Per Atascadero Municipal Code Section 9-2.107, commercial remodels are reviewed by the DRC to ensure consistency with the City's appearance review standards. During the recent construction a kitchen ventilation system for the new restaurant, an exhaust fan and associated makeup air equipment were installed on the roof of the building. The equipment was not identified on the original plans approved by the DRC or the building permits. Due to the slope of the roof and the scale of the building, staff has concerns that the roof mounted equipment is highly visible, and therefore inconsistent with the screening requirements of the City's appearance review standards, as well as the DRC's original project approval. General Plan Designation: General Commercial (GC) Zoning: Commercial Professional (CP) Proposed Class 1 Categorical Exemption for an existing facility Environmental Determination: Staff Staff recommends DRC visit the site to observe the existing roof mounted equipment, Recommendation: and provide staff and the applicant direction regarding possible screening requirements or relocation. Staff recommends that the makeup air equipment be moved to the rear slope of the building where it would not be seen by the public right-of-way, and the exhaust fan located at the roof pitch be painted a compatible color to match the building architecture. The site is currently not incompliance with the CUP, including standards for landscape, signage, trash storage, and parking. Prior to approving any building permits for expansion of the existing use, staff is bringing the project to DRC for discussion of the expansion and site consistency with the existing CUP approval. At that meeting, the DRC gave direction regarding the following compliance items: • All banners and non -permitted signage to be removed from the site • Three (3) standard parking spaces to be striped on site, consistent with the CUP • Landscape & irrigation to be installed, consistent with CUP requirements • Trash dumpsters shall remain stored in trash enclosure and shall not be left out on site • North driveway on Viejo Camino permitted to remain open (closure per CUP not required) • Site shall be maintained in good condition with ongoing compliance with the CUP DRC requested that the design of the kitchen's exhaust fan venting system and the revised landscape plan be brought back to DRC for additional review prior to permit issuance. The exhaust fan was to be relocated or screened to camouflage the exterior equipment. Location to comply with building and fire code setbacks. The landscape plan was to be updated to incorporate drought tolerant shrubs and screening plants consistent with CUP conditions. Revised Kitchen Ventilation System Location On July 11th, City Building and Planning staff met on site with the business owner and his project designer. It was determined that the existing location of the unpermitted exhaust fan on the side of the building does not meet the 10 setback required to the property line. The applicant is proposing to instead route the venting system vertically to exit through the roof. The new exhaust fan will be visible on the front slope of the roof, which faces EI Camino Real. It will be located towards the top of the two story structure, and will be painted to match the roof color. Both City Building and Planning staff agree that this is a preferred option, rather than exiting from the side of the building near the public sidewalk. A makeup air system will also be required as part of the overall kitchen ventilation system. The makeup air will be installed on the lower level roof, near Viejo Camino. A screening surround will be installed on all visible sides of the equipment. Updated Landscape Plan The applicant's designer has prepared an updated landscape plan to meet the conditions of the 2009 CUP. The landscape plan includes 5 new London plane sycamores as street trees along the EI Camino Real and Viejo Camino frontages. Boxwoods and blue agapanthus would be installed in rows along the frontages. Goldenrod and purple bell heath would be used as accent plants in wider planters and at the street corner. Staff believes that the proposed landscape plan is consistent with the intent of the original mitigation measures for drought tolerant shrubs and screening plants. It should be noted that due to the amount of concrete and hardscape installed on site, the amount of landscape area is significantly reduced from the original 2009 CUP approval. A wider concrete landing and staircase were installed near the front entrance at the street corner, and the planter which was planned to be in front of the parking spaces is currently concrete. The Viejo Camino driveway will also be left open, instead of replaced by landscape. The applicant is proposing to use three large movable planters in front of the standard parking spaces in order to add greenery to this area. However, the existing concrete is proposed to remain as is, and only the dirt areas will be landscaped. Staff agrees that this is the most feasible solution given the existing site improvements. Recently, the kitchen ventilation system for the new restaurant was installed. The roof mounted equipment includes an exhaust fan (located at the corner of the building at the pitch of the roof) and the associated makeup air equipment (installed on the front roof slope above the main entrance). The roof mounted equipment was not identified on the original plans approved by the DRC or the building permits. Due to the slope of the roof and the scale of the building, the roof mounted equipment, is highly visible. City standards require that all ground mounted and roof mounted equipment be screened from public view. Efforts are made with each project to plan the equipment to be located in the least visible areas, or construct screening systems where feasible. City Staff is concerned that due to the size and location of the makeup air system, a roof screen would look out of place and out of scale with the simple building roof slope. Therefore, staff recommends that the makeup air equipment be moved to the rear slope of the building where it would not be seen from the public right-of-way. The exhaust fan located at the roof pitch could take on the appearance of a chimney by leaving it in its existing location and simply painting it a compatible color to match the building architecture.
