LAS LOMAS SPECIFIC PLAN: REVIEW OF NEIGHBORHOOD ISSUES The Design Review Committee will review neighborhood concerns related to the Las Lomas Specific Plan area. Residents and the general public are invited to speak about any maintenance, construction, or neighborhood compatibility concerns within the Las Lomas project area. The Design Review Committee will determine if any issues need to be referred to staff for additional attention. At that meeting, the DRC added a condition to the project which requires the Multi -Family developer to install No Parking signs on Calle Milano. The project owner/applicant has submitted a request to DRC to remove the requirement for No Parking signs in order to continue to allow on -street parking on Calle Milano. The applicant states that this requirement is not applied to the rest of the Las Lomas project, and there is adequate width on the street to accommodate on -street parking. The Atascadero Sign Ordinance limits the amount of signage and color banding to 20 sq. ft. on two (2) sides of the canopy. The applicant is requesting an exception to the Sign Ordinance allowances, as provided per Atascadero Municipal Code Section 9- 15.006, subject to appearance review and findings. The applicant is proposing to install blue color banding, business name and/or logos on all four sides of the canopy, consistent with the Chevron Gas Station corporate design. The signage and color banding proposed on the canopy structure measures approximately 330 sq. ft. in total area. General Plan Designation: GC (General Commercial) Zoning District: CT (Commercial Tourist) Proposed Categorical Exempt Section 15311; Class 11 exemption for construction of new on Environmental site signs. Determination: Recommendation: The Atascadero Design Review Committee (DRC) will review the proposed application at their regular meeting on October 23, 2013 at 3:00 pm. The DRC will make a recommendation to the AUP Hearing Officer regarding the request for additional gas station canopy signage. Senior Planner Taylor gave the staff report. Gas station is in the process of converting to a Chevron station. In the administrative use permit process it allows for additional signage. DRC recently approved a similar project for the Tesoro Gas Station, who went thru the AUP process. The applicant is requesting that DRC approve the additional signage. ITEM NUMBER: 3 DATE: 1-15-14 Background The 100 unit Multi -Family apartment project located at 9000 Calle Milano was originally approved in 2003 as part of the Woodlands/Las Lomas Specific Plan. A Conditional Use Permit was approved by the Planning Commission in 2004 adopting the Master Plan of Development details for the project site. The current owner purchased the apartment project in 2011, and proposed some architectural design and floor plan changes for the ten (10) apartment buildings. The Las Lomas apartment project was originally approved with 80 two-bedroom units and 20 one - bedroom units, with loft/office spaces in many units. The new owners proposed to modify the unit mix to allow 20 one -bedroom units, 60 two-bedroom units, and 20 three-bedroom units, which was an increase of 20 additional bedrooms in comparison to the 2004 CUP. The number of parking spaces proposed by the new owner was consistent with the Municipal Code standards for the increase in bedrooms, and included an equivalent of 221 on-site parking spaces (100 spaces provided in garages, 104 uncovered spaces in parking lots, plus motorcycle spaces and bike racks.) On February 16, 2012, the Design Review Committee (DRC) approved the applicant's proposed design changes, subject to additional conditions and requirements. One of the additional requirements added by the DRC at the February 16, 2012 meeting was to require the Multi -Family developer to install "No Parking" signs on Calle Milano. This requirement was added by the DRC to address concerns which the neighbors raised at the DRC meeting regarding the increase in number of bedrooms proposed by the applicant. DRC's requirement for no on -street parking on Calle Milano was derived from this discussion in order to assure neighbors that the project's public roads would not be impacted. The no -parking signs were added to the subdivision improvement permit plans by City Staff and included as a condition on that permit. The no -parking signs have not yet been installed on Calle Milano by the apartment's owner. When tenants began moving into the units, it was not initially made clear to them that the garages were required to be used for parking. Tenants and contractors have been parking on Calle Milano for the past several months to access the site. The in summer 2013, the City began to receive complaints from the neighbors that the on -street parking was an issue which needed to be addressed and enforced, consistent with the DRC's 2012 direction. October 23, 2013 DRC Review In October, the apartment owner submitted a letter requesting that the DRC's previous requirement for installation of no parking signs on Calle Milano be removed. The owner stated that this requirement is not applied to the rest of the Las Lomas project, and there is adequate