DISCLOSURE OF EX PARTE COMMUNICATIONS: • Commissioner Ward attempted to visit the site but was unable to get to the structure due to the gate across the driveway. The structure is invisible from the street. No one was there and did not speak with anyone. • Chairperson Moreno visited the site and spoke with Mr. Johnson. PUBLIC COMMENT The following citizens spoke during Public Comment: Dennis Johnson. Mr. Johnson answered questions from the Commission. Chairperson Moreno closed the Public Comment period. MOTION: By Commissioner Jack and seconded by Vice Chairperson Bentz to adopt Resolution PC 2010-0019 approving PLN 2010-1380, Minor Conditional Use Permit 2010-0254 to permit an existing 1,520 square foot accessory structure that exceeds 50% of the size of the primary residence, with clarification of Condition 6 to read "a deed restriction (for no residential occupancy or conversion) applies only to the accessory building that is subject to the Conditional Use Permit." Motion passed 7:0 by a roll -call vote. COMMISSIONER COMMENTS AND REPORTS Commissioner Schmidt asked about the property discussed tonight and if the owners decided to add on to the residence, does the Conditional Use Permit go away? Director Frace answered Mr. Schmidt's question. Commissioner Jack complimented Assistant Planner Alfredo Castillo on the detail given in the staff report. Commissioner Ward gave a report on the Purple Heart Trail sign that was taken out by a driver in an accident on Highway 101. PC Draft Action Minutes of 10/5/10 Page 3of4 DIRECTOR'S REPORT • Director Frace stated that the next Planning Commission meeting is scheduled for October 19, 2010, however, currently there are no public hearing items for that agenda, but the Commission will be given an update on the Housing Element. The meeting of November 2, 2010 will be cancelled due to elections. • Director Frace gave an update on current projects within the City. • Director Frace said the Request for Proposals for the EIR for Eagle Ranch will be going out later this week. • Director Frace gave an update on the Paso Robles Ground Water Basin. Existing Use- Vacant Planned Development (PD1 7) BACKGROUND: In 2004, the City Council approved an application for a Tentative Tract Map, Conditional Use Permit, and Zone Change for a 25 unit, single-family residential Planned Development subdivision. As a part of this approval, an Arborist Report was completed in May 2004 detailing the condition of 73 native trees on site. The site was designed to avoid impacts to as many native trees as possible. A total of 16 trees were approved for removal as a part of the project approval. One of the key features of the development was the preservation of tree #64, a 42 -inch live oak. The development proposed that Atalaya Street would split and a traffic circle would be constructed around this large tree, preserving the oak tree and creating a key focal point and traffic calming similar to the preserved oaks in the middle of the right-of- way in the adjacent Oak Grove Phase I subdivision (Regio Place). OM MEW TAT 5 22.0' K11D ITEM NUMBER: 2 DATE: 10-19-10 In November 2005, the developer entered into a Performance Security Agreement with the City, for on and off-site improvements consistent with the approved public improvement plan. This agreement allowed the developer to proceed with recording a Final Map and legally subdividing the project into 25 single-family residential lots prior to completing the required improvements as outlined in the conditions of approval. In return, the developer secured performance bonds to ensure the public improvements would be completed as conditioned. The City would be able to execute these bonds to ensure the public improvement work is complete to the satisfaction of the City Engineer if the developer failed to complete the improvements. Initial grading and construction activities occurred in 2007, but eventually ended with the beginning of the recession. The owners of the property, Estate Financial, filed for Chapter 11 Bankruptcy protection in June of 2008. The property is currently under receivership and is seeking a buyer for the project. Recently, the City has taken steps to ensure that public improvements are completed consistent with approved public improvement plans for some of the larger subdivisions that have fallen into foreclosure. The City recently initiated actions on redeeming the $1.2 million bond for the subject tract (2640, Oak Grove Phase II) to ensure completion of the public improvements that were approved (BLD 2005-4677). ANALYSIS: An application has been submitted by Michael Fredericks Paving Company on behalf of the receivership of 24 ECR, LLC for the removal of one (1) 42" Live Oak. The tree is located on Atalaya Street in the center median nearest EI Camino Real. Public improvements are being completed consistent with approved plans for the Oak Grove Phase 2 (BLD 2005-4677). Atalaya Street was planned to split at the centerline of the proposed roadway near the subject tree. The tree was to be preserved within a traffic circle, per the original project design. The City Engineer and Michael Fredericks Paving met on site in Spring of 2010 to discuss the public improvements that needed to be complete. At that time, both the City Engineer and the applicant agreed that the subject tree appeared dead with no visible green foliage. The applicant has commenced work on the public improvements on-site and is now seeking a tree removal permit for the dead tree. Steven G. Alvarez, A&T Arborists, was retained by Michael Fredericks Paving Company for an assessment of the subject tree. Mr. Alvarez, on the tree removal permit application, noted that the subject tree is 90% dead due to construction impacts with no mitigation care. Tree Mitigation ITEM NUMBER: 2 DATE: 10-19-10 The Atascadero Municipal Code requires mitigation for all trees approved for removal. AMC Section 9-11.105 identifies specific conditions of approval which are required with the approval of a tree removal. Planning Commission can approve one or more of the following conditions as mitigation: AMC Section 9-11.105: Tree removal permits shall be conditioned by one or more of the following methods: (i) Depending on the characteristics of the site the applicant may plant replacement trees on site. This method shall include payment in advance for three (3) site inspections during a four (4) year establishment period; (ii) Payment of fee to the Tree Replacement Fund; (iii) Establishment of conservation easements, which will restrict removal of any tree within a designated area of the property. (Ord. 350 § 2 (part), 1998) In accordance with Section 9-11.105 