Matters are considered by the Council in the order of the printed Agenda. Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on file in the office of the City Clerk and are available for public inspection during City Hall Annex business hours at the Central Receptionist counter and on our website, www.atascadero.ora. An agenda packet is also available for public review at the Atascadero Library, 6850 Morro Road. Contracts, Resolutions and Ordinances will be allocated a number once they are approved by the City Council. The minutes of this meeting will reflect these numbers. All documents submitted by the public during Council meetings that are either read into the record or referred to in their statement will be noted in the minutes and available for review in the City Clerk's office. City of Atascadero Proclamation "Elks National Youth Week" May I - 7, 2005 WHEREAS, The Benevolent and Protective Order of Elks has designated the week beginning on the 1" Sunday in May, as "Youth Week", to honor America's Junior Citizens for their accomplishments, and to give fitting recognition of their services to Community, State and Nation; and, WHEREAS, The Atascadero Lodge No. 2733 will sponsor an observance during that week in tribute to the Junior Citizens of this Community; and, WHEREAS, No event could be more deserving of our support and participation than one dedicated to these young people who represent the nation's greatest resource, and who in the years ahead will assume the responsibility for the advancement of our free society; and, WHEREAS, Our Youth need guidance, inspiration and encouragement which we alone can give in order to help develop those qualities of character essential for future leadership; and go forth to serve America; and, WHEREAS, To achieve this worthy objective we should demonstrate our"partnership with Youth, our understanding of their hopes and aspirations and sincere'willingness to help prepare them in every way for the responsibilities and opportunities of citizenship; NOW THEREFORE, I, Wendy Scalise, the Mayor of the-City of Atascadero, do hereby proclaim the week beginning on the 1st Sunday in May as "Youth Week`, and urge all departments of government, civic,fraternal and patriotic groups, and our citizens generally, to participate wholeheartedly in its observance. CC Draft Minutes 03/22/05 Page 1 of 8 Emily Rosten read from a letter she wrote to the Editor of Atascadero News suggesting that the city's name be changed to Cielo Grande. tv Julie Bennett, representing the Atascadero Board of Realtors, thanked Jim Lewis and City staff for presenting the downtown plan to them. Michael Frederick presented a $2,400 check to the City which they had received for hauling off and selling the scrap iron from the bowling alley. Barbie Butz, representing the Atascadero Performing Arts Center Committee (APACC), thanked those who came to Colony Hall to see the Cal Poly students' work. Brad Goodrow shared with Council the Zoning Award his company received from the California Integrated Waste Management Board for their efforts in recycling. Mayor Scalise closed the Community Forum period. APPROVAL OF AGENDA: MOTION: By Mayor Pro Tem O'Malley and seconded by Council Member Luna to approve the agenda. Motion passed 5:0 by a roll-call vote. COUNCIL ANNOUNCEMENTS AND REPORTS: Council Member Clay spoke about the City name. Mayor Pro Tem O'Malley commended APACC for their work with the Cal Poly students. Council Member Pacas explained the meaning of the name Atascadero. Council Member Luna spoke about the proposal to change the name of Traffic Way. Mayor Scalise expressed her support of grass roots efforts. Council Member Clay stated he-would like to see some of the top displays for the performing arts center brought before the City Council PRESENTATIONS: 1. Deanne McKuen introduced children from the Atascadero Children's Center who sang a song for the Council. 2. Presentation of service plaque to former Parks and Recreation Commissioner, Eric Gobler. Mayor Scalise presented the plaque to Eric Gobler and thanked him for his work on the Parks and Recreation Commission. Mr. Gobler thanked the Councilfor being allowed to serve and encouraged more joint meetings with the Parks and Recreation Commission. A. CONSENT CALENDAR: 1. Downtown Public Investment Priorities ■ Fiscal Impact: None. ■ Recommendation: Council receive oral report and take action on prioritizing public projects in the downtown area. [City Manager] Assistant City Manager Jim Lewis gave the staff report and answered questions of Council. _ Council Member Luna changed his priorities to the following: ■ Sunken Gardens Improvements—change from 2 to 0 ■ Fagade improvement program-becomes number 2 ■ Creek pedestrian bridge—change to 0 ■ Pedestrian tunnel improvements-to number 1. Assistant City Manager Jim Lewis addressed issues raised during Public Comment. MOTION: By Council Member Clay and seconded by Mayor Pro Tem O'Malley to approve the priority list. Annual Housing Report (Calendar Years 2003-20041 • FiscaJvlmpact: None. ■ Recommendation: Council receive and file the attached annual housing report. [Community Development] Community Development Director Warren Frace gave the staff report and answered questions of Council. PUBLIC COMMENT Eric Greening stated his opposition to counting the 32 homeless shelter beds as housing and indicated his support for the very low income housing component. Mayor Scalise closed the Public Comment period. MOTION: By Mayor Pro Tem O'Malley and seconded by Council Member Clay to receive and