width available on the street to accommodate on -street parking. With the project still under construction, on-site parking for the tenants, contractors, and visitors is tight. In addition, the trailhead to the Las Lomas trail system is open to the general public and located directly across from the apartment's entrance. See Attachment 2 for owner's ITEM NUMBER: 3 DATE: 1-15-14 request letter. On October 23, 2013, the DRC met to review the owner's request and listen to public comments from residents of the Las Lomas development project. Comments were made by both the owners of the single-family lots and tenants in the apartment buildings, with comments both in favor of and against the on -street parking. Neighbor's comments (see Attachment 3) and public testimony included concerns such as safety, visual appearance, and effect on property values. At the meeting the DRC referred the proposal back to Staff and the applicant, with direction to look at other possible alternatives that could address resident traffic safety concerns and ensure adequate travel lane width in order to accommodate some on -street parking. In addition, the DRC requested that the applicant be provided the opportunity to install stop signs at the project driveway. The alternatives and stop sign are discussed below. Specific Plan Text Regarding Calle Milano Since the previous DRC meeting, staff has further reviewed the specific plan's policies regarding the on -street parking on Calle Milano. The original 2003 Las Lomas Specific Plan includes a section regarding circulation in the project area. The specific plan contains a policy that collector streets in the project will have "two travel lanes, center median, square curbs, no -parking, a detached sidewalk with parkway, Class 11 Bikeways, and street trees as depicted in Section A of Exhibit 8." Per the original City Council resolution, changes to the Specific Plan document must be approved by City Council. Therefore, the DRC's recommendation on January 15, 2014 will be forwarded to the Planning Commission, and then to the City Council for final determination. A formal application and fees have not yet been submitted by the apartment owner to amend the Specific Plan; however, these will be required prior to scheduling the item for Planning Commission. At this time City Staff is bringing the new information forward for DRC review and comment in order to follow up on direction from the previous October 25, 2013 meeting. Revised Striping Proposal The applicant and the project engineer have provided a revised striping proposal for on - street parking and has evaluated the installation of a stop sign at the project driveway. The striping proposal includes Class II bike lanes on Calle Milano as required by the Specific Plan. The project engineer is proposing on -street parking on Calle Milano between the apartment's entrance/public trailhead and the first intersection (Eliano St.) Because of the width required for the bike lanes, parking is proposed on one -side of the street only (south side, next to Open Space), within an area approximately 140 feet in length on Calle Milano. This proposal would accommodate approximately seven (6) cars to be parked in this area of Calle Milano. In addition, the applicant was provided the opportunity to request a stop sign at the driveway entrance. The applicant and his engineer have analyzed the stop sign concept and concluded that a stop sign would be inappropriate at this location. The City engineer agrees with the project engineer's assessment. Consequently, a three way stop is not included in the striping proposal and a stop sign warrant analysis has not been prepared. Emergency access to and from the Specific Plan area would be maintained in accordance with the original project approval, and includes a second project access point through Avion and Alondra Road on the back of the Las Lomas Specific Plan area. The total width of Calle Milano at the subject location is approximately 40 feet. Travel lanes are proposed at 11.5 feet in width, plus 5 -foot bike lanes on each side of the travel lanes. The average number of cars parked on Calle Millano is 11.3 per day. I have checked am, lunch ,after work and evening. There is trash, damaage to landscape, devaluing inptoperty look as well as poorly parked vehicles. In addition, there have been more than significant parking within the complex. Only 1 time there was not significant parking within the apartment designated parking. What has been noticed because people have left garages open- is that these are not beeing used for vehicle storage. Some are set up as an office, another seems to have been set up as a room, and most that have been visible are set with organized storage. Only a couple of the garages that were open and visable look like they have unpacked boxes. Seems like and actions are showing that the rentors are not concerned with adhereing to the rules and or being respectful to the property. Lastly, I had a discussion with a volunteer police deparment person who goes around and produces tickets for vehicles parked on the street. He was very willing to give notice and warrants to vehicles farther up on Calle Milano and Eliano but was told he is not allowed to give notice to the cars by the apartments. This seems odd and possibly incorrect but with current actions they are speaking the loudest, which is an interpretaion that he must be right. The purpose of my email is to highlight these areas and to follow up on your promise that NO PARKING signs were going up shortly. Can you please define what shortly means. Please advise if the city is going to enforce the no parking signage and please advise a date. If you are not going to follow thru please also notify me so I can then decide what is the next approach. I will be out of town on the date of the announced meeting, October 23, 2013. This letter will constitute my written objections to the proposed change. 