A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ATASCADERO APPROVING TENTATIVE TRACT MAP 2004-0053 AND
TRP 2004-0049 THEREBY ALLOWING A TWO LOT SUBDIVISION OF
APN 030-081-027 AND APN 030-081-033 CONSISTENT WITH THE PD-7
MASTER PLAN OF DEVELOPMENT AMENDMENT TO CUP 2001-0047
AND REMOVAL OF ONE NATIVE OAK TREE
(7257 Parriza Ct. /APN 030-081-027, 033 / Gearhart)
WHEREAS, an application has been received from Kelly Gearhart and Morro Road
Homes, LLC, 6205 Alcantara Avenue, Atascadero, CA 93422, (Applicant & Owner), to consider
a project consisting of a zone change from CR (Commercial Retail) to RMF-16 / PD-7
(Residential Multi-Family with Planned Development Overlay#7) with the adoption of a Master
Plan of Development, and a two-lot residential tract map, on a .36 acre lot located at 7257
Parriza Court(APN's 030-081-027, 033); and,
WHEREAS, the site's General Plan Designation is GC (General Commercial); and,
WHEREAS, the site's current zoning district is CR(Commercial Retail); and,
WHEREAS, the Planning Commission has recommended that the site be re-designated
to HDR (High Density Residential) and rezoned to RMF-16 (Residential Multi-family, 16-units
per acre) including a PD-7 overlay with a Master Plan of Development allowing a two lot
subdivision of the site; and,
WHEREAS, the City Council has ordained that the site be re-designated to HDR (High

including a PD-7 overlay with a Master Plan of Development allowing a two lot subdivision of
the site; and,
WHEREAS, the 1 aws and regulations relating to the preparation and public notice of
environmental documents, as set forth in the State and local guidelines for implementation of the
California Environmental Quality Act (CEQA)have been adhered to; and,
WHEREAS, a timely and properly noticed Public Hearing upon the subject Tentative
Tract Map application was held by the Planning Commission of the City of Atascadero on May
18, 2004 at which hearing evidence, oral and documentary, was admitted on behalf of said
application; and,
WHEREAS, the Planning Commission of the City of Atascadero, did recommend, to the
City Council of the City of Atascadero, approval of Tentative Tract Map 2004-0053; and,
WHEREAS, a timely and properly noticed Public Hearing upon the subject Tentative
Tract Map application was held by the City Council of the City of Atascadero on June 22, 2004
at which hearing evidence, oral and documentary, was admitted on behalf of said application;
and,

NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of
Atascadero:
Section 1. Findings of Approval for Tentative Tract Man, the City Council of the City
of Atascadero finds as follows:
1. The proposed subdivision, as conditioned, is consistent with the General Plan and
applicable zoning requirements.
2. The design and improvement of the proposed subdivision is consistent with the
General Plan and applicable zoning requirements.
3. The proposed subdivision, as conditioned, is consistent with the Planned
Development Overlay District #7 Master Plan of Development (Amendment to CUP
2001-0047).
4. The site is physically suitable for the type of development proposed.
5. The site is physically suitable for the density of development proposed.
6. The design and improvement of the proposed subdivision will not cause substantial
environmental damage or substantially and unavoidably injure fish and wildlife or
their habitat.
7. The design of the subdivision will not conflict with easements acquired by the public
at large for access through, or the use of property within, the proposed subdivision; or
substantially equivalent alternative easements are provided.
8. The proposed subdivision design and type of improvements proposed will not be
detrimental to the health, safety or welfare of the general public.
Section 2. Approval. The City Council of the City of Atascadero, in a regular session
assembled on June 22, 2004 resolved to approve Tentative Tract Map (TTM 2004-0053) subject
to the following:

