A preliminary review prior to submittal of a building application for proposed
improvements that include a new drive-through canopy to protect cars and workers
from weather, new exterior cladding and paint, and new and replacement paving
striping.
Alfredo Castillo, Assistant Planner, gave the staff report and answered questions from the
Committee.

Background:
The Dove Creek Planned Development was approved in 2004 with 279 residential units
on individual lots, 37.2 acres of open space, and 60,000 sq. ft. of commercial space at
the corner of Santa Barbara Road and EI Camino Real.

Due to the location along Highway 101 and the proximity of the dwelling units to the
freeway, the Dove Creek Master Plan included a Condition of Approval which requires
the developer to install a landscape buffer between the project site and Highway 101.
CUP Condition 31: "The applicant shall be responsible for the installation
and maintenance of screen landscaping along the highway 101 frontage
and within the Cal Trans right-of-way as shown in EXHIBIT C. subject to
staff and agency approval"
The approved landscape exhibit identified a landscape buffer made up of large
evergreen trees, dense screening trees, an understory of large shrubs, and mixed in low
shrubs and ground cover. Landscape was identified on both the subject site and within
the Caltrans right-of-way.

Landscape plans were completed and approved by Caltrans in 2006 for landscape
installation along the Highway 101 frontage between Santa Barbara Road and San
Diego Way, however, the landscape has not yet been installed. The landscape would
be installed by the developer (Robbins Reed/Corona Dove Creek LLC.) and a
maintenance bond would be held until the HOA accepts the landscape for permanent
maintenance.
The approved 2006 Caltrans plan includes:

The project developer, Robbins Reed Inc, has submitted a letter requesting relief from the
condition for Caltrans landscaping. See attachment #1. Removal of this Condition of
Approval would require a CUP Amendment to be approved by Planning Commission.
Robbins Reed, Inc. has identified several issues with the landscape, including:
• Installation cost to the developer
• Maintenance costs to the HOA
• Caltrans prefers not to have new landscape installed in their right-of-way
In order to reduce installation and maintenance costs, Staff recommends that the
DRC consider reducing the amount of landscape within the Caltrans right-of-way,
however, staff believes the landscape should not be eliminated completely.
Highway 101 landscape is a vital part of community appearance and has been identified
as a priory feature that the City should be focusing on in order to help with Economic
Development. The Dove Creek frontage acts as a community gateway feature along
Highway 101 and is a key site for implementing the long term vision for enhanced
community appearance along the Highway 101 corridor.
If the Dove Creek developer is released from the landscape requirements of the CUP,
the landscape would need to be installed with a City initiated Highway 101
enhancement project, thereby transferring the cost of this landscape buffering on to the
City. Waiving this condition for Dove Creek would also create a precedent for not
requiring 101 landscaping, making it difficult to require other project along the highway
to enhance their project frontages. In addition to the community appearance and
residential buffering issues, the native tree replanting is important in order to mitigate
the project development impacts, including removal of several mature coast live oaks
and the re -contouring of existing knolls along the highway.
Staff supports a reduction of Highway 101 landscaping, which would include the
installation of the 56 live oak trees and 25% of the required shrubs (approx. 200 5 -
gallon native shrubs). The oak trees will provide height and visual buffer for the Dove
Creel residences, and have the most visual impact from the highway. As seen with the
City's native tree replanting sites, it is important to plant a mixture of native shrubs along
with the new oak trees in order to create a complete ecosystem for the new oaks to
grow. This staff recommended reduced landscape would be less expensive for the
developer to install, and inexpensive for the HOA to maintain in the future. Once
established, the oaks and the few clusters of native shrubs would require no water and
very minimal maintenance. Reducing the landscape in this manner would not require a
CUP amendment as the tree planting could be found to be in substantial conformance
with the Condition of Approval.