1. Parking on Calle Milano currently causes traffic congestion at the area just uphill from the entry median. Going downhill, it is difficult to see vehicles exiting the apartment property with vehicles parked on the north side of Calle Milano above the apartment entrance. 2. Parking on Calle Milano will cause serious problems if emergency evacuation is needed. In the area of the median there is barely room to squeeze by if a vehicle is parked in that area. There are 100 units planned for the apartment complex. If even a portion of the occupiers of those units park anywhere on Calle Milano there will be a huge number of vehicles permanently congesting our only means of entry and exit from Las Lomas. This is a serious safety consideration. If the proposed town homes are built, and parking is allowed, parking on Calle Milano will significantly increase. The persons occupying the apartments must be required to park on site, or in an area where parking is allowed, not on the main ingress and egress street of Las Lomas. 3. The apartment dwellers all have garages and there is adequate parking available on site in parking lots. The purpose of the gate, as we were told, was to secure the apartment area and the property of the apartment dwellers. That gate is serving very little purpose if the apartment dwellers park their vehicles outside the gate. 4. Parking on Calle Milano will also cause deterioration in our landscaped areas since people will be exiting vehicles and walking onto the landscaped areas. 5. There are several specific vehicles that have been parked on Calle Milano without being moved for extended periods of time. If parking is allowed, more vehicles are likely to be dumped in this area. I hope you will take my comments into consideration and not allow the proposed change in parking on Calle Milano. When last we met at the DRC for Las Lomas, I almost asked you about this issue Now, 5 months later, I have more experience on which to base my opinion. As a threshold issue, what has changed from when the developer accepted the DRC recommendation to install NO PARKING SIGNS? "The applicant states that this requirement is not applied to the rest of the Las Lomas Project and there is adequate width on the street to accommodate on -street parking". I think this "waiver basis" was also true when the DRC asked for the NO PARKING signs and the developer did not complain then??!! Why now? Re DRC changing its mind: The DRC was fully aware to the width of the streets in the development. What has changed for the DRC to change its position?? The arguments and important development principles that were valid then are certainly valid now. Frankly, I am surprised the DRC would even consider this waiver. Is it not true that there is supposed to be sufficient on-site parking for apt owners?? If more space is needed, the developer should provide it, and not rely on city streets. My arguments against a waiver: 1. Pedestrian safety: I travel Calle Milano daily and, on at least 3 occasions over the past few months, pedestrians (I assume apt visitors) have darted out from between cars that now park on that street. Dangerous for me and them! In response, the developer might suggest crosswalks. However, we all know how faithfully pedestrians use such signs Yes, we have cars on Calle Milano south of the apts. However, this is not desired and no rationale for exacerbating the situation. If you were to drive Via Cielo at any time, you would rarely see cars parked thereon. This is a "neighborhood look" which is worth preserving whenever possible. 2. Blight: When the apts are fully occupied, I can well imagine that Calle Milano will become a refuge of boats, RVs, as well as cars. The only good news there is that we do not need to spend any money on landscaping, for it will not be visible from the street. 3. Transients/Theft: One good thing about on-site parking (and the use of a parking gate) is that the number of people who are able to simply wander (and check out) the premises is reduced. I would think that apt owners would want to limit the number of extraneous visitors to the complex. Did the development plans account for/provide parking for legitimate visitors to the apts?? 4. What is motivating the developer? The obvious reason the developer would want a waiver is that it gives apt owners the ability to rent rooms out to people and thereby increases the rent the developer can charge. Hence, a three-bedroom apt owner might rent the third bedroom out to 1-4 people, each of who would need to park his/her car somewhere. As I said earlier, if more space is needed, the developer should find that on-site!! I intend to attend this meeting on the 23rd and I will be encouraging my neighbors to do likewise. This action would create a hardship for me, and other residents of Los Lomas Village. Parking in Los Lomas Village is inadequate, and when I signed my lease, I was told that parking on the street was allowed. I am a single parent with two kids, renting a three bedroom unit. Both my kids have a car. I have a one car garage, and one assigned parking spot outside. There are about 7 unassigned spots for the entire complex to share. That leaves one car that has to park on the street. If parking on the street is no longer allowed, I will have to find some place several miles away to park, and shuttle one of my kids to their car, or I will have to break my lease and move. The worst part of this, is that there is absolutely no reason for the city to ban parking on this street. It is 38 feet wide, and parking does not restrict traffic in any way. It is a rural street, there are no other city residents that are affected by parking on the street. The owner mentioned that the houses further up the street were against the complex being built, and are the ones complaining. Only one house can even see the area where the cars are parked, so any complaints of an 'eyesore' are exaggerated. The builders clearly chose to maximize profit at the expense of the residents. The owner told me that one of the issues the City was having, is that the initial agreement with the City indicated that there would be no parking on the street. If that is the case, then I don't understand why the City is choosing to punish the residents because of the owners actions. New buildings are currently being built, and there is more then enough undeveloped space to create adequate parking. Why can't the City sue for breech of contract, or demand that they suspend construction on new units until adequate parking is created. This would help the residents, instead of harming them. I for one would be grateful for this action. Parking on the street is inconvenient for both residents and guests. Most importantly I would like to point out that parking on both sides of Calle Milano at this time, does not in any way impede or obstruct emergency response vehicles or personnel, as there is ample width on both sides. Secondly, I would like to present the fact that although there are two designated parking spots for each resident within the gated property, some current and future residents have student, children residing with them with vehicles. This would be a 3rd vehicle. Where shall they park? Are we to mandate public transportation to get them to and from school? And thirdly, everyone has occasional guests. The holidays are rapidly approaching. Are we not to host family and friends for a Thanksgiving or Christmas meal or other life events, such as baby showers or community bible study groups? Where are they to park? Lastly I would like to ask the home owners in our shared community, where their guests park? It seems that the real issue is that the vehicles are merely aesthetically disturbing to a few property owners. The vehicles that park there are not left for long periods of time, as a matter of fact, it is written in our signed leases that "no guest vehicles shall be left in place more than 72 hours". I am writing this letter in opposition to the request from the developer of the Las Lomas Village Apartment for the City of Atascadero to waive the No Parking requirement on Calle Milano. The developer knew of this requirement when he decided to develop this property and consequently the design of the property provides for adequate off-street parking for residents and guests. There is no compelling reason to change this requirement that was established as a condition for this apartment development to be approved. The developer provides no justification for this requested waiver other than to say that on -street parking is permitted in other parts of the Las Lomas development. In response, I would point out that this is in accordance with the master plan for the Las Lomas development. The section of Calle Milano in question provides the only access to the entire Las Lomas development; the master plan for this development is based on this section of Calle Milano serving as a welcoming landscaped entry to the entire development. The section of Calle Milano in question has been landscaped and maintained at considerable expense through special assessments paid by all owners and residents of the entire Las Lomas development. To allow on -street parking along this section of Calle Milano unnecessarily diminishes this desirable and welcoming design feature that is subsidized and enjoyed by the entire Las Lomas community and guests. If for some reason the City of Atascadero does decide to grant the developer's parking waiver request, then I think it would be reasonable for the city to require the developer to reimburse