PLN 2013-1481 TREE REMOVAL PERMIT FOR 7040 NAVAJOA AVE. Property Sharon Turner, 7040 Navajoa Ave., Atascadero, CA 93422 Owner/Applicant: Project organized by San Luis Obispo Air Pollution Control District (SLOAPCD) Certified Arborist: Greenvale Tree Company, PO Box 13234, San Luis Obispo, CA 93406 Project Title: PLN 2013-1481/TRP 2013-0165 Tree Removal Project Location: 7040 Navajoa Avenue, Atascadero, CA 93422 Description: APN 031-043-011 (San Luis Obispo County) Project Description A request to remove a California Black Walnut tree with a DBH of 40 -inches in the residential multi -family zone (RMF -10). The tree has been determined to be hazardous due to the lifting of the street creating drainage issues along Navajoa Avenue. Staff Staff recommends Planning Commission adopt Resolution PC 2013-0027, Recommendation: approving the removal of one (1) hazardous California Black Walnut tree subject to conditions of approval and mitigation. 3. PLN 2010-1361 / CITY OF ATASCADERO CLIMATE ACTION PLAN PLANNING COMMISSION REVIEW OF DRAFT PLAN Applicant: City of Atascadero, 6500 Palma Avenue, Atascadero, CA 93422 Project organized by San Luis Obispo Air Pollution Control District (SLOAPCD) Project Title: PLN 2010-1361, City of Atascadero Climate Action Plan Project Location: Citywide Project The City Council has designated the Planning Commission to act as the "Steering Description: Committee" for the San Luis Obispo County Air Pollution Control District's (APCD) Countywide Climate Action Planning project. The purpose of a Climate Action Plan is to reduce greenhouse gas emissions within the City of Atascadero. Atascadero's Draft Climate Action Plan has been developed by the APCD's project consultant and will be available for public review at the Atascadero City Hall or at www.atascadero.org beginning October 11, 2013. The Draft CAP incorporates the Greenhouse Gas Reduction measures which were reviewed by the Planning Commission and the City Council earlier this year. Staff At this meeting, staff recommends the Planning Commission review the Draft Climate Re c o m m e n d a t i o n : Action Plan (CAP) and provide staff with comments or changes to be incorporated into the Final Draft CAP. PLN 2010-1382 SLOCOG's NORTH COUNTY SALINAS RIVER TRAIL MASTER PLAN Applicant: SLOCOG, 1114 Marsh Street, San Luis Obispo, CA 93401 Project Title: PLN 2010-1382, SLOCOG's North County Salinas River Trail Master Plan Project Location: Salinas River & Anza Trail corridor Project SLOCOG recently released the Draft North County Salinas River Trail Master Plan for Description: public review. The Plan defines feasible short-term and desirable long-term multi -use trail alignments and improvements for the historic Anza trail through the Salinas River corridor. The Trail Master Plan will serve as a guide for future connection of a 35 -mile segment through a trail corridor from Santa Margarita to San Miguel through Northern San Luis Obispo County. SLOCOG has requested that the jurisdictions in North County review the proposed plan and provide a letter of support or comments to SLOCOG. The City is not required to adopt the Plan as it is SLOCOG's document; although the City may consider incorporating the Trail Master Plan into the City's Bike Plan and General Plan in the future for implementation purposes. Staff Staff recommends the Planning Commission review SLOCOG's Draft North County Recommendation: Salinas River Trail Master Plan, and provide comments and a recommendation to City Council. The Atascadero City Council will be reviewing the Draft Trail Master Plan on October 22, 2013, and will be issuing comments to SLOCOG. This includes, but is not limited to, Tentative Subdivision Maps, Parcel Maps, Variances, Conditional Use Permits, and Planned Development Permits. This does not disqualify the Planning Commission Member from participating and voting on the matter, but gives the public and applicant an opportunity to comment on the ex parte communication. (For each of the following items, the public will be given an opportunity to speak. After a staff report, the Chair will open the public hearing and invite the applicant or applicant's representative to make any comments. Members of the public will be invited to provide testimony to the Commission following the applicant. Speakers should state their name for the record and can address the Commission for three minutes. After all public comments have been received, the public hearing will be closed, and the Commission will discuss the item and take appropriate action(s).) 