Memorial Obiect Placement Reauest — Tree Dedication at Atascadero Lake Park Memorial Grove (Orlando) ■ Fiscal Impact: None. ■ Recommendation: Commission recommend approval to the City Council of a request by Sal Orlando to dedicate a California Sycamore Tree to be planted at Atascadero Lake Park Memorial Grove, Site #11, in memory of David Orlando. Shannon Sims, Administrative Assistant City of Atascadero City of Atascadero WELCOME TO THE ATASCADER0 PARKS AND RECREATION COMMISSION MEETING The Parks and Recreation Commission meet in regular session on the third Thursday of each month at 7:00 p.m., in the Atascadero City Hall, located at 6907 El Camino Real, Atascadero. The Parks and Recreation Commission consider matters in the order of the printed Agenda. Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on file in the Community Services Department and are available for public inspection during City Hall Annex, 6907 El Camino Real, during business hours at the Central Receptionist counter and on our website; www.atascadero.org. An agenda packet is also available for public review at the Atascadero Library, 6850 Morro Road. All documents submitted by the public during Parks and Recreation Commission meetings that are either read into the record or referred to in their statement will be noted in the minutes and available for review in the Community Services Department. REGULAR SESSION: ITEM NUMBER: A - 1 DATE: 07/17/08 CITY OF A TA SCA DERO PARKS AND RECREA TION COMMISSION DRAFT MINUTES Thursday, May 15, 2008 7:00 P.M. Chairperson Sechrist called the meeting to order at 7:05 p.m. and Vice Chairperson Butz led the Pledge of Allegiance. ROLL CALL: Present: Commissioners Chacon, Istenes, Marks, Vice Chairperson Butz and Chairperson Sechrist. Student Representative Paige Buck -Moyer Absent: Commissioner Dunn (excused) and Commissioner Hatch (excused) Others Present: Administrative Assistant Shannon Sims. Staff Present: Community Services Director Brady Cherry, Deputy Director of Public Works — Operations Geoff English and Assistant to the City Manager/City Clerk Marcia McClure Torgerson. COMMUNITY FORUM: Katie Patterson, student at Atascadero High School, spoke about the harmful effects of second hand smoke and expressed her concerns about exposure to smoke both indoors and outdoors. A community member spoke about the April 19th Tobacco Liter Clean -Up day that was held in Atascadero Lake Park in observance of Earth Day. She noted the large number of cigarette butts found in a short period of time at the park. Christina LeFevre, Health Education Specialist with the County of San Luis Obispo County Health Department Tobacco Control Program, elaborated on how smoke free areas can benefit the community. She has spoken to students at Atascadero High School about how they can improve their environment and has had a great response from them. She distributed education packets to the Commissioners. Digan Erickson, Atascadero High School student, spoke of her concerns with smoking amongst her peers. Chairperson Sechrist closed the Community Forum period. APPROVAL OF AGENDA: MOTION: By Vice Chairperson Butz and seconded by Commissioner Marks to approve the agenda. Motion passed 5:0 by a roll -call vote. COMMISSION/ YOUTH REPRESENTATIVE ANNOUNCEMENTS AND REPORTS: Vice Chairperson Butz encouraged the Commission to attend the upcoming Canine in the Park event on Saturday, May 31St, from 11:00am — 2:OOpm. Commissioner Marks spoke about a small, local organization called Vision Atascadero. She encouraged the submittal of photographs to the organization, featuring the theme, "Why I'm Glad to Live, Work or Play in Atascadero." For more information she urged people to contact Bruce Bevens at bbevens(cD-visionatascadero.com . Commissioner Chacon said he thinks Stadium Park is a "crown jewel" and would love to see it developed. Student Representative Buck -Moyer informed the Commission that there is a club at Atascadero High School called the National Honor Society that is participating in an upcoming 24-hour relay event. This event will raise money for drug and alcohol prevention in San Luis Obispo County. The event takes place on Friday - Saturday of Memorial Day weekend. Ms. Buck -Moyer welcomed any donations to go towards the entry fee. PRESENTATION: 1. Atascadero Champion of the Community Award 2007 presentation to Judy Hutton. Community Services Director Brady Cherry presented Judy Hutton the award and spoke of her selfless and tireless efforts at the Charles Paddock Zoo and for the Zoological Society. A. Parks and Recreation Commission Special Meeting Minutes — April 17, 2008 ■ Staff Recommendation: Commission approve the Parks and Recreation Commission Special Meeting Minutes of the April 17, 2008 meeting. [Community Services] MOTION: By Commissioner Chacon and seconded by Chairperson Sechrist to approve the consent calendar. Commissioner Istenes pulled Item A-2. Commissioner Istenes asked that an addition be made to her statements in the March 20, 2008 Minutes to include the following: that since it is only March, and delivery is not until August, there would be time to have a contest in the schools with June deadline and that she said that "Building the Dream" should have Atascadero children and residents involved. Assistant to the City Manager/City Clerk Marcia McClure Torgerson explained the process of