■ Recommendation: Commission approve the request by a local
Petanque Club to improve an area at Colony Park for a temporary

■ Fiscal Impact: None.
■ Recommendation: Commission receive, comment and file. No action

Overflow Basin For Colony Park (Formerly Traffic Way Park)
■ Fiscal Impact: Between $5,000 - $9,500, depending upon the scope
and number of revisions necessary to finalize the plan.
■ Recommendation: Commission review previous Park Site Plan and
subsequent changes, identify stakeholders for the Site Plan revision
and approve the process for the final Park Master Plan. Commission
may also consider approval of the new location for the Wastewater
Overflow Basin at this time. [Community Services]

WELCOME TO THE ATASCADER0 PARKS AND RECREATION COMMISSION MEETING
The Parks and Recreation Commission meet in regular session on the third Thursday of each month at 7:00 p.m., in the
Atascadero City Hall, located at 6907 El Camino Real, Atascadero. The Parks and Recreation Commission consider
matters in the order of the printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on
file in the Community Services Department and are available for public inspection during City Hall Annex, 6907 El
Camino Real, during business hours at the Central Receptionist counter and on our website; www.atascadero.org. An
agenda packet is also available for public review at the Atascadero Library, 6850 Morro Road. All documents
submitted by the public during Parks and Recreation Commission meetings that are either read into the record or
referred to in their statement will be noted in the minutes and available for review in the Community Services
Department.

Chairperson Butz called the meeting to order at 7:05 p.m. and Vice Chairperson
Chacon led the Pledge of Allegiance.

Eric Greening, 7365 Via, encouraged Commissioners to visit the Historic Colony House
Museum. He inquired if, now that the creek is flowing, the City would be able to draw
water from it through the pipe to fill the Lake.

COMMISSION ANNOUNCEMENTS AND REPORTS:
Commissioner Cooper reported that the Atascadero Youth Task Force has many
exciting things on the horizon. He said that the Task Force will be hosting the Chamber
Mixer on March 19th at the Atascadero High School.
Commissioner Hatch reported that the Veteran's Memorial Committee hopes to have
the remainder of the bricks in place by the end of the month and will also be completing
touch up work on the Memorial soon.

2. Alvord Field Building Signage and Installation of a New Babe Ruth
Batting Cage
■ Fiscal Impact: None.
■ Recommendation: Commission approve Babe Ruth Baseball's request
to install new building signage and a new batting cage beyond the left
field fence at Alvord Field. [Community Services]
3. Veteran's Memorial Shed Placement
■ Fiscal Impact: None.
■ Recommendation: Commission approve the location for the new
utility/storage shed for the Atascadero Veteran's Memorial at
Atascadero Lake Park, adjacent to Alvord Field. [Community Services]
Eric Greening pulled Item A-1 and requested that under item B-3 Public Comment, the
words "at the Estrada Adobe site" be added to what he said.
MOTION: By Commissioner Hatch and seconded by Vice Chairperson
Chacon to approve the consent calendar with the addition of
the words, "at the Estrada Adobe site" to Item A — 1.

B. MANAGEMENT REPORTS:

■ Recommendation: Commission recommend approval of a proposed
project to landscape an area near the Charles Paddock Zoo

Acting Public Works Director Geoff English introduced Eagle Scout Candidate, Jacob
Gerhardt.
Jacob Gerhardt, gave the presentation and answered questions of the Commission.
PUBLIC COMMENT
Eric Greening, thanked the applicant, particularly for noticing the neglected area at the
Lake Park and zeroing in on the need.
Chairperson Butz closed the Public Comment Period.
MOTION: By Commissioner Marks and seconded by Commissioner
Hatch to approve the proposed project.
Motion passed 7:0 by a roll -call vote.
2. Letter of Concern - Little Leaaue Plavaround
■ Fiscal Impact: None.
■ Recommendation: Commission review letter of concern by Kip
Meredith, President of Atascadero Little League, regarding safety
concerns with the location of the Paloma Park Playground.

