City of Atascadero 6500 Palma Avenue — 4t" Floor — Atascadero, CA CALL TO ORDER Chairman Carden called the meeting to order at 7:00 p.m. and Commissioner Fonzi led the Pledge of Allegiance. ROLL CALL Present: Chairman Carden, Commissioners Bentz, Clark, Eddings, Fonzi, and Kelley Absent: Commissioner Jeanes Others Present: None Staff Present: Community Development Director Paul Saldaiia, Principal Planner Warren Frace, Assistant Planner Jamie Heltsley, Assistant Planner Phil Dunsmore, Recording Secretary Pat Hicks PUBLIC COMMENT None CONSENT CALENDAR 1. Approval of minutes of the regular Planning Commissioner meeting of March 7, 2000. 2. Approval of minutes of the regular Planning Commission meeting of March 21, 2000. 3. Approval of minutes of special Planning Commission/City Council meeting of February 29, 2000. 4. Consideration of a one-year time extension for approved Tentative Tract M040400.d- 06117114 City of Atascadero Planning Commission Minutes Regular Meeting April 4, 2000 Page 2 of 9 Map #21-89 Staff Recommends: Adopt Resolution PC 2000-023 thereby approving a one-year extension of TTM #21089 in compliance with Section 9-2.118 of the Zoning Ordinance and Section 11-4.23 (a) of the Subdivision Ordinance extending the entitlement to April 9, 2001. MOTION: By Commissioner Bentz and seconded by Commissioner Eddings to approve the Consent Calendar. AYES: Chairman Carden, Commissioners Bentz, Clark, Eddings, Fonzi, and Kelley NOES: None ABSTAIN: Commissioners Bentz and Fonzi abstained from Item #1. Motion passed 6: 0 by a roll -call vote. PUBLIC HEARINGS 5. Continuance: Zoning Change 99007 and Tentative Parcel Map 99010 This item was continued from the March 21, 2000, Planning Commission Hearing and consists of a proposed rezone to Planned Development Overlay Zone PD -7 and 4 -lot Tentative Parcel Map to permit the construction of 4 detached, single family homes of 1450 ± square feet with an affordable housing density bonus to allow two bedrooms. The project is located at the northwest corner of Robles Avenue and Sombrilla Avenue on a vacant lot within an established neighborhood of single family and multi -family housing. The General Plan Designation is Low Density Multi -family (LDMF) and the Zoning District is RMF -10. The project is consistent with the maximum density permitted by the General Plan. The Planning Commission may recommend other development standards or regulations consistent with the purpose and intent of the General Plan or applicable City policy. PROPOSED ENVIRONMENTAL DETERMINATION: PROPOSED NEGATIVE DECLARATION: Based on the initial study prepared for the proposed project, a Negative Declaration is proposed for the project. The Community Development Department has determined that not significant environmental impact would result from the approval of this project. Staff Recommends: 1. Adopt Resolution PC 2000-018 recommending that the City Council certify the proposed Negative Declaration; and, City of Atascadero Planning Commission Minutes Regular Meeting April 4, 2000 Page 3 of 9 2. Adopt Resolution PC 2000-019 recommending that the City Council introduce an ordinance for first reading to approve Zone Change 99007; and, 3. Adopt Resolution PC 2000-020, recommending that the City Council approve the Master Plan of Development (CUP 99022) subject to Conditions of Approval; and, 4. Adopt Resolution PC 2000-021, recommending the City Council approve Tentative Parcel Map 99010 subject to Conditions of Approval. Principal Planner Warren Frace gave the staff report and answered questions of the Commission. Vice Chairman Clark asked for clarification on the selling price of the units. Commissioner Bentz stated that one page 24 "1 bedroom" should be "2 bedrooms." Commissioner Fonzi asked for an explanation on how the rent price will be regulated. Commissioner Kelley asked if the regulation runs with the property and where the 15 - year requirement came from. Mr. Frace replied that the City Attorney determined the number of years based on past experience. PUBLIC COMMENT There was no Public Comment. Chairman Carden closed the Public Comment period. MOTION: By Commissioner Fonzi and seconded by Commissioner Eddings to Adopt Resolution PC 2000-018 recommending that the City Council certify the proposed Negative Declaration; and, Adopt Resolution PC 2000-019 recommending that the City Council introduce an ordinance for first reading to approve Zone Change99007; and, Adopt Resolution PC 2000-020, recommending that the City Council approve the Master Plan of Development (CUP99022) subject to Conditions of Approval; and, Adopt Resolution PC 2000-021, recommending the City Council approve Tentative Parcel Map 99010 subject to Conditions of Approval, and amending condition #4 to require the deed restriction for a period of 15 -years." Reconsideration of Conditional Use Permit 99002: Central Coast Auto, 6000 San Palo (Gary Gramspacher) The applicant has requested reconsideration of Conditional Use Permit 99002 to allow the addition of a 14,000 square foot auto sales lot area north