CALL TO ORDER Chairman Carden called the meeting to order at 7:00 p.m. and led the Pledge of Allegiance. ROLL CALL PRESENT: Chairman Carden, Commissioner Eddings, Commissioner Jeanes, and Commissioner Kelley ABSENT: Vice -Chairman Clark, Commissioner Bentz, and Commissioner Fonzi STAFF: Paul Saldaiia, Director, Community and Economic Development; Warren Frace, Principal Planner; Phil Dunsmore, Assistant Planner; Jamie Heltsley, Assistant Planner; and Pat Hicks, Recording Secretary. PUBLIC COMMENT None CONSENT CALENDAR 1. Approval of minutes of the regular Planning Commission meeting of February 15, 2000. AYES: Chairman Carden, Commissioner Eddings, Commissioner Jeanes, and Commissioner Kelley NOES: None ABSTAIN: None MOTION: By Commissioner Eddings and seconded by Commissioner Kelley to approve the minutes of the regular Planning Commission meeting of February 15, 2000. M030700.do 06117114 City of Atascadero Planning Commission Minutes PUBLIC HEARINGS Regular Meeting March 7, 2000 Page 2 of 6 Chairman Carden announced that Item 4 would be continued to the meeting of April 4, 2000, due to a noticing problem. 2. Road Abandonment #2000-0002: summary vacation of a portion of the Coromar Avenue right-of-way, 7300 block Coromar Avenue (Kelly Gearhart The proposed project is a request to summarily vacate a portion of the Coromar Avenue right-of-way. The portion of the right-of-way proposed to be abandoned is unimproved and is classified as a local street in the City's Circulation Element. The project is consistent with California Streets and Highways Code Section 8331. The project site has a General Plan Designation of MDSF (Moderate Density Single Family) and a Zoning District of RSF-Y (Residential Single Family, minimum lot size 1 acre with sewer). The project is located between the 7300 block of Coromar Avenue and the 7000 block of Marchant Avenue (APN 031-081-016, APN 031-081-018). PROPOSED ENVIRONMENTAL DETERMINATION: GENERAL RULE EXEMPTION: The project is consistent with the General Rule Exemption per section 15061.c of the CEQA Guidelines. The General Rule Exemption applies to projects that are subject to CEQA, but it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. Staff Recommends: Adopt Resolution PC 2000-014 thereby recommending that the City Council summarily vacate a portion of Coromar Avenue colony right-of- way as conditioned and subject to the appropriate findings Jamie Heltsley, Assistant Planner, gave the staff report. Motion passed 4: 0 by a roll -call vote. 3. Conditional Use Permit 2000-0005: Enterprise Rental Car Office, 8759 EI Camino Real (Dale Lane for Enterprise Rental Car) The proposed project consists of the establishment of a car rental business in an existing suite of a commercial shopping center located at 8759 El Camino Real (Ralph's Center). The operation will consist of a 763± square foot office with a fleet of 20-30 cars. All vehicle maintenance and cleaning will occur off-site at appropriate facilities. The project site has a General Plan designation of (RC) Retail Commercial and a Zoning District of CR (Commercial Retail) (APN 030- 513-011-016). The use is conditionally allowed in the CR District. PROPOSED ENVIRONMENTAL DETERMINATION: CATEGORICAL EXEMPTION CLASS 1: The project is consistent with the Class 1 Categorical Exemption per section 15301 of the CEQA Guidelines. The Class 1 exemption pertains to the use of existing structures and facilities involving negligible or no expansion of the existing use. Staff Recommends: Adoption of Planning Commission Resolution Number 2000- 016 thereby adopting the proposed Class I Categorical Exemption and approving Conditional Use Permit 2000-0005 subject to the findings, exhibits, and conditions. Warren Frace, Principal Planner, gave the staff report. There was no Public Comment. Motion passed 4: 0 by a roll -call vote. 4. Conditional Use Permit #2000-0001: Frog Pond Mountain Winery, 13400 Old Morro Road (George Palmer) The proposed project is a request to allow the cultivation of grapes and the production of wine for commercial purposes on two residential lots located at 13400 Old Morro Road. The project does not involve the on-site sale or tasting of wine. The project site has a General Plan Designation of SSF (Suburban Single Family) and a Zoning District of RS (Residential Suburban). The proposed use is a conditionally allowed use in the Residential Suburban Zone. (APN 055-321- 008, APN 055-331-013). PROPOSED ENVIRONMENTAL DETERMINATION: CATEGORICAL EXEMPTION CLASS 1: The project is consistent with the Class 1 Categorical Exemption per section 15301 of the CEQA Guidelines. The Class 1 exemption pertains to the operation of existing structures and facilities involving negligible or no expansion of the existing use. Staff Recommends: Adopt Planning Commission Resolution 2000-013 approving Conditional Use Permit 2000-0001, conditionally allow the cultivation of grapes and the production of wine for commercial purposes at 13400 Old Morro Road and find the project exempt from CEQA under the Class 1 Categorical Exemption. This item was continued to the April 4, 2000, meeting due to a notification problem. 