A RESOLUTION OF THE ATASCADERO CITY COUNCIL CERTIFYING
MITIGATED NEGATIVE DECLARATION 2002-0038 PREPARED FOR
GENERAL PLAN AMENDMENT 2003-0004;
ZONE CHANGE 2003-0033; ZONE CHANGE 2002-0032;
ROAD ABANDONMENT 2002-0011; CONDITIONAL USE PERMIT 2002-
0074 AND TENTATIVE TRACT MAP 2002-0021
(9500 Las Lomas Avenue /Hendrix)
WHEREAS, an application has been received from Rex Hendrix (PO Box 6062,
Atascadero, CA 93423) Applicant and Property Owner to consider a project consisting of a
general plan amendment from HRD (High Density Residential) land use designation to GC
(General Commercial); zone change from RMF-16 (Residential Multi-Family) to CR
(Commercial Retail) and establishment of a planned development 18 zone overlaying a RMF-16
(Residential Multi-Family) zone with the adoption of a Master Plan of Development; a road
abandonment; and a thirty lot residential Tentative Tract Map on APN 030-481-005 and 030-
481-006; and,
WHEREAS, an Initial Study and Proposed Mitigated Negative Declaration 2002-0038
were prepared for the project and made available for public review in accordance with the
requirements of the California Environmental Quality Act (CEQA); and,
WHEREAS, the Planning Commission of the City of Atascadero held a public hearing
on Tuesday, March 4, 2003 following the close of the review period to consider the Initial Study
and Proposed Mitigated Negative Declaration; and,
NOW, THEREFORE, the Atascadero City Council, at a public hearing held on Tuesday
March 25, 2003, hereby resolves to certify Mitigated Negative Declaration 2002-0038 based on
the following Findings as shown on Exhibit A:
1. The Proposed Mitigated Negative Declaration has been completed in compliance
with CEQA; and,
2. The Proposed Mitigated Negative Declaration was presented to the Planning
Commission, and the information contained therein was considered by the
Planning Commission, prior to recommending action on the project for which it
was prepared; and,
3. The project does not have the potential to degrade the environment when
mitigation measures are incorporated into the project.
4. The project will not achieve short-term to the disadvantage of long-term
environmental goals.

5. The project does not have impacts which are individually limited, but
cumulatively considerable.
6. The project will not cause substantial adverse effects on human beings either
directly or indirectly.
On motion by Council Member O'Malley, and seconded by Council Member Luna the foregoing
resolution is hereby adopted following roll call vote:

Description: Overlay Zone Change with a Master Plan of Development(Conditional Use Permit),a Vesting Tentative
Tract Map to allow a 28-unit townhouse development and a 6,400 square foot commercial office building.
The site is gently sloped and primarily undeveloped with several native oak trees. A westerly portion of
the site is commercially developed and is proposed to be reconfigured with the addition of one office
building. Road abandonment of an unneeded and undeveloped portion of the westerly side of the Las
Lomas Avenue right-of-way is also proposed. The site is bounded by El Camino Real,Principal Avenue,
Las Lomas Avenue and Montecito Avenue. Public water and sewer are available to the site,and will
serve the project. Removal of native oak trees is proposed.
General Plan Designation: HDR(High Density Residential- 16 units/acre),GC(General Commercial)
Zoning District: RMF-16(Residential Multiple Family),CR(Commercial Retail)
Findings:
1. The project does not have the potential to degrade the environment.
2. The project will not achieve short-term to the disadvantage of long-term environmental goals.
3. The project does not have impacts which are individually limited,but cumulatively considerable.
4. The project will not cause substantial adverse effects on human beings either directly or indirectly.
Determination:
Based on the above findings,and the information contained in the initial study 2002-0038(made a part hereof by
reference and on file in the Community Development Department),it has been determined that the above project will
not have an adverse impact on the environment when the following proposed mitigation measures are incorporated
into the project(see attachment).

NOTICE IS HEREBY GIVEN that the Atascadero Planning Commission will be holding a
public hearing to consider the following project and environmental determination. The public is