Las Lomas community members for all expenses incurred to date in landscaping and maintaining the section of Calle Milano in question. The developer should also be required to pay for all landscaping and maintenance costs along this section of road in the future as a condition of this approval, The bottom line here is quite simple. The area in front of the Apartments was originally required to install No Parking signs, because that is the only way to ensure the safety of the Las Lomas residents. There is a large -center medianin this wider portion of the street, which forces cars to drive close to the edges of the street. Parking on the street causes through traffic to have to maneuver around the parked cars in a place and manner that is potentially dangerous and goes against the natural flow of traffic. In addition, the side of the street opposite the Apartments does not have -a sidewalk, which_ means. that if -street parking is allowed you are basically telling people "OK, go ahead and jaywalk" which -I can attest is what is currently happening. e Currently only 1/10th of future traffic • Forces unnecessary, potentially dangerous maneuvering • Says "OK" to jaywalking residents This is not a safe equation, and should not be supported by the City of Atascadero I have researched; and -found -out -that -each -of the Apartments -of the Las Lomas Village Apartments has on-site assigned parking spaces built-in to the already approved plan. The Apartments are one, two, or three bedrooms. The three -bedrooms by their own policy are meant for the third bedroom to be strictly for children, not for 3 -adult occupancy, which means that -at maximum each apartment should have only 2 cars. One of those cars is meant to park in the enclosed garages, and the other in an assigned parking space. There are also guest parking spaces provided on-site for visitors. There is NO reason that street side parking should be needed. There is no reason the City of Atascadero should allow on -street parking here. As loyal tenants, we would like to stand by our landlords in the recent issue with tenants parking on the public street. Please accept this letter in lieu of our inability to attend the meeting. As many local residents know, it is difficult to find decent, safe and clean apartments in North County. While looking for a place to live in Atascadero, we found two apartment complexes that we felt we could make an apartment a. home: Of course, one of them being Las Lomas Village and the other was Hidden Oak's Village. For those who do not know, Hidden Oak's Village is (for lack of a better term) a "sister complex" to Las Lomas Village. We were impressed with the outstanding reputation and consideration that the owners have offered the people of our community for many years. Every day we come home to an exceptional apartment complex and we are proud to say we live here. As tenants who participate in parking on the public street, we are disappointed in, the amount of time and energy that Las Lomas staff are having to waste on this issue. Our apartment complex is occupied in boosting The City of Ataseadero's economy and.its visual appearance. Is parking on the street harming anything? The road on bath sides is plenty big enough for cars to drive through while parked cars are also on the sides: Certainly, if parking on the street causes a dilemma for passing traffic then parking on the street would not be acceptable in any part of Calle Milano. However, this is not the case. Should we not allow any cars to park on any streets throughout Atascadero? The answer is simply no. Let us focus on the bigger struggles we face in our city rather than petty situations. Las Lomas Village is a respectable apartment complex that is taking a huge step in reforming the reputation of apartment complexes that Atascadero has to offer. Perhaps if a total agreement is not an option, then maybe both parties can cordially meet in the middle by limiting parking to a specific side of the road. My concerns are as follows: 1. Safety Vehicles parked on Calle Milano (street's south side) obstruct the view of vehicles departing applicant's property (at entrance in both directions). This hazard creates several unsafe conditions. These hazardous conditions will be ameliorated as soon as applicant complies with. the "no parking" requirements as set forth in the above entitled CUP. Anecdotally, on one occasion, a vehicle exiting applicants property, "took the corner `slide" crossing into my lane of travel "head on"! I contend this driver did so in part due to their view being obstructed by parked vehicles parked on Calle Milano at "Apartment's" entrance. 2. Safety — Vehicles parked on the north side of Calle Milano block the entrance to a marked open space trailhead. Notably, there is no sidewalk on this side of Caiie Milano. This situation (an open space trailhead blocked by parked vehicles with no sidewalk for egress) creates several unsafe conditions. This trailhead is popular and frequently utilized by hikers, bikers, equestrian and others. I personally utilize this traii and recently, due to vehicles blocking the trailhead entrance, had to navigate around a parked vehicle. While doing so, a vehicle traveling west on Calle Milano nearly struck a vehicle mat was traveling east (presumably in the drivers effort to yield room for me). Fortunately, I was on my bicycle and could quickly get out of the way (I contend that equestrian and others would not be as agile and therefore the conditions and risk created by parked vel-licies will be greater). 