' RESOLUTION NO. 50-82
RESOLUTION SPECIFYING ATASCADERO CITY COUNCIL
FINDINGS IN DENYING THE APPLICATION OF KELLY GEARHART,
' REPRESENTING GOOD RIDDANCE DISPOSAL, FOR A
SOLID WASTE DISPOSAL PERMIT
' WHEREAS, Mr. Kelly Gearhart has completed the application
process for a solid waste disposal permit in compliance with City
1 Code Section 6-4.13; and
WHEREAS, at the regular meeting of October 11, 1982, Council
considered public testimony concerning the application for a sol-
' id waste disposal contract; and
WHEREAS, as part of the application process, Council reviewed
written information presented by the applicant, his attorney, the
County Health Department and City Staff.
1 NOW, THEREFORE, BE IT RESOLVED by the Atascadero City Council
that the solid waste disposal contract application by Mr . Gear-
hart for Good Riddance Disposal Company is hereby denied based on
a review of information submitted and based upon the following
1 findings:
1. That it is not in the public interest for two collectors
' of solid waste materials to provide the same basic ser-
vices within the City of Atascadero.
2. That the granting of a permit is not in the best inter-
ests of the public health, safety or general welfare,
because the granting of a permit could jeopardize or
interfere with the quality and level of service that is
being provided within the City resulting in an overall
lowering of service levels.
' 3. That the efficient, safe and sanitary removal of - solid
waste is a proper concern of the City of Atascadero in
order to protect the general public health of the com-
munity.
' On motion by Councilman Mackey and seconded by Councilman
Wilkins , the foregoing resolution is hereby adopted in its
entirety on the following vote:
