IMPROVEMENT DISTRICT NO. 5
(CHANDLER RANCH AREA ASSESSMENT DISTRICT
RESOLUTION N0. 83 -88
RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS
PURSUANT TO THE MUNICIPAL IMPROVEMENT ACT OF
1913 AND ISSUE BONDS IN SAID PROCEEDINGS UNDER
THE PROVISIONS OF THE I1R0VEMENT BOND ACT OF
1915 AND ACCEPTING PETITION AND MAKING
PRELIMINARY FINDINGS THEREON
WHEREAS, the City Council (the "Council" ) of the
City of Atascadero (the "City" ) is considering the formation
of an assessment district pursuant to the Municipal
Improvement Act of 1913, being Division 12 (commencing with
Section 10000) of the California Streets and Highways Code,
for the construction of certain public works and improvements
more particularly described in Exhibit A attached hereto and
incorporated herein and made a part hereof; and
WHEREAS, the lands to be specially assessed for said
public improvements lie within the area commonly known as the
"Chandler Ranch Area" ; and
WHEREAS, the City Council of the City has been
presented an executed Petition and Waiver (the "Petition" ) by
certain property owners requesting the construction of said
public improvements; and
WHEREAS, it has been reported that the Petition
contains the signatures of more than sixty percent ( 60%) of
the owners of the assessable area of land to be subject to
assessment for the proposed pub Ui improvements and that the
Petition otherwise meets the requirements of Section 2804 of
Division 4 of the California Streets and Highways Code;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Atascadero as follows:
Section 1 . The foregoing recitals are true and
correct and this Council so finds and determines.
Section 2 . This Council hereby accepts the Petition
on file with the City Clerk and finds that it has been signed
by the owners of more than sixty percent (60%) of all the
assessable land within the proposed assessment district.
Section 3 . The Petition meets the requirements of
Section 2804 of Division 4 of the Streets and Highways Code
and further proceedings and limitations under the provisions
of the "Special Assessment Investigiation, Limitation and
Majority Protest Act of 1931" shall not be applicable.
Section 4. This Council declares its intention to
and determines to undertake proceedings pursuant to the
Municipal Improvement Act of 1913 and to issue bonds in said

proceedings under the provisions of the Improvement Bond Act
of 1915 for the construction in and for the City of
Atascadero, California, of said public improvements in and for
an assessment district in the City designated "City of
Atascadero Improvement District No. 5 (Chandler Ranch Area
Assessment District) . "
PASSED AND ADOPTED this 26th day of July, 1988, by
the following vote:
AYES: Councilmembers DEXTER, LILLEY, .. CKEY,, SHIERS AND MAYOR BORGESON

EXHIBIT A
Resurfacing of streets, including the removal and
replacement of the existing base and surface course prior to
resurfacing.
Partial grading of shoulders and minor drainage
improvements; minor widening of streets and surveying.
Construction inspection wil be performed throughout.
The work will also include necessary appurtenances,
including, but not limited to, mobilization, clearing and
grubbing, excavation, importation,:- f graded material,
compaction, testing, acquisition o� necessary easements and
tapering at driveways.

Atascadero, do hereby certify as follows:
The foregoing resolution is a full, true and correct
copy of a resolution duly adopted at a regular meeting of the
City Council of said City, duly and regularly held at the
regular meeting place thereof on t 26th day of July, 1988,
of which meeting all of the members. of said City Council had
due notice and at which a majority thereof were present; and
that at said meeting said resolution was adopted by the
following vote:
AYES: COu'NCILMEMBERS DEXTER, LILI.,EY, MACKEY, SHIERS AND MAYOR BORGESON
NOES: NONE
ABSENT: NONE
An. agenda of said meeting was posted at least 72
hours before said meeting at 6500 Palma Avenue, Atascadero,
California 93423, a location freely accessible to members of
the public, and a brief description of said resolution
appeared on said agenda.
I have carefully compared the foregoing with the
original minutes of said meeting on file and of record in my
office, and the foregoing is a full, true and correct copy of
the original resolution adopted at said meeting and entered
in said minutes.
Said resolution has not been amended, modified or
rescinded since the date of its adoption and the same is now
in full force and effect.
