AMENDMENT
An application to amend the Master Plan of Development and project conditions of CUP
2005-0175. The current owner is proposing to remove the requirements for additional
landscape, construction of an access road, and other conditions which are currently
required to be completed prior to Final Map recordation and conversion of the two
existing golf course structures to residential units. DRC to review proposed CUP
changes and make a recommendation to the Planning Commission.

DEVELOPMENT PROJECT REVIEW
2. FOUNDERS BANK, 6100 EL CAMINO REAL
Appearance review for first floor in the Downtown Commercial zone. Tenant
improvement permit submitted for new Founders Bank lending office. DRC to
review proposed use, exterior color scheme, new signage, and revisions to the parking
and landscape layout.
Bill Eisner, Project Architect, gave an overview of the small loan office project and answered
questions from the Committee.
The following changes have been approved with the bank:
- Additional parking planters
- A window sign
Roberta Fonzi discussed the CUP process for the bank.
Christian Cooper discussed parking with Jack-in-the-Box.
Roberta Fonzi talked about future reciprocal parking and adding something to south side facing
parking.
Christian Cooper discussed painting side with band facing Gaughan (North)
Chuck Ward stated it was a very important downtown site and wanted to maintain flexibility for
future reuse, but this would be a good interim use. Committee member Fonzi agreed.
The committee agreed to paint and add banding on the north side of the building.

exterior color scheme, new signage, and revisions to the
parking and landscape layout, as submitted by the applicant,
with a condition to add paint and banding on the north side of
the building.

3. SANTA YSABEL PD -7 DRIVEWAY DESIGN
The subject site is a 4 unit Planned Development approved in 2005 as a PD -7 with a
Master Plan of Development. The project is required to use pavers or decorative
concrete on the shared and individual driveways. The applicant is proposing to use
asphalt on the shared driveway and stained concrete on the four individual driveways
in front of the garages.
The applicant was not present for the meeting.
Director Frace and Associate Planner Taylor gave the staff report and stated that the project will
before the Planning Commission for final decision and the DRC will be the sounding board.
They discussed the following:
• History of PD requirement
• The PD condition requirement.
Chuck Ward discussed the drainage system and stated that pavers look good but are expensive.
Roberta Fonzi discussed affordable conditions
Christian Cooper stated that pavers look nicer, but also said that stained concrete looks good.
Roberta Fonzi stated that stained concrete needs maintenance and that brick walkways would be
nice.

with plain concrete with decorative banding instead of pavers.

1. ATASCADERO CREEK PEDESTRIAN BRIDGE & "CENTENNIAL PLAZA"
PROJECT CONCEPT
DRC review of Master Plan concept for "Centennial Plaza." Project is located in
Downtown between the Sunken Gardens and Atascadero Creek, providing a
connection to Colony Square. Includes pedestrian bridge design and location, plaza
connection to the Sunken Gardens, creek trails, and future phasing for downtown
parking and restroom.
PUBLIC COMMENT
Jim Wilkins suggested DRC see the Plaza pattern behind the Colony House Plaza and — historic
name bricks.
Roberta Fonzi would like to focus on 2012 phases.
Jim Wilkins — what is bridge surface.
Susan DeCarli — Branding is important and we should follow the Wayfinding Program.

DEVELOPMENT PROJECT REVIEW
1. OAK GROVE II AMENDMENT
DRC review of applicant's request to remove upgraded architectural features on the
side elevation of Lot 1, facing El Camino Real.
PUBLIC COMMENT
Sheryl Flores with Peoples' Self Help Housing was present for the meeting and stated that she
would like to remove the trim that is behind the fence. The extra trim is $1400 (rock plus
construction) for a total of $5,000. Limited visibility from El Camino Real and lots of
vegetation.
Bob Kelley asked about trim on other units.
Susan DeCarli asked: Was Peoples' Self Help Housing aware of the requirement and Planning
Commission process extended fence creates barrier to El Camino Real compromise? Suggested
possibility of smaller gable without columns.
Sheryl Flores stated fence location not clear on plans.
Bob Kelley stated the project must look good and not have a low income appearance; needs to
maintain street appeal.
Chairperson Fonzi closed the Public Comment period.