3. Safety - Vehicles parking on Calle Milano (at or near intersection Halcon) create serious hazards for vehicles and to pedestrians traveling on Calle Milano (either direction). At this intersection, Calle Milano is simply too narrow to safely accomrnodate parked vel-licles. I contend that Calle Milano was not engineered to accommodate parking in zones that are currently permitted to be marked "no parking". This road's safety will be improved markedly simply by Implementing the -designed "no parking" conditions. Respectfully, I am requesting that the City of Atascadero deny.applicants request to waive the installation of "no parking" signs and further I hereby respectfully request that City planners enforce implementation of all "no parking" requirements and do so forthwith. All future developers will be more likely to adopt a building permitting strategy which accepts DRC -imposed conditions in order to obtain the building permit, knowing that once the project is completed, waivers can be obtained. In addition, all future planning commissions will need to allocate valuable resources to future meetings like this one. In simple terms, a waiver here makes a mockery of the planning process. The DRC was very astute in requiring NO PARKING. It was telling the developer that on-site parking was the developer's problem and that the city was not obligated to assist by allowing street parking. If the builder had a problem with this, the builder should have resolved the issue before the permit was issued At meeting's end, I was very much concerned about the scope of analysis by the DRC for the following reasons: 1. One DRC member referred to the owner as a good man, a good developer. 1 am unclear about how this opinion should influence the DRC decision. 2. After public comments, all questions by the DRC dealt with the ability of the City to allow parking while preserving safety (e.g. speed bumps, reduced speed limits, emergency access, crosswalks, flow studies, etc.). 3. No questions were raised about the viability of an option for limited (e.g., 3- hour, no overnight) on -street parking and how such would address the tenants' legitimate concerns about space for visitors for parties. 4. No questions were addressed to the owner. If the DRC were truly interested in the full range of possible, equitable solutions, I think the DRC should have asked the owner to address the following: a. What additional steps could you take to increase on-site parking spaces (beyond the minimal actions the owner had already taken)? In an e-mail from the owner to you and Caliie, the owner states that "the site is so tight that even if we eliminate a building or two it would not solve the problem." I find this hard to believe and think the DRC should have asked for the rationale behind this statement. A parking space is about 8 feet by 20 feet. Twenty parking spaces would be created by replacing a 80 foot by 40 foot building! If eliminating two buildings would not solve the problem, then the owner should not have asked to expand the project from 80 to 100 units [and the DRC staff should, in the future, increase the parking requirement estimates]! b. Given that you accepted NO PARKING as a condition for obtaining a final building permit, what contingency plans did you develop for the possible (indeed likely) situation in which your tenants were to require more than the planned 221 parking sites? c. Did anyone at the City tell you early in the construction phase that a waiver would be obtainable? [This is an appropriate question because one tenant wrote that the rental company told her that on -street parking would be available. Seems presumptuous unless a deal was already struck.] d. If the NO PARKING waiver is accepted, how will you insure that all tenants use their garages for a car and not for storage? There are already vehicles that are parked 24 hr and not moved. I think- this hinkthis could lead to transient parking on the streets overnight. If any home in our development has a guest unit, the home must have a 3 -car garage! 2. The owner asked for a variance --to install 20 3 -bedroom apts and yet the renters most likely to require more than 2 parking places are those renting 3 -bedroom apts. 3. The DRC talked about the trailhead (and parking for it) as a basis for waiving no - parking; however, in fact, the demand for such is very low and there is parking available on Efiano alongside the park at the corner of Calle Milano and Eliano. 