Community Services Director Brady Cherry gave the report and answered questions of
the Commission.
PUBLIC COMMENT — None.
Community Services Director Brady Cherry said he will contact Kip Meredith, President
of Atascadero Little League to let him know the Commission has reviewed the letter.
3. Charles Paddock Zoo Front Entrance and Restroom Improvement
Project
■ Fiscal Impact: $763,000 in budgeted funds.
■ Recommendation: Commission review and approve the new restroom
design concept and location in the Charles Paddock Zoo. The
Commission may also provide comment on the preliminary front
entrance design. [Community Services]
Community Services Director Brady Cherry gave the report and answered questions of
the Commission.

Eric Greening, said the project looks good.
Chairperson Butz closed the Public Comment Period.
MOTION: By Vice Chairperson Chacon and seconded by Commissioner
Cooper to approve the new restroom design concept and
location in the Charles Paddock Zoo.
Motion passed 7:0 by a roll -call vote.
4. Sub -Committee Recommendations — Proaosed Smokina Ban
■ Fiscal Impact: To be determined.
■ Recommendation: Commission review the wide range of options
provided for consideration by the Commission Sub -Committee and
make a recommendation to Council. [Community Services]
Vice Chairperson Chacon thanked members of the Sub -Committee and gave the report.
Mr. Chacon answered questions of the Commission.
Commissioner Marks, read the following statement into the record:
"The Staff Report for this item is incomplete and misleading.
Proposals for restricting smoking in public parks have been brought before this
Commission by Atascadero High School students, residents, public health
specialists, and community service organizations on several occasions. During
one of those earlier meetings a community member, speaking during the public
comment period, indicated her belief that the issue had less merit since it had
been brought to us from outsiders.
I find this sort of xenophobia unfortunate from community members, and entirely
unacceptable in City documents.
I highlighted this problem as gently as I could during our October meeting, when I
requested that the minutes accurately reflect the residential status of speakers on
this topic and thanked the girl scouts for their related efforts. Furthermore, I
specifically requested a summary of other agency smoking restrictions. The Staff
Report's Observation No. 8: "state and federal laws do not currently ban use of
tobacco products in all outdoor areas" does not address that request. What are
the restrictions? Are there required setbacks from schools and children's play
areas? If so, how far? Observation No. 7 says "it appears that people are
generally more concerned about second-hand smoke in a confined area, rather
than in an unrestricted outdoor environment." That may be a true statement if
you are referring to people in general. But it is certainly not reflected by the 75%

of those surveyed who supported some restriction of smoking in parks and two-
thirds supported restriction in all parks and public facilities.
I don't believe a effort to evaluate reasonable alternatives and accurately report
the findings has been adequately demonstrated, and 1 suggest we continue this
item to a later date when such effort is made."
Commissioner Zirk expressed that he shares Commissioner Marks' viewpoint. He
commented that the real world is moving towards a smoking ban and he would like to
see that continue.
Commissioner Hatch said that the goal of the sub -committee was to be objective, gather
as much information as possible and analyze the results. She said the Commission's
job is to represent the public and it was obvious, by the lack of public comment, that the
public did not find this to be a pressing issue. Ms. Hatch respectfully disagrees that the
report is incomplete and thinks that maybe it's just not giving us the answer we want.
Commissioner Greenaway asked for clarification on current restrictions pertaining to
smoking.
Community Services Director Brady Cherry responded that there are currently no City
ordinances, however, the current State ordinances do apply.
Vice Chairperson Chacon stated that the sub -committee tried to state the balance and
be unbiased. He pointed out that the people who did turn out to speak during public
comment for this item were fundamentally the same people. Mr. Chacon also
commented that all Cities with smoking restrictions vary in the amount of restrictions;
they are not all uniform. Upon speaking with many members of the public on the
streets, he found people who smoked felt "demonized." He expressed how important it
is to listen to everyone's perspective and relayed his appreciation the public who did
come out and comment.
PUBLIC COMMENT
Eric Greening, spoke of smoking issues in Stadium Park and the possible fire hazards
that could be created by it. He talked about the flammable environment and the close
proximity of homes in Stadium Park and other City parks.
Wayne Hanson, resident and Chairperson of San Luis Obispo County Smoking
Coalition, said he's in attendance at this meeting as volunteer. He commended the sub-
committee and expressed amazement at amount of work they did. Mr. Hanson
announced that he was not happy with results or recommendations. He spoke about
fire hazards related to smoking and reminded the Commission that the Community
looks to them to make policy decisions.

