A G R E E M E N T
FOR JOINT USE OF FACILITIES
AGREEMENT entered into this 23rd day of February , by
and between Atascadero Unified School District and City of
Atascadero, hereinafter referred to as "School District" and
"City" .
W I T N E S S E T H
WHEREAS, Chapter 6 of Division 12 of the Education Code of
the State of California authorizes and empowers public school
districts and municipalities to cooperate with each other and to
that end enter into agreements with each other for the purpose of
organizing, promoting and conducting such programs for community
recreation and education objectives for children and adults of
the state; and
WHEREAS, the "School District" and "City" desire to
establish a basis for the cooperative use of their respective
recreational and educational facilities located in the community;
NOW, THEREFORE, "School District" and "City" hereby mutually
covenant and agree with each other as follows :
A. Principles
1 . The "School District" and "City" shall cooperatively
plan in the acquisition, development and maintenance of
certain school and recreational areas , facilities and
buildings to insure their maximum joint use for the benefits

of the residents of the City of Atascadero .
2 . This agreement covers general requirements needed to
effectively implement the overall cooperative program for
the "School District" and "City" . Agreements affecting the
joint acquisition, development, use and maintenance of
specific "School District" and "City" facilities may be
accomplished by an agreement executed for each such facility
and attached to this document as addenda. Each addendum
becomes a part of this agreement and is subject to the
general requirements specified here .
3. The administrators and delegated representatives of
both the "School District" and "City" shall confer
regularly in regard to the acquisition, development, use of
maintenance of joint—use facilities to insure maximum
community use and to avoid duplication.
4. A joint meeting of the "School District" and the
"City" representatives shall be held as necessary during the
term of this agreement to consider matters of mutual
concern.
5 . Details regarding usage of specific facilities shall
be outlined in a Letter of Understanding.
Utilizing guidelines established by this agreement , the
appropriate School District Administrator and the Parks and
Recreation Department Staff shall be responsible for
outlining specific responsibilities for the recreation staff
and. what is expected from the school district , and may

include any financial commitments for either agency.
B. Joint Planning
1 . The School District and the City shall advise the
other regarding its land acquisitions and major development
plans . The preliminary plans for all new recreational
facilities shall be presented to each staff for review
and suggestions. It is the policy of the cooperating
jurisdictions to acquire adjacent sites wherever
appropriate and possible .
2 . Each jurisdiction' s planning staff may perform minor
and short—term planning and design work for the other on an
actual cost basis when time permits.
3 . Public buildings and facilities for each
jurisdiction shall be designed to effectively serve the
specific purpose for which constructed. Where practical ,
they shall also be designed to meet community needs for both
leisure—time activities and school programs . Buildings and
grounds shall be designed to be compatible with the
surrounding environment and with a strong awareness for
efficiency of operation, maintenance and aesthetics .
4. The "City" and "School District" staff or architect
may consult on the initial site plan for areas that will be
included as addenda to this agreement in order to create an
efficient , integrated master site plan .
. 5 . The "City" shall work cooperatively with the

"School District" to acquire grants for development of
recreational facilities on or adjacent to district
property.
C. Joint Development
1 . Both the "School District" and the "City" may
agree to jointly develop facilities they deem beneficial to
both agencies . Projects recommended for joint development
during the next fiscal year should be presented to the
School Board and City Council for approval before
March 1st of the current fiscal year.
2 . The cost of developing such facilities jointly
approved by the agencies may be shared, as deemed
appropriate and fair to the agencies .
3 . Responsibility for preparing design, specifications,
and bid forms, for supervision of work, and for maintaining
the facility to be jointly developed shall be defined and
approved by the agencies before starting the development .
If the facility is built on school property, it has to
meet the State specifications established for school
districts .
4. Availability of new jointly developed facilities for
use shall be determined by the owner agency.
5 . Each, with the consent of the other agency, may make
such improvements as may be deemed necessary by them for
their program.