preparing, approving and processing Minutes. She stressed that the Minutes are intended to be "summary" minutes to record actions and public comments. Ms. Torgerson answered questions of the Commission. MOTION: By Commissioner Chacon and seconded by Commissioner Marks to approve Consent Items A-1, A-2 & A-3 with the addition of Commissioner Istenes' requested comments to Item A-2. Motion passed 5:0 by a roll -call vote. B. MANAGEMENT REPORTS: 1. Atascadero Lake Water Qualitv Improvement Proiect / Duck Feedinq Education Program (Cal Poly Senior Project — Progress Report Presentation) Fiscal Impact: None. ■ Recommendation: Commission receive report and comment. Informational item only. [Public Works] Deputy Public Works Director — Operations Geoff English briefed the Commission on the project and introduced Cal Poly Student, Garth. Garth, a Senior at Cal Poly University, presented a powerpoint presentation on the harmful effects ducks can have on water quality and the education program he developed to address this problem. He circulated copies of a postcard and flyers he created to circulate in order to help inform the public of the dangers of feeding and contributing to the ducks at Atascadero Lake. He also relayed his plans to use permanent signage around the Lake. Commissioner Marks suggested speaking with the City of Pismo Beach since they have had to deal with similar issues with the seagulls. Commissioner Chacon found the presentation to be very informative. He suggested addressing the issue of people dumping off their ducks at the Lake and encouraged seeking civic organizations for help with marketing efforts. Commissioner Istenes expressed her appreciation for the efforts. She encouraged pictures showing native fowl, not domestic, be shown on City advertising. Vice Chairperson Butz preferred the picture of the duck with a slash in it. She suggested starting the campaign with schools. Chairperson Sechrist relayed his appreciation and asked for clarification on the flyer/postcard. PUBLIC COMMENT - None. 2. Commission Manual ■ Fiscal Impact: None. ■ Recommendation: Commission read and review the Commission Manual from the City Clerk. Informational item only. [Community Services] Community Services Director Brady Cherry thanked Marcia McClure Torgerson for producing the Commissioner Manuel and mentioned that he will be sending additions and addendums to Commissioners to add to the manual as the need arises. Mr. Cherry turned the time over to Marcia McClure Torgerson. Assistant to the City Manager/City Clerk Marcia McClure Torgerson elaborated on the manual and reviewed various sections and answered questions of the Commission. PUBLIC COMMENT - None. C. Deputy Director of Public Works – Operations Geoff English updated the Commission on status of various park projects. Deputy Director of Public Works – Operations Geoff English informed the Commission that on Tuesday, May 22nd the California Department of Fish and Game will be conducting a fish sampling project at Atascadero Lake. Community Services Director Brady Cherry said that there will be an article in the fall Atascadero Magazine regarding ducks and fish issues. E. Chairperson Sechrist called the meeting to order at 7:08 p.m. and Commissioner Istenes led the Pledge of Allegiance. Eric Greening encouraged the Commission to scrutinize and participate in the processing of the general plan amendment for Eagle Ranch. Commissioner Istenes attended a National Parks Service meeting regarding the Anza Trail. She encouraged the City to do their part with helping with GIS mapping. APPROVAL OF AGENDA: MOTION: By Vice Chairperson Butz and seconded by Commissioner Hatch to approve the agenda. Motion passed 6:0 by a roll -call vote. COMMISSION/ YOUTH REPRESENTATIVE ANNOUNCEMENTS AND REPORTS: Vice Chairperson Butz presented the Atascadero Wine Festival brochure that will be distributed for the upcoming event. A. CONSENT CALENDAR: No reports. B. MANAGEMENT REPORTS: 1. Fish Habitat Presentation (California Department of Fish and Game) ■ Fiscal Impact: None. ■ Recommendation: Informational Item Only. No Action Required. [Public Works] Deputy Director of Public Works — Operations Geoff English gave brief staff report and introduced Mike Hill with the Department of California Fish and Game. Commissioner Istenes abstained from this Item and dismissed herself to sit in the audience. Mike Hill presented a power point presentation and relayed information about the history and findings on various lakes. He explained the spawning phases and processes and elaborated on electrofishing procedures. He explained in great detail the issues and findings associated with Atascadero Lake. Mr. Hill answered questions of the Commission. LynneDee Althouse, Ph.D., Althouse and Meade Biologists, updated the Commission on the construction and placement of the floating island that is located near the island in the lake. ITEM NUMBER: A - 2 DATE: 07/17/08 PUBLIC COMMENT Eric Greening thanked both of the presenters and inquired about the sustainable yield in terms of pressure that can be accommodated. Mr. Greening also inquired if birds are taken into consideration as well. Mike Hill responded to Mr. Greening's inquiry by stating that Trout are re -stocked every two weeks and if fishing pressure increases they put more fish out. Commissioner Istenes inquired if California Fish and Game would ever get involved with funding a study. Mike Hill responded that the Department of Fish and Game would not; a study would have to come out of the City's budget. Chairperson Sechrist closed the Public Comment period. Commissioner Dunn expressed concerns about the accuracy of who counts and watches. She also inquired about digging deeper and adding rocks at the bottom of the lake. Mike Hill responded that very good Wardens are in charge of counting and that digging deeper really wouldn't be a feasible option. Commissioner Istenes rejoined the Commission. 