CLOSED SESSION: (Immediately following Redevelopment Agency Meeting) 1. Conference with legal counsel [Govt. Code §54956.9] Existing litigation: a. City of Atascadero v Atascadero Unified School District b. City of Atascadero v Kelly Gearhart 2. Conference with labor negotiator(Govt. Code Sec. 54957.6) Agency Negotiator: City Manager Employee organizations: Department Heads, Mid-Management/Professional, Confiddntial, Atascadero Fire Captains, Atascadero Firefighters, Service Employees Intl. Union Local 620, Atascadero Police Assoc. City Attorney Roy Hanley announced there were no reportable actions taken in Closed Session. REGULAR SESSION, 7:00 P.M.: Mayor Johnson called the meeting to order at 7:05 p.m. and Council Member Luna led the Pledge of Allegiance. ROLL CALL: Present: Council Members Arrambide, Clay, Luna, Scalise and Mayor Johnson Absent: None Others Present: City Clerk Marcia McClure Torgerson Staff Present: City Manager Wade McKinney, Police Chief Dennis Hegwood, Fire Chief Mike McCain, Assistant City Manager Brady Cherry, Public Works Director Steve Kahn, Administrative Services Director Rachelle Rickard, Principal Planner Warren Frace and City Attorney Roy Hanley PRESENTATIONS: 1. Proclamation declaring April 2000, "Alcohol Awareness Month." Mayor Johnson read the Proclamation and Bill McGuire,North County Connection, accepted the award. Bill McGuire, 8600 Atascadero Ave.,thanked the City of Atascadero for their participation. 2. Service Recognition for Bill Zimmerman. Mayor Johnson presented a plaque to Mrs. Joyce Zimmerman for Bill Zimmerman's service to the community. City Manager Wade McKinney made a special presentation to Brady Cherry for his service to the City as Acting Public Works Director. He also presented Brady's wife with a bouquet of flowers, acknowledging the sacrifices she made to help Brady. Mr. Cherry thanked staff, the Council and the citizens for all the assistance he received while doing his job. COMMUNITY FORUM: Raymond Jansen, 6655 Country Club Drive,talked about achieving more honorable citizenship. Richard Mullen, 4200 Portola Road,thanked the City Council and Brady Cherry for the resurfacing of Portola Road. Joan O'Keefe, 9985 Old Morro Road East, stated that the City Attorney gave a presentation at the last Council meeting that was not listed on the agenda. She suggested that in the future, the City should publicly notice such presentations in the Council agenda so that the public can attend, if interested. She also expressed her concern that the EIR for the State Hospital expansion was not publicly noticed. She understands that the City is not the Lead Agency but asked that the City check into the State's lack of compliance with CEQA. Mayor Johnson thanked Ms. O'Keefe for bringing the issue to the Council's notice, and he stated that they need to talk to the State regarding the matter. Principal Planner Warren Frace announced that the copy of the EIR came in today. Raymond Jansen, 6655 Country Club Drive, expressed his concern for the excessive disposal of computers in landfills. Council Member Luna stated that he will take Mr. Jansen's concerns to the Integrated Waste Management Authority (IWMA). Mayor Johnson closed the Public Comment period. CC 04/11/00 Page 2 COUNCIL ANNOUNCEMENT AND REPORTS: Council Member Scalise congratulated the City's staff for their accomplishments as Atascadero was rated the highest in the County for customer service. Council Member Clay announced that he attends the Youth Task Force meetings. He commented that it is important that the older generation make contact with the younger generation and encouraged everyone to reach out to our young people. Council Member Luna asked and received from the City Attorney clarification on the issue of Adult Books stores in Atascadero. A. CONSENT CALENDAR: 1. City Council Minutes—March 28, 2000 ■ City Clerk recommendation: Council approve the City Council minutes of March 28, 2000 [City Clerk] 2. Zone Change 99001 —8930 Junipero Avenue (Bunyea) ■ Fiscal Impact: Negligible ■ Staff recommendation: Council introduce for second reading by title only and adopt the attached draft Ordinance, approving proposed Zone Change 99001, changing the zoning of the project area shown on Exhibit A from RSF-Y to RSF-X. [Community& Economic Development] 3. Final Parcel Map#99002/AT 99-040—6105 San Anselmo Road (Wilson Land Surverys /Gearhart) ■ Fiscal Impact: None ■ Staff recommendations: 1. Council accept the Final Parcel Map 499002; and 2. Council accept a 6-foot wide Public Utility Easement contiguous to the San Anselmo Road property line. [Community& Economic Development] 4. Final Parcel Map #99005 /AT 99-012—6205 San Anselmo Road (Wilson Land Surveys /Gearhart) ■ Fiscal Impact: None ■ Staff recommendations: L Council accept the Final Parcel Map #99005; and 2. November 1999—Accounts Payable & Payroll ■ Fiscal Impact: $891,130.82 ■ Staff recommendation: Review and approve [Administrative Services] MOTION: By Council Member Luna and seconded by Council Member Clay to approve the Consent Calendar. Motion passed 5:0 by a roll-call vote. Draft Ordinance in Item #A-2 will be Ordinance No. 372. B. PUBLIC HEARINGS: None C. MANAGEMENT REPORTS: 1. Information Bulletin A. Atascadero State Hospital EIR Review. Principal Planner Warren Frace gave a brief staff update on the Atascadero State Hospital EIR Review. Council Member Luna asked why a more thorough review was not done. Mr. Frace replied that it was based on direction given by Council to go no further do to lack of public support. Council Member Luna asked if we have a plan if Atascadero becomes a more probable site for the project. Mr. McKinney commented that we would already have, if chosen, a greater environmental impact. Principal Planner Warren Frace answered questions of the Council. PUBLIC COMMENT Lon Allan, Atascadero News, stated that Imperial County is strongly opposed to the development of the project in their area. Mayor Johnson closed the Public Comment period. B. General Plan Update Status Principal Planner Warren Frace gave a brief staff update on the General Plan Update. CC 04/11/00 Page 4 D. COMMITTEE REPORTS: S.L.O. Council of Governments/S.L.O. Regional Transit Authority Mayor Pro Tem Arrambide announced there will be a reception for State Director of Cal Trans at Hunter Ranch on April 13, 2000. Also, SLORTA is having a joint meeting with APCD in May. Economic Opportunity Commission Council Member Scalise announced that they just completed participation in Homeless Awareness Week. North County Homeless Coalition Council Member Luna announced they will be meeting Thursday at 3:30 p.m. at the Library. E. INDIVIDUAL DETERMINATION AND/OR ACTION: City Clerk City Clerk Marcia McClure Torgerson announced that the ad hoc committee meeting requested by Mayor Johnson is scheduled for Monday, April 24, 2000, at 2:00 p.m. F.