D. Joint Use
1 . The "School District" agrees to grant to the "City"
on application, the use of any facility or equipment owned
by the School District, which the "City" may require in
connection with its community learning and leisure program,
provided that the use of such facility or equipment for
community recreation purposes shall not interfere with its
use by the "School District" for that agency ' s stated
purposes, or constitute a violation of provisions of the
California Education Code or Government Code Sections .
2 . The "City" agrees to grant to the "School District"
on application, the use of any facility or equipment owned "
by the "City" which the "School District" may require in
connection with its program, providing such use of the
facility or equipment will not interfere with its use by the
"City" in connection with its stated purpose .
3 . The use of facilities and equipment pursuant to this
agreement shall be granted subject to existing rules and
regulations of the perspective owners pertaining to their
use .
All efforts shall be made to insure reasonable
conformity in such rules and regulations between respective
owners .
4. The Superintendent of Schools and the Parks and
Recreation Director shall delegate the responsibility for
establishing schedules for facility use to the Recreation

Division Staff , the Principals/Vice Principals of each
school , and the school district ' s Director of Maintenance &
Operations .
5 . The agency using facilities or equipment owned by
the other pursuant to this agreement shall furnish qualified
personnel deemed necessary by the respective owners for the
proper conduct and supervision of the activity.
6 . The party using facilities or equipment of the other
pursuant to this agreement will repair, or cause to be
repaired, or will reimburse the owner for the cost of
repairing damage done to said facilities or equipment
during the period of such use , other than that attributed to
ordinary and reasonable use . The Letters of Understanding
at each school site shall identify responsibilities for
replacement of items due to wear and tear on equipment and
facilities .
7 . The "City" will indemnify and hold harmless the
"School District" , and its officers, agents, servants, and
employees , from any and all claims , demands, actions, causes
of action, damages or liability for injury to or death of
persons , or for damage to property, resulting from or
arising out of any act or omission of the "City" or its
officers, agents , servants or employees of the use of
"School District" property or in the exercise of any other
right or privilege granted to the "City" by the "School
District" pursuant to this agreement . The "School

District" will indemnify and hold harmless the "City" and
its officers. agents, servants , and employees . from any and
all claims, demands, actions, causes of actions , damages or
liability for injury to or death of persons, or for damage
to property, resulting from or arising out of any act or
omission of the "School District" or its employees, agents,
servants, or employees in the use of "City" property or in
the exercise of any other right or privilege granted to the
"School District" by the "City" under or pursuant to this
agreement .
8 . Insurance shall be purchased and maintained by the
City of Atascadero and Atascadero Unified School District
for the term of this contract as follows :

A Certificate of insurance evidencing the required coverage with
a 30 day written cancellation notice to the other entity shall be
provided . Each entity shall name the other entity as additional j
insured. .

E. Cooperative Delivery of Programs
1 . When possible, the "School District" and "City"
shall work toward co-promotion of adult education programs
and City recreational activities . Responsible parties shall
be the Recreation Supervisor and the Adult School Principal .
2 . The "School District" shall endeavor to provide
space at each elementary school in Atascadero for the "City"
to conduct its After School Program.
3. The "City" will make available to the "School
District" zoo education programs . This could include a
teaching packet for district instructors , an in-school
program to be given by the Zoo Curator or designated
representative , and a slide presentation on zoo education .
4. The "City" may provide staff for "noon-time"
recreational activities at each elementary school and the
junior high school . Frequency and type of program shall be
determined by recreation staff and the appropriate school
principal .
5 . The "City" shall grant continued usage of Alvord
Field to Atascadero High School for its baseball programs .
Improvements needed specifically for the program shall be
the responsibility of the "School District" .
6 . An Atascadero High School student , to be designated
by the "School District" , shall be an ex-officio member of
the Parks and Recreation Commission. This will provide the
opportunity for direct communication with high school age

