CALL TO ORDER
Chairman Eddings called the meeting to order at 7:00 p.m. and Commissioner Blaser led
the Pledge of Allegiance.

PUBLIC COMMENT
Bill Bright, 11875 Santa Lucia Rd., asked what projected population build out numbers
would be under the three proposed General Plan Alternatives.
Caroline Peters, Carizzo Road, representing the North Atascadero Residents' Alliance for
No Change, stated that she was at the meeting to show her interest and concern regarding
the General Plan Update.
Acting Community and Economic Development Director, Warren Frace addressed the
questions raised. There will be a population build out number assigned to each of the
alternatives at the next level of review. Currently staff is refining the alternatives and is
aware of the issues raised by specific neighborhoods within the community. A mass
mailing for the entire city will be done once refinements on the alternatives are complete.

PUBLIC HEARINGS
2. PROJECT DESCRIPTION: TENTATIVE PARCEL MAP 2000-0009: 9092
LA CANADA ROAD: A residential subdivision of two existing lots totaling
17.5± acres into three parcels, 5.7± acres, 6.4± acres, and 5.3± acres in size. The
project site is steep and heavily wooded with native oak trees, with property
frontage on Del Rio Road. There are two PG&E easements and a blue line creek
along the Del Rio Road property frontage, therefore, future development will be
restricted to the flatter areas on the ridgeline with proposed access from La
Canada Drive over an easement from adjacent properties. Native tree removals
and site grading/disturbance will be required to construct the access road and the
future homes. The site has a General Plan designation of Suburban Single Family
and is zoned Residential Suburban with a minimum lot size of 5.04 acres based on
the performance standards calculation. General Plan Designation: Suburban
Single Family; Zoning District: Residential Suburban (RS). Site Address: 9092 La
Canada Road, Atascadero, CA 93422, APN 050-021-004, Applicant: James
Dulitz.
PROPOSED ENVIRONMENTAL DETERMINATION: PROPOSED
MITIGATED NEGATIVE DECLARATION 2000-0047: The Initial Study has
determined that the proposed project will not have a significant adverse impact on
the environment when mitigation measures are incorporated into the project. A
proposed Mitigated Negative Declaration of environmental impact has been
prepared for the project in conformance with the California Environmental
Quality Act (CEQA). The Proposed Mitigated Negative Declaration is available
for public review through April 17, 2001 at 6500 Palma Avenue, Community

Development Department, Room 104, from 8:00 a.m. to 5:00 p.m., Monday
through Friday.
Staff Recommends:
The Planning Commission adopt Resolution No. PC 2001-018, certifying the
proposed Mitigated Negative Declaration 2000-047 and approving Tentative
Parcel Map 2000-0009, a request to subdivide two existing lots totaling 17.5+
acres into three parcels, 5.74 5.34 and 6.4+ acres each, based on findings and
subject to conditions.
Associate Planner, Jamie Kirk provided the staff report and answered questions of the
Commission.
Commissioner Blaser inquired of the number of trees to be removed if the driveway goes
to 16 feet. Ms. Kirk stated that she was unsure of the number of trees, however, this was
why the condition incorporating retaining walls was included.
PUBLIC HEARING
Jim Dulitz, 1300 Garcia Road, applicant, addressed the Commission and gave a
background report on the site. Regarding the conditions for the project, Mr. Dulitz had
several concerns:
1. Condition No. 9, tree protection plan: The applicant stated that he has sent a map
to the Commission showing the inventory of existing trees on the property. He
feels that this inventory along with the existing tree ordinance for the City of
Atascadero should be adequate to meet this condition.
2. Condition No. 14, retaining walls along existing drivewaX: Mr. Dulitz feels that
the retaining walls required are excessive and his proposal is adequate.
3. Sealing of La Canada Road: In 1993 the applicant paid into an assessment
district, which included La Canada, and he feels that maintenance of this street is
the City's responsibility.
Mr. Dulitz answered questions of the Commission.
Chairman Eddings asked the City Engineer to discuss the 1993 assessment district issue
raised by the applicant. Mr. Kahn stated that in 1993, the homeowners came together and
created an assessment district on all of the roads in this area with a one-time maintenance
fix of the roads. The City then agreed to accept those roads for maintenance. Because
the road is slipping due to incorrect fill, the City Engineer has recommended the crack
sealing measure.
Danny Horn, 566 Spring Street, is the licensed land surveyor who prepared the tentative
map. Regarding the spray paint on the trees, this is a field operation tool they utilize to
ensure that trees are not counted twice.

