Speakers are limited to five minutes. Please state your name and address for the record before making your presentation. The Commission may take action to direct the staff to place a matter of business on a future agenda) CONSENT CALENDAR (All items on the consent calendar are considered to be routine and non -controversial by City Staff and will be approved by one motion if no member of the Commission or public wishes to comment or ask questions) 1. Approval of minutes of the regular Planning Commission meetings of September 21, 1999 and October 5, 1999. The minutes of the regular Planning Commission meeting of September 21, 1999 were referred back to staff for review for conformance with the tape recording regarding the El Centro project. Staff found the minutes accurately reflect the discussion regarding the project conditions. PUBLIC HEARINGS (For each of the following items, the public will be given an opportunity to speak. After a staff report, the Chair will open the public hearing and invite the applicant or applicant's representative to make any comments. Members of the public will be invited to provide testimony to the Commission following the applicant. Speakers should state their name and address for the record and can address the Commission for five minutes. After all public comments have been received, the public hearing will be closed, and the Commission will discuss the item and take appropriate action(s).) 2. CONDITIONAL USE PERMIT 99015 — 5318 Palma Avenue, (St. Luke's Episcopal Church A proposed conditional use permit to establish a non -denominational Youth Arts Activity Center in a Residential Multiple Family Zone. The use will operate under the definition of a day-care facility with a capacity of 30 or fewer children. The project is in a Low Density Multi -Family General Plan Designation and RMF -10 (Residential Multiple - Family — 10 units per acre) Zoning District. ENVIRONMENTAL STATUS: Class 22, Categorically Exempt (Class 22 exemptions include educational or training programs involving no physical changes.) Staff Recommendation: Adopt Resolution NO. PC 1999-050, thereby approving Conditional Use Permit 99015 subject to conditions listed in the staff report, finding that the project is exempt from California Environmental Quality Act (CEQA) under the Class 22 categorical exemption for educational or training programs involving no physical changes. 3. TENTATIVE PARCEL MAP 99006 — 5398 Portola Road (Lynn Mosher) A proposal to divide one lot consisting of 5.25 acres into two parcels containing 3.65 and 1.60 acres each. The property is currently one parcel with two existing single family homes. The new division will separate the existing homes to individual parcels. No additional development is proposed with this application. The project is in a Low Density Single -Family General Plan Designation and RSF-Z (Residential Single -Family, minimum lot size of 1.5 acres) Zoning District. ENVIRONMENTAL STATUS: A Negative Declaration has been prepared to evaluate the environmental impacts of this project. Staff Recommendation: Adopt Resolution NO. PC 1999-051, thereby approving Tentative Parcel Map 99006 subject to conditions listed in the staff report and finding that the project would not have significant adverse effects on the environment and approving the Negative Declaration. 4. GENERAL PLAN AMENDMENT 98002 — 3900 Traffic Way (APN 049-031-003) Mixed Use Cluster Residential Subdivision (General Plan Amendment 98002, Zone Chane 98004, Tentative Tract Map 98013) The proposed project consists of the following elements (1) General Plan Amendment 98002 to change the land use designation of approximately 39.9± acres from Single Family Suburban to 20.3± acres High Density Single Family, 10.0± acres Recreation, 2.7± acres Industrial and 6.9± acres streets and the extension of the Urban Service Line to provide sewer service to the project area, (2) Zone Change 98004 to change the zoning from RS (Residential Suburban) to RSF-X (Residential Single -Family 1/2 -acre minimum with sewer), L (Recreation), and I (Industrial), consistent with the General Plan Amendment with a Planned Development Overlay District, and (3) a 43 -lot tentative tract map with a net residential density of 38 dwelling units. PROPOSED ENVIRONMENTAL DETERMINATION: MITIGATED NEGATIVE DECLARATION: Based on the findings of an expanded initial study a Mitigated Negative Declaration is proposed for the project consistent with the California Environmental Quality Act. The initial study determined that the project would have a less than significant environmental effect when mitigation measures are incorporated into the project. Staff Recommendation: Adopt Resolution No. PC 1999-052, recommending that the City Council certify the Mitigated Negative Declaration; adopt Resolution No. PC 1999-053, recommending that the City Council approve General Plan Amendment 98002; adopt Resolution No. PC 1999-054, recommending that the City Council approve Zone Change 98004, creating a Planned Development Overlay District PD -15 and amending the Zoning Map; and adopt Resolution No. PC 1999-055, recommending that the City Council approve Tentative Tract Map 98013 as amended and subject to the Conditions of Approval.