4. The DRC does not appear to have considered the most obvious solution: the owner simply limits renters to those with only 1 or 2 cars. Major Issues/studies/addition.a,l data required: Planning Commission, Fire department, traffic safety, and Builder A 2004 CUP for the Las Lomas apartments refers to the "Specific Plan" for the whole development as stating that the road [which later was named Calle Milano] was a "no parking" street. If this Specific Plan is the foundational document for the whole development, it would mean that the DRC's 2/16/12 decision for no parking on Calle Milano was redundant and unnecessary (because the Specific Plan had always required it), and would also probably mean that only the Planning Commission could reverse that condition. If the DRC does.grant a waiver, can we appeal to the Planning Commission? 3 It is the position of the opponents to the waiver that, since the owner previously agreed to NO PARKING and now wants a waiver, the owner should be com.pelled.to show why the obvious solution (limit renters to those with less than 3 cars) does not work for him-. Ras owner generated any additional information for the DRC (beyond that at public meeting or in the two e -malls from builder to city)? If not, I think the DRC should require the owner to address the following: a. Has the owner taken the no parking requirement seriously? For example, has owner asked applicants how many cars they have; has builder informed applicants that there is space for only 2.21 cars/apt for the entire complex; has the owner told applicants that street parking will be available? Has owner developed contingency plans for more on-site parking? b. Is owner claiming financial hardship if the waiver request is not granted? c. Did anyone at the City tell the owner at any time after the no parking requirement was imposed that a waiver would be obtainable? d. Affordable Housing: What feature of this development makes this "affordable housing" [important insofar as the owner is claiming a special "consideration" because of this]. If the waiver is not granted, the owner might not be able to rent to a 3+ car entity but I have a hard time reconciling "affordable housing" with a family with more than 2 cars. If this is truly affordable housing, the number of potential renters must be very large and this restriction should not represent a monetary hardship for the owner. 0 Once the fire department generates its assessment of its emergency evacuation plan for the neighborhood (and if it is not charged with, doing this, why not?), does the public have the ability to review, comment on, and/or cross -exam its author before the DRC uses it? With respect to this, my fundamental issue deals with the following hypothetical: At full build- out, there will be about 380 homes served solely by Calle Milano. Assume that parking is allowed, leaving two narrow lanes for access/egress. There is a major fire and the fire department allocates one lane (e.g., the up slope) lane for the emergency vehicles and the down-slope for evacuees. What is the proper exit path for cars parked up slope?? Will they have to U-turn across the fire access lane? Would potential u -turners negatively impact the emergency response time? NOTE: Calle Milano is 40 feet wide. I have a 16 foot long car. Its turning radius is about 38 feet. Hence, if I am parked on one side of the street and try a u -turn, I am just able to complete the a -turn in one step but only if there is no car parked on the other side of the street. If there were a car parked on the other side of the street, it would require two steps for me to complete a u -turn. Less than 5% of all new cars have a turning radius of less than 34 feet [=40 ft- 6 ft width of car on other side] What is Fire Department's opinion of speed bumps on its access roads? 5 111M UNW-UM • the traffic engineer has generated his study, does the public have the ability to review, comment on, and/or cross -exam its author before the DRC uses it? One additional fact that should be produced: what is the cost to the city of the planned studies and traffic/parking related measures? The street is 40 feet wide. If cars are parked on both sides (consuming 1 • feet) and there is a 8 foot wide left -turn lane, then the two traffic lanes are only 8 to 9 feet wide. Is this safe? This need could be addressed by allowing limited parking on Calle Milano (e.g., 3 -hour parking between noon and midnight on the apartment -side of Calle Milano- no overnight parking). It has come to our attention the request made by the owner of the Las Lomas Apartments to waive the "No Parking" signs requirement along Calle Milano, specifically in the immediate vicinity of the Las Lomas apartments. We have had a chance to review the approved Specific Plan and the Staff Report dated 10-23-13 prepared for the Design Review Committee and there are some areas of concern that we would like to bring to your attention. The Woodridge/Las Lomas Specific Plan and the accompanying Vesting Tentative Tract Map were originally approved on September 23, 2003 by resolutions of the City Council (2003-045 and 2003- 046) upon recommendation from the Planning Commission. In the Specific Plan, Calle Milano was designated a "collector" street. Furthermore, the Specific Plan states that no parking would be provided or allowed on Collector Streets, and the exhibits referenced on the Specific Plan are a faithful illustration of what the document had already described. Woodlands