Regular Meeting
June 3, 2003 — 7:00 P.M.
CALL TO ORDER
Chairperson Fonzi called the meeting to order at 7:00 p.m. and Commissioner Bentz led the
Pledge of Allegiance.

There was Commission consensus to approve the agenda.

CONSENT CALENDAR
1. APPROVAL OF MINUTES OF THE REGULAR PLANNING COMMISSION
MEETING ON MAY 20, 2003.
MOTION: By Commissioner Jones and seconded by Vice Chairperson Kelley to approve the
Minutes of the Regular Planning Commission Meeting on May 20, 2003.

PUBLIC HEARINGS
2. APPEAL 2003-0001

An appeal of the Community Development Director's decision to deny a request to apply for a

reduction of the minimum lot size for a parcel within the RSF-Y zoning district. The General Plan
Land Use Designation is Single Family Residential. The site is zoned Residential Single Family -Y, a
medium density single family zoning designation with a minimum lot size of 1.0 acre.
Proposed
CEQA Exemption by Statute Section 15061. The project will have no significant effect on the

environment.
Determination
Planning Services Manager Steve McHarris provided the staff report and with Community
Development Director Warren Frace and City Attorney Roy Hanley answered questions of the
Commission.
PUBLIC COMMENT
Dan Stewart, Civil Engineer and applicant's representative, gave a brief history of the project. It
is Mr. Stewart's opinion that the variance didn't expire and the applicant should be permitted to
file an extension of the map at this time. He would like to find a solution to this issue for the
applicant. Mr. Stewart answered questions of the Commission.
Chairperson Fonzi closed the Public Comment period.
Commissioner Jones stated that his original concern was to find something to indicate why the
map had expired. He sees nothing in the record to support the applicant's position and nothing
that would allow the Commission to make an exception for this particular project. Though he is
sympathetic with the applicant, he will vote to deny the appeal.
Commissioner Bentz raised the option of a lot line adjustment to deal with this issue. He stated
that he is unable to find any basis to deny the staff recommendation.
MOTION: By Commissioner Jones and seconded by Commissioner Bentz to adopt
Resolution No. PC 2003-0044 a resolution of the Planning Commission of the
City of Atascadero denying APL 2003-001 subject to the findings as set forth in
the staff report, 1 through 4.

3. ZONE CHANGE 2003-0051:

9-3. 152 Allowed Uses, in the RSF-Y zoning districts consistent with General Plan
Goal HOS 3: Policy 3.1-3.

PUBLIC COMMENT — None
MOTION: By Commissioner Jones and seconded by Vice Chairperson Kelley to recommend
that the City Council adopt an Ordinance by the City of Atascadero approving
Zone Change 2003-0039 to amend the Zoning Ordinance to allow residential
second units in the RSF-Y zoning district subject to performance standards as
proposed by the planning staff with the text amendments.

Motion passed 7.0 by a roll -call vote.
Commissioner Jones left the meeting at 7:47 p.m.
4. ZONE CHANGE 2003-0052:

definition of "Auto Dealers"

City Attorney Roy Hanley provided the staff report and answered questions of the Commission.
Vice Chairperson Kelley requested a notation be added that this will correspond with the state
law. City Attorney Hanley stated that this notation could be added to the staff report for the City
Council.
PUBLIC COMMENT
Bill Brite, 11875 Santa Lucia Road suggested the definition be changed to read "sale of
motorized vehicles."
Chairperson Fonzi closed the Public Comment period.
MOTION: By Commissioner Bentz and seconded by Chairperson Fonzi to recommend to the
City Council that it introduce for first reading by title only, draft Ordinance
amending the definition of "auto dealer" in the Atascadero Municipal Code, and
including a revision to Section One as recommended by the City Attorney to read
as follows:
The definition of "Auto Dealers" in 9-3.701 is changed to read as follows:
Auto Dealers (New and Used) and Supplies. Retail and wholesale trade
establishments selling new and used automobiles and including but not
limited to, light trucks, motorcycles and mopeds.

Motion passed 6:0 by a roll -call vote.
COMMISSIONER COMMENTS & REPORTS
Commissioner Beraud reported on the Community Housing presentation, which she and several
other Commissioners attended. She was impressed with the fact that there are many ways to
meet the required numbers and many options to encourage people to live in the affordable units
for the long term.
Chairperson Fonzi asked for a summary of the day's events and what was learned.
Commissioner Porter reviewed the day's events and stated he came away with the conclusions
that: 1) it is possible to provide affordable housing and it is working in other areas of the county,
and 2) people are very happy to have a place of their own, either rented or owned. He felt that
projects set up as "communities" with common areas, front porches, etc., seemed hold the
greatest appeal to the occupants and worked better overall.
Community Development Director Frace reminded the Commission of the joint meeting
tomorrow evening, 6:30 p.m. on inclusionary housing. Director Frace informed the Commission
that Associate Planner Glenn Rider had resigned.
ADJOURNMENT
Chairperson Fonzi adjourned the meeting at 8:03 p.m. to the next regular meeting of the
Planning Commission on June 17, 2003.
