Summary:
The applicant, Michael Hawkins, is proposing to use a pre -manufactured 150 sq. ft. storage shed
in association with the BBQ sales at the Chalk Mountain Liquor and gas station at 9990 EI
Camino Real. The building has been installed at the comer of EI Camino Real and San Gabriel
Road within the existing parking lot. Appearance review and building permits are required in
order to allow a new building on a commercially zoned site.

Background:
The site is developed with an existing gas station and retail convenience store, Chalk
Mountain Liquor. An outdoor barbeque was previously located in front of the store. The
owner recently installed a new 10' x 15' storage shed at the corner of EI Camino and
San Gabriel Road for use in association with the barbeque sales. A correction notice
was issued by the City Building Inspector for construction without permits; the building is
not to be used until a valid building permit is obtained and inspections are completed by
the City and the Health Department. The owner contacted staff about obtaining a
permit, and it was determined that appearance review would be required due to the
location of the storage building on a commercial site.

Appearance Review
Staff is seeking recommendations and guidance regarding the appearance and location
of the storage building on the subject site. Standalone storage buildings are not typically
permitted to be located in a highly visible location on a commercial site. The applicant
has stated that the red barn type building is meant to attract people to the outdoor
barbeque sales. Staff is looking for direction from DRC regarding the storage use of the
building and its location on the corner directly next to EI Camino Real.
There are currently 23 parking spaces on site. The shed and barbeque area take up 3
existing spaces, leaving 20 spaces available, which meet the parking requirement for
the retail sales building. The number of parking spaces taken up by the shed is not an
issue.
However, the appearance of the storage building placed in the parking lot is an issue
which should be reviewed by DRC. Due to its current location within in the striped
asphalt parking lot, the building does not appear connected to the site. Typically, a
commercial building is integrated with the site through the use of landscaping, curbs,
and hardscape. The sales area, barbeque cooking area, walkways, etc. have not been
planned out, thereby creating a temporary and unfinished appearance on the corner of
the site.
Staff believes this is an important consistency issue for the commercial district. If this
metal building is allowed at this site, then every other commercial building on EI Camino

Real would be entitled to the same. Ultimately, metal sheds along EI Camino Real will
not be good for the overall appearance of the business district.
The DRC should also discuss what type if signage, if any should be allowed on this
building. No signage has yet been installed, but it would be good to address the issue at
this time.
Upon DRC review, staff shall work with the applicant to address any issues raised by
DRC, ensure the structure complies with building code requirements, and issue the
appropriate permits. Sign off from the County Health Department shall be required for
any food or supply storage, prep and cooking areas, or food sales within the building.

To Whom it May Concern:
Chalk Mountain Liquor was built in 1986 with the vision of offering delicious food and
providing excellent service in a clean environment. Chalk Mountain is famous for its
fried chicken and barbequed tri -tip. We have recently moved our barbequing location
from beside the building to the front corner of the property, which is along El Camino
Real and San Gabriel Road. We meet all regulations and concerns of the .San Luis
Obispo County Health Department. Our quality and standards have not changed, yet in
today's market we are, like many other businesses in Atascadero, showing a decrease in
sales. One of our solutions to help bolster business was to promote our barbequed tri -tip
sandwiches, ribs, and chicken. To do so, we constructed a portable red lox] 5 foot barn
to help draw attention to our new barbequing location. In doing this, we have doubled
our sales. Numerous compliments have been received from people in the community on
how great the corner looks with the addition of the barn and the barbeque pit. We feel
that it adds character and small-town charm, and serves a great need for our city.
Customers are now able to pull up and be served hot food without having to get out of
their vehicles, a highly desirable convenience for people with children, those in a hurry,
and those who prefer not to hassle with getting in and out of their vehicles. We believe
that this barn is a wonderful addition to the property, attracting customers with its
convenience and charm, and we are certain that upon your viewing of it, you will agree.

The applicant, Morgan Burkey, is proposing a commercial, outdoor bird breeding
business at 8650 Morro Road. The proposal includes breeding on-site up to 26 pairs (52
birds total) of parrots and other exotic birds. The bird enclosures will be located
outdoors in the rear of the property shielded from public view by the existing trees and
shrubs.

Background:
Consistent with San Luis Obispo County Animal Services' Hobby breeder requirements,
the City permits hobby breeding of 20 birds or less with a Home Occupation permit. The
City considered breeding of more than 20 birds operation an "animal husbandry" facility.
The Atascadero Zoning Ordinance allows for animal hospital and animal husbandry
facilities with a Conditional Use Permit (CUP) in a commercial retail zone (CR). San
Luis Obispo County Animal Services has a similar requirement for breeders whom sell
20 or more birds to obtain a commercial breeding permit. The Commercial Breeding
License license contains rules and regulation for the commercial breeding of
domesticated animals, including birds. Consistent with Atascadero Municipal Code
(AMC) Section 9-6.110
The applicant has been operating a commercial breeding operation at this location prior
to her CUP application. The applicant has been working with the County to come into
compliance with Animal Service's commercial breeding regulations. The County is
requiring the applicant obtain a City Business License and other needed permits prior to
the County issuing a Commercial Breeder's license.
The applicant met with City Staff on April 4, 2011 to discuss the requirements needed
for a breeding operation at the applicant's residence. City Staff provided a letter to the
applicant stating the requirements for a CUP including a site plan, location of where the
birds would be kept, the number of birds proposed and other additional information.
The applicant formally submitted a CUP application on November 1, 2011. The City's
Municipal Code requires an appearance review for all conditional use permits.
Site Plan / Appearance Review
The applicant is proposing various locations for the bird enclosures. The enclosures
vary in size ranging from 15 square feet (sf) to 64 sf. Each enclosure houses a pair of
birds. The majority of the enclosures are located near the rear of the lot as well as in the
middle of the lot. These enclosures would not be visible from the public right-of-way.
During a site visit staff took photographs of some of the enclosures. While most
enclosures were covered, other enclosures appeared exposed. In addition some of the
enclosures were covered with tarps to provide additional shelter for the animals. Staff
compared the site plan that was submitted by the applicant to what was located on the
property. The applicant had additional enclosures located on-site when compared to the
submitted site plan.
The proposed location of the enclosures do not meet the required setbacks for animal
husbandry facilities, which is 25 -feet from the side/rear property lines, consistent with
Atascadero Municipal Code (AMC) section 9-6.110.2(b). Staff will be requiring that the
minimum setbacks for the enclosures be followed.
Staff also encountered various violations of the City's Municipal Code during the site
visit include violation of the City's Scrap and Junk regulations (AMC 9-6.103),