file the housing report. Motion passed 5:0 by a voice vote. 3. Approval of Site Master Plan for Traffic Way Park and Recreation Center Design Plans • N Fiscal Impact: Approximately $6,000,000.00. ■ Recommendation: Council approve the Traffic Way Park- Master Plan, . Recreation Center Building Design Plan, and review the preliminary project schedule and budget. [Community Services] Mayor Pro Tem O'Malley stepped down from consideration of this item as he owns property within 500 feet of the project. Community Services Director Brady Cherry gave an overview of the process to date and answered questions of Council. David Volz, landscape architect, presented the design plan for Traffic Way Park and answered questions of Council. Maurice Macaray presented the design plan for the Recreation Center Building and answered questions of Council. PUBLIC COMMENT Barbie Butz expressed her support for the project and spoke about the focus group involved with developing the plan. CC Draft Minutes 03122/05 Page 5 of 8 Eric Greening stated his support for the center and discouraged rotating sports field A at this time. He hoped that the name of George Beatty would stay when the skate park moves to this location. Rick Mathews spoke about the potential traffic hazard at the northern most entrance to the property from Traffic Way, as well as the importance of a good design for the skate park. Janice Felde asked about plans for a public swimming pool at this site. John Nielson expressed his concern about the northern entrance to the park from Traffic Way. Mayor Scalise closed the Public Comment period. Assistant City Manager Jim Lewis explained the timeline and budget for the project and answered questions of Council. MOTION: By Council Member Clay and seconded by Council Member Luna to approve the Traffic Way Park Master Plan, Recreation Center Building Design Plan, and the preliminary project schedule and budget and that some attention be directed to mitigating the possible danger of the north entrance or exit. Motion passed 4:0 by a roll-call vote. • Mayor Pro Tem O'Malley rejoined the hearing. 4. Atascadero Road Program ■ Fiscal Impact: $240,000.00. ■ Recommendation: Council receive an update on the Atascadero Road Program. [Public Works] Public Works Director Steve Kahn gave the staff report and answered questions of Council. PUBLIC COMMENT Eric Greening stated that this was an excellent program, and asked if traffic calming measures such as those on Santa Ysabel are being built into other projects around town. Mayor Scalise closed the Public Comment period. MOTION: By Council Member Luna and seconded by Council Member Clay to receive the Road Program report. Motion passed 5:0 by a voice vote. Council Members Clay, Luna, and Mayor Scalise appoint their directly appointed Commissioners for the Planning Commission and the Park & Recreation Commission; and, 2. Council appoint Greg Porter to a four year term in the at-large position on the Planning Commission; and, 3. Council adopt the draft Resolution, allowing the Council to appoint up to two youth members to the Parks & Recreation Commission; and, 4. Council appoint Paige Buck-Moyer and Christopher Solkshinitz as youth members on the Parks & Recreation Commission. [City Clerk] City Clerk Marcia McClure Torgerson gave the staff report and answered questions of Council. PUBLIC COMMENT Rich Mathews, Parks and Recreation Commissioner, stated that a sitting Commissioner has applied for one of the open positions and urged Council to put her in a similar position to Planning Commissioner Greg Porter. • Mayor Scalise closed the Public Comment period. INDIVIDUAtr DETERMINATION AND/OR ACTION: City Council Council Member Luna asked if the city has written a letter to AssemblymanSam Blakeslee requesting his assistance in negotiations with -Atascadero State Hospital in getting the expansion of Paloma Creek Park. City Clerk Torgerson stated that if the letter has already gone out she would email a copy to Council. City Attorney City Attorney Enright reminded Council of the special joint meeting next Tuesday to discuss the Brown Act, conflicts/ethics issues and the Public Records Act. City Manager Assistant City Manager Lewis announced a study session in April 12th, 5:00 p.m. regarding Colony Square and another on April 26th, 5:00 p.m. regarding the impact of three-story buildings.. MEETING RECORDED AND MINUTES PREPARED BY: Grace Pucci, Deputy City Clerk CC Draft Minutes 0322/05 - - Page 8 of 8 t IA - ITEM NUMBER: A-2 DATE: 4/26/06 Atascadero City Council Staff Report - Community Development Department Single Family Planned Development Zone Change 2004-0093 (1565 EI Camino Real / Alvarez) RECOMMENDATION: Council adopt on second reading, by title only, draft Ordinance A approving Zone Change 2004-0093 based on findings. DISCUSSION: The proposed project consists of an application for a Zone Change, Conditional Use Permit (CUP) and Tentative Tract Map. The Zone Change request would establish a Planned Development #17 Overlay on the site subject to a Master Plan of Development (CUP) that would allow six (6) single-family residences and a landscaped common open space lot with a storm water detention basin to be constructed. All existing structures on site are proposed for demolition. The proposed Tentative Tract Map, as conditioned would create a six (7) lot subdivision. On April 12, 2005, the City Council conducted a public hearing to consider establishment of a PD-17 overlay zone and application of the overlay zone change on the subject parcel. FISCAL IMPACT: Based on