A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ATASCADERO, CALIFORNIA, AUTHORIZING THE CITY ENGINEER
TO SIGN AND SUBMIT AN AGREEMENT WITH THE UNION PACIFC
RAILROAD COMPANY FOR THE CONSTRUCTION OF AN OVERPASS
GRADE SEPARATION CROSSING OF THE UNION PACIFIC
RAILROAD COMPANY TRACKS
WHEREAS, the City of Atascadero has received approval to allow construction of a
grade separation crossing of Union Pacific's tracks at the northerly extension of a private portion
of El Camino Real in order to serve properties to the north of the tracts.
NOW, THEREFORE, BE IT RESOLVED by the City council of the City of
Atascadero, as follows:
1. The City Engineer is hereby authorized to sign and submit, on behalf of the City of
Atascadero, a New Public Road Crossing Agreement with the Union Pacific Railroad
Company.
2. The City Clerk is directed to attest the execution of the agreement
3. The City Clerk shall certify to the passage and adoption of this resolution, and it shall
thereupon take effect and be in force.
PASSED AND ADOPTED by the City Council of the City of Atascadero this 14th day of
September, 2004, by the following vote on roll call:
AYES: Council Members Clay, O'Malley, Pacas, Scalise and Mayor Luna
NOES: None
ABSENT: None
ADOPTED: September 14, 2004
