Director Frace and Chairperson Moreno explained that those issues would be addressed in the study session of tonight's meeting. CONSENT CALENDAR Chairperson Moreno announced a correction to the draft minutes of July 20, 2010, on Pages 2 and 4. On page 2, the number in the title should be PLN 2010-1370. The tree has been evaluated by an arborist and it has been determined that the tree's roots have been damaged from prior construction and the tree is in decline. Due to the location of the tree in a high traffic area, the potential failure of limbs creates a hazardous situation. The tree is proposed for removal with mitigation for replanting native trees elsewhere on site. ZONING CODE LAND USE STUDY SESSION Assistant Planner Alfredo Castillo explained the format for the study session and stated that no formal action will be taken. Unit 1 contains an existing single family residence and detached garage that will remain. Unit 2 and Unit 3 will be located at the rear of parcel lot and contain two single family residential units. RECOMMENDATION: Staff Recommends: The Planning Commission adopt Resolution PC 2010-0018 approving Tentative Parcel Map 2010-0097 for condominium purposes, a request to subdivide one parcel totaling 0.28 acres into three (3) air space parcels, and approving Minor Conditional Use Permit 2010-0251 based on findings and subject to Conditions of Approval. Environmental Status DISCUSSION: Background: ITEM NUMBER: 2 DATE: 9-7-10 One single family residential unit, with detached garage Section 15315 Categorical Exemption: Minor Land Divisions of residential property into four (4) or fewer properties. The subject property is located at 8760 Curbaril Avenue just north of the EI Camino Real/Curbrail intersection. The property was developed as a two (2) bedroom single family home with a detached garage in 1954. The General Plan designation and its corresponding zone were amended to a multi -family use/zone in 2000 via a City Council resolution. The home is occupied with a tenant and it is currently being utilized as an investment property. The owner of the existing residence is the applicant requesting the subdivision of land for condominium purposes. Surrounding Land Use and Setting: North: Residential Multi -Family High (RMF -16) South: Residential Multi -Family Low (RMF -10) East: Residential Multi -Family Low (RMF -10) West: Commercial Retail (CR) ITEM NUMBER DATE: 9-7-10 Aerial Photo Analysis The proposed project consists of a request to subdivide the existing 0.28 acre parcel into three (3) airspace condominiums under one common lot. The density proposed for the subdivision is consistent with the General Plan designation of Medium Density Residential (MDR) and the corresponding Residential Multi -Family (RMF -10) zoning district. Consistent with the Atascadero Municipal Code (AMC) 9-12.104, the applicant is also required to obtain a Conditional Use Permit (CUP) for development of or conversion of existing units into condominiums. Existing Site Conditions The project site contains one existing single family dwelling unit with a detached garage. Access to the detached garage is from an existing 12 -foot, unpaved driveway on the eastern side of the property. There is some vegetation at the rear and front of the ITEM NUMBER: 2 DATE: 9-7-10 property, with an existing non-native tree planted within the front setback. The site is relatively flat with little to no grade elevations. Surrounding the property are small lot single family residential units to the north, a single family residential unit to the south, a three unit single family residential condominium development to the east, and the Walgreens Drug Store to the west. The applicant has submitted a property conditions report consistent with AMC 9-12.106. The applicant expects no major renovations. The applicant has proposed minor renovations such as painting the exterior and interior finishes, as well as minor cosmetic upgrades inside the unit to prepare for possible sale. The existing unit will have a private use easement to retain a portion of the front and side yards. The second and third units would be located at the rear of the lot. These units are approximately 1,034 sf of building footprint with attached garages and upper floor living spaces. Access for the two units is from a shared landscaped walkway. The units will be architecturally identical. Both units will contain private use easements similar to the existing unit and consistent with the AMC private open space requirement. Common areas throughout the condominium development include the use of either stamped concrete or pavers for driveway, guest parking, and access to all the garages (condition 12). The driveway has been designed to accommodate the necessary fire turnaround as requested by the Atascadero Fire Department. This fencing plan is included as attachment 8. The applicant is required to complete frontage improvements with the additional units proposed (condition 19). These improvements include completing a curb, gutter and sidewalk, consistent with new development in the area and existing infrastructure in the neighborhood. The applicant is also required to mitigate additional stormwater runoff generated by development of the site (condition 39). The applicant has proposed to install an underground stormwater detention system to capture stormwater runoff from the additional units and the existing units for the 50 year and 100 year stormwater flow. In the worst case scenario, any additional flow would exit through an existing 4 -inch relief line that would utilize drainage constructed from Walgreens. The applicant will also utilize Low Impact Development (LID) techniques in the common areas such as the driveway and common landscape areas to reduce the amount of runoff. Architectural