Ron Kiel, 9090 La Canada, made the following comments to the Commission:
1. Feels the driveway should be accepted as designed.
2. The requirement for retaining walls on both sides of the entire length of the
driveway would be costly and unsightly.
3. The condition requiring the applicant to upgrade La Canada should be eliminated.
4. The tree inventory submitted by the applicant should be adequate.
Joan O'Keefe, 9985 Old Morro Road East, read from a prepared statement outlining her
concerns about this project. (Attachment 1)
Chairman Eddings closed Public Comment.
Commissioner Norton inquired of staff what the "less damaging aspects" on this project
might be. Ms. Kirk stated that when she was on the site evaluating the location of the
driveway, she felt she had identified a better location for an access driveway that would
follow the existing contour. However, upon contacting the applicant's representative, she
learned that this option was not acceptable.
Chairman Eddings inquired about Condition No. 20, and asked if the 16 -foot wide road
meets Uniform Fire Code provisions, and if there is flexibility in this requirement.
Acting Fire Chief, Kurt Stone stated that the 16 -foot width was recommended because of
the length of the continuous slope.
Commissioner Norton asked why retaining walls were required on both sides of the
driveway. Ms. Kirk responded that the purpose of this requirement was to keep the
height of the cut slopes in the location in which they evaluated them. The maximum
height of the retaining wall would depend on the height of the cut slope.
Chairman Eddings expressed concern regarding the visual impact of 734 feet of masonry
wall on both sides of the driveway.
Commissioner Fonzi agreed with Chairman Eddings and stated that she would prefer to
see landscaping, jute netting, etc. rather than retaining wall.
Chairman Eddings stated that he could approve the project with the removal of Condition
23 (road sealing), and with the added condition that the applicant work with staff to
improve the driveway and minimize tree loss by working with an arborist. Additionally,
he would like to delete the requirement for masonry retaining walls and add instead a
combination of slightly steeper slopes, covered with jute netting or landscaping and
perhaps wooden retaining walls.
Commissioner Norton agreed with Chairman Eddings with the addition of a tree
conservation easement.

MOTION: By Commissioner Fonzi and seconded by Chairman Eddings to adopt
Resolution No. PC 2001-018, certifying the proposed Mitigated Negative

Associate Planner Kirk requested clarification on the Tree Conservation Easement and if
it was to cover all tree mitigation fees for development on the lots including future single-
family residences.
The Motion was amended by Commissioner Fonzi so that the Tree Conservation
Easement would cover the driveway only and that subsequent construction would
be covered under the regular regulations.
By Commissioner Fonzi and seconded by Chairman Eddings to adopt
Resolution No. PC 2001-018, certifying the proposed Mitigated Negative
Declaration 2000-047 and approving Tentative Parcel Map 2000-0009, a

3. PROJECT DESCRIPTION: CONDITIONAL USE PERMIT 2001-0030
/TREE REMOVAL PERMIT 200-0013: 7855 DEL RIO ROAD
The project consists of the replacement and upgrade of an existing water pump
facility for the Atascadero Mutual Water Company. The new booster pump
station will be within an enclosed building with neighborhood compatible
architectural features, approximately 18 feet wide and 40 feet long. Site
construction will require the removal of two mature native oak trees. The pump
station will improve water service to existing residential neighborhoods and
reduce exterior noise levels. General Plan Designation: Suburban Single Family;
Zoning District: Residential Suburban (RS). Site Address: 7855 Del Rio Road,
Atascadero, CA 93422, APN 050-031-034, Applicant: Atascadero Mutual Water
Company.

