HomeMy WebLinkAboutResolution 47-83 ' T!N0 AGENDA DATE AT -lµ-g 3 ITEM ' RESOLUTION NO. 47-33 ' RESOLUTION OF THE ATASCADERO CITY COUNCIL DESIGNATING AUTHORITY TO MAKE DETERMINATIONS ON EMPLOYEE DISABILITY ' WHEREAS the City of Atascadero, hereinafter referred to as Agency, is a contracting agency of the Public Employees' Retire- ment System; and WHEREAS, the Public Employees' Retirement Law requires that a contracting agency determine whether an employee of such agency in employment in which which he is classified as a local safety member is disabled for purposes of the Public Employees' Retire- ment Law and whether such disability is "industrial" within the meaning of such Law; and WHEREAS, the City Council has determined upon legal advice ' that it may delegate authoirty under Section 21034 of the Govern- ment Code to make such determinations to the incumbent of the office (position) of City Manager. ' NOW, THEREFORE, BE IT RESOLVED that the City Council delegate and it does hereby delegate to the incumbent of the office (posi- tion) of the City Manager authority to make determinations under ' Section 21023 (c) , Government Code, on behalf of the Agency, of disability and whether such disability is industrial and to cer- tify such determinations and all other necessary information to the Public Employees' Retirement System; and BE IT FURTHER RESOLVED that such incumbent be and he is au- thorized to make applications on behalf of the Agency for disa- bility retirement of employees in employments in which they are local safety members and to initiate requests for reinstatement of such employees who are retired for disability. On motion by Councilman Nelson and seconded by Councilman Wilkins , the foregoing resolution is hereby adopted in its entirety on the following vote: AYES: Councilmen Molina, Nelson, Stover, Wilkins and Mayor Mackey ' NOES: None ABSENT: None ADOPTED: November 14 , 1983 ' MAPJ IE R.
