Tree to be planted at Atascadero Lake Park Memorial Grove Site #3 in

1. Banning or Restricting Smoking in the City's Outdoor Recreation
Areas, Parks and the Charles Paddock Zoo

■ Recommendation: Commission gather public input to aide in the

committee regarding smoking in City outdoor recreation areas, parks
and the zoo.

resident, Howard Marohn, to restrict dogs from access to the lawn area

WELCOME TO THE ATASCADER0 PARKS AND RECREATION COMMISSION MEETING
The Parks and Recreation Commission meet in regular session on the third Thursday of each month at 7:00 p.m., in the
Atascadero City Hall, located at 6907 El Camino Real, Atascadero. The Parks and Recreation Commission consider
matters in the order of the printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on
file in the Community Services Department and are available for public inspection during City Hall Annex, 6907 El
Camino Real, during business hours at the Central Receptionist counter and on our website; www.atascadero.org. An
agenda packet is also available for public review at the Atascadero Library, 6850 Morro Road. All documents
submitted by the public during Parks and Recreation Commission meetings that are either read into the record or
referred to in their statement will be noted in the minutes and available for review in the Community Services
Department.
In compliance with the Americans with Disabilities Act, if you need special assistance to participate in a City
meeting or other services offered by this City, please contact the Community Services Department at (805) 461-
5000. Notification of at least 48 hours prior to the meeting or time when services are needed, will assist the City staff
in assuring that reasonable arrangements can be made to provide accessibility to the meeting or service.
TO SPEAK ON AGENDA ITEMS
Members of the audience may speak on any item on the agenda. The Parks and Recreation Chairperson will identify
the subject, staff will give their report, and the Commission will ask questions of staff. The Chairperson will announce
when the public comment period is open and will request anyone interested to address the Commission regarding the
matter being considered to step up to the lectern. If you wish to speak for, against or comment in any way:
• You must approach the lectern and be recognized by the Chairperson
• Give your name and address (not required)
• Make your statement
• All comments should be made to the Chairperson and Commission
• All comments limited to 3 minutes (unless changed by the Commission)
• No one may speak for a second time until everyone wishing to speak has had an opportunity to do so, and
no one may speak more than twice on any item.
The Chairperson will announce when the public comment period is closed, and thereafter, no further public comments
will be heard by the Commission.

Chairperson Sechrist called the meeting to order at 7:02 p.m. and Commissioner Chacon led the
Pledge of Allegiance.

COMMISSION/ YOUTH REPRESENTATIVE ANNOUNCEMENTS AND REPORTS:
Commissioner Marks informed the Commission that she had visited Grace Pucci, former recording
secretary, and reported that she has lots of challenges ahead, but is doing well.
Commissioner Hatch expressed appreciation for everyone's efforts and announced that
construction on the Veteran's Memorial has begun.

■ Recommendation: Commission recommend approval to the City Council of a
request by Sal Orlando to dedicate a California Sycamore Tree to be planted at
Atascadero Lake Park Memorial Grove, Site #11, in memory of David Orlando.