students concerning their needs for recreational activities
in the community.
7. The "School District" and "City" shall cooperatively
work to maximize the usage potential of school district
outdoor recreational facilities . Under guidelines
established by the "School District" the "City" will be
responsible for coordinating outdoor facility usage during
non-school hours at the elementary and junior high schools
in Atascadero.
S . All children in the Atascadero Unified School
District are eligible to participate in recreation
activities sponsored by the "City" .
F. Costs and Re-Imbursements
1 . The "City" and "School District" shall , when
possible , cooperatively purchase equipment for use by the
intramural programs of the district and City sponsored
activities .
2 . Specific details regarding costs for facility usage
shall be outlined in the Letter of Understanding for each
site, with the specific goal to reduce program delivery
costs for the "School District" and the "City" .
3 . If either entity initiates action to terminate this
agreement , the improvements on said sites shall become the
property of the entity and title thereto shall vest in the
entity without the necessity of a formal documentation of
transfer effective on said date . For projects involving

State or Federal parks and recreation funds , the above
action may not be completed until State or Federal
representatives have determined that the benefits received
were commensurate with the type and duration of interest in
the land held by the project applicant .
H. Terms of Agreement .
1 . This agreement shall become .operative on date set
forth above, and shall continue in effect for a period of
five (5) years unless previously terminated by either party
on ninety (90) days written notice to the other party.
IN WITNESS WHEREOF the parties hereto executed this
agreement as of the date set forth above .

THE ATASCADERO UNIFIED SCHOOL DISTRICT
AND THE CITY OF ATASCADERO
I . Basic Purpose
Since worthwhile recreational activity contributes to the well-being
of individuals , and in turn , to the progress of society , provision of
meaningful leisure opportunities can be properly recognized as a
governmental service . Consequently , the Parks and Recreation Depart-
ment has been delegated the responsibility for providing the commun-
ity with these leisure skills and opportunities .
In order to maximize these services and to maximize potential for
quality programs , the Atascadero Parks and Recreation Department and
the Atascadero Unified School District are committed to cooperate with
one another whenever feasible . The cooperation will include ongoing
communication for planning , implementing , and evaluation of cooperative
community recreation programs.
II . Mechanism for implentation of specific cooperative ventures
A. Community recreation Advisory Committee/Sub Committee of City-Schools
Committee .
1 . Membership
1 member; Parks and Recreation Commission
3 members ; School Administrative Staff
2 members ; Parks/Recreation Administration Staff
1 member ; Atascadero Youth Sports Committee
1 member; at large , community.
2 . Duties :
a. Review all new plans for development of school or park sites
within the City of Atascadero .
b . Make recommendations to agency governing boards for cooperat-
tive programs .
c . Identify and coordinate other public resources . Inform the
public of availability of community resources , and encourage
support .
d. Coordinate community resources by promoting :
1 . Greater use and sharing of human talents and resources .
2 . Learning and enrichment opportunities for all ages .
3 . Coordinate use of educational and community facilities .
4 . Improve community , school , and recreation/park relationship.
5 . Increase interagency coordination and cooperation.
6 . Increase citizen involvement in the learning and leisure
decision-making process .
B. Division of Cost 14we %No
1 . Before any joint acquisition, development , or program implemen-
tation , a cost analysis listing benefits and responsibilities
will be reviewed by the joint committee . Recommendations will be
made by this council to the administrative staff of both agencies .
2 . The administrative staffs will agree on the division of costs ,
based on a direct relationship of use.
3 . Regular reports evaluating the cooperative effort and its budget
will be reviewed by the joint committee .
C. Personnel
1 . All personnel hired for joint supervision or program coordination
will be interviewed and chosen by a select committee of staff from
the facilities , or programs involved. Both agencies will be repre-
sented.
2 . Decisions will be made by the administrative staff of both agencies
about supervisorial responsibilities and evaluation of staff mem-
bers .
IN WITNESS the parties hereto have caused this MEMORANDUM OF UNDERSTAND-
ING to be executed in concept by their respective duly authorized officers ,
and to seek and develop a Joint Exercise of Powers Agreement between the
Atascadero Unified School District and the City of Atascadero .

