ORDINANCE NO. 407
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ATASCADERO AMENDING SECTION 4.20.190 OF THE ATASCADERO
MUNICIPAL CODE TO PROVIDE FOR A VETERANS' PREFERENCE IN
RECRUITMENT FOR EMPLOYMENT
THE COUNCIL OF THE CITY OF ATASCADERO DOES ORDAIN AS
FOLLOWS:
SECTION 1. Section 2-2.07 of the Atascadero Municipal Code hereby is amended to
read as follows:
2-2.07 Appointments.
(a) Appointments to vacant positions in the competitive service shall be made in accordance
with the personnel rules or policies. Appointments and promotions shall be based on merit and
fitness to be ascertained so far as practicable by examination. Examinations may be used and
conducted to aid in the selection of qualified employees and shall consist of selection techniques
which will test fairly the qualifications of candidates, such as achievement and aptitude tests,
written tests, personal interviews, performance tests, physical agility tests, the evaluation of daily
work performance, work samples, or any combination of these or other tests. The probationary
period shall be considered an extension of the examination process. Physical, medical,
psychiatric and polygraph tests may be given as part of any examination.
(b) In any examination the Personnel Officer may include, in addition to competitive tests, a
qualifying test or tests and set the minimum standards therefor. Any tests or examinations used
for selection of personnel to fill a particular position must reflect the requirements of the position
for which the test is being administered.
(c) When an appointment is to be made to a vacancy in the competitive service, the Personnel
Officer shall transmit to the appointing authority the names of all persons on the appropriate
certified employment list in the order in which they appear on the list.
(d)"Notwithstanding any of the provisions in the foregoing paragraphs, where all other
qualifications are equal, preference shall be granted to veterans in the selection of candidates to
fill the vacancy. As used in this section, "veteran" shall have the same meaning as under
Government Code Section 18973.
SECTION 2. This ordinance shall become effective on the thirtieth day following
passage and adoption hereof.