Specific Plan — November 14, 2003 Section I1.B.1.a (Page I1-23) Collector Streets Collector Streets provide linkages between local residential streets and minor arterials. Collectors are designed to handle a larger volume of traffic. Under this Plan, a collector street provides access to the Plan Area from Halcon Road to the first intersection of the Plan Area. The collector street has two travel lanes, center median, square curbs, no pork,"g, a detached sidewalk with parkway, Class 11 Bikeways, and street trees as depicted in Section A of Exhibit 8 - Street Sections. They took great care to specify a number of amenities that spoke of values and a quality of life that would be desirable to future tenants and homeowners. From the broad scope definition of Land Uses all the way down to the details of specifying native plants on disturbed open space, we must give due consideration to all amenities in between, such as, nature trails, view fencing, and street trees to name a few. The Class II Bikeways called for in the Specific Pian is in the very midst of those amenities that were carefully crafted by a team of professionals on both sides of the counter to create a great neighborhood, and we are proud to be the team who will bring a portion of it to reality. If the Class II Bikeways on Calle Milano are under consideration to be eliminated from the plan to provide for parking that was not originally permitted nor specified, then it needs to be processed as an amendment to the Specific Plan pursuant to the Government code 65453 (a) as noted on the Section I.D.1 of the plan. Section IV -2 of the Specific Plan goes into great detail of the amendment process. At the very least, the waiver of the "No Parking" on Calle Milano is a change in text that affects standards and policies (circulation and traffic) that would require public review and approval by the Planning Commission. 3. The Circulation Element's designation of Calle Milano as a collector street plainly describes the fact that it is designed to handle all incoming and outgoing traffic for the project. Woodlands Specific Plan — November 14, 2003 Section I.D.1 (Page I-15) CIRCULATION ELEMENT The Plan's circulation system is designed to provide a functional and efficient transportation network for automobiles, bicyclists, and pedestrians. The street system is comprised of a network of collector and local residential streets designed to accommodate traffic generated by Plan residents. All streets are public. Exhibit 7 - Circulation Map, has been incorporated into this Plan consistent with §65451(0)(2) of the State Government Code. It would seem counter -intuitive and in direct opposition to the original premise of "providing a functional and efficient transportation network of automobiles, bicyclists and pedestrians" for the DRC to consider speed bumps to slow down traffic and thus provide safety for pedestrians when the main road is designed to efficiently handle all traffic in and out of the project. Any effort to slow down traffic will impede its efficient flow. We cannot ignore the issues of safety created by parked vehicles acting as screens when pedestrians try to go across the road and are difficult to be spotted by drivers entering or leaving the project. Even if the "No Parking" restriction is lifted temporarily, we cannot dismiss the issues of street maintenance when oil leaks from parked cars begin to erode and deteriorate the paved surfaces where the Class II Bikeway is required to be. Over time, it will make for uneven and unsafe surfaces for those resident who will venture to use those lanes. Finally, we cannot ignore the neighbors reporting trampled landscape, and the presence of trash generated around parked vehicles on Calle Milano. This would not be an issue if the required "No Parking" signs had been installed as originally intended. In summary, it is our request that Calle Milano should remain a "Collector Street" as originally designed to allow it to handle traffic efficiently, that the required "No Parking" signs should be installed to maintain safe vehicle/pedestrian interactions, and the Class II Bikeway striping be completed in order to protect the integrity of the paved surfaces for current and future users of the project's Bikeway. It has come to our attention that the developer of the Las Lomas Village Apartments is in the process of seeking an amendment to the Woodlands Specific Plan in order to allow parking along Calle Milano, which is classified as a collector street. We believe that such a request is in conflict with the City's General Plan and other planning policies. In any case, our clients have expressed concerns regarding the processing of the Specific Plan amendment, which of course will require public hearings at both the Planning Commission and City Council in accordance with Government Code Section 65453• We understand that the developer's application is scheduled to be heard by the City's Design Review Committee ("DRC") on January 15, 2014. At this time we are requesting that we be kept informed of any meetings that are scheduled regarding this matter, so that our clients can fully participate in the process.