2. Pr000sed Ban of Tobacco -Use in Outdoor Recreation Areas. Parks and the Charles Paddock Zoo ■ Fiscal Impact: Approximately $1,200 for signage and education materials. The Tobacco Control Program can help with some of these initial costs. ■ Recommendation: Commission review the policy issues, receive public comment and recommend regulation of smoking in outdoor recreation areas to the City Council. [Community Services] Deputy Director of Public Works — Operations Geoff English reviewed basic details of this item and introduced Christina LeFevre. Christina LeFevre, Health Education Specialist with the County of San Luis Obispo County Health Department Tobacco Control Program presented a powerpoint presentation promoting banning tobacco use and answered questions of the Commission. Commissioner Chacon commented that the hardest aspect of the proposed ban will be the enforcement. PUBLIC COMMENT Denise Carigo, an Atascadero High School student, read a prepared statement about how smoke hurts everyone, even animals. Maggie Carigo is involved with lots of organizations and wants to help establish the precedence that tobacco use is not acceptable in our community. ITEM NUMBER: A - 2 DATE: 07/17/08 Deidre Millage, San Luis Obispo County Drug and Alcohol Services, works with 10 different organizations within the county and is representing several roles. Ms. Millage said that youth smoking is a community problem. Lane Hanson, resident of Atascadero and Chairperson of County Tobacco Control Coalition, spoke about the progress being made in reducing second hand smoke both in and outdoors. Chairperson Sechrist closed the Public Comment period. Vice Chairperson Butz questioned what other county parks are involved. Christina LeFevre responded that Pismo, Arroyo Grande Fields, Morro Bay Beach are currently smoke free. Ms. LeFevre said that County parks are not smoke free yet. Commissioner Hatch expressed her appreciation for the time, energy and commitment to this. She expressed concern when taking away people's rights and thinks education would be a better and more productive route. Commissioner Istenes expressed worry about enforcement and discrimination. PUBLIC COMMENT Maggie Carigo gave a positive example of how someone could deal with enforcing the ordinance. Chairperson Sechrist closed the Public Comment period. Commissioner Dunn expressed appreciation and commented there will always be people who think that their rights supersede others and she thinks that's a poor excuse. Commissioner Chacon congratulated the Atascadero High School students for pressing forward with this issue and reminded them they have the responsibility to tell their piers to stop smoking when they see them doing it. Chairperson Sechrist relayed his appreciation for the efforts to help people stop smoking. He believes, however, that something like this infringes on the rights of people and has concern about enforcement issues. Commissioner Hatch said she appreciates people who are passionate. She does not like smoking, personally, but respects the freedoms of everybody. She doesn't think we have right to pick and choose which behaviors people around us have. Student Representative Buck -Moyer spoke about peer pressure and thinks that creating smoke free areas help to create positive peer pressure. Commissioner Istenes suggested giving people smoking areas instead of all out banning. She also suggested having kids to community service to pick up cigarette butts. ITEM NUMBER: A - 2 DATE: 07/17/08 MOTION: By Commissioner Hatch and seconded by Commissioner Istenes to accept the ban within the perimeter of the zoo and within 25 feet of any outdoor public seating area which would include ball fields and bleachers. Motion failed 3:3 (Chacon, Dunn and Butz opposed). More discussion ensued amongst commissioners. MOTION: By Commissioner Dunn and seconded by Vice Chairperson Butz to recommend that staff come back to us with a proposal with regulation of smoking in outdoor recreation areas and the Charles Paddock Zoo. Further discussion took place by commissioners. MOTION: By Commissioner Dunn and seconded by Vice Chairperson Butz to recommend that staff come back to the Commission with several different proposals, ranging from an all out ban on smoking at the Charles Paddock Zoo and in all outdoor recreation areas, a proposal that is more moderate in scope that has designated areas in which people are not to smoke and possibly an additional proposal where there is even a smoking area for smokers so that the Commission can review and forward it to the City Council. Motion passed 5:1 by a roll -call vote (Sechrist opposed). 