Subject : Memorandum of Understanding With Atascadero
Unified School District -
BACKGROUND
As a result of the Park and Recreation Department ' s desire to improve
communication with the Atascadero Unified School District , Staff began
working on ideas on how the City could address some of our concerns re-
garding joint use of facilities , and at the same time address School
District concerns in reference to the usage of their facilities by the
Recreation Department . Our staff began meeting with appropriate school
district administrators to address joint concerns . This continues today
to be an ongoing process .
In discussions at the City/School Committee level , it was determined
that an advisory committee should be established to address the possible
formation of a Memorandum of Understanding and a Joint Powers Agreement .
The committee consisted of School District Administrators , one member of
the Parks and Recreation Commission and Parks and Recreation Staff . Since
that time the committee has recommended two additional members -- one
youth sports group representative and an at large member of the community .
THEORY BEHIND DEVELOPMENT OF MOU
Many juridictions have improved the use of resources , facilities , and pro-
grams by joining forces for the common good. However , some communities
suffer from a lack of coordinated services . Many reasons have been brought
forward to explain why cooperative programs either fail or have a low de-
gree of success . Solutions have been sought to help resolve some of the
problems . As a method to help improve the problems , the concept of a
Memorandum of Understanding and a Joint Powers Agreement was developed.
The intent to cooperate is based on two main concepts :
1) Both Education and Recreation and Parks have a philosophical and statutory
responsibility to meet education and recreation needs for the community.
2) A formal cooperative provision of services assures the community that
their right to optimum services for their tax dollar is being respected.
WHAT IS A MOU?
Simply stated, a MOU is a very brief general statement of purpose to
cooperatively provide learning and leisure services . The MOU is an
"umbrella" which can provide for later, more specific agreements between
the governing bodies . The MOU includes the need for ongoing communication
between the School District and the City. It also includes sections on
implementation of cooperative ventures , including committee membership,
duties of committee , division of costs , and personnel .
What it is not is a detailed document which identifies specifics of the
joint powers agreement . This would be identified as the committee actually
begins work on the joint powers agreement itself.
The adoption of a MOU represents a beginning -- it is a statement of
cooperation between the governing bodies of the School District and the
City. As before , specific information as relates to the detailed JPA
will be discussed by the Committee and forwarded to the Joint City/
School Committee .
RECOMMENDATION
Approve the Memorandum of Understanding between the Atascadero Unified
School District and the City of Atascadero and authorize the Mayor and
the Parks and Recreation Director to sign the MOU on behalf of the City.
It is further recommended the Parks and Recreation staff be authorized to
continue the process of developing a formal joint powers agreement with
the school district .

STATEMENT OF SUPPORT
The Joint City/School Committee has endorsed this concept as well as the
Parks and Recreation Commission. In addition , the School Board was very
supportive of the MOU at its meeting on May 4th, as department staff pre-
sented the MOU for School Board consideration.

MEMORANDUM OF UNDERSTANDING
BETWEEN: The Atascadero Unified School District and
The City of Atascadero
The Atascadero Unified School District and the City of Atascadero
have determined that it will be beneficial to enter into an
agreement to share facilities for the purchase and disbursement
of gasoline for vehicles .
THE ATASCADERO UNIFIED SCHOOL DISTRICT SHALL:
1 . Provide the City of Atascadero with one 10, 000 gallon gasoline
gasoline storage tank and pump for the express use of the City.
2 . Shall purchase gasoline in a timely manner, shall require a
separate invoice for fuel which is pumped into the City tank
and shall bill the City accordingly.
3 . Invoices shall reflect a surcharge of one and one-half ( 1 'z) cents
per gallon to cover the costs of the District .
4 . The pump meter shall be read and the tanks measured no less than
three times per week and a reconciliation made at that time .
Copies of the reconciliation shall be forwarded to the City in
a timely manner.
5 . All necessary reports to the County, State and Environmental
Protection Agency shall be made by the District .
6 . Should this agreement terminate, the District shall reimburse
the City for the gas in the tank.
THE CITY OF ATASCADERO SHALL:
1 . Reimburse the District for the gas in the tank at the inception
of this agreement .
2. Shall provide its own lock for the pump.
3 . Shall provide its own locks to be placed on the chains which
secure the gates to the service yard.