Amber Aloin, Health Education Specialist with the County of San Luis Obispo Public
Health Department Tobacco Control Program, thanked the sub -committee for their
work. She pointed out that students are especially concerned about tobacco in the
community. Ms. Aloin said that the Commission has an opportunity to be leaders for the
community.
Sandy Jack, resident, said he served on Commission during Stadium Park project. He
commended the sub -committee's work. Mr. Jack stated that he is against continued
erosion of individual rights and freedoms and doesn't want designated smoking areas or
total bans. He encouraged the Commission to not add another law that the City can't
enforce.
Bill Hatch, resident, concurred with Mr. Jack's remarks about individual freedom and
rights. He said that we don't want to create laws that divide the community and create
confrontation amongst our citizens. Mr. Hatch encouraged the Commission to weigh
this carefully.
Al Fonzi, 7880 Sinaloa, suggested that gathering signatures of thousands of registered
voters, then taking the issue to Council is the way to go. He said he is not in favor of a
total ban in park areas, options one or two are the best choices in his opinion. Mr. Fonzi
also expressed that the City does not have the police resources to try to enforce such a
ban.
Chairperson Butz closed the Public Comment Period.
Community Services Director Brady Cherry clarified that the report in the packet is the
work of the sub -committee, not City staff. He thanked all three of the sub -committee
members for their hard work and dedication.
Commissioner Marks thanked everyone for showing up and voicing their opinion.
Commissioner Zirk inquired who was in charge of the phone survey regarding the
smoking issue for which he received a phone call late last year and what were the
results.
Chairperson Butz re -opened the Public Comment Period.
Christina Le Fevre, resident and Health Education Specialist with the County of San
Luis Obispo Public Health Department Tobacco Control Program, stated that she is
appearing before the Commission this evening on maternity leave, not as paid
employee. She stated she has no knowledge of a phone survey being conducted in the
City of Atascadero regarding the proposed smoking ban. Ms. Le Fevre answered
questions of the Commission.

Commissioner Hatch, said that if people are truly interested in something, they will show
up. She commented that people had numerous chances to show up and speak and
that few people actually attended. Ms. Hatch believes the Commission and sub-
committee has done their due diligence with this issue.
Commissioner Cooper thanked the sub -committee and public speakers. He said he has
a strong opinion about this issue, especially being he's a Health Science teacher. He
agreed that attendance was poor and that effort was made. Mr. Cooper agreed with
Commissioner Marks to take no action at this time and possibly collect more
information. He strongly encouraged a full ban.
Commissioner Zirk commented that in his research 9 cities have banned tobacco
products outright in all city parks and 2 cities banned it in designated areas. He
expressed concern about setting an example for the young people.
Youth Representative Matthew O'Connell said aside from all the health issues, visiting a
park should be a pleasant outdoor experience. He personally feels that if he is in the
area where smoker is, it does make him feel uncomfortable. Mr. O'Connell stated that it
would be difficult to enforce but he wants to see a more pleasant environment. He said
that restricted areas would be beneficial.
Commissioner Hatch commended Commissioner Cooper on educating youth about
health issues as a teacher. She stated that educating youth that they can make choices
is important. With regards to cigarette litter, Ms. Hatch talked about other types of trash
that are strewn about the parks.
Commissioner Marks recommended that staff reports be filled with facts.
Chairperson Butz said she talked to a lot of people and that they are really divided. She
expressed concern about why the public didn't come out to comment on this issue when
they were offered so many opportunities. She expressed worries about the costs
involved with a total ban and the ability to enforce.
Vice Chairperson Dan Chacon said he thinks there is a lot of personal and emotional
attachment people have to this issue. He re-emphasized that the sub -committee really
tried to take all of their emotions and personal feelings out of this issue. Mr. Chacon
encouraged that we don't characterize other people by what they do.
Commissioner Greenaway expressed that she could see banning smoking at the Zoo
but not at a park.
A discussion about possible Motions ensued amongst the Commissioners.