of the Atascadero Native Tree Ordinance, removal of the tree will require either planting of seven, 5 -gallon oak trees or a fee of $350 is to be paid to the City. Multi -family and Commercial/Roads applicants may plant larger size specimens to reduce the quantity of replacements required using the following ratio: 24" box = 2 — 5 gallon locally grown or 15 gallon other trees 36" box = 4 — 5 gallon locally grown or 15 gallon other trees 48" box = 6 — 5 gallon locally grown or 15 gallon other trees 60" box = 6 — 5 gallon locally grown or 15 gallon other trees This 48 -inch box tree is the equivalent of six 5 -gallon replanting for multi- family/commercial projects which is based on the City's Native Tree Guidelines and Standards (Res. 1998-034). It is staff opinion that this is an appropriate substitution considering the prominence that the site plan gave the original 42 -inch costal live oak. The remaining 5 -gallon tree to be replanted as mitigation is proposed to be planted in the rear portion of either lot 20 (APN 049-047-020) or lot 21 (APN 049-047-021). Based on the approved landscaping plan, staff recommends this location because there is no other public area or common area that could accommodate this planting. Combined with the 48 -inch box, this will satisfy the requirements of Section 9-11.105 of the Atascadero Municipal Code. Staff has identified the following finding as appropriate for the application request. The tree is dead, diseased or injured beyond reclamation, as certified by a tree condition report from an Arborist. CONCLUSIONS: A certified arborist has determined that the subject 42 -inch DBH Coast Live Oak tree is in decline and creates a potential hazard for future residents on Atalaya Street. Based on the arborist's evaluation and above analysis, findings can be made to approve the requested removal, subject to the required mitigation. ALTERNATIVES: 1. The Commission may approve the project with additional or revised project conditions. 2. The Commission may deny the project if it is found that the required findings cannot be made. The Commission's motion to deny must include a finding basis for denial. 3. The Commission may continue the hearing and refer the item back to staff for additional information or analysis. Direction should be given to staff and the applicant on required information. There is no action required. DISCUSSION: Background: The State of California requires all cities to file an Annual Housing Element Progress Report to the Department of Housing and Community Development (HCD). The purpose of the Housing Report is to monitor the implementation of the City's General Plan Housing Element and progress toward meeting the City's Regional Housing Needs Allocation (RHNA). The allocations are targets for the production of affordable housing for various income groups throughout the City. They are the basis for assuring that adequate sites and zoning are available to accommodate at least the number of units allocated. These housing allocation numbers are not housing unit quotas that the City must achieve within the time frame of their next housing element update, but housing targets that the City must provide zoning for and reduce obstacles to development. City Staff and its consultants have updated the City's Housing Element. This updated housing element has been reviewed and approved by HCD in 2010 and will be brought to the Planning Commission for review and recommendation later this year. Analysis: The current allocation sets housing needs for a seven year period ending in 2014. As of December 31, 2009, Atascadero had met approximately 35% of its total housing allocation. Of these new units, the City issued building permits on eight (8) new residential units in 2009. Of these units, three (3) were considered moderate income because of the formula established for 2nd unit calculation. The remaining five (5) units were considered above moderate or market rate units. To date, the City has met approximately 10% of the requirement for moderate housing (9 units) and 12% for low housing (9 units). The City has met approximately 6% (6 units) for very low housing needs for the 2007-2014 reporting period. These percentages only reflect units that have been issued a building permit and do not reflect entitled units or the units from the various projects that have been approved. Many of these large scale projects halted ITEM NUMBER DATE: 10-19-10 construction activities in 2008 due to the significant tightening of credit and capital, and the downturn of the housing market. Many of these larger projects include affordable housing production requirements as a part of their conditions of approval. ITEM NUMBER: 3 DATE: 10-19-10 2009 Affordable Housing Production Calendar year 2009 had a similar drop off in issued building permits compared to 2008. The downturn of the economy is the key factor in such a dramatic difference between building permits issued from previous years. Calendar year 2009 saw the worst of the recession with unemployment peaking, a high number of foreclosures due to the collapse of the sub -prime market and loss of jobs and other sources of income. Similar to many national trends, the City was no different and saw little development in new units due to a lack of demand. The City issued eight (8) building permits for new construction, and did not rehabilitate any existing units. Of these eight units, three (3) second units are considered affordable for the moderate income level group. This group is defined as "affordable" if the cost per square foot for a typical rent in Atascadero ($1.09/sf based on the San Luis Obispo Multi -Family Housing Rental Survey) multiplied by the square footage of the second unit. If the rent falls within an income category, that unit is deemed affordable for that income type. The median home price in Atascadero for a new or existing home or condo in 2009 according the California Realtors Association was $279,500. This median home price gave the ability for moderate income wage earners to become homeowners for the first time in many years. With the median home price expected to be generally flat in 2010, the affordability for new or existing homes has been its highest it has been for the first time in over 10 years. Conclusion: The City expects generally the same level of construction activity for 2010. With significantly fewer units built as compared to 2005-2007. This includes limited development. However after 2010, staff expects to see an increase in affordable housing for very low, low, and moderate income units as existing projects that were approved with the inclusionary policies restart construction.