Planning Services
1. The approval of this application shall become final, PM PS
subject to the completion of the conditions of approval,
following the end of the referendum period for General
Plan Amendment 2003-0010 and Zone Change 2003-
0075 unless,an appeal to the decision is filed within 14
days of the Planning Commission action as set forth in
Section 9-1.111(b)of the Zoning Ordinance.
2. Approval of this Tentative Tract Map shall be valid for PM PS :
two years after its effective date. At the end of the
period, the approval shall expire and become null and
void unless an extension of time is granted pursuant to
a written request received prior to the expiration date.
3. The Community Development Department shall have PM PS
the a uthority to approve m inor c hanges to t he project
that (1) result in a superior site design or appearance,
and/or (2) address a construction design issue that is
not substantive to the Tentative Parcel Map.
4. The Tract Map shall be subject to additional fees for PM PS
park or recreation purposes (QUIMBY Act) as required "
by City Ordinance.
5. The applicant shall record CC&R's for the subdivision FM
subject to the review and approval of the City Engineer,
City Attorney and Planning Department. The CC&R's
shall identify the maintenance responsibilities of all
private driveways, sewer facilities, drainage facilities,
common parking areas, site lighting, landscape areas,
fencing,and other common facilities. The CC&R's shall
also state that each unit shall have no more than three
bedrooms and that all exterior colors,exterior materials,
and yard fencing shall be consistent with the overall
master plan of development.
6. The granting of this entitlement shall apply to the On going PS
property located at 7257 Parriza Ct.(APN 030-081-027,
033)regardless of owner.

7. The subdivider shall defend, indemnify, and hold Ongoing CA
harmless the City of Atascadero or its agents, officers,
and employees against any claim or action brought to
challenge an approval by the city, or any of its entities,
concerning the subdivision
8. A tract map drawn in substantial conformance with the PM PS
approved tentative map, and in compliance with all
conditions set forth herein,shall be submitted for review
and approval in accordance with the Subdivision Map
Act and the City's Subdivision Ordinance.
Engineering Conditions:
PROJECT SPECIFIC CONDITIONS
9. Obtain approval by the City Engineer of the grading & GP CE
drainage plan and the storm drain design&facilities.
10. Detention basins will be designed per section 5.06 GP CE
(Drainage Structures)of the Engineering Standards.
11. Submit calculations to support the design of any GP CE
structures or pipes. Closed conduits shall be designed
to convey the 10-year flow with gravity flow,the 25-year
flow with head, and provide safe conveyance for the
100-year overflow.
12. Provide for the detention of the 50 year developed GP CE
storm runoff,while metering out the 2 year undeveloped
storm runoff.
13. Show the method of dispersal at all pipe outlets. Include GP CE
specifications for size&type.

15. Acquire drainage easements where needed. Drainage GP CE
shall cross lot lines only where a drainage easement
has been provided.

original condition upon completion of construction

18. All public improvements shall be constructed in GP CE
conformance with the City of Atascadero Engineering
Department Standard Specifications and Drawings or
as directed by the City Engineer.
Utilities:
19. There are several large transmission gas mains that GP CE
cross this property.Prior to any building permit issuance
all work around the mains will be approved by the utility
in writing and all conflicts will be resolved.
Easements&Property Issues: GP CE
20. Provide documentation for all of the easements
required for construction,access,and utilities.
21. Submit copies of all legal descriptions and exhibits for GP CE
any required easements for the review and approval by
the City Engineer.
22. Prior to issuance of building permits,the applicant shall GP CE
submit a grading and drainage plan with a separate
sheet(s) devoted to sedimentation and erosion
control, prepared by a registered civil engineer for
review and approval by the City Engineer.
SANITARY SEWER CONDITIONS
23. Drainage piping serving fixtures which have flood levels IP WW
rims located below the elevation of the next upstream
manhole cover of the public sewer system shall be `
protected from backflow of sewage by installing an
approved type backwater valve.
24. Sanitary sewer laterals (of force mains) must be IP WW
installed in private easements when crossing adjoining
properties in route to the public sewer.
25. If an existing sanitary sewer lateral is not utilized it shall FM
be properly abandoned.
26. All new and existing buildings in this tract shall have FM WW
their own exclusive sanitary sewer lateral, connection
and connection permit.

