WITNESSETH: That the Contractor for and in consideration of the covenants,conditions,agreements,and stipulations of the State hereinafter expressed, #

1. Portions of State Routes (SR) 41 and 46 in CHP's Central and Coastal Divisions have
been identified as problem roadways. Through resources provided by a grant project
through the Office of Traffic Safety (OTS), the "corridor" approach will be applied in an
attempt to enhance traffic safety in these specific locations. In order to cohesively i
approach traffic safety from a variety of disciplines, federal, state, regional, and local
governments as well as the private sector will form a task force to develop a "Corridor
Safety Action Plan." In addition to travel and meeting rooms expenses associated with
supporting the task force, project funds provide for CHP and allied agency enforcement
overtime, seven radar units and fixed-wing aircraft operation costs for speed enforcement,
and educational and promotional materials. The project goal is to reduce fatal and injury
collisions on SR 41 and 46 by 25 percent.

2. Contractor agrees to perform enhanced traffic law enforcement on State Route 41 within
the City of Atascadero. Contractor will be requested to complete and submit the
statistical data requested on the Office of Traffic Safety (OTS) Schedule C for the Base
Year and for the period of May 24, 1996, through January 31, 1997 (Schedule C is
provided as Exhibit A). Additionally, contractor will submit time keeping data and
invoices for the officers deployed pursuant to this project. This data will include names
of officers, dates, and hours of deployment. This information is due to the California
Highway Patrol Headquarters, Office of Special Projects, Atn.: Allice Huffacker, P.O.
Box 942898, Sacramento, CA 94298-0001, no later than February 15, 1997.
3. Contractor agrees to abide by the attached FORM 17A NONDISCRIMINATION
CLAUSE, STATE CONTRACT REQUIREMENTS, DISPUTE RESOLUTION,
FEDERAL GRANT REQUIREMENTS, DISPUTE RESOLUTION PROVISION and
EQUAL OPPORTUNITY COMPLIANCE STATEMENT, all of which by reference are
made a part hereof.
4. The term of this agreement shall be May 24, 1996 through January 31, 1997.
5. California Highway Patrol Coordinator for this service shall be Ms. Alice Huffaker,
Associate Transportation Planner, Office of Special Projects, telephone (916) 657-7222.
6. This agreement may be cancelled by State upon thirty (30) days prior written notice to
Contractor.
7. This agreement may be amended by mutual consent of the parties hereto.
8. State agrees to pay Contractor monthly in arrears for overtime services. Reimbursement
of services is limited to a total amount of One-Thousand Eight-Hundred Dollars
($1,800.00) for officers and Two-Hundred Dollars ($200.00) for sergeants. Overtime
reimbursement will include overtime salary and overtime benefits; it will not cover
overhead or indirect costs. One-Thousand Three-Hundred Thirty-Three Dollars and
Twenty-Five Cents ($1,333.25) will be available in the 1995/96 Federal Fiscal Year
(October 1, 1995, through September 30, 1996). Six-Hundred Sixty-Six Dollars and
Seventy-Five Cents ($666.75) will be available in the 1996/1997 Federal Fiscal Year
(October 1, 1996, through January 31, 1996.) Monies not used in the 1995/1996 Federal
Fiscal year will roll over into the 1996/1997 Federal Fiscal Year.

9. Payment shall be made from funds appropriated to the Department of California Highway
Patrol and subject to the fiscal procedures of the State of California. The total amount of
this contract shall not exceed Two-Thousand Dollars ($2,000.00).
10. Contractor agrees to submit all invoices in duplicate to the service coordinator for
approval clearly indicating this contract number (95-C9716). Invoices not on pre-printed
bill heads shall be signed by the Contractor furnishing the service. Contractor shall
receive payment within fifty (50) days from the postmarked date of a properly submitted
invoice.

