AGENGY OF ATASCADERO� ADOPTING AN ENFORCEABLE
OBLIGATION PAYMENT SCHEDULE
PURSUANT TO ABXI 26
The Atascadero Community Redevelopment Agency resolves as follows:
SECTION 1: The Atascadero Community Redevelopment Agency finds and declares
as follows:
A. Pursuant to the Community Redevelopment Law (Health and Safety Code
Sections 33000 et seq.), the City Council of the City of Atascadero (City) created the Atascadero
Community Redevelopment Agency (Agency); and
B. As part of the 2011-2012 State budget bill, the California State Legislature
recently enacted, and the Governor signed, companion bills ABXI 26 and ABXI 27, which
eliminate every redevelopment agency unless the community that created it adopts an ordinance
(Continuation Ordinance) agreeing to participate in a Alternative Voluntary Redevelopment
Program which requires the payment of an annual "community remittance" payment, and,
C. ABX 1 26 also requires redevelopment agencies to adopt, by August 27, 2011, an
Enforceable Obligation Payment Schedule (EOPS) whichwill. serve as the basis for the payment
of the Agency's outstanding financial obligations if the City does not adopt an ordinance electing
to participate in. the Alternative Voluntary Redevelopment Program and the Agency is dissolved;
and,
D. The City held a first reading of the Continuation Ordinance on August 9, 2011,
and a second reading is scheduled for September 13, 2011 and the City adopted an Urgency
Continuation Ordinance on August 9, 2011; and,
E. The California League of Cities and the California Redevelopment Association
filed a lawsuit in the Supreme Court of the State of California ("Lawsuit") challenging the
constitutionality of ABXI 26 and ABXI 27; and,
F, On August 1. 1, 2011, the Supreme Court agreed to consider the Lawsuit and
issued an immediate stay of ABXI 27 in its entirety and a partial stay of ABXI 26; and,
G. On August 17, 2011, the Supreme Court issued a modification of the stay in the
Lawsuit; and,
H. Adoption of the FOPS is important as the Agency may be limited to only making
payments for debts and obligations listed on the FOPS during the time the stay is in place.

L This Resolution is proposed for adoption in order to allow the Agency to continue
to make payments for the obligations identified in the EOPS.
SECTION 2. Recitals. The Recitals set forth above are true and correct and
incorporated herein by reference.W
SECTION 3® AURK21AL2L_LQkS. The Agency hereby adopts the EOPS in the
Schedule attached hereto as Exhibit A.
SECTION 4® s. The Executive
Director is hereby authorized and directed to post a copy of the EOPS on the City's website, The
Executive Director is further authorized and directed to transmit, by mail or electronic means,, to
the San Luis Obispo County Auditor -Controller, the State Controller and the Department of
Finance, notification providing the website location of the posted EOPS and other information as
required by ABI 26,
SECTION 5: The Secretary shall certify to the adoption of this Resolution,
PASSED AND ADOPTED August 25, 2011.