5. PLN 2013-1462 TITLE 9 ZONING ORDINANCE AMENDMENTS Applicant: City of Atascadero, 6500 Palma Avenue, Atascadero, CA 93422 Project Title: Title 9 Zoning Ordinance Amendments — 2013 Strategic Planning Action Items Project Location: Citywide Project This action consists of proposed Zoning Ordinance Text Amendments to Title 9 Planning Description: and Zoning Code to the following sections: • Allow multi -family residential uses in the CP/CR zone as conditionally allowed uses; • Amend Section 9-4.105 front setback standards to allow exceptions with DRC approval; • Amend Section 9-4.128 fencing and screening to allow fence height exceptions with DRC approval and allow fences up to four (4) feet in height within the front setback of parcels less than one (1) acre in size. • Amend Section 9-4.139 through 9-4.154 Grading and Drainage Standards for consistency with State Post Construction Stormwater regulations; • Amend Section 9-4.160 Streets, to allow frontage improvement exceptions for certain residential projects and clarification of improvements; • Amend Section 9-6.103 to allow for cargo containers as accessory structures with issuance of a building permit; • Amend Section 9-11.105, exempting emergency septic system repairs from the Native Tree Ordinance. General Plan Designation: N/A Zoning: N/A Proposed Exempt from CEQA (Section 15061.(3) No possibility that the proposed activity will have Environmental a significant effect to the environment — therefore, not subject to CEQA. Matters are considered by the Commission in the order of the printed Agenda. Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on file in the office of the Community Development Department and are available for public inspection during City Hall business hours at the Front Counter of City Hall, 6500 Palma Avenue, Atascadero, and on our website, www.atascadero.orct. An agenda packet is also available for public review at the Atascadero Library, 6850 Morro Road. All documents submitted by the public during Commission meetings that are either read into the record or referred to in their statement will be noted in the minutes and available for review in the Community Development Department. Commission meetings are audio recorded, and may be reviewed by the public. Copies of meeting recordings are available for a fee. Contact the City Clerk for more information (470-3400). In compliance with the Americans with Disabilities Act, if you need special assistance to participate in a City meeting or other services offered by this City, please contact the City Manager's Office or the City Clerk's Office, both at (805) 470-3400. Notification at least 48 hours prior to the meeting or time when services are needed will assist the City staff in assuring that reasonable arrangements can be made to provide accessibility to the meeting or service. TO SPEAK ON SUBJECTS NOT LISTED ON THE AGENDA Under Agenda item, "PUBLIC COMMENT", the Chairperson will call for anyone from the audience having business with the Commission to approach the lectern and be recognized. 1. Give your name for the record (not required) 2. State the nature of your business. 3. All comments are limited to 3 minutes. 4. All comments should be made to the Chairperson and Commission. 5. No person shall be permitted to make slanderous, profane or negative personal remarks concerning any other individual, absent or present. This is when items not on the Agenda may be brought to the Commission's attention. A maximum of 30 minutes will be allowed for Public Comment Portion (unless changed by the Commission). TO SPEAK ON AGENDA ITEMS (from Title 2, Chapter 1 of the Atascadero Municipal Code) Members of the audience may speak on any item on the agenda. The Chairperson will identify the subject, staff will give their report, and the Commission will ask questions of staff. The Chairperson will announce when the public comment period is open and will request anyone interested to address the Commission regarding the matter being considered to step up to the lectern. If you wish to speak for, against or comment in any way: 1. You must approach the lectern and be recognized by the Chairperson. 2. Give your name (not required). 3. Make your statement. 4. All comments should be made to the Chairperson and Commission. 5. No person shall be permitted to make slanderous, profane or negative personal remarks concerning any other individual, absent or present. 6. All comments limited to 3 minutes. If you wish to use a computer presentation to support your comments, you must notify the Community Development Department at 470-3402 at least 24 hours prior to the meeting. Digital presentations must be brought to the meeting on a USB drive or CD. You are required to submit to the Recording Secretary a printed copy of your presentation for the record. Please check in with the Recording Secretary before the meeting begins to announce your presence and turn in the printed copy.