1. During the performance of this contract,contractor and its subcontractors shall not unlawfully discriminate,
harass or allow harassment,against any employee or applicant for employment because of sex,race,color,

age, marital status, denial of family and medical care leave and denial of pregnancy disability leave.
Contractors and subcontractors shall insure that the evaluation and treatment of their employees and

The prospective contractor's signature affixed hereon and dated shall constitute a certification
under the penalty of perjury under the laws of the State of California that the bidder has, unless
exempted, complied with the nondiscrimination program requirements of Government Code
Section 12990 and Title 2, California Code of Regulations, Section 8103.
NATIONAL LABOR RELATIONS BOARD
Contractor agrees that by signing the contract, does swear under penalty of perjury that no more
than one final unappealable finding of contempt of court by a Federal court has been issued
against the contractor within the immediately preceding two-year period because of the
contractor's failure to comply with an order of a Federal court which orders the contractor to
comply with an order of the National Labor Relations Board. (Public Contract Code Section
10296)
AMERCIANS WITH DISABILITIES ACT (ADA) OF 1990 (42 U.S.C. 12101 ET SEQ.)
Contractor by signing this contract assures the State that it complies with the Americans with
Disability Act(ADA) of 1990 (42 U.S.C. 12101 et seq.), which prohibits discrimination on the
basis of disability, as well as all applicable regulations and guidelines issued pursuant to the
ADA.
STATE AUDITOR AUDIT PROVISION
The contracting parties hereto shall be subject to the examination and audit of the State Auditor
for a period of three (3) years after final payment under the contract in accordance with the
Government Code Section 8546.7. In addition, the contractor may be subject to examination and
audit by representatives of the California Highway Patrol. The examination and audit shall be
confined to those matters connected with the performance of the contract including, but not
limited to, the costs of administering the contract.

DISPUTE RESOLUTION PROVISION
By signing the contract, contractor agrees to abide by this
provision.
Any dispute concerning a question of fact arising under the
terms of this contract which is not disposed of within a
reasonable period of time by the Contractor and State
employees normally responsible for the administration of this
contract shall be brought to the attention of the
Administrative Services Officer (or designated
representative) of each organization for joint resolution.
At the request of either party, the State shall provide a
forum for discussion of the disputed item(s) , at which time
the Administrative Services Officer, or his/her
representative, shall be available to assist in the
resolution by providing advice to both parties as to the
State of California, California Highway Patrol, policies and
procedures. If agreement cannot be reached through the
application of high level management attention, either party
may assert its other rights and remedies within this contract
or within a court of competent jurisdiction.
The rights and remedies of the State provided above shall not
be exclusive and are in addition to any other rights and
remedies provided by law or under the contract.