unpermitted structures, and electrical hook-ups that were utilized that is not consistent
with the California Building Code.

At this time, it is unknown whether any retail sales are proposed on-site. Currently there
is an existing residential home as well as a converted building that functions as a
locksmith. The applicant needs to clarify if retail sales will occur on the premise. If on-
site retail will occur, staff is recommending use of the locksmith building for retail
transactions.
Staff Recommendations
Staff is seeking direction of the scope of CUP requirements. The following are items
staff is recommending to be addressed by the applicant prior to a Planning Commission
meeting. The DRC should provide additional input or modifications to ensure that the
proposed breeding operation is compatible with surrounding properties.
1. Staff is requesting a written description of the following operational elements:
• The maximum number of birds to be bred on-site
• Number of employees;
• Hours of operation;
• Proposed location of retail sales;
• Disposal of animal waste;
• Disposal of dead birds.

2. Provide staff with scaled site plan showing the location of all proposed
enclosures, building setbacks, animal waste storage and surface material under
cages.
3. Staff is requesting a proposed animal waste collection area for sanitary
purposes, consistent with the County's Commercial Breeding Guidelines.
4. For consistency with the County's Commercial Breeding guidelines, staff is
recommending co -location of bird enclosures under multiple shade/weather
structures that are constructed with wood framing/footings and a roof or other
similar type of structures. These structures may range from 120 to 400 sf in size
and should show proper electrical hook-ups per the building code when
necessary.
5. Staff is recommending that compacted earth, decomposed granite, concrete, turf,
or other similar surface be laid in the area of the proposed bird enclosures for
water quality purposes. Drainage from the cage area must be maintained and not
directed to Atascadero Creek.
6. The property shall be continuously maintained in a clean and sanitary condition
by daily removal of waste and by the use of spray and disinfectants to prevent
the accumulation of flies, the spread of disease or offensive odor. This includes
the cleanup of leaves, debris, trash, junk, on the property.

What Is the South EI Camino Real Corridor Visioning Study?
In an effort to comply with SB 375 (Regional Greenhouse Gas Reduction), the City of
Atascadero and the San Luis Obispo Council of Governments (SLOCOG) are proposing
to work with residents, property owners, and business owners to create a new "vision"
for future development along EI Camino Real, south of Highway 41.
Through this visioning effort, SLOCOG and the City of Atascadero hope to transform
this area of the City into a vibrant district that provides integration of housing,
commerce, jobs, and transportation. It is envisioned that this pilot project will be the
basis for future integration of uses throughout the County.
What is SB 375?
SB 375 sets regional targets for reducing greenhouse gas emissions. SB 375 builds on
the existing framework of rules to tie together the regional allocation of housing needs
(RHNA) and regional transportation plan in an effort to reduce greenhouse gas (GHG)
emissions from vehicle trips.
As a part of implementing SB 375, SLOCOG has created a "Sustainable Communities
Strategy" (SCS) that demonstrates how the County will meet the greenhouse gas
emission targets. In addition, SB 375 creates California Environmental Quality Act
(CEQA) streamlining incentives for projects that are consistent with the County's
Sustainable Communities Strategy to fast track future development. The South EI
Camino Real Corridor Visioning will be implementing SLCOG's SCS to reduce
greenhouse gas emissions through land use decisions and transportation options.

What Are We Trying to Accomplish with this Study?
Key Goals that City Staff and SLOCOG Staff are looking for include the following:
• Creating a "complete" street for EI Camino Real that includes integration of
bicycles, transit and automobiles
• Review non-residential land uses to ensure maximum flexibility for integration
with residential uses and economic viability
• Review vacant properties to ensure they are the highest and best uses
• Analyze and review key intersections or properties that act as "nodes" to the
study area
• Review and pinpoint grant funding for potential streetscape improvements and
implementing the vision plan
How Will the City and SLOCOG Craft this Plan?
Establishing a South EI Camino Real Corridor Visioning Plan is the first step in creating
a framework for development of the area. This future plan will build on the City's existing
General Plan. The City and SLOCOG will be soliciting public input in order to ensure
that plan is consistent with the direction that residents and stakeholders envision. Public
Participation will include focus group meetings with business owners, affordable
housing groups, as well as public workshops for residents. In addition to the public
workshops and focus group meetings, the City's Design Review Committee, consisting
of members of the City Council and Planning Commission, will also weigh in the give
Staff direction and guidance throughout this effort.
What are the Next Steps?
While this is an ambitious vision plan, the City will work with SLOCOG to craft a scope
of work that outlines how City Staff, SLOCOG and potential consultants will go about to
ensure that a vision is established an embraced by property owners, businesses and
key stakeholders. In addition, the City and Regional Planning Department at Cal Poly
San Luis Obispo has expressed interest in assisting the City in this visioning project with
both their undergrad and graduate studio courses.
