The Commission may take action to direct the staff to place a matter of business on a future agenda) Note: The General Plan Update is not on the Planning Commission Agenda. Anyone wishing to address the General Plan Update should speak during this portion of the meeting. CONSENT CALENDAR (All items on the consent calendar are considered to be routine and non -controversial by City Staff and will be approved by one motion if no member of the Commission or public wishes to comment or ask questions.) 1. APPROVAL OF MINUTES OF THE REGULAR PLANNING COMMISSION MEETING OF MARCH 20, 2001. PUBLIC HEARINGS (For each of the following items, the public will be given an opportunity to speak. After a staff report, the Chair will open the public hearing and invite the applicant or applicant's representative to make any comments. Members of the public will be invited to provide testimony to the Commission following the applicant. After all public comments have been received, the public hearing will be closed, and the Commission will discuss the item and take appropriate action(s).) 2. PROJECT DESCRIPTION: CONDITIONAL USE PERMIT 2001-0026: 5200 PALMA AVENUE A request for an affordable housing density bonus to increase the residential density by 25%. The project involves the construction of two, one -bedroom units on a lot currently developed with two, two-bedroom units. An existing two- bedroom unit will be deed restricted for 10 years to provide affordable housing to low income families in accordance with state law. The project will be served by public sewer and water with access from Palma Avenue. General Plan Designation: Low Density Single Family; Zoning District (LDMF): Residential Multiple Family, 10 one -bedroom units per acre (RMF -10), Site Address: 5200 Palma Avenue, Atascadero, CA 93422, APN 029-302-038, Applicant: James and Judith McKrell PROPOSED ENVIRONMENTAL DETERMINATION: CLASS 3 CATEGORICAL EXEMPTION: The project has been determined to be exempt from the requirements of the California Environmental Quality Act under the Class 3 exemption (Section 15303). Class 3 exemptions includes the construction of multi -family residential structures totaling no more than four dwelling units. Under Section 15300 of CEQA this project has been determined not to have a significant effect on the environment. The environmental determination is available for public review through April 3, 2001 at 6500 Palma Avenue, Community Development Department, Room 104, from 8:00 a.m. to 5:00 p.m., Monday through Friday. 3. PROJECT DESCRIPTION: TENTATIVE PARCEL MAP 2000-0013: 4580 POTRERO ROAD Parcel map subdividing one existing 5.86 acre lot into two parcels. There is currently one residential structure on the existing lot and the subdivision will create one new parcel (3.36 acres) with one new entitlement. The new parcel will be accessed from Obispo Road. General Plan Designation: Suburban Single Family; Zoning District: Residential Suburban (RS), minimum lot size 2 '/2 - 10 acres (calculated to be 2.5 acres using performance standards). Site Address: 4580 Potrero Road, Atascadero, CA 93422, APN 049-111-001, Applicant: Tom Beckwith. PROPOSED ENVIRONMENTAL DETERMINATION: PROPOSED NEGATIVE DECLARATION 2001-010: The Initial Study has determined that the proposed project will not have a significant adverse impact on the environment. A proposed Negative Declaration of environmental impact has therefore been prepared for the project in conformance with the California Environmental Quality Act (CEQA). The Proposed Negative Declaration is available for public review through April 3, 2001 at 6500 Palma Avenue, Community Development Department, Room 104, from 8:00 a.m. to 5:00 p.m., Monday through Friday. PROJECT DESCRIPTION: TENTATIVE TRACT MAP 2000-00019 ROAD ABANDONMENT 2001-0003: RANCHO DE PARAISO 6250 SAN GABRIEL ROAD The project consists of a residential subdivision of 10 existing colony lots totally 69.4± acres into 17 -lots and a road abandonment application requesting the abandonment of a portion of the Portal Road colony right-of-way and a realignment and improvement of the Escondido Road colony right-of-way. The project will involve the construction of 16 new homes with 6 new homes accessing from Portal Road, 5 homes accessing off of Escondido Road and 5 homes accessing from an existing driveway on San Gabriel Road. The project will include the improvement of Escondido Road connecting it to San Gabriel Road. The extension of Escondido Road will require the crossing of a blue line creek. The public improvements required for the project will require the removal of several native trees. Two open space easements are proposed as part of the project totaling 13 acres +/- and a pedestrian easement is proposed to provide a public pedestrian connection between the terminus of Portal Road and the extension of Escondido Road. The project also involves a city initiated application for a zone change to change the zoning district from Agriculture to Residential Suburban. The zone change application will change the City's Zoning Map to mirror the Suburban Single Family general plan designation shown on the Land Use Element. The zone change will not have an affect of the future use of the property and will fulfill Section E.2 (Implementation) of the City's General Plan. ENVIRONMENTAL ANALYSIS: The site is within an area where the General Plan and zoning allow for the density and parcel sizes proposed. Based on the initial study prepared for the project, Mitigated Negative Declaration 2001-0006 is proposed. The Community Development Department recommends that the Planning Commission find that no significant harm would come to the environment from approval of this Tentative Tract Map and Road Abandonment, with the incorporation of the recommended mitigation measures. The proposed Mitigated Negative Declaration is available for public review from March 22, 2001 through April 17, 2001 at 6500 Palma Avenue, Community Development Department, Room 104-A, from 8:00 a.m. to 5:00 p.m., Monday through Friday. 5. PROJECT DESCRIPTION: ZONE CHANGE 2001-0013 (AGRICULTURE TO RESIDENTIAL SUBURBAN): CITY OF ATASCADERO, RANCHO DE PARAISO, 6250 SAN GABRIEL ROAD The project consist of a city initiated application for a zone change to change the zoning district of the Rancho de Paraiso Tract Map area (69.4± acres) from Agriculture to Residential Suburban. The zone change application will change the City's Zoning Map to mirror the Suburban Single Family General Plan designation shown on the Land Use Diagram. The zone change will not have an affect of the future use of the property and will fulfill Section E.2 City of Atascadero Planning Commission Agenda (Implementation) of the City's General Plan.
