Mayor Luna called the meeting to order at 7:00 p.m. and Council Member Clay led the Pledge of Allegiance. ROLL CALL: Present: Council Members Clay, O'Malley, Pacas, Scalise and Mayor Luna Absent: None Others Present: City Clerk Marcia McClure Torgerson, Deputy City Clerk Grace Pucci Staff Present: Community Development Director Warren Frace, Administrative Services Director Rachelle Rickard, Deputy Public Works Director Geoff English, Police Lt. John Couch, Fire Captain Roland Snow and City Attorney Roy Hanley. COMMUNITY FORUM: Bob Simpson, Ministerial Association, led those present in prayer. Jill Keezer spoke for her family and neighbors regarding recent burglaries in their neighborhood and about the burglar who was apprehended but is now out on bail. CC Minutes 05/25/04 Page 1 of 6 Approved June 22,2004 Mark Schafer, Executive Director of Ride-On Transportation, passed out a flyer and spoke about the services they provide. (Exhibit A) Bill Bright suggested the Police Department have a community meeting to inform the neighbors about the burglar Ms. Keezer had spoken about and who is now out on bail. Steve Martin, Executive Director Atascadero Main Street informed the Council that Main Street and the Chamber of Commerce are working together with Atascadero Redevelopment Specialist Marty Tracey to put together a workshop for business and property owners interested in the fagade improvement program. The workshop is scheduled for June 17th, 8:00 to 10:00 a.m. in the Lake Pavilion. Joann Main, Executive Director Atascadero Chamber of Commerce, announced they are sponsoring an economic forecast program on June 3rd, 7:30 to 11:00 a.m. at the Lake Pavilion. Mayor Luna closed the Community Forum period. APPROVAL OF AGENDA: MOTION: By Council Member Clay and seconded by Council Member O'Malley to approve the agenda. Motion passed 5.0 by a roll-call vote. PRESENTATIONS: 1. Proclamation declaring June 7 & 8, 2004 - "Special Olympics - Law Enforcement Torch Run Days." Mayor Luna read the Proclamation and presented it to Police Lt. John Couch. COUNCIL ANNOUNCEMENTS AND REPORTS: Mayor Luna announced he would be in Judges chambers tomorrow regarding Creekside Parcel Associates v City of Atascadero; therefore his office hours are cancelled. Council Member Clay asked where Council Member O'Malley had been on the last two Wednesday evenings between 6:00 and 9:00 a.m. Council Member O'Malley announced he has been and would continue to be at the Main Street Downtown Farmer's Market. City Council Meeting Minutes — April 27, 2004 ■ City Clerk recommendation: Council approve the City Council minutes of the meeting of April 13, 2004. (City Clerk) 2. April Disbursements — April 2004 Accounts Payable & Payroll ■ Fiscal impact: Total expenditures for all funds if $1,510,903.81 ■ Recommendation: Council approve certified City accounts payable, payroll and payroll vendor checks for April 2004. (Administrative Services) 3. Parking & Business Improvement Area Assessment ■ Fiscal impact: The City receives approximately $10,500 annually from the Downtown Parking and Business Improvement Area Assessments. ■ Recommendation: Council adopt the draft Resolution of Intention, declaring intent to levy annual Downtown Parking & Business Improvement Area assessment, and set a public hearing for June 8, 2004. (City Manager) 4. Weed Abatement-Awarding of Contractor Bid ■ Fiscal impact: None. Funds are budgeted annually to cover the costs of the weed abatement program, and are recovered through assessments on property tax bills of those parcels abated. ■ Recommendation: Council authorize the City Manager to execute the contract with Jack R. Bridwell for weed abatement. (Fire) 5. Single Family Planned Development Zone Change 2003-0063, Master Plan of Development (CUP 2003-0112), Vesting Tentative Tract Map 2003-0037-1325 EI Camino Real (Gearhart) ■ Fiscal impact: The project would likely have a slight negative impact on City revenues. As a general rule, single-family dwellings require services that exceed the revenue generated by the proposed uses. ■ Recommendation: Council adopt on second reading, by title only, the attached Draft Ordinance, enacting Zone Change 2003-0063 adding the PD-17 zoning overlay district to