APPEARANCE REVIEW STUDY SESSION Assistant Planner Castillo explained the purpose of the Study Session. He explained the Appearance Review Guidelines guide the development of our City. Mr. Castillo explained that the Guidelines have not been revised since the early 1980s, but, the core guidelines remain relevant. Mr. Castillo and Director Frace answered questions from the Commission. PUBLIC COMMENT None Chairperson Bentz closed the Public Comment period. 3. NATIVE TREE ORDINANCE STUDY SESSION Associate Planner Callie Taylor explained the Native Tree Ordinance (NTO). The Ordinance was put in place to protect our native trees. Ms. Taylor answered questions from the Commission. PUBLIC COMMENT The following people spoke during public comment: Joan O'Keefe and David Frayer. Chairperson Bentz closed the Public Comment period. COMMISSIONER COMMENTS AND REPORTS Commissioner Schmidt said it's a great week with the theatre opening on Friday and we are happy with what Galaxy has brought to the City. PC Draft Action Minutes of 3/15/11 Page 3 of 4 DIRECTOR'S REPORT • Director Frace announced that the next meeting will be held on April 5, 2011, but currently, there are no public hearing items scheduled at this time. We have a Facebook link now for Community Development planning items. It is an experiment with some connections to our website. • The Draft EIR for the Walmart/Annex project is out for public review and will close this Friday, March 18, 2011, at 5 p.m. Once that concludes, the EIR consultant will be reviewing comments and the project will come before the Planning Commission and then to City Council. • Galaxy Theatres grand opening is scheduled for Friday, March 18, 2011. At staff level, we are working on a parking -logistics plan. We have an agreement with Rabobank for additional parking, and there are about 350 spaces total. For most evenings, parking should be more than adequate, but we will continue to monitor the parking. We are moving forward with the pedestrian bridge. • The next phase of Colony Square will be forthcoming to the Planning Commission. The tree is in severe decline, creating a potential hazard in a high traffic area, as evaluated by the arborist. RECOMMENDATION: Staff Recommends: The Planning Commission adopt Resolution PC 2011-0003 to allow the removal of one (1) hazardous Live Oak totaling 44 '/2 inches DBH subject to conditions of approval and mitigation. Zoning District: Right -of -Way / RSF-X with PD -17 overlay ITEM NUMBER: 2 DATE: 4-5-11 BACKGROUND: Traffic circles were designed with the original Oak Grove project in 2003 to save several large oak trees at the center of the development. There are four (4) large Live Oaks in the first traffic circle on Regio Place, and 2 Live Oaks in the smaller traffic circle at Copado Way and Regio. Construction began on the development in 2005. Thirteen of the 32 lots in the project were completed and sold before the construction halted in 2007 and the project went into bankruptcy and receivership. The current project owner, Alta Community Development, LLC, purchased the remaining unfinished lots in summer of 2010, and has hired a contractor to complete construction on the project. The on-site improvement permit, which includes the construction of the traffic circles, was almost complete when the project stopped in 2007. However, there are a few outstanding items, including landscape of the traffic circles with drought tolerant plants, and an arborist evaluation, which need to be completed prior to closing out the permit for the on-site improvements. The on-site improvements must be completed by the current project owner prior to final of the last house in the project. For the past few years, the Oak Grove Homeowners Association has been maintaining the portions the on-site improvements which were completed prior to 2007, including the landscape and drainage basins near EI Camino Real and the native trees throughout the project. Two years ago, the HOA hired an arborist to evaluate and treat the large native trees on site. Many of the trees were impacted by the construction of the roads and were beginning to deteriorate in health. Anti -fungal and nutrient treatments were done by an arborist to prolong the life of the trees and attempt to reverse the damage done by the construction. ANALYSIS: An application has been submitted by the Oak Grove Homeowners Association for the removal of one (1) 44 '/2 inch DBH Live Oak. The tree is located within the planter area in the first traffic circle on Regio Place. Despite the efforts by the HOA to save the tree, the 44 '/2 inch Live Oak has continued to decline. The arborist, Chris Stier, evaluated the tree and identified large dead and broken limbs, sparse growth and discolored leaves, oozing lesion on the trunk, bark