5. Conditional Use Permit 2000-0002: Fence Factory Sales Facility, 2650 El Camino Real (Bennet Partnership) The proposed project consists of the establishment of a fence equipment sales use with an 20,000± S.F. outdoor storage lot and two 2,400± square foot storage buildings and one 2,000± square foot office building with road improvements at 2650 El Camino Real. The project also includes a request to allow a temporary outdoor storage area and office on the adjacent lot for use during construction of the project (2600 El Camino Real). The project has a General Plan designation of (CPK) Commercial Park and is zoned "CPK" (Commercial Park) (APN 049-201- 014 & 024). PROPOSED ENVIRONMENTAL DETERMINATION: NEGATIVE DECLARATION: The Initial Study has determined that the proposed project will not have a significant adverse impact on the environment. A proposed Negative City of Atascadero Planning Commission Minutes Regular Meeting March 7, 2000 Page 5 of 6 Declaration of environmental impact has therefore been prepared for the project in conformance with the California Environmental Quality Act (CEQA). Staff Recommends: Adopt Resolution No. PC 2000-015, thereby, adopting the Proposed Negative Declaration #2000-008; and, approving Conditional Use Permit #2000-0002, allowing the establishment of fencing equipment storage and sales at 2650 El Camino Real, subject to the findings, exhibits and conditions. Phil Dunsmore, Assistant Planner, provided the staff report and answered questions of the Commission. Chairman Carden questioned what triggered the need for a Conditional Use Permit. Mr. Dunsmore and Mr. Frace explained the area of outdoor storage triggers the requirement for the Use Permit. Commissioner Eddings requested an explanation on the drainage pattern. Mr. Dunsmore clarified the issue for him. Commissioner Kelley questioned the septic system located under the pavement. Mr. Dunsmore stated that it would be reviewed when the materials for the building permit are submitted. He explained that currently the laying of pavement has not been approved. There was no Public Comment. Commissioner Jeanes expressed concern for the yellow signs and awnings. Commissioner Kelley wanted the appearance of the building changed. He stated that he would like to see improvements done to the east side of "Building C" and the north and east side of "Building A". He suggested that the architectural design should be reviewed and upgraded by staff by referring to the Appearance Review Manual. Warren Frace, Principal Planner, replied that staff does look at the Manual, but they also look at the use and have encouraged landscaping. Chairman Carden stated that he would not like to see businesses scared away by requiring high architectural standards. Commissioner Eddings commented that when it comes to the Highway 101/El Camino Real area, he is more concerned about appearance than he would normally be. City of Atascadero Planning Commission Minutes Regular Meeting March 7, 2000 Page 6 of 6 AYES: Chairman Carden, Commissioner Eddings, Commissioner Jeanes, and Commissioner Kelley NOES: None ABSTAIN: None MOTION: By Commissioner Kelley and seconded by Commissioner Eddings to adopt Resolution No. PC 2000-015, thereby, adopting the Proposed Negative Declaration #2000-008; and, approving Conditional Use Permit #2000-0002, allowing the establishment of fencing equipment storage and sales at 2650 El Camino Real, subject to the findings, exhibits and conditions, along with an additional condition that the applicant work with staff to upgrade the appearance of the buildings consistent with the Appearance Review Manual. Motion passed 4: 0 by a roll -call vote. COMMUNITY DEVELOPMENT STAFF REPORTS Warren Frace, Principal Planner, thanked the Commission for participating in the joint session with the Council on SMART Growth Principals. Paul Saldana, Director, Community Economic & Development, stated that the Main Street Program is moving along and is on schedule. He announced that on March 22, 2000, at 6:30 p.m., there would be a townhall forum on the design scenarios. A presentation will be given by Cal Poly's third year planning class. This student project provides general plan recommendations and downtown design guidelines. The project received a national student planning award by the American Planning Association He encouraged the commissioners to plan on attending as many summer commission meetings as possible. COMMISSIONER COMMENTS & REPORTS ADJOURNMENT Chairman Carden adjourned the meeting at 7:55 p.m. to the next regular meeting of the Planning Commission on March 21, 2000.
