The Commission may take action to direct the staff to place a matter of business on a future agenda) CONSENT CALENDAR (All items on the consent calendar are considered to be routine and non -controversial by City Staff and will be approved by one motion if no member of the Commission or public wishes to comment or ask questions) 1. Approval of minutes of the regular Planning Commission meeting of February 15, 2000. PUBLIC HEARINGS (For each of the following items, the public will be given an opportunity to speak. After a staff report, the Chair will open the public hearing and invite the applicant or applicant's representative to make any comments. Members of the public will be invited to provide testimony to the Commission following the applicant. Speakers should state their name and address for the record and can address the Commission for five minutes. After all public comments have been received, the public hearing will be closed, and the Commission will discuss the item and take appropriate action(s).) Road Abandonment #2000-0002: summary vacation of a portion of the Coromar Avenue right-of-way, 7300 block Coromar Avenue (Kelly Gearhart The proposed project is a request to summarily vacate a portion of the Coromar Avenue right-of-way. The portion of the right-of-way proposed to be abandoned is unimproved and is classified as a local street in the City's Circulation Element. The project is consistent with California Streets and Highways Code Section 8331. The project site has a General Plan Designation of MDSF (Moderate Density Single Family) and a Zoning District of RSF-Y (Residential Single Family, minimum lot size 1 acre with sewer). The project is located between the 7300 block of Coromar Avenue and the 7000 block of Marchant Avenue (APN 031-081-016, APN 031-081-018). PROPOSED ENVIRONMENTAL DETERMINATION: GENERAL RULE EXEMPTION: The project is consistent with the General Rule Exemption per section 15061.c of the CEQA Guidelines. The General Rule Exemption applies to projects that are subject to CEQA, but it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. Staff Recommends: Adopt Resolution PC 2000-014, recommending that the City Council summarily vacate a portion of Coromar Avenue colony right-of-way as conditioned and subject to the appropriate findings Conditional Use Permit 2000-0005: Enterprise Rental Car Office, 8759 El Camino Real (Dale Lane for Enterprise Rental Car) The proposed project consists of the establishment of a car rental business in an existing suite of a commercial shopping center located at 8759 El Camino Real (Ralph's Center). The operation will consist of a 763± square foot office with a fleet of 20-30 cars. All vehicle maintenance and cleaning will occur off-site at appropriate facilities. The project site has a General Plan designation of (RC) Retail Commercial and a Zoning District of CR (Commercial Retail) (APN 030- 513-011-016). The use is conditionally allowed in the CR District. PROPOSED ENVIRONMENTAL DETERMINATION: CATEGORICAL EXEMPTION CLASS 1: The project is consistent with the Class 1 Categorical Exemption per section 15301 of the CEQA Guidelines. The Class 1 exemption pertains to the use of existing structures and facilities involving negligible or no expansion of the existing use. Staff Recommends: Adoption of Planning Commission Resolution Number 2000- 016 thereby adopting the proposed Class I Categorical Exemption and approving Conditional Use Permit 2000-0005 subject to the findings, exhibits and conditions. Conditional Use Permit #2000-0001: Frog Pond Mountain Winery, 13400 Old Morro Road (George Palmer) The proposed project is a request to allow the cultivation of grapes and the production of wine for commercial purposes on two residential lots located at 13400 Old Morro Road. The project does not involve the on-site sale or tasting of wine. The project site has a General Plan Designation of SSF (Suburban Single Family) and a Zoning District of RS (Residential Suburban). The proposed use is a conditionally allowed use in the Residential Suburban Zone. (APN 055-321- 008, APN 055-331-013). PROPOSED ENVIRONMENTAL DETERMINATION: CATEGORICAL EXEMPTION CLASS 1: The project is consistent with the Class I Categorical Exemption per section 15301 of the CEQA Guidelines. The Class 1 exemption pertains to the operation of existing structures and facilities involving negligible or no expansion of the existing use. Staff Recommends: Adopt Planning Commission Resolution 2000-0013 approving Conditional Use Permit 2000-0001, conditionally allow the cultivation of grapes and the production of wine for commercial purposes at 13400 Old Morro Road and find the project exempt from CEQA under the Class I Categorical Exemption. 5. Conditional Use Permit 2000-0002: Fence Factory Sales Facility, 2650 El Camino Real (Bennet Partnership) The proposed project consists of the establishment of a fence equipment sales use with an 20,000± S.F. outdoor storage lot and two 2,400± square foot storage buildings and one 2,000± square foot office building with road improvements at 2650 El Camino Real. The project also includes a request to allow a temporary outdoor storage area and office on the adjacent lot for use during construction of the project (2600 El Camino Real). The project has a General Plan designation of (CPK) Commercial Park and is zoned "CPK" (Commercial Park) (APN 049-201- 014 & 024). PROPOSED ENVIRONMENTAL DETERMINATION: NEGATIVE DECLARATION: The Initial Study has determined that the proposed project will not have a significant adverse impact on the environment. A proposed Negative Declaration of environmental impact has therefore been prepared for the project in conformance with the California Environmental Quality Act (CEQA). Staff Recommends: Adopt Resolution No. PC 2000-015, thereby, adopting the Proposed Negative Declaration #2000-008; and, approving Conditional Use Permit #2000-0002, allowing the establishment of fencing equipment storage and sales at 2650 El Camino Real, subject to the findings, exhibits and conditions.
