No.ACO239 y: SERVICE AGREEMENT S AUTOMATIC ALARMS, INC. 89763 P.O.Box 3636•San Luis Obispo,CA 93403•(805)543-3214•(800)499-6161 Al rm Co.OptContractorLicense 00239 Alarm Co.Opt.License ACO239 This AGREEMENT made this __ day of between AUTOMATIC ALARMS,INC., it assigns or successors(hereinafter called"COMPANY")and its assigns or successors(hereinafter called'SUBSCRIBER"). 1. The Company will furnish electric protective service to the Subscriber in connection with Subscriber's premises at by means of the electrical protective equipment(hereinafter referred to as'SYSTEM")specified in the Schedule of Installation and/or Schedule of Services. 2. Schedule of Installation: Installation shall start approximately and complete approximately shall constitute start of work. 3. Schedule of Services 4. TERM,PAYMENT,RENEWAL:Subscriber hereby agrees to pay Automatic Alarms,Inc.,its agents or assigns: (a) For installation,the sum of ($ ) Dollars,payable ($ )Dollars upon execution of this agreement and ($ )Dollars upon completion of installation or beneficial use,whichever occurs first. (b) For service,the sum of ($_ )Dollars per year,payable at the rate of ($ )Dollars per month,in advance of the first day of the month commencing with the month following completion of installation or beneficial use,for a period of from the date of completion of installation of the system.In addition,together with the first monthly payment,Subscriber shall pay the pro rata share of the monthly charge for the month in which beneficial use first occurred. (c) This agreement shall automatically be renewed for additional terms of months each at the same monthly service rate,subject to paragraph fourteen,unless either party notifies the other in writing,of its intention to terminate this agreement,no less than thirty(30)days prior to the expiration of the original term or any renewal terms thereof. (d) The shall be responsible for making payment of commercial communications carrier signal service charges to the commercial communica- tions carrier. 5. INSTALLATION OF SYSTEM:INTERRUPTION OF SERVICE:Subscriber authorizes Company,its agent or assigns,to install or cause to be installed the protective system set forth herein.Subscriber authorizes use of electrical outlets required and necessary current through this meter,at his expense.It is agreed that the Company is authorized to make any preparations such as drilling holes,making attachments or doing any other thing or things necessary or pertinent to the installation of the system.Company intends generally to conceal wiring in the finished areas of the premises;however,there may be areas in which,due to construction,decoration or furnishings of the premises,that it would be impractical to conceal the wiring;and in such cases the wiring will be exposed.Subscriber warrants that Subscriber has full authority and permission from the owner of said premises to permit the installation of the system.Any error or omission in the construction or installation of the system must be called to the attention of Company in writing,within ten (10) days after the completion of installation. Otherwise,the installation shall be deemed totally satisfactory to and accepted by Subscriber.Company assumes no liability for delays in installation of equipment or for interruption of service due to strikes,riots,floods, storms, earthquakes,fires,power failure,insurrection,interruption or unavailability of signal carrier service,acts of God,or for any other cause beyond the control of a-v.and will not be required to supply service to Subscriber while interruption of service due to any such cause may continue.Company will in such event attempt to give notice to Subscriber.Upon completion of the installations,Company shall thoroughly instruct Subscriber in the proper use of the system. 6. SERVICE; INSPECTION;COST OF REPAIRS:Subscriber authorizes and empowers Company to service the aforesaid system and to make necessary inspections, tests,and repairs to provide services specified in paragraph three above. Repairs to Company-owned equipment necessitated by ordinary wear and tear shall be at Company's expense.Repair and/or replacement of systems necessitated by causes beyond the control of Company shall be made at Subscriber's expense,and then only upon prior approval by Subscriber.Emergency service,when provided in paragraph three above is defined as that service is to be performed as soon as practical to restore the system to as near normal as possible with the parts and devices readily at hand.The Company shall not be obligated to replace the system or parts of system that are no longer current production models of the manufacturer.Company shall not be obligated to replace system or parts of system with improved or state-of- the-art models without adequate compensation.Subscriber acknowledges the Company's obligation hereunder relates solely to the service of the specified alarm system and that Company is in no way obligated to insure the operation of the system or to maintain or service Subscriber's property or the property of others to which Company's system is connected.Unless otherwise stated in paragraph three above,inspections,tests and repair visits to Subscriber's premises will be charged for on a time and material basis, 7. RECEIPT OF COPY:SUBSCRIBER ACKNOWLEDGES RECEIPT OF A COPY OF THIS AGREEMENT. 8.