Elevations The proposed new units consist of two-story, 3 bedrooms, two and half bathroom residences with a total living space of approximately 1,960 sf. Each unit will have an attached garage with access to the garage from the first floor. Exterior materials include the use of durable fiber cement siding and wood trimming. Wood trellises are located at the garage and front door for architectural variation and alleviate the appearance of a singular "box". Seven additional trees are to be planted within planters along the side setbacks to provide shade and reduce the "heat island" effect. A condition of approval includes planting of at least one (1) shade tree in the rear setback for each new unit (condition 14). An additional condition of approval is to provide landscaping along the side yard setback adjacent to the Walgreens site (condition 15). This landscaping is to be either drought tolerant shrubs, the use of drought tolerant, fast growing cypress trees or the use of trellises with landscaping such as vines or other aesthetically pleasing landscaping in order to break the visual appearance of the masonry wall as well as light glare on from the nighttime use of the Walgreens site. Irrigation systems will be provided for all three units. The irrigation system proposed to be installed includes "low flow" spray heads consistent with the City's landscape ordinance, as well as separate control boxes for each unit that includes rain sensors to reduce irrigation use during the rainy season. The private use easement areas will contain no formal landscaping with the exception of the trees in the rear yard and plantings on the side yard consistent with the condition of approvals. Plantings in this area will be the responsibility of future homeowners, with the exception of the shade trees. Environmental Review: As proposed, the project qualifies for a Class 15 exemption of the California Environmental Quality Act (CEQA) (Section 15315, Minor Land Divisions). This exempts division of residential projects in urban areas of four or fewer parcels when the division in conformance with the General Plan and zoning, and no variance or exceptions are required, all services and access to the proposed parcels to local standards are available and the parcel has not been involved in a larger division within the previous 2 years and does not have an average slope greater than 20 percent. Findings for a Tentative Parcel Map The Planning Commission must make the following seven findings in order to approve a Tentative Parcel Map for the proposed condominium map. If the Commission chooses to deny the project, site specific findings for denial must be sited. 1. The proposed map, as conditioned, is consistent with the General Plan and applicable zoning requirements. 2. The design and improvement of the proposed map, as conditioned, is consistent with the General Plan and applicable zoning requirements. 3. The site is physically suitable for the density of development proposed. ITEM NUMBER: 2 DATE: 9-7-10 4. The design and improvement of the proposed map will not cause substantial environmental damage or substantially and unavoidably injure fish and wildlife or their habitat. 5. The map is consistent with the character of the immediate neighborhood. 6. The design of the condominium map will not conflict with easements acquired by the public at large for access through, or the use of property within, the proposed subdivision; or substantially equivalent alternative easements are provided. 7. The proposed condominium map design and type of improvements proposed will not cause serious public health problems. Findings for a Conditional Use Permit The Planning Commission must make the following five findings in order to approve a Conditional Use Permit for the proposed condominium map and conversion of the existing unit, consistent with AMC 9-12.104. If the Commission chooses to deny the project, site specific findings for denial must be sited. 1. The proposed project or use is consistent with the General Plan. 2. The proposed project or use satisfies all applicable provisions of the Title (Zoning Ordinance). 3. The establishment, and subsequent operation or conduct of the use will not, because of the circumstances and conditions applied in the particular case, be detrimental to the health, safety, or welfare of the general public or persons residing or working in the neighborhood of the use, or be detrimental or injurious to property or improvements in the vicinity of the use. 4. That the proposed project or use will not be inconsistent with the character or the immediate neighborhood or contrary to its orderly development. 5. That the proposed use or project will not generate a volume of traffic beyond the safe capacity of all roads providing access to the project, either existing or to be improved in conjunction with the project, or beyond the normal traffic volume of the surrounding neighborhood that would result from full development in accordance with the Land Use Element. ITEM NUMBER: 2 DATE: 9-7-10 CONCLUSIONS: The subdivision is consistent with the adopted General Plan and Zoning Ordinance. The parcel configurations are consistent with the Subdivision Ordinance requirements and the size and shape of the proposed units are consistent with the character of the immediate neighborhood. Additional landscaping has been included as a condition of approval to help alleviate the visual appearance of the 6 -foot high masonry wall adjacent to the existing commercial retail uses. Staff recommends the Planning Commission approve the Tentative Parcel Map and Conditional Use Permit as conditioned. ALTERNATIVES: 1. The Commission may approve the Tentative Parcel Map and Conditional Use Permit subject to additional or revised project conditions. The Commission's motion to approve needs to include any new or revised project conditions. 