findings from the Taussig Study, revenue from new residential development including property tax revenues; vehicle licensing fees, sales taxes, and other revenues are insufficient to cover the maintenance and emergency services costs of new development. Based on the revenue projections from the Taussig Study, the City has developed standard conditions of approval for new development projects that require the cost of maintenance and emergency services to be funded by the project through a combination of road assessment districts, landscape and lighting districts and community facilities districts (Conditions CUP 16 and 17, TTM 14 and 15). DISCUSSION: The proposed consists of an application for a Zone Change, Conditional Use Permit (CUP) and Tentative Parcel Map. The Zone Change request would place a Planned Development #7 overlay on the site subject to a Master Plan of Development (CUP) that would allow four (4) new single-family residences to be constructed. The project would demolish one single-family residence. The Tentative Parcel Map would create a four (4) lot subdivision. No native trees exist on site. On April 12, 2005, the City Council conducted a public hearing to consider establishment of a PD-7 overlay zone and application of the overlay zone change on the subject parcel. FISCAL IMPACT: The project would likely have a slight negative impact on City revenues. As a general rule, single-family dwellings require services that exceed the revenue generated by the proposed uses. CUP Conditions 16 and 17, and TTM Conditions 12 and 13 have been included to partially mitigate these associated costs by requiring emergency services and facility maintenance costs to be 100% funded by the project. DISCUSSION: The Municipal Code, Section 6-13.03, addresses the abatement of vegetative growth 9 and/or refuse which constitute a hazard. Adoption of the proposed Resolution is the first step in this annual program, which requires City Council action. The Fire Department conducted its initial inspection during the first two weeks in April. There are approximately 10,098 parcels within the City, and this year 2,370 parcels were identified to have vegetative growth and/or refuse, which are or may become a public nuisance. FISCAL IMPACT: The City recovers costs for administering this program through the 150% administrative fee, which is placed on the San Luis Obispo County Special Tax Assessment for the fiscal year 2005-2006 Tax Roll. These facilities would be similar to the Phase I Streetscape improvement installed near the intersection of EI Camino Real and Traffic Way. The beauty of Downtown Atascadero would be enhanced and public safety would be improved. Stadium Park Access and Entrance Improvements The city would purchase private property near the park entrance. This property would be used for access, parking, open space and landscaping. Street Smarts The City would utilize a traffic safety program similar to one put forth by the City of San Jose Department of Transportation. This program will focus on the "Education" segment of traffic safety. This program would promote awareness by creating a dialogue between the public and city staff about attitudes and actions on the streets. People will learn to think about their behavior so that next time they might hesitate before running a red light, speeding, or jaywalking. The City would conduct neighborhood outreach by hosting an event that focuses on driver, pedestrian, and bike education. We need to encourage the development of biking and walking paths. Very few children and adults bicycle or walk in our community. Establishing bike and walking paths that connect key areas of town will encourage people to get out of their cars and recreate and commute in a non-polluting manner. 6. What methods should be used to fund Atascadero's public recreation programs and facilities? As with any municipality, Atascadero has the opportunity to obtain low-interest loans and grants specifically earmarked for development and improvement of recreational sites. Our tightening state and national economies may make procuring such grants more difficult; and that should encourage us to try even harder. Maintenance and facility use should be paid for through a combination of user fees and general fund budgets. The rationale behind this combination is that recreation programs and facilities offer both a community-wide and individual benefit. Those folks who participate in recreational programs or use facilities should pay a nominal fee for use or participation with the remaining cost from general fund. Those folks who never or rarely participate in programs or'use facilities are benefiting from the enrichment that the active participants receive from recreational activities. An engaged and active citizenry are an integral part of a healthy community. 7. If appointed, what specific goals would you like to see the Commission achieve? 1. After the City Council has had an opportunity to make its individual determination, the City Clerk will collect the ballots and will announce first the Council Member's name and second, the name(s) of the candidate(s) of that Council Member's choice(s). Results of each individual Council Member vote will be a matter of public record. c. The candidate or candidates receiving a majority of the votes of the Council Members present shall be appointed. In the event that no candidate or candidates receive a majority vote or in the event of a tie vote, then a run-off ballot or ballots will be cast, following the procedure of sub-paragraph a. above.