28. Newly created lots are subject to the payment of sewer FM WIN
extension fees prior to final map recording.
STANDARD CONDITIONS
29. All public improvements shall be constructed in FM CE
conformance with the City of Atascadero Engineering .
Department Standard Specifications and Drawings or
as directed by the City Engineer. .!
30. In the event that the applicant is allowed to bond for the
public improvements required as a condition of this
map, the applicant shall enter into a Subdivision
Improvement Agreement with the City Council.
31. An engineer's estimate of probable cost shall be
submitted for review and approval by the City Engineer
to determine the amount of the bond.
32. The Subdivision Improvement Agreement shall record
concurrently with the Final Map.
33. The applicant shall enter into a Plan Check/inspection
agreement with the City.
34. The applicant shall be responsible for the relocation
and/or alteration of existing utilities.
35. The a pplicant shall i nstall all n ew u tilities(water,g as,
electric,cable TV and telephone)underground. Utilities
shall be extended to the property line frontage of each
lot or its public utility easement.
36. The applicant shall monument all property corners for
construction control and shall promptly replace them if
disturbed.
37. The applicant shall acquire title interest in any off-site
land that may be required to allow for the construction
of the improvements. The applicant shall bear all costs
associated with the necessary acquisitions. The
applicant shall also gain concurrence from all adjacent
property owners whose ingress and egress is affected
by these improvements.

38. Slope easements shall be provided as needed to
accommodate cut or fill slopes.

40. The final map shall be signed by the City Engineer prior
to the map being placed on the agenda for City Council
acceptance.
41. Prior to recording the tract map, the applicant shall
submit a map drawn in substantial conformance with
the approved tentative map and in compliance with all
conditions set forth herein.The map shall be submitted
for review and approval by the City in accordance with
the Subdivision Map Act and the City's Subdivision
Ordinance.
42. Prior to recording the tract map, the applicant shall set
monuments at all new property comers. A registered
civil engineer or licensed land surveyor shall indicate by
certificate on the parcel map, that comers have been
set or shall be set by a date specific and that they will
be sufficient to enable the survey to be retraced.
43. Prior to recording the tract map, the applicant shall pay
all outstanding plan check/inspection fees.
44. Prior to recording the map,the applicant shall complete
all improvements required by these conditions of
approval.
45. Prior to recording the tract map,the applicant shall have
the map reviewed by all applicable public and private
utility companies (cable, telephone, gas, electric,
Atascadero Mutual Water Company). The applicant
shall obtain a letter from each utility company indicating
their review of the map. The letter shall identify any
new easements that may be required by the utility
company. A copy of the letter shall be submitted to the
City. New easements shall be shown on the map.
46. Upon recording the final map, the applicant shall
provide the City with a black line clear Mylar (0.4 mil)
copy and a blue line print of the recorded map.
47. Prior to the final inspection of any public improvements,
the applicant shall submit a written statement from a
registered civil engineer that all work has been
completed and is in full compliance with the approved
plans.
48. Prior to the final inspection,the applicant shall submit a
written certification from a registered civil engineer or
land surveyor that all survey monuments have been set

49. An encroachment permit shall be obtained prior to any
work within City rights of way.
50. Prior to the issuance of building permits the applicant
shall submit a grading and drainage plan prepared by a
registered civil engineer for review and approval by the
City Engineer.
Atascadero Mutual Water Company(AMWC):
1. Before recordation of the final map,the applicant shall IP AMWC
submit plans to AMWC for the water distribution facilities
needed to serve the project. AMWC shall review and
approve the plans before construction begins on the water
system improvements. All new water distribution facilities
shall be constructed in conformance with AMWC
Standards and Details and the California Waterworks
Standards(Code of Regulations Title 22, Division 4,
Chapter 16). All cross-connection devices shall conform
to AWWA and California Department of Health Services
standards.
2. Prior to the issuance of building permits,the applicant IP AMWC
shall obtain a"Will Serve"letter from the Atascadero
Mutual Water Company for the newly created lots.
3. Before the start of construction on the water system IP AMWC
improvements,the applicant shall pay all installation and
connection fees required by AMWC. Subject to the
approval of AMWC,the applicant may enter in to a
"deferred connection"agreement.

4. All water distribution facilities shall be constructed in IP AMWC
conformance with Atascadero Mutual Water Company
standards, policies and approved procedures. All cross-
connection devices shall be constructed in conformance
with AWWA and Department of Health Services
standards.
5. The applicant is responsible for designing and FM/113 AMWC
constructing water system improvements that will provide
water at pressures and flows adequate for the domestic
and fire protection needs of the project.
6. The water meter for this lot has already been installed as IP AMWC
a portion of the improvements for the previous Tract Map.