BUSINESS SERVICES SECTION
FEDERAL GRANT REQUIREMENTS
1. Non-sollcatlon clause.The contractor warrants that he/she has not employed or retained any company or persons,other than a bona
fide employee working solely for the contractor, to solicit or secure this contract, and that he/she has not paid or agreed to pay any
company or person,other than a bona fide employee working solely for the contractor, any fee,commission, percentage, brokerage
fee,gifts,or any other consideration,contingent upon or resulting from the award or making of this contract.For breach or violation of
this warranty, the State shall have the right to annul this contract without liability,or in its discretion to deduct from the contract price
or consideration, or otherwise recover, the full amount of such fee,commission, percentage, brokerage fee, gift, or contingent fee.
2. Publicity right clause.All publicity rights and copyrights are to be retained by the California Highway Patrol(CHP) and the Office of
Traffic Safety (OTS) and that any oral or written release of information are subject to prior written approval of the CHP and OTS.The
study was done in cooperation with the Stateof California,OTS and the Federal Highway Administration or the National Highway Traffic
Safety Administration.The opinions,findings and conclusions expressed in the publication are those of the authors and not necessarily
those of the other cooperating parties.
3. Ownership of data.All data, maps, photographs,and other material collected or prepared under the contract shall become the joint
property of the CHP and Federal agency.
4. Contractor shall maintain accounting records and other evidence pertaining to cost incurred. Records and documents shall be kept
available at the contractor's California office during the contract period and thereafter for three (3)years from date of final payment.
S. Contract agrees to make no significant changes in the committed staff without prior approval of CHP and Federal agency during the
term of this contract.
6. Contractor agrees to abide by the attached Equal Opportunity Compliance statement which is made by reference a part hereof.
7. Contractor agrees to abide by the Clean Air Act of 1970(42 U.S.C. 1857 et seq.);Federal Water Pollution Control Act(33 U.S.C. 1251
et seq.); Davis-Bacon Act(40 U.S.C. 276 a to a-7);the Copeland"Anti-Kick Back"Act(18 U.S.C.874);and the Security and Privacy
agreement(42 U.S.C.3701 et seq.)throughout the term of this contract.
8. Contractor and State mutually agree to abide by the conditions and procedures of the Federal Management Circular 74-4:cost principles
applicable to grants and contracts with State and local governments. Contractor shall be reimbursed for costs incurred in the
performance hereof as are allowable under the provisions of Part 1 —15 of the Federal Procurement Regulations.
9. Office of Traffic Safety(OTS),Federal Highway Administration and National Highway Safety Administration reserves the right to review
all activities at reasonable times during the contract period.
10. If a subcontractor is proposed,complete identification of the subcontractor tasks shall be provided. The contractor may not assign or
subcontract any portion of the contract without the express written consent of the CHP and Federal agency.The primary contractor is
not relieved of any responsibility by virtue of employing a subcontractor.The State will not accept any liability for commitments made
to a subcontractor by the prime contractor.
11. it is mutually understood between the parties that this contract may have been written before ascertaining the availability of
congressional appropriation of funds,for the mutual benefit of both parties in orderto avoid program and fiscal delays which would occur
if the contract were executed after that determination was made.
12. This contract is valid and enforceable only if sufficient funds are made available to the State by the United States Government for the
current fiscal year for the purposes of this program. In addition, this contract is subject to any additional restrictions, limitations, or
conditions enacted by the Congress or any statute enacted by the Congress which may affect the provisions, terms or funds of this
contract in any manner.
13. It is mutually agreed that if the Congress does not appropriate sufficient funds for the program,this contract shall be amended to reflect
any reduction in funds.
14. The CHP has the option to void the contract under the 30-day cancellation clause or to amend the contract to reflect any reduction of
funds.

EQUAL OPPORTUNITY COMPLIANCE STATEMENT

contain the statements following below. If a subcontractor is to be
employed, the contractor must include a statement of compliance with Equal

During `the performance of this contract, the contractor agrees as follows:

also involved as participants in this project.

parameters of this traffic safety grant are for us, state Route
41 from U.S. 101 to our eastern city lixits. Along this route,
assigned APO officers will concentrate on traffic enforcement and
safety concerns relating to excessive speed, D.U.I. , right-of-way
violations and other such problems.
YXBC. 6L Sun=*. special enforcement activities dedicated to this
project will be primarily accomplished on an overtime basis by
assigned officers. The amount allocated to APD by the grant will
be approximately $2,000.00. Our participation will not exceed
the amount authorized. Finally, it is likely that a small amount
of revenue will be generated as a result of an increase in court-
levied fines.

been identified as the corridor for which a Safety Action Plan is to be developed;and

in improving traffic safety on the corridor,
NOW,THEREFORE BE IT RESOLVED that the City Council of the city of Atxscadero hereby

A. General Characteristics
The California Highway Patrol (CHP) is an operating department within the Business, i
Transportation; and Housing Agency. Its authority and responsibilities are established
in the California Vehicle Code. The overall purpose of the Department, as a principal
criminal justice agency, is to ensure safety, security, and service to the public. This is
accomplished through:

day of the year for over 32.1 million residents of the State of California and some 22.2

The Department is responsible for approximately 97,579 miles of highway. Of this,
I 14,144 miles are state highways and 83,435 miles are county roads. In 1994, i
approximately 195.8 billion miles were driven on CHP patrolled highways. There i
898 injury, and 111,316 property damage collisions in the CHP's I

Road patrol officers are deployed on major highway systems within the Department's
jurisdiction according to past traffic collision experience and future projections.
Emphasis is generally placed on the enforcement of collision-causing violations. ;

STATEMENT OF THE PROBLEM j
In 1994, 480,093 traffic collisions were reported on public roadways in California. Of '
these collisions, 3,772 resulted in fatalities, 203,223 resulted in injuries, and 273,098 s
resulted in property damage only. A traffic collision was reported every one minute
' and six seconds; one person was killed every two hours and five minutes. Major
} factors causing or contributing to traffic collisions were speed, driving under the
influence (DUI), right-of-way violations, improper turning, weather conditions, and
traffic congestion.

