CALL TO ORDER Chairman Carden called the meeting to order at 7:02 p.m. Commissioner Jeanes led the Pledge of Allegiance. ROLL CALL Present: Commissioners Carden, Eddings, Bentz, Fonzi, Jeanes, Kelley and Norton. Absent: None Staff: Community & Economic Development Director Paul Saldana, Assistant Planner Jamie Heltsley, Assistant Planner Phil Dunsmore, and Recording Secretary Grace Pucci. PUBLIC COMMENT None CONSENT CALENDAR 1. Approval of minutes of the regular Planning Commission meeting of August 1, 2000. 2. Acceptance of Final Parcel May for LLA 99014/ATAL 99-2814660 Hidalgo Avenue (WilsonLand Surveys/McCain. MOTION: By Commissioner Bentz and seconded by Commissioner Fonzi to approve the Consent Calendar. NOES: None ABSTAIN: Commissioner Kelley abstained on Item 1 Motion passed 6:0 by a roll -call vote with Commissioner Kelly abstaining on Item 1. PUBLIC HEARINGS 3. TENTATIVE PARCEL MAP #2000-0004 The proposed project consists of a parcel map to subdivide one existing 1.29 acre residential parcel into two parcels of 0.74 and 0.55 acres each. The subdivision will result in the creation of one new entitlement allowing the potential addition of one new single-family residence. The project is proposed on a 1.29 acre site at 7900 Santa Ynez Avenue with a General Plan Designation of HDSF (High Density Single Family) and a Zoning District of RSF-X (Residential Single Family 0.5 acre minimum net lot size) (APN 031-181-006). PROPOSED ENVIRONMENTAL DETERMINATION: Negative Declaration: The Initial Study has determined that the proposed project will not have a significant adverse impact on the environment. A proposed Negative Declaration of environmental impact has therefore been prepared for the project in conformance with the California Environmental Quality Act (CEQA). Staff Recommends: Adopt Planning Commission Resolution 2000-046 certifying the proposed Negative Declaration 2000-0026 and approving Tentative Parcel Map 2000- 0004. Assistant Planner Phil Dunsmore provided the staff report and answered questions of the Commission. Commissioner Fonzi questioned the location of the lot line if the driveway were to be widened and how it would impact an existing adjacent house. Assistant Planner Dunsmore stated that the driveway would be widened and the increased right of way would be to the left side on a vacant piece of land. This would require that an old elm tree on the property be removed. Commissioner Kelley inquired if the driveway would be left as is if the Commission approved the Tentative Parcel Map. Mr. Dunsmore indicated that the Planning Commission does have that option. City of Atascadero Planning Commission Minutes Regular Meeting August 15, 2000 Page 5 of 5 Commissioner Bentz, in reference to the Staff Report, page 15 under Subdivision Design, regarding the "flag" lot at the rear of the site, inquired whether the requirement is for a driveway 24 feet wide or 20 feet wide. Mr. Dunsmore responded that the access way should be 24 feet wide and the driveway should be 20 feet wide unless otherwise approved by the Commission. PUBLIC COMMENT LaVae Peysar, 7900 San Dimas, Atascadero, (resident at the rear of the property) requested that the driveway be kept as it currently is for two reasons: 1) To prevent removal of the elm tree, and 2) To allow the resident at the rear of the property to landscape their entryway and keep that property private as it currently is. The well on the property is not being used at this time and could be capped. Chairman Carden closed the public comment period. Commissioner Kelley would like to keep the driveway intact to preserve the elm tree and the future use of the water well if it is required. The driveway appears to be working well and does not need to be made larger. Commissioner Kelley proposed that the conditions be amended to remove the condition under the Planning Section, number 4 removing the requirement for the 20 foot wide paved driveway. Assistant Planner Dunsmore stated that staff would concur with this amendment but suggests they retain the 24 -foot width easement requirement, while not requiring the driveway improvements. Commissioner Kelley agreed. Commissioner Bentz inquired whether this amendment would have an impact on the fire department's ability to service the residential units at that address. Mr. Dunsmore responded that there is sufficient room at the end of the driveway for turnarounds as the driveway is currently constructed to residential driveway standards (12 foot wide, paved, flat, good visibility) and there were no comments from the fire department on the subdivision. Commissioner Kelley reminded the Commission of the lot split on Lomitas where the width of the city road was retained at 18 feet. Commissioner Fonzi questioned whether the applicant would sell both pieces of two lots if this is approved as one piece. Mr. Dunsmore indicated that engineering conditions (applicant installing all new utilities, etc.) will stay with the property, they are conditions that are standard with all subdivisions. The applicant would have to sell the property as one piece with the conditions as they are until the final parcel map is filed at which time it can be sold as two separate lots. City of Atascadero Planning Commission Minutes Regular Meeting August 15, 2000 Page 5 of 5 Commissioner Fonzi requested a correction to number 8 under Engineering (page 24) changing Cascabel Road to Santa Ynez. MOTION: By Commissioner Kelley and seconded by Commissioners Fonzi to adopt Planning Commission Resolution 2000-046 thereby adopting Negative Declaration 2000-0026 and approving Tentative Parcel Map 2000-0004 based on findings and subject to conditions: 4. (Planning Conditions) Prior to the final map the driveway serving Parcel 1 at rear of lot shall be improved to meei subdivision e anee standards (twen4y feet wide paved drivel such that the flag lot portion of the driveway be 24 feet wide and the paved section remain as is. 8. (Engineering Conditions) A six-foot Public Utility Easement (PUE) shall be provided contiguous to the r-v„seabe' n ,a Santa Ynez Road property frontage. AYES: Commissioners Kelley, Fonzi, Norton, Bentz, Jeanes, Eddings and Chairman Carden. NOES: None ABSTAIN: None Motion passed 7:0 by a roll -call vote. COMMUNITY DEVELOPMENT STAFF REPORTS Director Saldana reported on the Community Workshop for the General Plan, which was held on August 10th. The information obtained from that workshop (input from the community) is posted on the new General Plan Website future. ataseadero. org. There is a report section where all the information that has been gained from the neighborhood meetings and community workshop is listed. Approximately 120 people participated in last week's workshop. Chairman Carden inquired if it is still necessary for Home Depot to make additional filings to the Commission. When the project was approved all that was required was the administrative use permit for the signs. The Commission will be receiving phase II of the overall development project in the first meeting of September. Commissioner Kelley asked when the Commission would begin addressing zone changes for the General Plan. Director Saldana stated that the next step would be to take the information received by the community and put together a variety of alternatives. There would then be a meeting with the Planning Commission, the City Council and the public on those alternatives. Then they will go through the environmental review process which will take three to four months to complete, after which there will be a series of public hearings on those alternatives. Commissioner Kelley inquired about the progress of the Main Street Program. Director Saldana stated that the Carlton Permit was to be issued on August 16th and ground will be broken on the 28th of August. Other than that, formation meetings will be held for the Main Street Organization during September. COMMISSIONER COMMENTS & REPORTS Chairman Carden congratulated Commissioner Bentz on his run for City Council.