Greenaway to implement the second options to recommend
implementation of partial restrictions in such places as;
1. Zoo
2. Children's playground. (already State law)
3. Spectator areas at City parks (within 20 feet) in such
places as;
a. Concerts
b. Movies
c. Athletic Events
d. Theatrical Events, etc.
4. For the above restricted areas, we recommend
identifying designated smoking areas.
Motion passed 6:0 by a roll -call vote. (Zirk abstained)

Community Services Director Brady Cherry talked about quarterly Mayor/Mayor Pro -
Tem and Chair/Vice-Chair meetings. He asked that if the Commission has any items to
be discussed at this meeting, to relay them to Chairperson Butz or Vice Chairperson
Chacon.
Commissioner Hatch added the following items to the items list for the meeting:
• The City promote use of Colony Park Community Center to be utilized more
as money maker during the day (conventions, seminars, etc.)
• Utilization of Stadium park
• Increase efforts to utilize and promote Atascadero Lake Park more during the
Holiday season
Chairperson Butz suggested the following be added to the list:
• Using Colony Park Community Center for more senior activities

Staff Report — Public Works Department
Petanque Club Request
Colony Park Community Center
RECOMMENDATION:
Commission approve the request by a local Petanque Club to improve an area at
Colony Park for a temporary location for a Petanque Terrain (Court).
DISCUSSION:
There is a request by a local Petanque Club to convert the unused dirt area behind the
outdoor basketball courts at the Colony Park Community Center to a Petanque Terrain
(courts). This currently neglected space can be transformed into a popular focal point
for healthful recreation by broad local demographics as well as be a tourist attraction.
The improvements will be temporary until the Colony Park Master Plan is completed.
The improvements will essentially be setting aside a flat decomposed granite surface
for the courts. The area will be temporary until permanent courts can be located in the
Colony Park Master Plan or elsewhere. The Club will be utilizing surplus materials and
volunteer help to minimize costs. Mr. Nathan Doster of the Petanque Club will be
present to answer questions, if necessary.
FISCAL IMPACT:
None to the City, the Club will do the improvements.

Staff Report — Public Works Department
Wrestling Bacchantes
Location Selection Process
RECOMMENDATION:
Commission receive, comment and file. No action required.
DISCUSSION:
Background: The sculptured statue known as the Wrestling Bacchantes was created by
Italian artist Petrilla and exhibited at the 1904 World's Fair by the Italian Government. It
was then purchased by Atascadero Founder E.G. Lewis for display in the Atascadero
Colony Civic Center. They were displayed at various locations in the Civic Center prior
to their most recent installation in the Sunken Gardens.
Ethos, a well respected art conservation firm located in Cambria, was contracted to
evaluate the statue, resulting in the 2004 Condition Assessment Report and
Conservation Treatment Proposal. The report described in detail the condition of the
statue and the various factors that had contributed to their deterioration. Factors such
as rain, temperature fluctuations and water condensation; microbiological growth, road
vibrations, and vandalism all contributed to the deterioration. Additionally, previous
restorations had created stress points which over time resulted in cracks in the original
marble.
On December 12, 2006, the Atascadero Community Redevelopment Agency awarded a
contract for $235,100 to Ethos for the restoration and conservation of the Wrestling
Bacchantes. The restoration is currently well underway at the Ethos studio in Cambria.
It is anticipated that the restoration will be complete and the statue ready for return late
this year.