There is a higher incidence of traffic collisions on some stretches of roadway, or
"corridors," than on others. While several different public safety agencies may have
an interest or obligation to ensure safety on these corridors, each agency tends to work

State Routes 41 and 46 form such a corridor. The two routes form an elongated ' X '
j that connects U. S. 101 and Interstate 5 at Atascadero and Kettleman City and Paso
Robles and Lost Hills, respectively. These roadways provide two of the most direct
east/west connections between U. S. 101 and Interstate 5 in the Central Valley, and
have increasingly become the major east-west thoroughfares between the Central Valley
and California's central coast. In the area, U. S. 101 and Interstate 5 are multi-lane
freeways, whereas State Routes 41 and 46 are two-lane rural highways, separated by
1 double yellow lines, with occasional passing lanes.
1 Typically, commuters in smaller passenger vehicles; vacationers in larger passenger
vehicles; recreationists towing boats, jet skis and driving recreational vehicles; and
drivers in commercial vehicles use the corridor. Traffic volumes and the mixture of
vehicles on the roadway are greatest on Fridays (traffic entering and leaving the area

for the weekend) and Sundays (return traffic). The mixture of vehicles and diverse i
driving patterns, and transitions between roadway environments cause a high number 1
of potential collisions between the vehicles using the highway. All too often, the
potential becomes actuality, as illustrated in the following statistics:
Between January 1, 1992, and December 20, 1995, there were eight fatal collisions i
• on the specified rural section of State Route 41, in which 12 people died.

ATTEMPTS TO SOLVE THF PROBLEM
During 1995, shared enforcement efforts were staged four times on State Route 46.
Officers from the California Highway Patrol (CHP) Templeton and King City Areas
cooperated to establish four-officer speed teams to enforce the speed limit (55 MPH).
The Templeton office conducted one DUI checkpoint; and intermittently used the fixed-
wing aircraft for speed enforcement.

expires. Agencies within the task force may seek additional funding for specific
projects to improve safety on the corridor.
Activity Phase - 2-1-96 to 1-31-97

that can be changed to improve the roadway environment and the operation of the
corridor, thus reducing traffic collisions. The task force will develop a Safety Action

30th.

The California Highway Patrol (CHP) requires $100,000 to implement and complete the "SR 41 and
46 Traffic Safety Corridor Project."

Personnel Costs ($41,936) 1
The task force will be allocated 940 hours of CHP officer overtime, and 94 hours of sergeant l
overtime. A total of 80 hours of nonuniformed (clerical and/or dispatch) has been allocated.
The overtime will be used to counteract improper turns, driving at unsafe speeds, right-of-way
violations, and other rules-of-the-road violations that have been identified as the primary
collision factors on the corridor. A portion of the project-funded overtime may be set aside !
for court appearances resulting from enforcement action taken during project operations.
Should it become evident that the court overtime reserve will not be needed, the reserved
hours will revert to enforcement.

ATASCADERO, CALIFORNIA, AUTHORIZING THE ATASCADERO
POLICE DEPARTMENT TO PARTICIPATE IN A MULTIAGENCY
TRAFFIC SAFETY/ENFORCEMENT GRANT
WHEREAS, the California Highway Patrol has received grant funds for 11-1e;
creation of a multiagency SR 41 and 46 Traffic Safety Corridor Project Task Force;
and
WHEREAS, State Routes 41 and 46 from U.S. 101 to their intersections with
Interstate 5 have bee identified as the corridor for which a Safety Action Plan is to be
developed; and
WHEREAS, the grant allows funds for law enforcement; and
WHEREAS, the Task Force has agreed that increasing law enforcement is an
important element in improving traffic safety on the corridor.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of
Atascadero does hereby authorize the Atascadero Police Department to participate in
the grant and authorizes the Mayor to sign the participation agreement.
On motion by Councilperson Johnson and seconded by Councilperson Luna,
the foregoing Resolution is hereby adopted in its entirety on the following roll call