51. A soils investigation prepared by a licensed BP BS
Geotechnical Engineer is to be provided for the project.
The report is to be provided at the time of building
permit submittal along with the building plans for review
by the Building Division. Recommendations contained
in the report are to be incorporated into the project
plans.
Fire Marshal Conditions
52. A fire hydrant must be provided within 400 feet of the BP FD
project street frontage.
53. Provide appropriate address signage at each residence. BP FD
In addition, a sign is to be provided at the entrance to
the project off of the common drive listing the addresses
located within the project.
54. Note on the plans that signage or striping is to be FO FD
provided along the street frontages and at the fire
department turnaround, which clearly indicate that
parking, is prohibited. Signage shall read "NO
PARKING—FIRE LANE".
55. The private driveway for Lot 1 shall be incorporated into GP/BP FD/PS
the required fire department turnaround. The design of
the driveway and turnaround shall be approved by the
Fire Department prior to issuance of grading or building
permits.
Mitigation Measures
All lighting shall be designed to eliminate any off site glare. All GP/BP PS/BS 1_d.
exterior site lights shall utilize full cut-off,"hooded"lighting
fixtures to prevent offsite light spillage and glare. no sag-lens
or vertical directed lights,400 watts or less. Light pole heights
shall not exceed 30-feet, intensity is limited to 2.0 foot candies
at ingress/egress,and otherwise 0.6 foot candle minimum to
1.0 maximum in parking areas. Fixtures shall be shield cut-off
type. Fixtures located near residential properties shall be
specifically designed to prevent off site glare and spillage.All
lighting shall be reviewed and approved by staff to prevent
offsite light spillage.
The project shall be conditioned to comply with all applicable GP/BP PS/BS 3_b
District regulations pertaining to the control of fugitive dust
(PM-10)as contained in section 6.4 of the Air Quality
Handbook. All site grading and demolition plans notes shall
list the following regulations:
A. All material excavated or graded shall be sufficiently
watered to prevent excessive amounts of dust. Watering
shall occur at least twice daily with complete coverage,

preferably in the late morning and after work is finished
for the day.
B. All clearing,grading,earth moving,or excavation
activities shall cease during periods of high winds(i.e.
greater than 20 mph averaged over one hour)so as to
prevent excessive amounts of dust.
C. All material transported off-site shall be either sufficiently
watered or securely covered to prevent excessive
amounts of dust.
D. The area disturbed by clearing,grading,earth moving,or
excavation operations shall be minimized so as to
prevent excessive amounts of dust.
E. Permanent dust control measured identified in the
approved project revegetation and landscape plans shall
be implemented as soon as possible following
completion of any soil disturbing activities.
F. Exposed ground areas that are planned to be reworked
at dates greater than one month after initial grading shall
be sown with fast-germinating native grass seed and
watered until vegetation becomes established.
G. All disturbed areas not subject to revegetation shall be
stabilized using approved chemical soil binders,jute
netting,or other methods in advance by the APCD.
H. All roadways,driveways,sidewalks,etc.to be paved
shall be completed as soon as possible. In addition,
structural foundations shall be completed as soon as
possible following building pad construction.
I. On-site vehicle speed shall be limited to 15 mph for any
unpaved surface.
J. All unpaved areas with vehicle traffic shall be watered at
least twice per day,using non-potable water.
K. Streets adjacent to the project site shall be swept daily to
remove silt,which may have accumulated from
construction activities so as to prevent excessive
amounts of dust from leaving the site.
L. Wheel washers may be required when significant offsite
import or export of fill is involved.
The primary contractor shall designate a person to monitor GP/BP PS/BS 3.b.2
dust control/daily site clean up, noise,and erosion
control/storm water programs.The job superintendent/monitor
shall coordinate with construction crews as necessary to
prevent non-compliance. Duties shall include holidays and
weekend periods when official work may not be in progress.
The name and telephone number of such persons shall be
provided to the staff prior to the issuance of building/grading
permits.
A preconstruction meeting with engineering/planning staff, GP/BP PS/BS 3.b 3
grading equipment operators,job supervisors,and the project
arborist to review the project conditions and requirements shall
be required prior to issuance of building permits for any portion
of the project.

