City Hall Council Chambers 6907 EI Camino Real, Atascadero, California CALL TO ORDER - 7:00 p.m. Chairperson Jack called the meeting to order at 7:00 p.m., and Commissioner Schmidt led the Pledge of Allegiance. ROLL CALL Present: Chairperson Jack, Vice Chairperson Moreno, Commissioners Bentz, Colamarino, Schmidt, Sturtevant and Ward Others Present: Recording Secretary Susanne Curtis Anshen Staff Present: Community Development Director Warren Frace, Deputy Public Works Director David Athey, and Associate Planner Callie Taylor APPROVAL OF AGENDA MOTION: By Vice Chairperson Moreno and seconded by Commissioner Bentz to approve the agenda. Motion passed 7:0 by a roll -call vote. PUBLIC COMMENT - None. PLANNING COMMISSION BUSINESS - None. PC Minutes 03/17/09 Page 1 of 5 CONSENT CALENDAR 1. APPROVAL OF MINUTES OF THE REGULAR PLANNING COMMISSION MEETING ON FEBRUARY 17, 2009. MOTION: By Commissioner Schmidt and seconded by Commissioner Sturtevant to approve the Consent Calendar. Motion passed 7:0 by a roll -call vote. COMMUNITY DEVELOPMENT STAFF REPORTS 2. PLN 2009-1319/TREE REMOVAL PERMIT FOR 3182 PASEO DEL LAGO Property The Lakes of Atascadero HOA, c/o Mark IV Property Owner: Management, 5735 EI Camino Real #H, Atascadero, CA 93422 Applicant: Clay Chisum, 3281 Via del Sueno, Atascadero, CA 93422 Certified A & T Arborist, 1565 EI Camino Real, Atascadero, CA 93422 Arborist: Project Title: PLN 2009-1319 / TRP 2009-0129 Tree Removal Permit Project Open space next to the lake (The Lakes Development), Location: Atascadero, CA 93422 APN 049-031-070 (San Luis Obispo County) Project 52" DBH Valley Oak proposed for removal. The tree is dead as Description: certified by the project arborist. Associate Planner Callie Taylor gave the staff report and answered questions of the Planning Commissioners. DISCLOSURE OF EXPARTE COMMUNICATIONS: • Chairperson Jack visited the site and spoke with an unnamed homeowner. Associate Planner Callie Taylor and Community Development Director Warren Frace continued to answer questions of the Planning Commissioners. PUBLIC COMMENT: None. MOTION: By Vice Chairperson Moreno and seconded by Commissioner Colamarino to adopt Resolution PC 2009-0011 to allow the removal of one (1) dead Valley Oak totaling 52 inches DBH subject to conditions of approval. Motion passed 7:0 by a roll -call vote. PC Minutes 03/17/09 Page 2 of 5 PUBLIC HEARINGS 3. PLN 2008-1293 CONDITIONAL USE PERMIT AMENDMENT, 5400 SAN ANSELMO AVE. Property Vern H. Haynes, 2012 Park Street, Paso Robles, CA 93446 Owner: Applicant: Rev. Vern Haynes, True Spirit Missionary Baptist Church, 5400 San Anselmo Ave., Atascadero, CA 93422 Project Title: PLN 2008-1293 / Amendment to Conditional Use Permit 1989-003 Project 5400 San Anselmo Ave., Atascadero, CA 93422 Location: (San Luis Obispo County) APN 049-163-051 Project The project consists of an Amendment to the existing Conditional Description: Use Permit 1989-003. The Amendment includes a remodel and 1364 sq. ft. addition to the existing church. General Plan Designation: SFR -Y Zoning District: RSF-Y Proposed CEQA exemption class 1 (section 15301) Existing Facilities Environmental Determination: DISCLOSURE OF EX PARTE COMMUNICATIONS: • All Commissioners stated they had visited the site, but had not spoken with anyone. Associate Planner Callie Taylor gave the staff report. Associate Planner Callie Taylor, Deputy Public Works Director David Athey, and Community Development Director Warren Frace answered questions of the Planning Commissioners. PUBLIC COMMENT: Ted Weber, applicant's Architect, stated it is understandable to restrict the parking on San Anselmo due to Sight Standards. He also asked that the CUP be valid for 24 months rather than 12 months. Mr. Weber answered questions of the Planning Commissioners on the parking lot configuration. Pastor Vern Haynes and Assistant Pastor Vern Haynes, Jr., answered questions of the Commissioners. PC Minutes 03/17/09 Page 3 of 5 Jolene Horn spoke in favor of the project and of the positive impact on the community of this church. She asked if the indentation in front of church could be handicapped parking. Jerry White, Youth Minister of True Spirit Missionary Baptist Church, urged passing this project as this is a wonderful church that is rapidly growing. Jolene Horn spoke again about the existing small sanctuary which will become office space and the new sanctuary which will be a separate space. Chairperson Jack closed the Public Comment period. Commissioners asked about changing Condition No. 4 from 12 months to 24 months and the parking possibilities for handicapped in front of the church as well as the parking lot configuration. Deputy Public Works Director David Athey and Community Development Director Warren Frace answered questions of the Planning Commissioners. MOTION: By Vice Chairperson Moreno and seconded by Commissioner Bentz to adopt Resolution PC 2009-0012 approving PLN 2008- 1293, an amendment to Conditional Use Permit 1989-003, based on findings and subject to Conditions of Approval, changing Condition No. 4 to twenty-four (24) months rather than twelve (12) months. DISCUSSION: The Commissioners held a discussion on the street parking. Commissioner Schmidt felt the sight distance was not a problem when he parked along side of the road, and would like to consider adding a caveat that the applicant could apply for street parking if they felt it necessary. Commissioner Bentz called for the motion. Motion passed 6:1 by a roll -call vote. (Commissioner Schmidt opposed.) COMMISSIONER COMMENTS AND REPORTS Community Development Director Warren Frace discussed the up -coming conference details and Administrative Services Director Rachelle Rickard provided pointers on conference expense rules from the Travel Policy. PC Minutes 03/17/09 Page 4 of 5 DIRECTOR'S REPORT • Announced a Special Training March 31, 2009, at 6 p.m. in City Council Chambers with the Parks and Recreation Department hosted by City Staff, including information on the Brown Act, ethics training, the Norms, ex -parte disclosures and the City Manager's presentation on the Budget. • Next meeting of the Planning Commission is April 7, 2009, and the agenda has only two minor items at this time. • The next City Council meeting on March 24, 2009, will cover the Tractor Supply Store as well as the West Front mixed use project. Also on the City Council's agenda for that meeting will be the Greenhouse Gases issue.