4. Shall provide its own motor oil , transmission oil and other
supplies . The District will supply a secure area, however
the City shall supply their own lock.
S. Upon receipt of billings, the City shall reimburse the District
in a timely manner.
This agreement is entered into in the spirit of cooperation for the
mutual benefit of both public intities and as a method of saving
public funds . The agreement can be amended at any time by mutual
consent and can be canceled by either party should it cease to be
beneficial and upon the giving of reasonable notice.

The Sewer Extension Reimbursement Agreement executed between
the Atascadero Unified School District (AUSD) and the City of
Atascadero is hereby amended as follows:
Portion of Item 4 :
Delete the following paragraph:
"The amount to be paid by each parcel, upon connection, shall be
an amount, based upon the comparative size of each parcel (front
footage) in relation to the total size of all of the above
indicated parcels combined. This same method of calculation shall
also apply to any new parcels created out of the territory
comprising the above indicated parcels after the effective date of
this agreement and continuing during the entire term thereof. "
Replace the above statement with the following:

Sewer Extension Reimbursement Agreement
WHEREAS, on November 24, 1986, the City of Atascadero
approved an agreement between the City and the Atascadero Unified
School District for the extension of the city sewer service to
the San Gabriel Road school site.
WHEREAS, on said date the City did adopt Resolution No.
131-86.
WHEREAS, Resolution 131-86 specified that the . School
District shall be entitled to reimbursement under the terms of
the ordinance, Section
NOW, THEREFORE, This agreement, made and entered into this
23rd day of February 1987 by the Atascadero Unfied School Dis-
trict in the County of San Luis Obispo, State of California,
hereinafter referred to as the District and the City of Atas-
cadero (ACSD) in the County of San Luis Obispo, California,
hereinafter referred to as the City.
WITNESSETH
In consideration of the mutual promises, agreements,
covenants and conditions set forth herein, and in consideration
of the final approval of said sewer extension, the parties hereto
do hereby mutually covenant and agree as follows:
1. That the recitals set forth hereinabove are true, cor-
rect and valid.
2. _ That the District owns real property described as San
Gabriel Road Elementary School, 8500 San Gabriel Road,
Atascadero, CA 93422.
3. That in the construction of an approved sewer extension,
the District will award a bid to the lowest responsible
bidder for the construction of the approved sewer ex-
tension. The bid price, and any approved change orders,
and including engineering costs, minus the school front-
age, shall constitute the total funds expended which
shall be subject to recovery under the reimbursement
agreement.
4. That the District is entitled to refunds of portions of
said expensitures, from the time of completion of con-
struction, at such time within fifteen (15) years fol-
lowing the date of the execution of this Agreement as
additional connections are made to said sewer extension,
from the following parcels:

