At that meeting, the City Council added several conditions of approval in the resolution in order to minimize impact on adjacent properties. Refuge Church is currently in the process of obtaining building permits to begin implementing the items approved with the conditional use permit. Staff is bringing the construction proposal to DRC in order to clarify a few items which were to be modified per the conditions of approval. This DRC meeting is not intended to modify the Council's resolution of approval or reopen any issues previously decided by the City Council. General Plan Designation: Single -Family Residential — Z (SFR -Z) Zoning: Residential Single -Family — Z (RSF-Z) DRC Action: DRC will provide clarification on the implementation of conditions related to the following: 1. Background: This year a CUP amendment was approved for facility expansion at Refuge Church. On May 28, 2013, the City Council upheld the Planning Commission's approval of an amendment to Conditional Use Permit 2002-0071. At that meeting, several conditions of approval were added to the resolution by Council in order to minimize impact on adjacent properties. ITEM NUMBER: 2 DATE: 9-11-13 The CUP amendment included the following components: • New asphalt parking lot with one additional drive approach and landscape buffer next to San Clemente Road. Parking lot to be redesigned to connect to existing lot and eliminate one access point on San Clemente • Six (6) new parking lot and playground pole lights, for a total of eight (8) pole lights allowed on site • New masonry trash enclosure, to be relocated away from San Clemente • Allowing a 768 sq. ft. storage garage building • Eight (8) foot fence to enclose yard space behind sanctuary • New and/or relocated signage • Add adjacent property to Master Plan of Development to allow existing residence to be converted to church offices in the future Refuge Church is currently in the process of obtaining building permits to begin implementing the items approved with the conditional use permit. Staff is bringing the construction proposal to DRC in order to clarify the lighting and trash enclosure conditions of approval. Due to neighborhood concern regarding the facility expansion, and previous history of project appeal, Staff is bringing specific construction details to DRC for review prior to installation. These are only items which may be open to interpretation or "staff discretion." This DRC meeting is not intended to modify the Council's resolution of approval or reopen any issues previously decided by the City Council. DRC Action: DRC is being asked to provide clarification on the implementation of conditions related to the following: 1. Site lighting (light pole height & bulb wattage) 2. Nighttime security lighting 3. Location of trash enclosure There are other issues which have been discussed which may be bought up at the DRC meeting. Staff believes that the other issues which have been raised can be addressed at a staff level in order to provide compliance with the CUP, and these items do not need DRC direction at this time. Item #1: Site Liahtin The CUP approval allows for a total of 8 pole playground (including the 2 existing lights). The specifies site lighting levels: ITEM NUMBER: 2 DATE: 9-11-13 lights within the parking lot and following condition of approval "A photometric plan shall be submitted and building permits obtained prior to installation of any new exterior lights. Parking lot lights shall be limited to a maximum of 2.0 footcandles, with site safety to be considered and light levels discussed with a lighting professional in charge of preparing the photometric plan. The photometric plan shall verify compliance with City codes, and ensure no light spill offsite. Light sources shall be shielded so that they are not visible from offsite. The photometric plan shall ensure that any existing exterior lights on site are incompliance with City codes. New and existing exterior light fixtures shall be modified or moved as necessary to comply with City lighting ordinances. " City staff has been working with the applicant's lighting designer for the last several months to ensure the new parking lot light poles comply with this condition. Because the lighting on the subject site has caused neighborhood concern in the past, staff requested that the church test one of the fixtures on site prior to submitting building permits for permanent installation of the proposed lights. The light pole was initially tested at 16 feet in height, which created a low footcandle level on the ground as required by the condition of approval. Upon the first text, the City immediately received calls from concerned neighbors. Due to the slope of the site and the downhill location of the neighbor's properties, the light source was visible from adjacent properties. City staff has since met on site with the church representatives and the neighbors to look at the lights on two occasions, and both groups worked together to come up with solutions. At a site meeting on August 3, 2013, the following lighting proposal as agreed upon by both the church and the neighbors: • 12 foot tall light poles • 60 watt induction bulbs (similar to LED) • Shielding to be installed on downhill side to block any glare visible from downhill • 2 existing light poles to be replaced • 4 new parking lot lights • 1 new light at playground • Photometric plan provided (see Attachment 3) • City staff will inspect the lights after installation to ensure that the light source is not causing glare for downhill properties; light sources shall not be visible from off site. • Upon installation, lighting designer shall measure light output at the property lines to verify that there is no light spill offsite created by the church Staff recommends that the DRC find the above lighting specifications consistent with the condition of approval in order to begin installation. A photometric plan is included as Attachment 3. Due to the lower pole height, there are bright spots created ITEM NUMBER: 2 DATE: 9-11-13 directly under the light fixture that are as high as 4.9 footcandles; however, the lower pole heights are preferred as they minimize offsite glare and are more residential in nature. Per the conditions of approval, the lights are required to be turned off by 10pm. However, the church has stated that they will try to turn them off earlier as their services and meetings are done. CUP conditions of approval require the church to also verify that all the existing site lights are in compliance with City codes. City staff is working with the lighting designer to identify any existing site or building mounted lights which have sources visible from offsite, or are causing light spill offsite. The church has already changed out several fixtures. A few additional building mounted lights have been identified as non-compliant and will be changed out with shielded fixtures. Item #2: Nighttime Security Lighting At the May 2013 City Council meeting, the City Council included a condition that only security lighting may be left on after 10pm. There has