Dear Callie,
The Dove Creek Development currently has a condition imposed upon it that requires the
developer to landscape the Cal Trans property along Hwy 101 between Santa Barbara
Road and San Diego Way. This requirement was placed on the project many years ago
and since then many changes have occurred in the development environment.
This condition is now placing an unnessary burden on the project that could impact the
successful completion of the Dove Creek neighborhood. As such, we are formally
requesting removal of the condition to landscape the Cal Trans Right -0f -Way. In order to
assist with your evaluation of this requet I have provided a list of specific reasons as to
why this condition is burdensome to the project.
1. I have talked with Cal Trans at length and while they are not required to maintain the
landscaping in this area they do not want landscaping in this easement. They are willing
to comply with the condition as imposed by the City however they do not see a benefit in
completing this work.
2. Additionally, one of Cal Trans largest concerns is erosion control. Cal Trans works to get
stabilized slopes along freeway frontage that works well in a natural/native condition.
They expressed that this area is currently well stabilized and with creeks on both ends of
the frontage and a downstream wetland they are concerned about the impacts unnessary
new planting could have on erosion. We understand that re-establishment of stabilization
is a requirement of the landscaping in this area however in order to make new planting
become well established so as to provide the same Control as native vegetation is a
challenge that usually requires several years. Cal Trans' stance is that it should be left
"as is" since it works well and does not cause any traffic hazards due to runoff, nor does
it discharge silt or sediments into the creeks.
3. The maintenance of the Right -of -Way (ROW) is conditioned to be funded by the existing
Home Owners Association (li at Dove Creek. There is a large safety concern to have
private maintenance crews working along the Highway without the support of any Cal
Trans traffic control measures.
4. Since the maintenance of the ROW falls into the HOA responsibility it creates a large
financial burden for the existing and future homeowners in the neighborhood. This

maintenance is a largecost (more than typical maintenance due to the hazardous
conditions and insurance requirements of Cal Trans to work within their easements). The
cost for this maintenance would impact the monthly HOA payment for every existing and
new homeowner. In an environment when the current HOA budgets are underfunded and
have almost 10% delinquency rates (the amount of homeowners who are behind in paying
their dues) this added cost could threaten the overall success of the neighborhood. The
HOA's (there are 2) for Dove Creek already have to impose special assessments and
increase dues simply to stay ahead of current costs and create the proper reserve account
balances for the future. By adding added costs to maintain an area that does not directly
impact the beauty, usefulness, and overall neighborhood would not be viewed as a benefit
to the homeowners and as such funding ROW maintenance would most likely not get the
proper attention. This could lead to poorly maintained landscaping which in effect can be
less appealing than the existing navite grasses that match all the other Highway slopes
throuebt the City.
5. As we are starting to build the remaining homes in Dove Creek we are working with future
homeowners to get financing for their new home however in the current economic
environment — for lenders and borrowers — added costs associated with HOA dues can play
a large part in somoene's ability to get funding. Since the cost of monthly HOA dues are
part of the analysis in determining an affordable mortgage payment a large HOA payment
could potentially lead to funding not being approved. With this being such a large factor
it could impact the overall success of completing the homes in Dove Creek — it buyers
cannot afford payments then we cannot continue to build homes.

Reconsideration for Proposed New Building in Commercial Service
Zone
CUP 2005-0161, 8900 EI Camino Real
The applicant/owner is requesting an amendment to reinstate approval of an expired
condition to permit construction of Phase II storage building. The new building would
include 1,000 sf expansion of an existing automotive repair shop and 2,920 sf of
additional indoor storage. The building would be 20 feet in height and be located at the
rear of the property. The improvements would include the creation of additional parking
for expanded business operations.

Amendment to Reinstate Expired Condition — CUP 2005-0161:
On October 18, 2005, the Planning Commission approved CUP 2005-0161 allowing for
a phased plan to build two 4,000 metal storage buildings on the project site. Phase II of
the project was required to be constructed within 5 -years of project approval. Otherwise
approval of Phase II would expire and become null and void, requiring a Conditional
Use Permit amendment to reinstate. Currently one building containing 1,000 SF of
storage space and a 3,000 SF for a transmission shop has been built. The applicant is
now requesting an amendment to reinstate approval for the second building, which
would include an additional 1,000 SF for the transmission shop and 2,920 SF of
additional storage space. The proposed building would be located at the rear of the
property, be 20 feet in height, and meet all required setbacks. The updated site plan
would include 19 parking spaces.
The Atascadero Municipal Code (AMC) identifies auto repair and services as a
permitted use and warehousing as a conditional use in the Commercial Service zoning
district. Buildings constructed within this district do not require front, rear, or side
setbacks unless they include ground floor residential uses, are adjacent to residential
zones or uses, are adjacent to an alley. However, buildings are required to have a
minimum interior setback of 6 feet from other buildings.

Site Plan and Landscaping:
The proposed structure would be located at the rear of the site. New parking would be
located adjacent to the proposed new building, consistent with the approved CUP.
Existing landscaping is located along EI Camino Real consistent with the approved
CUP. With the additional parking, AMC 9-4.119 requires a six (6) foot landscape finger
be provided for every eight parking spaces. Staff is recommending that this finger be
provided to provide shade and reduce the heat island effect.