On February 10, 2009 staff made a presentation to City Council regarding the
placement of the statue upon completion of the restoration. Staff asked for direction
regarding the process to determine the location. The City Council directed staff to
return the statue to somewhere in the Sunken Gardens and to work through the Parks
and Recreation Commission to seek input from the Historical Society, Ethos and the
public. This process is to result in a recommendation to the City Council.
Conclusion: Staff proposes to bring this item back to the Parks and Recreation
Commission in June or July in the form of a workshop that will include the following:
• Presentation by Ethos regarding long-term care and display concerns.
• Comments by the Atascadero Historical Society.
• Placement options in the Sunken Gardens prepared by City staff considering
financial and other constraints.
• Public comment opportunities
A final recommendation from the Parks and Recreation will be forwarded to the City
Council following the public workshop.
FISCAL IMPACT:
There are no financial impacts of the actions presented in this staff report. The
Atascadero Redevelopment Agency budget for 2007-2009 has a current balance of
$51,980.00 for the return transportation and placement of the statue.

Master Plan Revision Process /
New Site Location for the Wastewater Overflow Basin
For Colony Park (Formerly Traffic Way Park)
RECOMMENDATION:
Commission review previous Park Site Plan and subsequent changes, identify
stakeholders for the Site Plan revision and approve the process for the final Park Master
Plan. Commission may also consider approval of the new location for the Wastewater
Overflow Basin at this time.
DISCUSSION:
Background: In August 2004, the City Council directed staff to proceed with the
development of a site plan for the expanded Colony Park/Traffic Way Park, and develop
a building design for the new Recreation Center. The City retained the services of Volz
Design, landscape architects and park planners, to work with the City in developing a
Site Master Plan for Colony Park/Traffic Way Park and the Recreation Center complex.
To expedite the planning process, a team of community members and staff members
were assembled to form a focus group to develop ideas and design concepts for the
site. The focus group was comprised of the following individuals; Barbie Butz, Jerri
Dahlen, Rod Landis, Doug Livengood, Rick Matthews, Jay Sechrist, Barbara Newsome,
Jamie Ogden, Paula Anton, Brady Cherry, Geoff English, Dan Lashley, Steve Kahn,
and project architects David Volz and Gary Vazquez.
The City of Atascadero also retained the services of BFGC Architects, to prepare the
design plans for the new Recreation Center building. City staff worked with the architect
on the building design, and the plans were approved by the City Council in February of
2005. The construction documents were then prepared, and additional exterior park
features were subsequently added to the project, as the Community Center construction
budget allowed for the exterior landscaping, picnic area, and outdoor basketball courts.
COLONY PARK/TRAFFIC WAY PARK MASTER PLAN
The Colony Park focus group team walked the 12.5 care site at its first meeting, and
discussed and evaluated the present environment of the total property. Many ideas and
issues were discussed including, tying the facility to the downtown, using the creek as a
natural park amenity, trail and pedestrian connections, determining the use of the Hay
and Feed building (now the George Beatie Skate Park), setting aside an area for a
future pool facility, visibility from the street, adequate parking, and the many present and
future uses of the entire park site.
The focus group recognized that the future development of Colony Park facilities would
play an important role in creating and reshaping the use of the park property itself, and
could have a significant impact on the downtown area in a positive sense.
The original site plan that was developed Plan incorporated several guiding principles
important to the focus group:
1) It must be able to accommodate the construction of the recreation center within
one year.
2) It must retain and enhance the Atascadero Girls Softball Association uses.
3) It must include the development of a skate park on-site.
4) It may identify an area to be set aside for a future pool site.
5) It should protect and enhance the riparian areas.
6) It should be balanced in design to meet present and future needs.
7) It must be proportionate to Atascadero's population and economic growth of the
community.
Based upon the above and many other factors discussed by the focus group, the
Committee went through design exercises to explore a number of design options.