an RSF-X site. The proposed project also includes a HS (Historic Structures) overlay designation on Lot 32, as conditioned. (Community Development) CC Minutes 05/25/04 Page 3 of 6 Approved June 22,2004 6 Auto and Vehicle Dealerships Zoning Text Amendment Zone Change 2003-0077 (Community Redevelopment Agency) ■ Fiscal impact: The project would likely have a positive impact on City revenues. As a general rule, sales tax revenues from automobile sales exceed the cost of city services by the proposed use. ■ Recommendation: Council adopt on second reading, by title only, the attached Draft Ordinance, enacting Zone Change 2003-0077 enacting a Zone Text amendment related to minimum lot sizes for auto and vehicle dealerships. (Community Development) 7. EI Camino Real Gravity Main Sewer Extension ■ Fiscal impact: Total project cost attached to staff report ■ Recommendations: Council: 1) Accept Specialty Construction, Inc.'s work as complete. 2) Authorize the City Manager to execute and file the Notice of Completion. (Public Works) Eric Greening pulled Item #4 MOTION: By Council Member Clay and seconded by Council Member O'Malley to approve Items #A-1, 2, 3, 5, 6 and 7. Motion passed 5.0 by a roll-call vote. (Item #A-5 Pacas opposed) Item #4: Eric Greening asked for the record what the date is on which homeowners must have abated or it will be done for them. City Clerk Marcia McClure Torgerson announced the date is June 5m MOTION: By Council Member Clay and seconded by Council Member O'Malley to approve Item #A-4. Motion passed 5:0 by a roll-call vote. B. PUBLIC HEARINGS: 1. Weed Abatement— Hearing of Objections ■ Fiscal impact: Costs involved in administering this program are recovered through the 150% administrative fee charged to parcels abated by the City Contractor. ■ Recommendations: Council: 1) Hear and consider all objections to the proposed removal of vegetative growth and/or refuse and allow or overrule any objections; and, 2) Authorize the Fire Chief to proceed and perform the work of abatement. (Fire) CC Minutes 05/25/04 Page 4 of 6 Approved June 22,2004 Fire Captain Roland Snow briefly explained about weed abatement and answered questions of Council. PUBLIC COMMENT Bill Bright questioned why he had received an abatement notice, as his property has been mowed for several months. Captain Snow explained the noticing process. Jill Keezer asked if there were exclusions for having livestock on ones property to help control weeds. Captain Snow stated the abatement process does provide for pasturing animals as long as they significantly reduce vegetation on the property. Mayor Luna closed the Public Comment period. MOTION: By Council Member O'Malley and seconded by Council Member Clay to authorize the Fire Chief to proceed and perform the work of abatement. Motion passed 5:0 by a roll-call vote. C. MANAGEMENT REPORTS: 1. Information Bulletin a. Semi-Annual Report from Atascadero Chamber of Commerce. (City Manager) The bulletin was received and filed. D. COMMITTEE & LIAISON REPORTS: Mayor Pro Tem Scalise 1. League of California Cities: Attended the Channel Cities meeting in Arroyo Grande with Council Member Pacas, Redevelopment Specialist Marty Tracey and City Clerk Marcia McClure Torgerson. 2. Local Agency Formation Commission (LAFCO) (City Selection Committee appointment): Sphere of influence for Nipomo area was passed, and they are ready to start on Paso Robles. 3. S.L.O. Council of Governments (SLOCOG)/S.L.O. Regional Transit Authority (SLORTA): Meets next week and will be looking at audits. CC Minutes 05/25/04 Page 5 of 6 Approved June 22,2004 Council Member O'Mallev 1. Air Pollution Control District (APCD): Will meet tomorrow morning in San Luis Obispo. They will be making tough decisions this year due to State funding reductions. Council Member Pacas 1. Atascadero Youth Task Force: Will meet next Tuesday, 7:00 a.m. in the Lake Pavilion. E. INDIVIDUAL DETERMINATION AND/OR ACTION: City Clerk City Clerk Marcia McClure Torgerson reported Parks and Recreation Commissioner Lou Coppo has resigned. Council Member Clay has appointed Sandy Jacks who will fill the vacancy in July. Additionally, advertising is being done for a Parks and Recreation Commission Youth Representative. F.