2. The Commission may deny the Tentative Parcel Map and Conditional Use Permit if it is found to be inconsistent with the General Plan or any of the other required findings. The Commission's motion to deny must include a finding basis for denial. 3. The Commission may continue the hearing and refer the item back to staff for additional information or analysis. Direction should be given to staff and the applicant on required information. Unit 1 is in good physical and structural condition. The structure was approximately built in the 1950's and was built to standard building practices for that time period. It is not in compliance with the 2007 building and zoning codes. The foundation. ventilation, utilities, walls, roofs, windows, mechanical, plumbing, and electrical equipment are all in good condition. There will be no renovations that require a building permit to the existing residence. (2) - Pest inspection is included with this submittal. A provision for review and approval by the City Community Development Department for any changes to the CC&R's that relate to the above requirements prior to the changes being recorded or taking effect. 9. Prior FM PS/PW to recordation of the final map, the applicant shall submit a condominium plan for recording concurrently with the final map. A qualified licensed professional shall prepare the final map and the condominium plan. 11. The color scheme of the new units shall be consistent with the BP PS submitted development application color scheme. Any deviations from this color scheme shall be approved by the City. 12. Developer shall provide entryway features such as a trellis or BP PS other similar structure along the walkway between unit 2 and unit 3 near the driveway. 17. Applicant shall produce a "Tenant Information Package" that BP PS includes a "Notice of Intent to Convert" to the existing residents. This package shall be consistent with section 9- 12.107 of the Atascadero Municipal Code. The City shall approve this package prior to deliver to existing resident. This package shall be submitted for review and approval prior to issuance of a building permit. City Engineer Project Conditions 18. Prior to recording the final map, the applicant shall submit a FM CE copy of a valid tax bond. 19. Project shall include construction of curb, gutter and sidewalk GP, BP CE along entire property frontage. 20. Applicant shall submit offsite improvement plans for approval FM CE by the City Engineer. 21. Prior to recording the final map, the applicant shall bond for or FM CE complete all improvements required by these conditions of approval. 22. An engineer's estimate of probable cost shall be submitted for GP, BP CE review and approval by the City Engineer to determine the amount of the bond. 23. Applicant shall sign City bond agreements if bonding for the FM, GP, BP CE improvements. 24. Applicant shall update bond estimates and provide the City FM, GP, BP CE with new bonds every two years. Drainage easements shall be obtained by the applicant, as GP, BP CE needed, to accommodate both public and private drainage facilities. 30. A preliminary subdivision guarantee shall be submitted for FM CE review in conjunction with the processing of the Parcel map. 31. The final parcel map shall be found acceptable to the City FM CE Surveyor prior to the map being placed on the agenda for City Council acceptance. 32. Prior to recording the parcel map, the applicant shall pay all FM CE outstanding plan check/inspection fees. 33. Prior to recording the parcel map, the applicant shall bond for FM CE or set monuments at all new property corners. A registered civil engineer or licensed land surveyor shall indicate by certificate on the parcel map, that corners have been set or shall be set by a date specific and that they will be sufficient to enable the survey to be retraced. 34. Prior to recording the final map, the applicant shall submit a FM CE map drawn in substantial conformance with the approved tentative map and in compliance with all conditions set forth herein. Prior to the issuance of building permits the applicant shall GP, BP CE submit plans and supporting calculations/reports including street improvements, underground utilities, composite utilities, and grading/drainage plans prepared by a registered civil engineer for review and approval by the City Engineer. 38. Prior to the issuance of building permits the applicant shall GP, BP CE submit calculations to support the design of any structures or pipes. Closed conduits shall be designed to convey the 10 - year flow with gravity flow, the 25 -year flow with head, and provide safe conveyance for the 100 -year overflow. 39. Prior to the issuance of building permits the applicant shall GP, BP CE provide for the detention and metering out of developed storm runoff so that it is equal to or less than undeveloped storm runoff in accordance with City Standards. 40. Drainage basins shall be designed to desilt, detain and meter GP, BP CE storm flows as well as release them to natural runoff locations. 41. A mechanism for funding and maintenance of the storm drain GP, BP CE facilities shall be provided. 42. Prior to the issuance of building permits the applicant shall GP, BP CE show the method of dispersal at all pipe outlets. Include specifications for size & type. 43. Prior to the issuance of building permits the applicant shall GP, BP CE show method of conduct to approved off-site drainage facilities. 44. Concentrated drainage from off-site areas shall be conveyed GP, BP CE across the project site in drainage easements. Acquire drainage easements where needed. Drainage shall cross lot lines only where a drainage easement has been provided.