as attached.
Assistant Planner Phil Dunsmore provided the staff report and answered questions of the
Commission.
PUBLIC COMMENT
John Neil, Atascadero Mutual Water Company, gave a history of the site and its purpose.
He stated that the existing station does not meet current demands and that the proposal
presented was selected unanimously by area residents. This location is critical for proper
inlet and outlet pressure.
Carol McCulley, 9850 San Marcos Road, expressed concerns regarding the constant
water release from the existing pump station and questioned whether the pumps at the
new station will function similarly.
City Engineer, Steve Kahn stated that an underground storm drain would be constructed
under San Gabriel Road.
John Neil addressed the issue of discharges from the existing pump station. The new
location will have discharges but they should be piped beneath Del Rio Road into a blue
line stream. Mechanical seals will be placed on the pump so that the release of water
will be reduced to a trickle.
Tom Sogen, 7855 Del Rio Road, stated that though he is happy to see this project going
in, he is concerned about water release and the condition of the ground in the area.
Chairman Eddings closed Public Comment.

Planning Commission Resolution Number 2001-0017 thereby adopting
the proposed Mitigated Negative Declaration and approving Conditional
Use Permit 2001-0030 subject to the findings, exhibits and conditions as

4. PROJECT DESCRIPTION: TENTATIVE TRACT MAP 2000-0001; ROAD
ABANDONMENT 2001-0003: SAN GABRIEL ROAD / PORTAL ROAD /
ESCONDIDO ROAD AREA: A residential subdivision of 10 existing colony
lots totaling 69.3± acres into 17 lots and a road abandonment application
requesting the abandonment of a portion of the Portal Road colony right-of-way
and a realignment and improvement of the Escondido Road colony right-of-way.
The project will involve the construction of 16 new homes with 6 new homes
accessing from Portal Road, 5 homes accessing off of Escondido Road, 5 homes
accessing from an existing driveway on San Gabriel Road and one home with
direct access onto San Gabriel Road. The project will include the improvement of
Escondido Road connecting it to San Gabriel Road. The extension of Escondido
Road will require the crossing of a blue line creek. The public improvements
required for the project will require the removal of native trees. Two open space
easements are proposed as part of the project totaling 13± acres and a pedestrian
easement is proposed to provide a public pedestrian connection between the
terminus of Portal Road and the extension of Escondido Road. General Plan
Designation: Suburban Single Family; Zoning District: Agriculture; Site Address:
6250 San Gabriel Road, CA 93422, San Luis Obispo County, APN 054-192-004,
054-192-005, 054-191-025, 054-192-017, 054-192-018, 054-191-026, 054-191-
027, 054-191-020, 054-191-021: Applicant: Rancho De Paraiso (Harry B.
Larsen Family Trust).

the City Council certify the proposed Mitigated Negative Declaration 2001-
0006; and,
2. The Planning Commission adopt Resolution No. PC 2001-014, recommending
the City Council approve Road Abandonment 2001-0003, a request to
abandon a portion of the Portal Road colony right-of-way and the
realignment of the existing Escondido Road colony right-of-way, based on the
appropriate findings and subject to the Conditions of Approval; and,
3. The Planning Commission adopt Resolution No. PC 2001-015, recommending
the City Council approve Tentative Tract Map 2000-0001, a request to
subdivide 69.39 acres into 17 lots, based on the appropriate findings and
subject to the Conditions of Approval.
Associate Planner, Jamie Kirk provided the staff report and answered questions of the
Commission. City Engineer, Steve Kahn discussed the public improvements.
PUBLIC COMMENT
Ken Wilson, Wilson Land Surveys, applicant's representative, gave a history of the
project and discussed the benefits from the project to the City of Atascadero. Mr. Wilson
expressed concern regarding the improvement conditions, which he feels could cost the
applicant from $800,000 to $1,000,000. There is some duplication of conditions in the
staff report and they would like to see some of these removed including:
1. Conditions 58 and 32, improvement of the roads: The applicant is willing to
improve to City standards the area in front of the property including Portal and
Escondido, and the building of a new road from San Gabriel up to Escondido.
The applicant feels that improvements past their property line are excessive and
should be the City's responsibility. (City Engineer Kahn stated that he would be
in favor of removing Condition 32, but not 58.)
2. Fire Road and Public Pedestrian Easement: This would be detrimental to the
subdivision and not necessary.
3. Existing driveway: Can eliminate half of the tree removals with a 16 foot wide
paved road with two -foot shoulders.
4. Fish and Game approval on culvert: Requests staff to state that Fish and Game
will be contacted as well as the Army Corps of Engineers, and once these
agencies have given their approval, this would be all the requirements necessary
to determine the type of crossing for the culvert.
5. Water Company Condition: Deferred to Russ Thompson for discussion.
6. Tree Conservation Easement: The Tree Conservation Easement and Tree
Mitigation Requirements were surprising; the applicant does not feel both are
necessary. They would be agreeable to the Tree Conservation Easement alone.
Russ Thompson, RTC, spoke on the benefits and improvements from this project to the
water system including increasing fire flow and provide a link between the San Marcos

