The applicant is looking to submit for building permits in early summer with construction to commence in the Fall of 2013. Background The Taco Bell was constructed in 1978 at 7385 EI Camino Real as a part of the Aadobe Plaza Precise Plan. The original Taco Bell did not have a drive-through facility. In 1992, the property owner proposed a complete redesign of the building and proposed the addition of the drive-through window. The City processed and approved a Conditional ITEM NUMBER: 2 DATE: 4/10/13 Use Permit alongside a complete redesign of the Taco Bell. The CUP was approved by the Planning Commission in February 1993. Staff issued a building permit that contained a site plan that differed from the approved Conditional Use Permit in August of 1993. This site plan contained a different circulation pattern for the drive-through to allow additional queuing of customers for the drive -up window. The redesigned Taco Bell with a drive-through window was constructed and finaled in December 1993. This building has been utilized by Taco Bell since 1993. The applicant has recently renewed their lease with the property owner and is seeking to redesign and upgrade the building to provide a more consistent architectural look with existing corporate branding. Site Plan / Circulation The applicant is proposing few changes to the existing drive-through location, parking location, etc. from the approved 1993 CUP. The 1993 CUP application and staff report showed difficulty in locating the drive-through lane to accommodate turning radii and stacking queues. TACO BELL oMOOD&�i 0 ITEM NUMBER: 2 DATE: 4/10/13 a U F _ s `167.58' i6 p The applicant is proposing an American with Disabilities Act (ADA) accessible ramp connecting the restaurant to the sidewalk. This new ramp, which is required by the California Building Code, will remove some of the existing front landscaping to accommodate the ramp. With the installation of this ramp, City staff will require replacement of the existing drive approach with Caltrans Standard A87 drive approach that includes a four -foot (4) wide pedestrian path. View from Property Line with Adobe Plaza Based on the approved CUP 1, from 1993, staff will ensure that a bicycle rack and three (3)proposed parking spaces adjacent to the Adobe Plaza is provided for employee parking only. This will be a conditioned as a part of the building permit. Site Landscaping The applicant proposes removing a substantial amount of landscaping fronting EI Camino Real and along the side setback next to the drive- ITEM NUMBER: 2 DATE: 4/10/13 through lane. The landscaping is proposed to be replaced with more water efficient landscaping, consistent with the City's Municipal Code. The plan calls for the elimination of landscaping for the accommodation of a new ADA ramp in the front of the building. This area of landscaping also functions as the site's drainage basin. City staff will require a drainage study and accommodation of drainage on-site as a part of the building permit. The existing rear landscaping is proposed to remain intact. The existing CUP required landscaping on the side of the drive-through isle and in the rear of the property. The applicant proposes to maintain the existing shrubs and trees along the property line that abuts existing residential. The DRC should review this rear landscaping and determine if it is adequate. Proposed Landscaping Plan ITEM NUMBER: 2 DATE: 4/10/13 Fencing / Trash Enclosures The applicant proposes to leave the existing wood fence abutting the residential uses and the trash enclosure. The existing Conditional Use Permit is specific on the requirements for screening of both the trash enclosures and the wooden fence. The CUP requires that a six (6) -foot wall or fence be provided to buffer the site from the adjacent residential uses. As a part of the remodel in 1993, the owners of the property installed a wood fence and utilized landscaping to screen and buffer the property from the adjacent residential. The fence is well hidden with existing landscaping, however, the fence is in poor condition. With most new commercial applications or business, City staff requests that a solid masonry wall be constructed when a commercial use abuts a residential use. Staff is recommending that the existing fence abutting the residential uses be replaced with a solid masonry wall that is six -feet in height, consistent with the approved CUP. Rear of property line with existing wood fence r -.7111: ITEM NUMBER: 2 DATE: 4/10/13 In addition to the existing wooden fence, the applicant has not indicated whether the trash enclosure fencing will be replaced. The trash enclosure was built in 1993 along with the addition of the drive-through lanes. Staff is recommending that the gates of the trash enclosures be replaced with decorate fencing (or other type of decorative materials) consistent with the revised architecture of the building. Existing Trash Enclosures L Lighting City staff has received complaints from neighbors in regards to the lighting at the existing Taco Bell. Complaints have varied and include excess light glare from the existing