PUBLIC COMMENT - None
MOTION: By Commissioner Istenes and seconded by Commissioner Hatch
to approve Consent Items #2 and #3.
Motion passed 6:0 by a roll -call vote. (Marks abstained due to
absence at June 19, 2008 meeting)
Community Services Director Brady Cherry asked that Item #A-1 be approved with the addition of
Mr. Garth Leaven's last name to the minutes.
MOTION: By Commissioner Dunn and seconded by Commissioner Marks to
approve Consent Item #1 with the addition of Mr. Garth Leaven's
last name to the minutes.
Motion passed 7:0 by a roll -call vote.
B. MANAGEMENT REPORTS:
1. Policy Development Process: Proposed Ban of Tobacco -Use in Outdoor
Recreation Areas, Parks and the Charles Paddock Zoo
• Fiscal Impact: None.
■ Recommendation: Commission form a sub -committee to gather information,
review the policy options, and hold public discussion in a publically noticed
meeting to develop recommendations to return to the entire Parks and Recreation
Commission in September. [Community Services]
Community Services Director Brady Cherry gave the staff report and answered questions of the
Commission.
PUBLIC COMMENT
Christina LeFevre, Health Education Specialist with the San Luis Obispo County Health
Department Tobacco Control Program, commented that they are proposing full tobacco ban, to
include smokeless tobacco.
Chairperson Sechrist closed the Public Comment period.
MOTION: By Commissioner Dunn and seconded by Commissioner Marks to
form a sub -committee to gather information, review the policy
options, and hold public discussion in a publically noticed
meeting to develop recommendations to return to the entire Parks
and Recreation Commission in September.
Motion passed 5:2 by a roll -call vote. (Hatch and Sechrist
opposed)
There was Commission consensus that Commissioner Chacon, Hatch and Chairperson
Sechrist will be members of the sub -committee.
2. Consideration of Cancelling the August 2008 Parks and Recreation
Commission Meeting
■ Fiscal Impact: None.
■ Recommendation: Commission consider canceling the regular August Parks and
Recreation Commission meeting. [Community Services]
Community Services Director Brady Cherry gave the staff report and answered questions of the
Commission.
PUBLIC COMMENT - None
MOTION: By Commissioner Chacon and seconded by Commissioner Dunn
to cancel the regular August Parks and Recreation Commission
meeting.
Motion passed 7:0 by a roll -call vote.
C. COMMITTEE & LIAISON REPORTS:
Vice Chairperson Butz noted that at the upcoming Prevention Alliance banquet, August 21 st, Mitzi
O'Rourke will be receiving an award.
Chairperson Sechrist spoke of the upcoming Commission Chair/Council meeting and asked that
Commissioners submit anything they would like to have discussed to him, Brady Cherry or
Shannon Sims.
D. STAFF COMMENTS/ ANNOUNCEMENTS:
Community Services Director Brady Cherry mentioned that tentatively the joint City Council/Parks
and Recreation Commission Meeting will be scheduled in September or October. He said this
meeting will be to discuss items that will be strategic objectives and goals for the next couple fiscal
years.
Community Services Director Brady Cherry reported that the RCD Trail project has been re -scoped
and the Commission will probably take the lead in the public process.
Vice Chairperson Butz pointed out that her and Commissioner Hatch's e-mails are noted
incorrectly in the newspaper.
Community Services Director Brady Cherry reviewed upcoming events and gave project updates.
Deputy Director of Public Works — Operations Geoff English relayed project updates to the
Commission.
Commissioner Hatch informed the Commission that on September 20th, at 10:00 a.m., at the
Atascadero Lake Park, there will be a Poker Run benefit barbecue for the Veteran's Memorial.
Commissioner Dunn encouraged the sub -committee to be thorough and impartial.
Commissioner Marks encouraged participation in the City's Music in the Park and City classes
provided at Colony Park Community Center.
Commissioner Butz reported that the Atascadero Wine Festival was a success even though
attendance was down despite the heat.
ADJOURNMENT:
Chairperson Sechrist adjourned the meeting at to next regularly scheduled meeting on September
18, 2008.

CHAMBER SHOWCASE MIXER — ATASCADERO PARKS AND RECREATION
COMMISSION BOOTH:
Commissioners interacted and discussed with the public issues, priorities and projects
of the Atascadero Parks and Recreation Commission. A written survey regarding a
proposed smoking ban in Atascadero's outdoor recreation areas was distributed. 105
surveys were completed by the public. Numerous parks projects and information about
Commission business was on display.
ADJOURNMENT:

Memorial Object Placement Request
Tree Dedication at Atascadero Lake Park Memorial Grove
RECOMMENDATION:
Commission recommend approval to the City Council of a request by Norma Holzer to
dedicate a Western Redbud tree to be planted at Atascadero Lake Park Memorial
Grove Site #3 in memory of Edward Holzer.
DISCUSSION:
Background: Norma Holzer has submitted a request to plant a tree from family and
friends in memory of Edward Holzer in the Atascadero Lake Memorial Grove.
Analysis: The Policy on the Naming of Public Buildings, Parks and Other Public
Facilities includes a provision to be followed by staff for the recognition of individuals.
SECTION II, E.
"In addition to the naming of public facilities by using the criteria established
above, the City can provide for the recognition of individuals, either deceased or
living, by the placement of memorial objects (symbols); such as living trees,
public benches, rocks, memorial flagpoles, sculptures, etc., in public facilities.
The placement and identification of these recognition symbols will be at the
discretion of the Parks and Recreation Commission and the City Council on a
case-by-case basis.
The attached request complies with previously established policies for the recognition of
individuals at City park facilities and is consistent with the established plans for
Atascadero Lake Park.
Conclusion: Staff recommends approval to the City Council of a request by Norma
Holzer to dedicate a Western Redbud tree at Atascadero Lake Park Memorial Grove in
memory of Norma Holzer.