beetle and borers, plus fungal growth and wood rot with a large pocket at one of the main roots. The arborist believes that the tree has been in decline for at least two to four years, with the construction of the road and curb factoring into the decline of the tree. The arborist stated that the tree is quickly becoming a hazard as it dies and becomes brittle and unstable. The wood rot and borers can also spread to other nearby trees if the infested tree is not removed, so removal is important to protect the remaining trees onsite. ITEM NUMBER: 2 DATE: 4-5-11 The arborist has stated that the other remaining large trees on site do not need to be removed at this time, but would benefit from a good pruning to remove dead wood. In accordance with the conditions and mitigation measures of the original 2003 project approval, the developer (currently Alta Community Development, LLC) is required to obtain an arborist letter prior to completion of the on-site improvement permit to verify that the trees are all in good condition and any necessary mitigation has been implemented prior to permit final. 1k n ITEM NUMBER: DATE: 4-5-11 Tree Mitigation Permit fees are not required for the removal of hazardous trees. The regular fee for a Tree Removal Permit which requires Planning Commission hearing is $755. The fee has been waived for the subject application. The Atascadero Municipal Code requires mitigation for all trees approved for removal. AMC Section 9-11.105 identifies specific conditions of approval which are required with the approval of a tree removal. Planning Commission can approve one or more of the following conditions as mitigation: AMC Section 9-11.105: Tree removal permits shall be conditioned by one or more of the following methods: (i) Depending on the characteristics of the site the applicant may plant replacement trees on site. This method shall include payment in advance for three (3) site inspections during a four (4) year establishment period; (ii) Payment of fee to the Tree Replacement Fund, (iii) Establishment of conservation easements, which will restrict removal of any tree within a designated area of the property. (Ord. 350 § 2 (part), 1998) In accordance with Section 9-11.105 of the Atascadero Native Tree Ordinance, staff has included a condition in the attached resolution which requires either replanting or payment of fees to the tree fund. The applicant shall either replant seven (7), five -gallon native trees in the project site, or make a mitigation payment of $370.83 into the tree fund, or combination thereof. The Oak Grove HOA shall work with the current developer to plant a combination of native trees and shrubs (complete native habitat) in the common areas prior to final of the on-site improvement permit. Staff has identified the following finding as appropriate for the application request. The tree is dead, diseased or injured beyond reclamation, as certified by a tree condition report from an Arborist. CONCLUSIONS: A certified arborist has determined that the subject 44 '/2 -inch DBH Live Oak tree is in severe decline and creates a potential hazard in a high traffic area near the road in the Oak Grove development. Based on the arborist's evaluation and above analysis, findings can be made to approve the requested removal, subject to the required mitigation. ALTERNATIVES: 1. The Commission may approve the project with additional or revised project conditions. 2. The Commission may deny the project if it is found that the required findings cannot be made. The Commission's motion to deny must include a finding basis for denial. 3. The Commission may continue the hearing and refer the item back to staff for additional information or analysis. Direction should be given to staff and the applicant on required information. There is considerable dieback on the leafed out branches. Many larger branches are dead, broken and in very poor condition. Oozing lesion noted on the trunk. Trunk bark peels off easily and below there is visible fungal growth indicative of wood rot. Borer frass found in crevices of bark and when the bark is peeled back the borer's tunneling is evident. One large rotted pocket in one of the main buttress roots was noted. Conclusions This tree is quickly becoming a hazard; as it dies it becomes brittle and unstable. The wood rot (visible signs of the fungus) and the borers can spread to the other trees if the infested tree is not removed. From the extent of the rot and borer activity this tree has been declining for at least two to four years. Construction of the nearby road and curb could be a factor in a steeper decline. Heavy rain and wet soils can also lead to accelerated decline. Recommendations Due to the extent of rot and borer damage, removal at this point is the only remedy.