Background:
In 1991, the Eagle Creek Golf Course and residential subdivision was approved as a
Planned Development #8. The property was rezoned from Commercial Tourist to
Special Recreation and Single -Family with the PD -8 Overlay District. The rezoning and
PD -8 allowed for the construction of the golf course, driving range, and 13 single-family
units.
In 1998, the PD -8 was amended to allow the golf course and driving range to take
access off of Atascadero Road rather than Santa Barbara Road as originally required.
In 2000, the owner applied for a Zone Change and PD Master Plan Amendment to
remove the outdoor driving range and add four additional single-family units. The
request was approved in 2001.
By 2005 the Eagle Creek Golf Course was closed to the public and watering and
maintenance of the course ceased. The owner, Kelly Gearhart, proposed to amend the
PD and CUP to convert the 10 acre Special Recreation parcel to new uses. During the
processing of the amendment application in 2006 and 2007, there was significant

neighborhood discussion about the poor condition of the abandoned golf course and
what uses would be compatible with the neighborhood. The City Council held two
separate study sessions to review proposed changes to the Eagle Creek Golf Course.
Ultimately, Mr. Gearhart submitted an application to convert the existing golf course
buildings into two single-family residential dwellings on individual lots, and restore the
golf course back to a native landscape. This concept was supported by the surrounding
neighbors and the City Council. The application, which was approved by City Council in
November of 2007, consisted of:
• General Plan Amendment to convert 10.0 acres from CREC (Commercial
Recreation) to RSF-Y (Residential Single -Family 1.0 acre min)
• Zone Change of 10.0 acres from LS (Special Recreation) to SFR -Y (Single -
Family Residential 1.0 acre min)
• Amendment to the Planned Development -8 zoning text to identify an exclusively
residential project
• Amendment of the Master Plan of Development (Conditional Use Permit) to
replace existing golf course with two single-family residences
• Vesting Tentative Parcel Map to subdivide 10.0 acres into two lots (1.0 acres and
8.9 acres each)

Landscape Restoration & Removal of Golf Course Improvements
With the 2007 project amendment, the previous owner (Kelly Gearhart) proposed a site
plan and landscape plan which was approved by the City Council and was conditioned
to be implemented prior to final map. Upon completion of the site restoration, the final
map could be recorded to create two individual lots and building permits could be issued
to convert the existing golf course buildings to two single-family residences. The larger
lot would be solely responsible for the ongoing maintenance of the restored open space
on the 8.9 acre lot.

The site plan, landscape restoration plan, and project conditions of the 2007 approval
include the following required improvements:
■ Golf course fairways to be converted back to a natural landscape with the
planting of native trees, shrubs and grasses (see landscape plan). Dead trees
and non -natives to be removed. This restoration planting was intended to create
an attractive visual landscape along US 101 and create a beneficial natural
habitat along Paloma Creek.
■ Installation of a gated gravel driveway to take access from Santa Barbara Road.
Driveway is to provide access to the rear of the existing lots for maintenance
■ The existing golf course to be recontoured to improve drainage
■ Biological mitigation identified in Althouse and Meade report to be implemented,
including obtaining permits through Department of Fish & Game for previously
installed culvers and outfalls.
■ Open space easement placed over the golf course area to ensure remains open
and landscaped in perpetuity. Landscape to be maintained by the owner of Lot
1. Deed restriction would prohibit the construction of new structures, parking of
vehicles, storage of equipment, or the permanent keeping of livestock
■ The existing parking lot and support facilities surrounding the clubhouse on lots 1
& 2 to be removed.
■ All asphalt and concrete driveways and parking areas, utilities, transformers, and
putting greens associated with the golf course and located on APN 045-391-014,
013, and 012 to be removed.
■ Sheds on Lot 1 towards the front of the lot to be removed (currently cross
property line between Lot 1 & 045-391-014).
■ 60± foot dedication at the northeastern corner of the golf course area to
accommodate future roundabout at Santa Barbara interchange.

Council policy requires Planned Development (PD) projects to provide a number of
public benefits in exchange for the Planned Development. During the 2006 and 2007
Council Study sessions, it was determined that the open space restoration element of
the project would be considered the public benefit of the project similar to the PD
benefits of a PD -16.
Change in Ownership
The current property owner, Kevin McGurty, was transferred ownership of the property
through foreclosure in 2008. Improvement plans and building permits for the conversion
of the golf course structures to residential units and almost complete, however, the final
map has not been recorded. The 2007 conditions require that the golf course
restoration be completed or bonded for prior to recordation of final map. Due to the
market conditions and cost of the improvements, Mr. McGurty has not yet moved
forward with any of the restoration work or completion of the final map.
2011 Proposed Amendment:
The current owner (Kevin McGurty) has requested to remove and/or defer the site
improvements which were proposed by the previous owner (Gearhart) and were
conditioned to be completed prior to final map recording. Mr. McGurty has stated the
improvements proposed by the previous owner are not feasible due to the cost and
timing required prior to final map (see applicant letter, Attachment 2). Mr. McGurty has
had discussions with the neighbors, and most are in support of seeing the project move
forward and the vacant buildings be converted to single-family residences as soon as
possible.
Amendments to the Master Plan of Development (CUP) and Tentative Parcel Map
(TPM) are required in order to change the project conditions and exhibits consistent with
the current owner's proposal. The proposal is being presented to the Design Review
Committee for feedback, and will then go to the Planning Commission for consideration.

