HomeMy WebLinkAboutResolution 2003-012 RESOLUTION NO. 2003-012 A RESOLUTION OF THE ATASCADERO CITY COUNCIL CERTIFYING MITIGATED NEGATIVE DECLARATION 2002-0038 PREPARED FOR GENERAL PLAN AMENDMENT 2003-0004; ZONE CHANGE 2003-0033; ZONE CHANGE 2002-0032; ROAD ABANDONMENT 2002-0011; CONDITIONAL USE PERMIT 2002- 0074 AND TENTATIVE TRACT MAP 2002-0021 (9500 Las Lomas Avenue /Hendrix) WHEREAS, an application has been received from Rex Hendrix (PO Box 6062, Atascadero, CA 93423) Applicant and Property Owner to consider a project consisting of a general plan amendment from HRD (High Density Residential) land use designation to GC (General Commercial); zone change from RMF-16 (Residential Multi-Family) to CR (Commercial Retail) and establishment of a planned development 18 zone overlaying a RMF-16 (Residential Multi-Family) zone with the adoption of a Master Plan of Development; a road abandonment; and a thirty lot residential Tentative Tract Map on APN 030-481-005 and 030- 481-006; and, WHEREAS, an Initial Study and Proposed Mitigated Negative Declaration 2002-0038 were prepared for the project and made available for public review in accordance with the requirements of the California Environmental Quality Act (CEQA); and, WHEREAS, the Planning Commission of the City of Atascadero held a public hearing on Tuesday, March 4, 2003 following the close of the review period to consider the Initial Study and Proposed Mitigated Negative Declaration; and, NOW, THEREFORE, the Atascadero City Council, at a public hearing held on Tuesday March 25, 2003, hereby resolves to certify Mitigated Negative Declaration 2002-0038 based on the following Findings as shown on Exhibit A: 1. The Proposed Mitigated Negative Declaration has been completed in compliance with CEQA; and, 2. The Proposed Mitigated Negative Declaration was presented to the Planning Commission, and the information contained therein was considered by the Planning Commission, prior to recommending action on the project for which it was prepared; and, 3. The project does not have the potential to degrade the environment when mitigation measures are incorporated into the project. 4. The project will not achieve short-term to the disadvantage of long-term environmental goals. City of Atascadero Resolution No.2003-012 Page 2 of 2 5. The project does not have impacts which are individually limited, but cumulatively considerable. 6. The project will not cause substantial adverse effects on human beings either directly or indirectly. Removal of native oak trees is proposed. The project does not have impacts which are individually limited,but cumulatively considerable. 4. The project will not cause substantial adverse effects on human beings either directly or indirectly. Determination: Based on the above findings,and the information contained in the initial study 2002-0038(made a part hereof by reference and on file in the Community Development Department),it has been determined that the above project will not have an adverse impact on the environment when the following proposed mitigation measures are incorporated into the project(see attachment).
