Callie Taylor, Associate Planner, (805) 470-3448, ctaylor@atascadero.org Colony Square CUP Amendment CUP 2004-01271 DRC 2012-0003 Background: The Colony Square Master Plan of Development was approved by Planning Commission as a Conditional Use Permit in 2005. The mixed use project was approved for 67 residential units, 75,230 square feet of retail/restaurant space, a 10 -screen movie theater, and 17,100 square feet of office space. Most buildings were approved at three stories in height with restaurants and commercial uses on the ground level. Offices and live -work housing units were to be located on the upper two floors. Building A of Colony Square, which includes Galaxy Theater, was completed in March 2011. The property owner is currently working to secure tenants for the next phase of the project so that additional buildings can be constructed. Approved Site Plan ITEM NUMBER: 1 DATE: 6-21-12 I;.I Camino Real Proposed Amendment: T.i H,,.-, v An amendment to the Master Plan of Development (CUP) is proposed in order to eliminate the second and third floor residential space in some buildings and permit changes to the elevations, square footage, and minor modifications to the site plan. Given the changes in the retail construction and banking industries in recent years, it has been difficult to find tenants and lending to construct the large buildings currently designed with the 2004 Conditional Use Permit. The architect and property management company have proposed revisions which would enable smaller buildings to be constructed as tenants become available. The residential and office components would be removed from the second and third floors of buildings B, C, F, G, and H. The buildings are broken up into smaller 3,000 to 5,600 sq. ft. components of retail space which can be constructed individually. These buildings could hold 2 to 3 smaller tenants, or one large tenant. Building D, located adjacent to Capistrano, is proposed to remain as originally designed with residential units to be constructed in the future. K: ITEM NUMBER: 1 DATE: 6-21-12 The proposed elevation revisions are consistent with the 2004 architectural concepts and the constructed theater. Although the buildings would be only one level, they are designed to appear as taller two story structures, similar to the existing theater and adjacent retail previously constructed. Additional parking areas are proposed to be included behind buildings B and C with the proposed redesign. The site maintains the pedestrian character outdoor plazas as originally designed. Background: The Artery in Downtown Atascadero has completed a mural on the south and west sides of its building facing Palma Avenue and the adjacent alley. Consistent with the ITEM NUMBER: 2 DATE: 6-21-12 City Council's Mural Policy Directions, adopted February 23, 2010, murals are regulated under the City's Sign Ordinance but are not subject to any permitting fees. As such, murals exceeding the size limitations of the Sign Ordinance would be subject to an Administrative Use Permit (AUP) approval for the size and location of the mural. The Content of the mural is not subject to the AUP approval process. The Design Review Committee should focus its review of the mural based on the size and location. The DRC should not focus their discussion or decision based on the artistic message of the mural. Existing Signage: The City's Sign Ordinance regulates signage in the Downtown zoning districts as follows: Atascadero Municipal Code 9-15.005(b)(3) Maximum Allowed Sign Area. Each business shall be allowed a total of one (1) square foot of sign area per linear foot of the street frontage occupied by the business, with a minimum total of twenty (20) square feet allowed for each business, and a maximum total sign area of fifty (50) square feet. The Artery has approximately 32 linear feet of street frontage along Traffic Way and 50 linear feet of street frontage along Palma Avenue. Thus the total maximum sign area for The Artery is 50 square feet (sf) for consistency with the City's Municipal Code. The Artery has two existing signs. One painted wall sign facing Traffic Way and projecting non -illuminated sign. The existing signage is consistent with the City's Sign Ordinance. ITEM NUMBER: 2 DATE: 6-21-12 Mural: Over the last few weeks, The Artery has completed an artistic mural on both the west and south sides of the building. The west side mural covers the majority of the 600 sf wall, based on the building's frontage along Palma Avenue and the height of the wall facing Palma, which is approximately 12 -feet in height. The south side of the building that faces the rear Alley also has a mural that has been painted. The estimated size of the mural on the west side of the building is approximately 200 sf. The location of this mural is near the top of the building and thus can be seen from both the alley and surrounding neighborhood. The City permits artistic murals with approval of an Administrative Use Permit (AUP). South Wall- Palma Avenue West Wall- Facing Alley ITEM NUMBER: 2 DATE: 6-21-12 The DRC is considered the hearing body for this application. The City Council has provided policy direction that encourages public art throughout the City with the approval of a no cost AUP. Again, the DRC should focus recommendation for approval of the mural based on size and location of the mural, which faces Palma Avenue. The exact size of the mural is hard to define, however the mural does take up over 75% of the wall facing Palma Avenue while the west side mural takes up the upper portion of the wall that is above 5905 Palma Avenue. Both murals are calculated to be approximately 650 to 700 sf in total size. Neighbor Comments: City staff has received several comments from local residents and business owners regarding the murals. The comments raised concern about the artistic message of the existing mural. Again, the Sign Ordinance regulates size, number, height, location of signs and murals, not the message. An AUP approval cannot be made based on content, consistent with 1St Amendment protections. Conclusion: Staff recommends approval of the artistic mural sign based on Council direction to encourage public art. The mural meets the findings required for approving an AUP including: • Whether the sign is detrimental to the health, safety, or welfare of the general public or persons residing or working in the neighborhood of the use; • The sign is not detrimental or injurious to property or improvements in the vicinity of the use; • The mural is consistent with the surrounding neighborhood; specifically the mural is attached to the Downtown's art supply store. Environmental Review: Class 11 of the California Environmental construction of new on-site signs. Quality Act (Section 15311) exempts the FINDINGS FOR APPROVAL: An Administrative Use Permit shall be approved if the hearing officer makes the following findings in the affirmative: 1. The proposed project is determined to qualify for a Class 11 Categorical Exemption from the California Environmental Quality Act (CEQA), consistent with Section 15311. 2. The proposed project, as conditioned, is consistent with the General Plan. 3. The proposal, as conditioned, will not be detrimental to the health, safety, or welfare of the general public or persons residing or working in the neighborhood of the use, or be detrimental or injurious to property or improvements in the vicinity of the use. I know everyone\'s opinion of \"art\" is different than their neighbors\' but in my opinion that mural is in total violation of the sign ordinances in Atascadero. Almost all of the merchants downtown have been working hard to improve the appearance of our downtown. The RDA money was meant to improve communities and prevent them from looking like ghettos! Well, that mural DOES NOT compliment the \"Historic Colony District\" in any way! It looks like graffiti in Downtown Los Angeles and does nothing to celebrate the history of our town.