been some difference of opinion about what should be classified as "security lighting." The church's plan is to leave the two existing parking lot lights on at night, as well as the building mounted lights. There are also currently various types of motion sensor lights installed throughout the site which turn on throughout the night. Neighbors have expressed concern that the site is too bright throughout the night, and the motion senor lights go on continually as animals walk through the site. City staff is looking for direction from DRC as to what should be classified as "security lighting" and may be permitted to remain on after 10pm. Item # 3: Location of Trash Enclosure An existing trash enclosure is currently located next to San Clemente Road. As part of the CUP, a new masonry trash enclosure is to be installed. At the May 2013 meeting, the City Council included a condition of approval which requires the trash to be relocated to minimize impact on the San Clemente neighbors: "The trash enclosure shall be relocated away from the San Clemente Road frontage. The applicant shall work with City staff and Atascadero Waste Alternatives to find a location and design that is acceptable. The church would prefer to locate the enclosure further down San Clemente, closer to the Portola Road intersection, in order to provide greater distance from the neighbor's residences on San Clemente. The neighbors have expressed concern that this new location does not meet the condition to relocate the trash "away from San Clemente" and would prefer that the trash enclosure be installed in the upper parking lot on the Portola Road side. City staff met on site with Atascadero Waste Alternatives (AWA) to discuss possible ITEM NUMBER: 2 DATE: 9-11-13 locations for trash and recycle dumpster service. Due to the slope of the driveway on the Portola side, AWA is has stated that they will need to access the site from San Clemente Road. The trash trucks would have to either back in or back out of the Portola Road entrance, and due to the heavy traffic on Portola this is not a safe situation. In addition, the slope of the lot near Portola concerns AWA as there is potential for dumpsters to roll away as the employees are moving them in and out of the enclosure. CONDITIONAL USE PERMIT 2002-0071 AT 6955 AND6PORTOLA RD APN 054-071-001 and 054-083-004 (Refuge Church) WHEREAS, an application has been received from Refuge Church (6955 Portola Rd, Atascadero, CA 93422) Owner and Applicant to consider a project consisting of a Conditional Use Permit Amendment for expansion of existing church facilities, including parking, storage buildings, offices, fencing and lighting (Amendment to CUP 2002-0071); and, WHEREAS, the site's current General Plan Designation is Single -Family Residential - Z (SFR -Z); and, WHEREAS, the site's current Zoning is Residential Single -Family - Z (RSF-Z); and, WHEREAS, Churches are a Conditional Use in the Single -Family Residential - Z zone; and, WHEREAS, Refuge Church has an existing Conditional Use Permit, approved originally in the 1980's, amended in 2002, and amended again in 2006, that established a Master Plan of Development for the church use and property at 6955 Portola Road, and the existing CUP is required to be amended to further expand facilities and area of site operations; and, WHEREAS, the proposed expansion of church facilities qualifies for Class 3 and a Class 1 categorical exemptions per the requirements of CEQA; and, WHEREAS, the laws and regulations relating to the preparation and public notice of environmental documents, as set forth in the State and local guidelines for implementation of the California Environmental Quality Act (CEQA) have been adhered to; and, WHEREAS, a timely and properly noticed Public Hearing upon the subject Conditional Use Permit Amendment application was held by the Planning Commission of the City of Atascadero at which hearing evidence, oral and documentary, was admitted on behalf of said Master Plan of Development; and, WHEREAS, the Planning Commission of the City of Atascadero, at a duly noticed Public Hearing held on April 16, 2013, studied and considered the Conditional Use Permit Amendment 2002-0071, and, City of Atascadero Resolution No. 2013-028 Page 2 of 18 WHEREAS, an appeal of the project and the required appeal fees were submitted to the City of Atascadero within the 14 day project appeal period by Sarah Peterson (8455 San Clemente Road, Atascadero, CA 93422), and, WHEREAS, the City Council of the City of Atascadero, at a duly noticed Public Hearing held on May 28, 2013, heard the appeal of the Amendment to Conditional Use Permit 2002- 0071, and, NOW, THEREFORE, the City Council of the City of Atascadero takes the following actions: SECTION 1. Findings upholding Planning Commission's approval of Conditional Use Permit 2002-001.7. The City Council finds as follows: 1. The proposed project or use is consistent with the General Plan and the City's Appearance Review Manual, and any pertinent City policy or criteria adopted by ordinance or resolution of the City Council; and, 2. The proposed project or use satisfies all applicable provisions of the Title (Zoning Ordinance); and, 3. All site work, grading, and site improvements shall be consistent with the Master BP PS, CE, BS Plan of Development as shown in EXHIBITS C through G. A building permit shall be obtained for fences over 6 feet in height 18. A photometric plan shall be submitted and building permits obtained prior to BP PS, BS installation of any new exterior lights. Parking lot lights shall be limited to a maximum of 2.0 footcandles, with site safety to be considered and light levels discussed with a lighting professional in charge of preparing the photometric plan. The photometric plan shall verify compliance with City codes, and ensure no light spill offsite. Light sources shall be shielded so that they are not visible from offsite. The photometric plan shall ensure that any existing exterior lights on site are incompliance with City codes. New and existing exterior light fixtures shall be modified or moved as necessary to comply with City lighting ordinances. 19. A new 768 sq. ft. storage garage shall be permitted behind sanctuary, above the BP PS, BS new parking lot facing San Clemente as shown in EXHIBIT C. A building permit shall be obtained prior to construction of the garage. Siding shall be installed and painted to match the existing sanctuary building. The roll up garage door shall be painted to match the walls of the garage to help it blend in. Accessibility and setbacks shall be provided for storage garage, consistent with Building codes in place at time of construction. 20. One (1) monument sign (up to 20 sq. ft. in size) and one wall sign (up to 10 sq. ft. in Ongoing, PS, BS size) may be permitted facing Portola Road. BP All other temporary signs and banner shall be removed from both of the subject properties. No signage shall be installed on San Clemente Road. A limited number of directional signs may be permitted in addition to the permitted signage, per Sign Ordinance standards.