agreement and continuing during the entire term thereof.
5. (a) The City will collect the amounts applicable in
Section 4 from the owners of . real properties within -
fifteen (15) years following the date of execution of
this agreement as permits are issued for connection of
said real properties to said sewer extension.
5. (b) If any portion subject to reimbursement has not
been reimbursed at the end of 15 years following the
date of execution of the agreement, the terms of the
agreement are extended for an additional five (5) years.
6. All monies collected in accordance with Item 5, above,
will be refunded to the District..
7. District further agrees to defend, indemnify and save
- harmless the City of Atascadero (ACSD) and their of-
ficers, agents and employees from any and all liability,
claims, demands, costs, expenses, causes of action,
damages and judgments, of whatsoever kind and nature and
to whomsoever occurring, arising out of this Agreement
or occasioned by the performance or attempted perfor-
mance hereof, including but not limited to any act or
omission to act on the part of the Distrct or its agents
or employees or independent contractors directly re-
sponsible to the Distict.
8. Neither party to this Agreement shall assign or transfer
this Agreement or any interest therein without the prior
written consent of the other party.
9 . Any waiver by City of any failure by District to comply
with any , term or condition of this Agreement shall not
be construed as a waiver by City of any similar or other
failure by the District to comply with any term and con-
dition of this Agreement.
10. This Agreement shall be binding on the heirs, assigns,
transferees, executors, successors, administrators and
trustees of the parties hereto.
IN WITNESS WHEREOF City and District have executed this
Agreement on the day and year first hereinabove set forth.

HANDSITY , the foregoing is adopted in its entirety on the following

A RESOLUTION OF THE COUNCIL OF THE CITY OF
ATASCADERO APPROVING AN AGREEMENT BETWEEN
THE CITY AND THE ATASCADERO UNIFIED SCHOOL
DISTRICT FOR EXTENSION OF CITY SEWER SERVICE
TO THE SAN GABRIEL SCHOOL SITE
BE IT RESOLVED by the Council of the City of Atascadero
as follows:
SECTION 1. That certain agreement, attached hereto marked
Exhibit A and map attached hereto marked Exhibit B, and in-
corporated herein by reference, between the City of Atascadero
and the Atascadero Unified School District for extension of
City sewer service to the San Gabriel School Site is hereby
approved and the Mayor is authorized to execute the same.
It is in the interest of the Atascadero County Sanitation
to provide sewer service when consistent with the General Plan; and
The proposed project has received a Negative Declaration
pursuant to the provisions of the California Environmental
Quality Act;
SECTION 2. The City Clerk shall furnish a copy of this
resolution and a copy of the executed agreement approved by it to
LAFCO.

EXHIBIT A
SEWER EXTENSION AGREEMENT
This Agreement is made between the CITY OF ATASCADERO
hereinafter called "City, " and the ATASCADERO UNIFIED SCHOOL
DISTRICT hereinafter called "AUSD, " both of whom agree as
follows:
CITY AGREES TO:
1. Sewer Services
Allow the AUSD to cause the extension of the City sewer
main from its present terminus in or near Highway 41, along said
Highway 41, then along San Gabriel Road east of said Highway 41
to the school site, and outside the present Urban Services Line.
2. Rates
Charge the same rate for schools that are charged to
similar properties located inside the Urban Services Line, as
determined by the Director of Public Works.
3. Regulation & Service
Grant exclusive right of use by the AUSD to the extended sewer
main unless said line is taken into the Urban Services
Line (USL) or otherwise permitted to serve areas outside the USL
pursuant to a General Plan Amendment. Any permitted connections to

shown on Exhibit B.
4. Schedule
Perform all work in accordance with a schedule acceptable
to the City.
5. Cost
Pay the total cost of right-of-way, engineering, and
construction of said sewer service including main extensions to
the point of service. Said cost shall include the cost of sewer
wyes or tees, laterals, manholes, and other facilities as required
by the City Public Works Department.
6. Encroachment Permit
Obtain encroachment permit from Caltrans, as necessary,
and meet the terms thereof.
7. Regulation and Service
Prohibit any tie-ins to the new sanitary sewer lines. It
is intended that these utility lines serve only School or City
facilities directly related to School or City operations. No
service is to be provided without City action amending its General
Plan to enable such service and an amendment to this agreement
consenting to tie-ins to uses unrelated to school or City operation