The Site Master Plan (attached) approved the City Council represented a refinement
of all of the factors discussed by the focus group, F.Y.I. (teen advisory group), and
the Parks and Recreation Commission at its own public hearing on February 17,
2005.
David Volz, of Volz Design, described the original plan as an expression of the
direction of how the citizen groups and city staff envisioned Colony Park
accommodating the new Recreation Center building, and how the entire park
complex could function in the future. Colony Park has become a significant part of
Atascadero's community life now, and it will become even more vital in the future as
the park improvements are made and the city's downtown evolves. The Parks and
Recreation Commission, the Colony Park Focus Group, F.Y.I. and city staff all came
up with a good plan with the information available at that time.
Once new information became available, a number of things occurred which caused
changes in the original site plan once the Colony Park Community Center design got
underway. The primary change involved shifting the Community Center building on
the property from the location originally conceived in the site plan. The building
location was shifted to the current location due to several factors; the project no
longer required the ball fields to be moved because the undergrounding of the
wastewater overflow basin was determined to be impractical, and there was a desire
to save considerable money needed to move the ball fields, and also save as many
mature trees on the property as possible (particularly the native sycamores and
oaks). These trees can be seen surrounding the Community Center today. Thus, the
ball fields remain in their original location, and the building was shifted southwest.
After it was determined that the overflow basin would not be feasible to underground
beneath the relocated ball fields, Public Works Engineering staff started work to
design a new above ground basin in a new location on the site. That work has now
been done, and drawings are attached which shown the new location. This project is
ready to be approved by the City Council and have bids sent out. The project is
being held until the Parks and Recreation Commission can review and approve the
new location. This approval could be done at anytime from the time of the
Commission meeting of March 19th, 2009, forward, as deemed appropriate by the
Commission. Once approved, the project will proceed, and the Commission will
establish the permanent location for the basin, and the park master planning process
will account for that change.
COLONY PARK COMMUNITY CENTER
The new Community Center building has been in operation since December, 2007,
and the site has worked very well, including the new exterior project amenities.
Public input by citizens and youth was incorporated into determining the activities,
features and spaces in the new center building. The desired programs are reflected
in the architect's design. Some of the noteworthy features of the center included in
the facility are a large gymnasium, teen center with lounge and cafe, dance/exercise
room, arts and crafts room, meeting room, computer unit, storage, staff offices and
restrooms. Exterior improvements were included in the project, including the picnic
area, basketball courts and an area set aside for a "sprayground" water play area.
Parking around the Community Center and Colony Park, has emerged as an issue
that must be addressed as the Commission considers modifying the site plan.
2009 SITE MASTER PLAN CONSIDERATIONS
- The Community Center footprint created by the shifting on the building on the site.
- The Girl's Softball Association Fields to remain in their original location.
- The Wastewater Overflow Basin being relocated to a new above -ground location.
- Consideration of need for additional parking.
- Is there enough space and parking for Aquatics Center w/pool? Is a pool feasible?
- What is the highest and best use for the old Overflow Basin site?
- Providing for Atascadero Creek Trail enhancements and amenities.
- Current as -built locations for basketball courts, water play area and picnic area.
- Other new recreation features and facilities that could be added to the Park.
- Original site plan features and uses to be re -visited.
- Retaining Parks and Facilities maintenance building and storage area on site.
- Neighborhood impacts.
- Identifying community stakeholders to include in the Master Plan process.
FISCAL IMPACT:
Revision process will be conducted by the Commission and City staff. Funding for David
Volz, Inc., the current plan's original designer, to prepare new park conceptual design
plans will be between $5,000 and $9,500, depending upon the scope and number of
revisions necessary to finalize the plan.