The applicant shall contract with a Certified Arborist to monitor GP/BP PS 4.e.1.
grading and paver installation within native tree drip lines prior
to the issuance of building/grading permits.The Arborist shall
be onsite during grading and paver installation.The
construction crews shall follow all recommedations by the
Arborist.A written agreement outlining times when the Arborist
will monitor must be submitted to and approved by staff prior to
the issuance of building/grading permits.
All existing native trees on-site are to be retained;the building GP/BP PS 4.e.2.
permit site plan shall identify all protection and enhancement
measures recommended by the Certified Arborist in the Tree
Protection Plan.Tree protection fencing shall be installed at
the location called out in the Tree Protection Plan.
Pervious pavers shall be installed on portions of the project GP/BP PS 4 e.3.
that encroach into the canopy of native trees.
Should any cultural resources be unearthed during site GP/BP PS 5.b.1
development work,the provisions of CEQA-Section 15064.5,
will be followed to reduce impacts to a non-significant level.
All disturbed areas, not shown on the project landscape plan GP/BP PS,BS 6.b.1.
for landscaping,shall be hydroseeded with a native seed mix
and anchored in place by tracking or crimping. All disturbed
areas shall have appropriate erosion control methods or
landscape treatment in place for the duration of the project.
The lead contractor(site foreman)shall be responsible for the
daily clean-up of any mud or debris that is tracked onto
surrounding streets by construction vehicles.
An Erosion Control Plan/Stormwater Pollution Prevention Plan 6.b.V&a.c.e.
(SWPPP) shall be submitted and approved by the City
Engineer and Planning Department prior to the issuance of the
building permit. The plan shall be on-site and implemented at
all times including storm water measures for the operation and
maintenance of the project for the review and approval of the
City Engineer. The Building Permit application plans shall
identify Best Management Practices(BMPs)appropriate to the
uses conducted on site that effectively prohibit the entry of
pollutants into storm water runoff.
A soils report shall be required for future building permits GP/BP BS s_d.
according to standards of the City Of Atascadero Building
Department.The building plans will be required to follow the
recommendations of the soils report to assure safety for
residents and buildings.
The building/grading permit for the project shall incorporate a GP/BP BS 8 a.c.e.1
Storm Water Pollution Prevention Plan (SWPP),approved by
the city staff,that adheres to the guidelines outlined by the
Phase II of the National Pollutant Discharge Elimation System
from the California Regional Water Quality Control Board.All
guidelines shall be followed on the project site.
For the duration of the project:The perimeter of the site shall GP/BP BS/PS 8.a.c.e.2
be lined with appropriately anchored straw wattle rolls to
prevent soil from leaving the site.All existing gutters shall have
sand bags appropriately placed and silt traps installed in drains

to capture sediment.All disturbed areas, not part of the project
landscape plan for landscaping,shall be immediately
hydroseeded with a native seed mix and covered with an
appropriate erosion control method(hydro-mulch,or straw
mulch crimped or appropriately anchored.
The project shall follow mitigations to reduce noise from the GP/BP PS/BS 11.c.1
proposed project to acceptable levels:
A. The project shall restrict deliveries after 9:00 p.m and
before 7:00 a.m.
B. The project shall construct a sound wall at least 8-feet
high along the project's rear(east)property line.
C. The project shall construct a parapet wall at least 3-
feet high along the roof line at the Walgreen's,or
construct individual screens between roof-top air
conditioners and nearby residences to the east.
D. Project construction shall not occur after 9 p.m.and
before 7:00 a.m.
E. The project shall utilize construction equipment with
effective mufflers to gas-and diesel-powered
construction equipment
All construction activities shall comply with the City of GP/BP BS/PS 11.d
Atascadero Noise Ordinance and be limited to the following
hours of 7 a.m.to 7 p.m.
Further, particularly loud noises shall not occur before 8 a.m.
on weekdays and not at all on weekends.
The Community Development Director upon a determination
that unusually loud construction activities are having a
significant impact on the neighbors may modify the hours of
construction.
Failure to comply with the above-described hours of operation
may result in withholding of inspections and possible
construction prohibitions,subject to the review and approval of
the Community Development Director.