of the approved auto sales lot. The new project area, which includes the 14,000 square foot sales lot, lighting and drainage, is already developed on a .5 acre site with a General Plan designation of Tourist Commercial and a Zoning District of Commercial Tourist (CT) (APN 049-222-046). The original Use Permit was approved by the City Council on May 25, 1999. PROPOSED ENVIRONMENTAL DETERMINATION: CATEGORICAL EXEMPTION CLASS 3: Section (15303): construction of new small facilities or structures, not involving the use of significant amounts of hazardous substances, desi _ng, ed for an occupant load of 20 persons or fewer. Staff Recommends: Adopt Resolution PC 2000-025 thereby adopting the proposed Class 3 Categorical Exemption and approving the amendment of CUP 99002 subject to the finding, exhibits, and conditions. Assistant Planner Phil Dunsmore provided the staff report. Commissioner Fonzi asked how it became a sales lot with out having a permit. Mr. Dunsmore responded that it was done without staff's knowledge. PUBLIC COMMENT There was no Public Comment. Chairman Carden closed the Public Comment period. Vice Chairman Clark stated that is was very disconcerting that improvements were done without a permit while other applicants have to wait for approval. Mr. Dunsmore responded that the drainage was done without a permit. He clarified that the purpose of a hearing is to make sure drainage is adequate and landscape is provided. Mr. Frace explained that when staff became aware of the situation they began working with the applicant to bring the project to conformance. City of Atascadero Planning Commission Minutes Regular Meeting April 4, 2000 Page 5 of 9 Commissioner Fonzi and Vice Chairman Clark agreed that it would be granting special privilege to approve this request after the fact. Chairman Carden and Commissioner Eddings commented that the project was not a big project and it fits in with the Zoning for that particular land use. Commissioner Bentz stated that the applicant would have sixty (60) days to come into conformance if the request is granted. MOTION: By Commissioner Eddings and seconded by Commissioner Bentz to adopt AYES: Chairman Carden, Commissioners Bentz Eddings, and Kelley NOES: Vice Chairman Clark and Commissioner Fonzi ABSTAIN: None Motion passed 4:2 by a roll -call vote. 7. Reconsideration of Conditional Use Permit 99014: Mid Town Mini Storage, 9200 El Camino Real The applicant, Duane DeBlauw, (411 El Camino Real, Arroyo Grande, CA 93420) has requested reconsideration of Conditional Use Permit 99014 to allow the mini -storage warehouse use to be expanded from 27,000 ± to 41, 500 ± square feet by adding a second story unit. The office and caretakers' residences are proposed to the expanded from 1040± to 1550 ± square feet. The project will have two driveway access points on El Camino Real with automatic security gates. The project is proposed on a 1.28 ± site with a General Plan Designation of Service Commercial and a Zoning District of Commercial Service (APN 056-061-024, 025, 026). The original use permit was approved by the Planning Commission on November 2, 1999. ENVIRONMENTAL DETERMINATION: Mitigated Negative Declaration: A Mitigated Negative Declaration was certified for the original use permit. Staff has determined that the proposed project changes will not result in any new impacts that were not analyzed in the original Mitigated Negative Declaration. Staff Recommends: Adopt Resolution PC 2000-026 thereby finding the proposed project reconsideration consistent with the original Mitigated Negative Declaration approving the amendment of Conditional Use Permit 99014 subject to the findings, exhibits, and conditions as attached. Principal Planner Warren Frace provided the staff report. Commissioner Kelley expressed concern for the appearance of the building from the freeway. PUBLIC COMMENT Duane DeBlauw, applicant, explained project changes to the Commission. Commissioner Fonzi asked the applicant about the elevator changes. Mr. DeBlauw stated that the elevator is now on the side where it will be less visible. Chairman Carden closed the Public Comment period. MOTION: By Commissioner Kelley and seconded by Commissioner Eddings to Adopt Resolution PC 2000-026 thereby finding the proposed project reconsideration consistent with the original Mitigated Negative Declaration approving the amendment of Conditional Use Permit 99014 subject to the findings, exhibits, and conditions as attached. AYES: Chairman Carden, Commissioners Bentz, Clark, Eddings, Fonzi, and Kelley NOES: None ABSTAIN: None Motion passed 6:0 by a roll -call vote. 8. Conditional Use Permit 2000-0001: Frog Pond Mountain Winery, 13400 Old Morro Road The proposed project is a request to allow the production of wine for commercial purposes on a residential lot located at 13400 Old Morro Road. The project does not involve the on-site sale or tasting of wine. The project site has a General Plan Designation of SSF (Suburban Single Family) and a Zoning District of RS (Residential Suburban). The proposed use is a