Proposed Color Scheme:
The applicant is proposing the building retain the previously approved color scheme.
This color scheme proposed a grey roof/building color to blend in with the existing metal
sheeting.
Staff recommends that the color of the new building be changed from the currently
proposed gray color used to an earth tone color that matches the existing building that
faces EI Camino Real. This recommended color change would reduce the industrial
appearance of the proposed building and alleviate visual monotony at the site as a
whole.

The applicant, Greg Jespersen, is proposing an automotive repair and tire shop at 9005 EI
Camino Real. The proposal includes converting a vacant welding shop into a 1,755 square foot
tire repair area, 2,400 square foot auto repair area, and an outdoor used tire and accessory
vehicle storage area.

Background:
The Atascadero Zoning Ordinance allows for auto repair and services in the commercial
retail zoning district through approval of a Conditional Use Permit (CUP).
The applicant had met with City Staff on August 10, 2011 to discuss the requirements of
a conditional use permit. Staff provided a letter to the applicant discussing the
necessary fees to complete the conditional use permit, as well as notify the applicant of
municipal code violations that were witnessed during site visits after the meeting. Staff
informed the applicant of violations that included major tenant improvements without a
building permit, improper storage of materials on-site and operating the automotive
repair business without a use permit or business license.
The applicant formally submitted a CUP application on October 27, 2011. The City's
municipal code requires an appearance review for all conditional use permits.
Site Plan
The applicant is proposing to convert the previous welding operation into a tire repair
and auto repair shop. The applicant has proposed that the tire repair portion of the
business be located near the main entry along EI Camino Real. The auto repair portion
will be located at the rear of the building with the repair bay entry located off of La Linia
Avenue.
The site plan also shows two (2) proposed tire storage areas. The storage areas will be
fenced off with a chain link fence, however these tire storage areas are not covered at
this time. A new trash enclosure is proposed near the existing metal storage building,
however the applicant has not provide any details on how the trash enclosure will look.
The applicant has proposed vehicle storage on the remainder of the site. The applicant
proposes to maintain the dirt/existing decomposed granite lot for the vehicle storage.
The applicant has not proposed any changes to the exterior of the building, nor provided
any landscaping plans showing areas of landscaping and plantings. The application did
not indicate what will be stored in the existing metal storage building.

The Committee recommends approval of the schematic design of "Centennial Plaza"
and Atascadero Creek trail to the City Council.
DISCUSSION:
Background:
The DRC reviewed the Centennial Plaza project on September 15, 2011. At the
meeting the Committee provided the following direction:
1. Move the pathway closer to Atascadero Creek.
2. Relocate the sculpture outside of the plaza.
3. Provide a sign for the plaza.
4. Incorporate memorial bricks into the plaza.
5. Consider a time capsule in the plaza.
6. Incorporate additional historic features around the plaza.
7. Include Wayfinding signs.
8. Provide plenty of lighting and electrical hook-up capacity.
Staff has worked with the project architect, Thom Jess of Arris Studio Architects to
incorporate these changes into the project (refer to color attachment for a full set of
plans).

Previous Staff Report
The 2005 Downtown Revitalization Plan (following page) envisioned an Atascadero
Creek pedestrian bridge and creekside trail that would connect Downtown to Colony
Square. With the completion of the Galaxy Theatre at Colony Square, the pedestrian
bridge has become the number one priority for the Redevelopment Agency. Staff is
currently working on the environmental review and engineering for the pedestrian
bridge, which is scheduled to be installed next summer, 2012.
One of the primary purposes of the pedestrian bridge is to connect the Sunken Gardens
to Colony Square. This will improve pedestrian circulation throughout the Downtown,
which will benefit businesses and make more public parking available for Colony
Square. In order to make this connection to the Sunken Gardens and East Mall, the
City is acquiring a lot along East Mall. The 2,500 square foot lot is owned by the Olsen

Summary:
In order to fully realize the potential of the pedestrian bridge project, staff has prepared
a conceptual Master Plan of the Downtown Atascadero Creek block. The plan
envisions a number of possible improvements that would enhance pedestrian circulation
and access to the creek as well as creating a new public gathering place tentatively
called "Centennial Plaza." The project would provide the following features and public
benefits:
• Pedestrian connection to Colony Square
• Improved Downtown parking
• Downtown restroom for Sunken Garden / Transit Center
• Creekside trail
• Creek restoration and improved public access with interpretive signage
• Improved visibility and police monitoring of Creek
• ADA parking for City Hall and Colony House
• Relocation of Colony houses from Walmart project area (EIR mitigation requirement)
• Public enhancement project for Atascadero's Centennial celebration in 2013.
• Enhanced location for Tent City / Colony Days
• Public Art -
