ACTION MINUTES
Regular Meeting — Tuesday, October 5, 2010 — 7:00 P.M.
City Hall Council Chambers
6907 EI Camino Real, Atascadero, California
CALL TO ORDER - 7:01 p.m.
Chairperson Moreno called the meeting to order at 7:01 p.m. and Commissioner
Sturtevant led the Pledge of Allegiance.
ROLL CALL
Present: Chairperson Moreno, Vice Chairperson Bentz, Commissioners
Colamarino, Jack, Schmidt, Sturtevant, and Ward
Absent: None
Others Present: Recording Secretary Annette Manier
Staff Present: Community Development Director Warren Frace and Assistant
Planner Alfredo Castillo

Motion passed 7.0 by a roll -call vote.

CONSENT CALENDAR
Annette Manier, Recording Secretary, announced an addition to the minutes on Page 4
of 5 that should be added as follows: "Motion Passed 6:0 by a roll call vote."
1. APPROVAL OF DRAFT ACTION MINUTES OF THE PLANNING
COMMISSION MEETING ON SEPTEMBER 7, 2010.
MOTION: By Vice Chairperson Bentz and seconded by Commissioner
Jack to approve the Consent Calendar.
Motion passed 6:0 by a roll -call vote. (Moreno abstained)

Assistant Planner Alfredo Castillo gave the staff report and answered questions from
the Commission.
DISCLOSURE OF EX PARTE COMMUNICATIONS:
• Commissioner Ward attempted to visit the site but was unable to get to the
structure due to the gate across the driveway. The structure is invisible from the
street. No one was there and did not speak with anyone.
• Chairperson Moreno visited the site and spoke with Mr. Johnson.
PUBLIC COMMENT
The following citizens spoke during Public Comment: Dennis Johnson.
Mr. Johnson answered questions from the Commission.
Chairperson Moreno closed the Public Comment period.
MOTION: By Commissioner Jack and seconded by Vice
Chairperson Bentz to adopt Resolution PC 2010-0019
approving PLN 2010-1380, Minor Conditional Use Permit
2010-0254 to permit an existing 1,520 square foot
accessory structure that exceeds 50% of the size of the
primary residence, with clarification of Condition 6 to
read "a deed restriction (for no residential occupancy or
conversion) applies only to the accessory building that
is subject to the Conditional Use Permit."
Motion passed 7:0 by a roll -call vote.
COMMISSIONER COMMENTS AND REPORTS
Commissioner Schmidt asked about the property discussed tonight and if the owners
decided to add on to the residence, does the Conditional Use Permit go away? Director
Frace answered Mr. Schmidt's question.
Commissioner Jack complimented Assistant Planner Alfredo Castillo on the detail given
in the staff report.
Commissioner Ward gave a report on the Purple Heart Trail sign that was taken out by
a driver in an accident on Highway 101.

DIRECTOR'S REPORT
• Director Frace stated that the next Planning Commission meeting is scheduled
for October 19, 2010, however, currently there are no public hearing items for
that agenda, but the Commission will be given an update on the Housing
Element. The meeting of November 2, 2010 will be cancelled due to elections.
• Director Frace gave an update on current projects within the City.
• Director Frace said the Request for Proposals for the EIR for Eagle Ranch will be
going out later this week.
• Director Frace gave an update on the Paso Robles Ground Water Basin.
ADJOURNMENT - 7:42 p.m.
The next regular meeting of the Planning Commission is scheduled for October 19,
2010, at City Hall, Council Chambers, 6907 EI Camino Real, Atascadero.