conditionally allowed use in the Residential Suburban Zone (APN 055-321-008, APN 055-331-013). PROPOSED ENVIRONMENTAL DETERMINATION: Categorical Exemption Class 1: The project is consistent with the Class 1 Categorical Exemption per section 15301 of the CEQA Guidelines. The Class 1 exemption pertains to the operation of existing structures and facilities involving negligible or not expansion of the existing use. City of Atascadero Planning Commission Minutes Regular Meeting April 4, 2000 Page 7 of 9 Staff Recommends: Adopt Resolution PC 2000-013 approving Conditional Use Permit #2000-001, conditionally allowing the production of wine for commercial purposes at 13400 Old Morro Road and find the project exempt from California Environmental Quality Act (CEQA) under the Class 1 Categorical Exemption for the operation of existing facilities that involves negligible or not expansion of the existing uses. Assistant Planner Jamie Heltsley gave the staff report. Vice Chairman Clark asked what type of waste would be in the water. Ms. Heltsley replied that waste would consist of water and organic compounds without chemicals. PUBLIC COMMENT Tim Woodle of Pults and Associates, applicant's representative, explained that water usage would have a minimal impact. George Palmer, applicant, explained that the winery has been a hobby for him in the past, and he has had no complaints. Rosemary Anderson, 13600 Old Morro Road expressed concern with the issue of water supply. Larry Hersh, 11800 Old Morro Road, stated that he is opposed to the project, and questioned the drainage of dregs. He also stated that the project is in conflict with the Zoning Ordinance and General Plan. Constance Sole, 13010 Old Morro Road, expressed concern with wear and tear on the public road. Peter Russell, 12200 Old Morro Road, stated that he was in favor of the project. Edward English, 13750 Old Morro Road, expressed opposition to the project and asked who will monitor maximum use of the area. Chairman Carden closed the Public Comment period Mr. Woodle responded by clarifying some of the public's issues. Commissioner Fonzi asked what water the project would use. Mr. Woodle replied that, primarily, City water would be used. Vice Chairman Clark asked what it done with the dregs. MOTION. • Vice Chairman Clark and seconded by Commissioner Eddings to Adopt Resolution PC 2000-013 approving Conditional Use Permit #2000-001, conditionally allowing the production of wine for commercial purposes at 13400 Old Morro Road and find the project exempt from California Environmental Quality Act (CEQA) under the Class 1 Categorical Exemption for the operation of existing facilities that involves negligible or not expansion of the existing uses. AYES: Chairman Carden, Commissioners Bentz, Clark, Eddings, Fonzi, and Kelley NOES: None ABSTAIN: None Motion passed 6:0 by a roll -call vote. COMMUNITY DEVELOPMENT STAFF REPORTS 9. Referral 2000-0001: San Luis Obispo County Office of Education School Site Acquisition Recommendation A request from the San Luis Obispo County office of Education for a Commission recommendation concerning the acquisition of a piece of property for the construction of a community school located at 10801 El Camino Real. The request has been made in accordance with section 21151.2 of the Public Resources Code requiring school districts to consult with a Planning Commission prior to the purchase of a school site. Staff Recommends: Adoption of Resolution PC 2000-024 thereby determining that the construction of a community school at 10801 El Camino Real is consistent with the City's General Plan. Assistant Planner Jamie Heltsley gave the staff report. PUBLIC COMMENT There was no Public Comment. Chairman Carden closed the Public Comment period. Commissioner Kelley stated that the proposed project is not the best use of the land, and suggested maybe zoning it as high-density, multi -family. MOTION: Commissioner Kelley and seconded by Commissioner Bentz to Adoption of Resolution PC 2000-024 thereby determining that the construction of a community school at 10801 El Camino Real is consistent with the City's General Plan, with the following amendments: 1) Amend draft ordinance to read: "Now, therefore, be it resolved that the Planning Commission finds as follows: The proposed project is consistent with the land use designation of the General Plan; however, the Planning Commission finds that a residential use would be a higher and better use of the site." 2) Amend Condition #2 to read: "...circulation and parking impacts of the proposed use should be evaluated." 3) Add Condition #4 to read: "No modular building to be added at this site." AYES: Chairman Carden, Commissioners Bentz, Clark, Eddings, Fonzi, and Kelley NOES: None ABSTAIN: None Motion passed 6:0 by a roll -call vote. Other Staff'Reports Community Development and Economic Director Paul Saldana talked about the Main Street Conference that Commissioner Jeanes is currently attending. Mr. Saldana announced that there will be a newsletter educating the public on the General Plan Update.