A revised Mitigated Negative Declaration will be processed prior to Planning
Commission hearing.
The current owner is proposing to start by obtaining building permits to convert the
storage building on Lot 2 (1.0 acre lot) to a residence. While construction is underway,
he would process the final map for recording so that the lots could be sold
independently. By selling Lot 2 as a completed residence, he intends to generate
necessary funds to complete the conversion and improvements on Lot 1 (the 8.9
existing golf course). No work would be performed on the larger (Lot 1) or club house
buildings until the front unit is completed, the lot split if finalized, and Lot 2 is sold.
The applicant proposes the following phases:
Final map: create 2 lots which can be sold independently
■ Grant access easement to properties on Eagle Creek Ct. for landscape and
septic maintenance (in -lieu of constructing access road)
■ Grant dedication for round about at freeway
■ Open space easement on Lot 1
Phase 1 construction, site improvements proposed:
■ Conversion of front building (storage building) to SFR
■ Remove all dead or dying trees
■ Remove improvements on adjacent lots 12 & 13 (Eagle Creek Ct)
■ Install landscape in front yard of Lot 2
Conversion of club house to SFR
■ Request flexibility to convert to either one main house, or one main house
and one second unit. Modifications to floor plans and elevations
■ Request to waive installation of garage depending on new owner and budget

We were forced to become owners of the Project through foreclosure in 2008. Based on
a deteriorating real estate market, inflexible development restrictions and exorbitant costs
associated with compliance with the existing conditions of approval, we were left vAth no
alternative but to let the Property sit in the hopes the market would improve.
Unfortunately, the market is getting worse, the structures are deteriorating and the overall
condition and abandonment status has began to generate complaints and affect
neighborhood values. Moreover, neighbors have reported vandalism and increasing signs
of vagrancy. an the positive side, mother nature has capably reclaimed the abandoned
golf course which has now become a natural open space asset and wildlife habitat which
the adjoining landowners now enjoy and wish to preserve.
Trapped by an impossible predicament, we contacted everyone in the neighborhood to
offer suggested remedies and obtain input to address the realities. Based on those
numerous meetings and discussions we are hereby submitting a plan for reconsideration
which amends the conditions of approval to reflect current economic realities and the
general consensus of the neighbors. That consensus can also be gleaned from the
numerous letters previously submitted in support of this submittal.
It is our intent to honor the neighbors wishes to preserve the "open space" in its current
natural condition with an overlay easement. The only exceptions would be to cut down
all dead or dieing trees and granting an access easement to adjoining landowners on the
western property line to temporarily access their properties for septic maintenance and
repairs. In order to accomplish this, all previous conditions pertaining to fencing.
grading, access roads and uses would be eliminated.
It is also our intent to start by finishing the storage building fronting Ataseadero road.
This will hopefully generate necessary funds to improve the remaining structures.
Accordingly, we have requested that the project be phased to accomplish the lot split and
allow for the sale and/or the issuing of a certificate of occupancy before the back parcel
may be improved. With the exception of removal of all improvements on Lots 12 & 13
to be accomplished in the first phase of work, we have also requested that staff be given
flexibility and latitude to work with us to finish and develop the remaining structures and
unprovements- -- -

2. The Community Development Department shall have the authority to

site plan project by less than 10%, (2) result in a superior site design or
appearance, and/or (3) address a construction design issue that is not
substantive to the Master Plan of Development.

mph on any unpaved surface at the construction site.
9. All trucks hauling dirt, sand, soil, or other loose materials are to
be covered or should maintain at least two feet of freeboard
(minimum vertical distance between top of load and top of
trailer) in accordance with CVC Section 23114.
10. Install wheel washers where vehicles enter and exit unpaved
roads onto streets, or wash off trucks and equipment leaving
the site.
11. Sweep streets at the end of each day if visible soil material is
carried onto adjacent paved roads. Water sweepers with
reclaimed water should be used where feasible.
12. The contractor or builder shall designate a person or persons
to monitor the dust control program and to order increased
watering, as necessary, to prevent transport of dust off site.
The name and telephone number of such persons shall be
provided to the APCD prior to land use clearance for map