lights shining into bedroom windows. The applicant is not proposing any changes to the existing light pole locations, however staff is recommending that the existing lights be modified and shielded to avoid light glare into the neighboring residents. An existing light fixture ITEM NUMBER: 2 DATE: 4/10/13 Architecture Revisions The applicant is proposing a substantial remodel and fagade upgrade to the exterior of the building. The applicant will maintain the existing roofline and some other elements to reduce construction costs rather than a complete tear down of the building. The applicant is proposing to replace the majority of the front fagade by eliminating the Spanish style colonnades in both the entries and windows and replacing them with a modern square finish, replicating the company's revised corporate architecture. In addition to the new square entry and window columns, the applicant is proposing additional finishes on the building such as wood finishes and additional lighting around the building. Additionally, the applicant is proposing to replace signage along the building. Along with the outside remodel, the applicant is proposing a remodel to the interior of the building. All development shall be in conformance with Attachment A (revised site plan), Attachment B (revised Conditions of Approval) and all other codes and ordinances of the City of Atascadero. Any substantial modification to this approval shall be approved by the Planning Commission prior to implementing any change. 2. A grading / drainage plan shall be submitted and deemed approved prior to issuance of building permits. Plan shall show existing and proposed contours and be accompanied by a soils report for the construction of foundation and materials. 3. All improvements in the public right-of-way shall be constructed in accordance with the City of Atascadero Engineering (Public Works) Department Standard Specifications and drawings, or as directed by the City Engineer. An encroachment permit shall be obtained from the City Engineering Department prior to construction. The applicant shall enter into a Plan Check/Inspection agreement with the City. The proposed southerly driveway approach shall be constructed in accordance with City Standard No.423 and City Standard No, 409. 4. Pacific Gas and Electric shall review and approve plans for work within their easement prior to issuance of building permits. 5. No deliveries by common trailers of twenty -feet or greater shall be made after 9 a.m. 6. The main central part of the Adobe Plaza parking lot shall be restriped, as shown on the site plan to include compact spaces, prior to final inspection. The Taco Bell parking lot shall be restriped per the site plan prior to final inspection.. 7. A landscaped strip, not to exceed five feet in width, shall be provided along the southerly property line. The "blue haven" junipers shall be a minimum of five feet tall at time of planting. Additionally, a landscape planter island shall be placed approximately in the center of the southerly row of parking. 8. The three proposed parking spaces adjacent to Radio Shack shall be designated for employee parking only. 9. A new bicycle parking rack to accommodate a minimum of five bikes shall be provided on the Taco Bell parcel. 10. A solid six foot wall or fence and landscaping strip shall be provided along the entire rear of adobe plaza as a buffer between the commercial and residential properties. The fence ITEM NUMBER: DATE: 4/10/13 near the trash enclosures shall be raised to provide a consistent six foot fence in line with the grade of the southern section or rear fencing. In addition, a six foot solid wall or fencing shall be provided on the rear portion of the southerly side property line (from the rear of the Kragen building to the rear property line). 11. All proposed lighting shall be directed away from adjacent residential property and shielded so as not to adversely impact surrounding residences. Lighting shall be of the minimum intensity necessary to light the Taco Bell and drive-through area. 12. The Taco Bell building shall be painted the same color as the remainder of Adobe Plaza. Sign shall be installed in conformance with the Zoning Ordinance after obtaining building permits. 13. The drive-through circulation pattern is approved as follows: a. The turning radii throughout the drive-through shall be verified as adequate prior to issuance of permits. b. The stacking (waiting) area for drive-through vehicles shall be separated from the Site's through traffic by a concrete or asphalt curb. 14. The white stripping area proposed to indicate "exit only" shall be enhanced with raised surface material, such as "botts dots". Likewise, the pedestrian crossing area of the drive-through lane shall be delineated with a distinctive paving material, such as exposed aggregate concrete. 15. This Conditional Use Permit shall expire one year from the date of final approval unless all conditions are satisfied and the project shows substantial progress, or unless a time extension has been granted pursuant to a written request prior to the expiration date.