PUBLIC HEARING:
Banning or Restricting Smoking in the City's Outdoor
Recreation Areas, Parks and the Charles Paddock Zoo
RECOMMENDATION:
Commission gather public input to aide in the development of policy options and
recommendations by the sub -committee regarding smoking in City outdoor recreation
areas, parks and the zoo.
DISCUSSION:
Background: At the July 17, 2008, Parks and Recreation Commission Meeting, the
Commission directed that a sub -committee come back with several policy options
regarding smoking in outdoor recreation areas. The options would range from a total
ban on smoking in all parks and the Zoo to taking no action on smoking in these areas.
The sub -committee is comprised of Commissioners Chacon, Hatch and Sechrist; to be
chaired by Commissioner Chacon. The sub -committee has met and developed a survey
to gather wider public input, and has engaged in further research the topic. In addition,
the sub -committee held a public forum on September 30, 2008 at the Pavilion on the
Lake. After sufficient public input, the sub -committee will bring back a range of policy
options so the full Commission. The Commission will then formulate a recommendation
to forward to the City Council.
The San Luis Obispo Tobacco Control Program has offered to provide additional
information and help with identifying the policies adopted by other cities.
Smoking is currently prohibited in playground areas per State law, and at all elementary
and secondary school properties. Regulations might affect the smoking and the use of
tobacco products in the following recreational areas:
- Atascadero Lake Park
- Colony Park
- Paloma Creek Park
- Sunken Gardens
- Apple Valley Park
- Stadium Park
- Charles Paddock Zoo
- City owned recreational trails
Many California cities already have some type of prohibitions against smoking in public
recreation areas. Atascadero would be assessing whether to join these cities in by
creating some sort of ordinance to prohibit or limit smoking in the Zoo and the City's
outdoor recreation areas. There are also more than 16 zoological institutions in
California that are smoke-free. The Parks and Recreation Commission will conduct a
public hearing at this regular meeting to provide another opportunity to obtain public
input on the matter of smoking and the use of tobacco products in parks and the Zoo.
The smoking survey is on-going.
FISCAL IMPACT:
None at this time.

Staff Report — Public Works Department
Public Request to Restrict Dogs from Access to the
Lawn Areas at Atascadero Lake Park
RECOMMENDATION:
Commission consider a request by Atascadero resident, Howard Marohn, to restrict
dogs from access to the lawn area at Atascadero Lake Park and provide direction to
staff regarding future action, if any, regarding this matter.
DISCUSSION:
Background: Atascadero resident, Howard Marohn, has submitted a letter requesting
that dogs be restricted from access to the lawn areas at Atascadero Lake. (See
Attachment #1) Below is the current Atascadero Municipal Code citation related to
animals in City Parks.
Chapter 1 Atascadero City Park, 10-1.32 Animals and pets.
It is unlawful for any person within the park to commit any of the following acts:
(a) To allow any animal or pet under his supervision to be in the park unless controlled by a
leash not to exceed six (6) feet in length, or by a bridle;
(b) To allow any animal or pet under his supervision to molest, inconvenience or endanger
any occupant of the park;
(c) To abandon any animal or pet under his supervision within the park;
(d) To allow any animal or pet under his supervision to be outside of an enclosed vehicle at
night;
(e) To leave any animal or pet under his supervision unattended at any time;
(f) To allow animal or pet under his supervision to be in any park buildings or structures
except seeing eye and hearing dogs;
(g) To allow any animal or pet under his supervision to use the park as a waste area. (Ord.
105 § 1 (part), 1985)
Analysis: Current rule signs at Atascadero Lake Park notify park users that
dogs must be kept on a leash. In addition, there are currently signs posted requesting
that park users pick up after their dogs. Additional advisory signs may be posted
recommending that park users keep their animals off of the lawn areas, however, we
currently do not have funding for additional signs and this rule would not be enforceable
without modifications to the Atascadero Municipal Code.
Conclusion: Staff requests that the Parks and Recreation Commission consider
a request by Atascadero resident, Howard Marohn, to restrict dogs from access to the
lawn area at Atascadero Lake Park and provide direction to staff regarding future action,
if any, regarding this matter.
FISCAL IMPACT:
None at this time.