Road area and the San Gabriel area interconnecting these two portions of the Water
Company's water system creating a dramatic increase in pressure in both areas.
However, Condition 80 prevents the possibility of looping the water system through this
route and they would prefer to add the wording "or as approved by Atascadero Mutual
Water Company."
Michael Sherer, Real Estate Broker representing the Larsen Family in the sale of the
parcels, stated his concerns as follows:
1. Fire emergency access: All new homes will have fire sprinkler systems which
alleviates the necessity for a second emergency access. A great concern with the
fire access road is that it is incorporated into a pedestrian access and any gates
installed cannot be locked. This road cuts directly through the middle of four or
five of the parcels and the applicant is concerned with liability issues.
2. The road was originally a based road but now is a 20 foot wide paved road and
the applicant is concerned with neighborhood reaction.
3. Tree Conservation and Mitigation: The applicant is willing to set aside 13 acres
of open space, which they considered would suffice for mitigation.
4. Would like to do soil tests to see if the slope can be increased, allowing the road
size to decrease to 16 feet, and thus protecting the trees.
5. The Conditions limit the maximum amount of grading to eight feet; applicant
would like this increased to at least 12 feet.
6. Culvert crossing: Expenditure to build bridge could be excessive.
John Neil, Atascadero Mutual Water, stated for clarification that on the existing water
main in Escondido Road, there are two, two-inch pressure reducing valves serving that
line. The Water Company is amenable to allowing some flexibility in the condition
regarding the overland routing.
Daphne Fossi, 5105 Llano Road, inquired as to the number of trips per day on Santa
Lucia. Ms. Kirk stated that staff does not have current build out information, however,
the addition of this project will bring a net increase of 70 trips per day. Ms. Fossi would
also like to see the driveway requirement reduced to 16 feet to save trees.
Joan O'Keefe, 9985 Old Morro Road East, expressed concern with tree protection and
the issue of the culvert. She agrees with the staff on their recommendations for approval.
Ethan Hanson, San Gabriel Road, lives across from the project and stated his concern
with the deterioration of San Gabriel Road.
Chairman Eddings closed Public Comment.
Commissioner Fonzi asked for an estimate on the cost to improve the road (Condition
58). City Engineer, Steve Kahn stated that there is slipping at the side of the road, but he
is uncertain of the cost to repair this. A soil report is needed first to determine the cause
of the slippage.

Commissioner Norton expressed concern about crossing the blue line creek. Ms. Kirk
stated that under Condition 10, the applicant has the option of a bridge crossing or a
culvert with headwalls. A culvert alone would require a significant amount of fill and
staff does not support this approach.
Commissioner Norton inquired if it would be acceptable to have turnouts periodically and
a 16 -foot wide road along the existing driveway. Acting Fire Chief, Kurt Stone stated
that he would be open to look at this possibility.
Commissioner Blaser asked if it would be possible for the applicant to agree to pay into a
bond for repair of Escondido. City Engineer, Steve Kahn indicated that this could be a
possibility, but he would need to have a better idea as to the scope of work involved.
Chairman Eddings felt the fire easement needed further discussion. Ms. Kirk stated that
staff is concerned with fire access given the location of the new houses at this site.
Chairman Eddings stated he was comfortable leaving the bridge crossing up to the
Department of Fish and Game and the Army Corps of Engineers.
Commissioner Fonzi asked for clarification on the applicant's conception that sprinklers
would eliminate the necessity for the additional fire access road. Acting Chief, Kurt
Stone stated that this was not correct and discussed how fire would spread in this area.
Commissioner Blaser inquired if it would be possible to restrict public pedestrian access
on the fire road. Ms. Kirk stated that the Commission has the discretion to remove the
pedestrian easement from the map.
Chairman Eddings led a discussion regarding the recommendations the Commission
would make on this project.
MOTION: By Chairman Eddings and seconded by Commissioner Fonzi to adopt
Resolution No. PC 2001-013, recommending the City Council certify the
proposed Mitigated Negative Declaration 2001-0006; and, the Planning
Commission adopt Resolution No. PC 2001-014, recommending the City
Council approve Road Abandonment 2001-0003, a request to abandon a
portion of the Portal Road colony right-of-way and the realignment of the
existing Escondido Road colony right-of-way, based on the appropriate
findings and subject to the Conditions of Approval; and, the Planning
Commission adopt Resolution No. PC 2001-015, recommending the City
Council approve Tentative Tract Map 2000-0001, a request to subdivide
69.39 acres into 17 lots, based on the appropriate findings and subject to
the Conditions of Approval with the following amendments to Resolution
2001-015:

1. Elimination of duplicated conditions specifically conditions 32 and
33.
2. The private accessway serving lots 2, 3, 4, 5, and 6 shall be
narrowed from 20 -feet to 16 -feet to minimize tree removals.
3. The 13+/- acres of Tree Conservation Easements shall satisfy the
monetary mitigation fees required for the tree removals. The 100
tree replacements are still required to be planted on the site.
4. Eliminate conditions 9 and 10.
5. The applicant and the City Engineer shall work together on a fair
financial agreement for the public improvement listed in conditions
57 — 72. The financial agreement and terms of the agreement shall
be presented to the City Council.

5. PROJECT DESCRIPTION: ZONE CHANGE 2001-0013, SAN GABRIEL
ROAD / PORTAL ROAD / ESCONDIDO ROAD AREA: The project consists
of a city initiated application for a zone change to change the zoning district of the
Rancho De Paraiso Tract Map area (69.4± acres) from Agriculture to Residential
Suburban. The zone change application will change the City's Zoning Map to
mirror the Suburban Single Family general plan designation shown on the Land
Use Element. The zone change will not have an affect of the future use of the
property and will fulfill Section E.2 (Implementation) of the city's General Plan.

PROPOSED ENVIRONMENTAL DETERMINATION: PROPOSED
MITIGATED NEGATIVE DECLARATION 2001-0006: The Initial Study has
determined that the proposed project will not have a significant adverse impact on
the environment when mitigation measures are incorporated into the project. A
proposed Mitigated Negative Declaration of environmental impact has been
prepared for the project in conformance with the California Environmental

Quality Act (CEQA). The Proposed Mitigated Negative Declaration is available
for public review through April 17, 2001 at 6500 Palma Avenue, Community
Development Department, Room 104, from 8:00 a.m. to 5:00 p.m., Monday
through Friday.
Staff Recommends:
The Planning Commission adopt Resolution No. PC 2001-016, recommending
that the City Council introduce an ordinance for first reading to approve Zone
Change 2001-0013 changing the zoning district within the Rancho De Paraiso
Tract Map from the Agriculture zoning district to the Residential Suburban
zoning district.
Associate Planner Jamie Kirk provided the staff report and answered questions of the
Commission.
PUBLIC COMMENT
None
MOTION: By Commissioner Fonzi and seconded by Commissioner Norton to adopt
Resolution No. PC 2001-016, recommending that the City Council
introduce an ordinance for first reading to approve Zone Change 2001-
0013 changing the zoning district within the Rancho De Paraiso Tract
Map from the Agriculture zoning district to the Residential Suburban
zoning district.

Commissioner Fonzi urged all in attendance to come to the downtown Spring Clean-up
on Saturday, from 9:00 a.m. to 12:00 p.m.
Commissioner Norton inquired if more information was available on the 2x units.
Interim Community and Economic Development Director, Warren Frace stated that staff
is looking at this issue as part of the process of refining the alternatives, and when those
refined alternatives are released there will be a detailed section addressing 2x units. No
date has yet been established for the future open house meeting.
Chairman Eddings stated that he appreciates the staff's hard work on the issues presented
tonight and the Fire Department's attendance at tonight's meeting.
ADJOURNMENT
Chairman Eddings adjourned the meeting at 9:55 p.m. to the next regularly scheduled
meeting on Tuesday, May 1, 2001.
