram to protect the health, safety
and welfare of its citizens and is compatible with existing and proposed
development; and,
SECTION 2. Approval. The Planning Commission of the City of Atascadero,
California, in a regular session assembled on April 21, 2009 hereby resolves to approve General
Plan Amendment 2009-0023 Cycle 1-2009 consistent with the following:

BE IT FURTHER RESOLVED that a copy of this Resolution be delivered forthwith by
