A RESOLUTION OF THE ATASCADERO CITY COUNCIL
EXTINGUISHING THE SUNSET DATE FOR A 35-FOOT CREEK
SETBACK REQUIREMENT ALONG ATASCADERO CREEK AND
GRAVES CREEK
(GENERAL PLAN POLICY LOC 8.2.2.)
WHEREAS, the Atascadero City Council, approved General Plan Amendment
2003-0007 at a duly noticed Public Hearing held on Tuesday, March 9, 2004, and,
WHEREAS, the General Plan Amendment 2003-0007 amended Policy LOC
8.2.2. by establishing a 35-foot setback along the reservation boundaries of Atascadero
Creek and Graves Creek with a sunset date of March 1, 2005, and,
WHEREAS, the City Council has agendized the issue for a regular meeting on
February 22, 2005 to consider an extension of the sunset date, and,
NOW,THEREFORE, the City Council takes the following actions:
The Atascadero City Council, in a regular session assembled on February 22, 2005,
resolved to extend the date the 35-foot interim creek setback to September 1, 2005, or
until the adoption of the creek setback ordinance, whichever shall occur earlier.
On motion by Mayor Pro Tem O'Malley and seconded by Council Member Luna,
the foregoing Resolution is hereby adopted in its entirety on the following roll call vote:
AYES: Council Members Clay,Luna,O'Malley and Pacas
NOES: Mayor Scalise
ABSENT: None
ADOPTED: February 22, 2005