3. Mid -Year and Mid -Cycle Budget Revisions ■ Fiscal Impact: None. ■ Recommendation: Informational Item Only. ADJOURNMENT: Chairperson Sechrist adjourned the meeting at 10:25 p.m. MINUTES PREPARED BY: Shannon Sims, Administrative Assistant ITEM NUMBER: A - 3 DATE: 07/17/08 Atascadero Parks and Recreation Commission Staff Report — Community Services Department Memorial Object Placement Request Tree Dedication at Atascadero Lake Park Memorial Grove (Orlando) RECOMMENDATION: Commission recommend approval to the City Council of a request by Sal Orlando to dedicate a California Sycamore Tree to be planted at Atascadero Lake Park Memorial Grove, Site #11, in memory of David Orlando. DISCUSSION: Background: Sal Orlando has a request to plant a tree from family and friends in memory of David Orlando in the Atascadero Lake Memorial Grove. Analysis: The Policy on the Naming of Public Buildings, Parks and Other Public Facilities includes a provision to be followed by staff for the recognition of individuals. SECTION II, E. "In addition to the naming of public facilities by using the criteria established above, the City can provide for the recognition of individuals, either deceased or living, by the placement of memorial objects (symbols); such as living trees, public benches, rocks, memorial flagpoles, sculptures, etc., in public facilities. The placement and identification of these recognition symbols will be at the discretion of the Parks and Recreation Commission and the City Council on a case-by-case basis. The attached request complies with previously established policies for the recognition of individuals at City park facilities and is consistent with the established plans for Atascadero Lake Park. Conclusion: Staff recommends approval to the City Council of a request by Sal Orlando to dedicate a California Sycamore tree at Atascadero Lake Park Memorial Grove in memory of David Orlando. ATTACHMENT: Letter of Request ITEM NUMBER: B - 1 DATE: 07/17/08 Atascadero Parks & Recreation Commission Staff Report — Community Services Department Policy Development Process: Proposed Ban of Tobacco -Use in Outdoor Recreation Areas, Parks and the Charles Paddock Zoo RECOMMENDATION: Commission form a sub -committee to gather information, review the policy options, and hold public discussion in a publically noticed meeting to develop recommendations to return to the entire Parks and Recreation Commission in September. DISCUSSION: Background: At the June 19, 2008, Parks and Recreation Commission meeting, the Commission directed that staff come back with several policy options regarding smoking in outdoor recreation areas. The options would range from a total ban on smoking in all parks and the Zoo, to doing nothing at all. These options will help the Commission to formulate a recommendation to forward to the City Council. The San Luis Obispo Tobacco Control Program has offered to provide additional information and help with identifying the policies adopted by other cities. Staff is recommending that the Commission form a sub -committee comprised of two Commissioners, a City staff person, a member of the Tobacco Control Program and two citizens at -large to hold a public forum on the topic and work on the range of policies. The sub -committee could hold the public forum in August. Smoking is currently prohibited in playground areas per State law, and at all elementary and secondary school properties. Regulations might affect the smoking and the use of tobacco products in the following recreational areas: - Atascadero Lake Park - Colony Park - Paloma Creek Park - Sunken Gardens - Apple Valley Park - Stadium Park - Charles Paddock Zoo - City owned recreational trails Many California cities already have prohibitions against smoking in public recreation areas. Atascadero would be assessing whether to join these cities in by creating some sort of ordinance to prohibit or limit smoking in the Zoo and the City's outdoor recreation areas. There are also more than 16 zoological institutions in California that are smoke- free. The Parks and Recreation Commission is being asked to form as sub -committee for creating a range of policy options which would regulate outdoor smoking and the use of tobacco products in parks and the Zoo. The Commission will later recommend policy direction to the City Council. FISCAL IMPACT: None. ITEM NUMBER: B - 2 DATE: 07/17/08 Atascadero City Council Staff Report — Community Services Department Consideration of Cancelling the August 2008 Parks & Recreation Commission Meeting RECOMMENDATION: Commission consider cancelling the regular August Parks and Recreation Commission meeting. DISCUSSION: Background: For the past several years, the Parks and Recreation Commission has traditionally been "dark" in August, due to summer vacations, light business and other conflicts. At this time, there is no urgent business pending that would require an August meeting of the Commission this year. Also, there are some potential conflicts which the Commission may want to be aware of. In particular, the San Luis Obispo County Prevention Alliance Annual Awards Dinner is being hosted on August 21st, 2008. City Council Members, City staff, as well as Atascadero Youth Task Force members are invited to attend this event. This year, Atascadero citizens will be receiving awards for their services to youth. Finally, the month of August might possibly be used to hold a public forum on the policy options for the proposed outdoor smoking ban. City staff is recommending that the August 21 st, 2008, meeting be cancelled.
